Minutes of an adjourned regular meeting of the Common Council of the City 1
of Rochester, Minnesota, -held in the Coun&il Chambers, in the City Hall, in
said City, on April 10th;1939.
President Lemmon called the meeting to ord4r at 7:30 o'clock P.M., the
following members being present: Lennon, Amundsen, Fryer, Green, Moody,
Richman, Williams. Absent: None.
Upon motion by Richman second by Wi.l li ams., the minute s of a special
meeting held March 29th, and an adjourned regular meeting held March 31st,1939,
were each approved.
President Lemmon announced this as being the time and place fixed for
a hearing on the sprinkling, flushing or treating of streets during the 1939
season, and asked if any..one..present wished to be heard concerning either or
any of said streets. No one present wished to be heard.

President Lemmon announced this as being ,the time and place fixed for a
hearing on the construction of a sanitary sewer in 92 Avenue Southeast from
Eleventh Street to Twelfth Street Southeast and asked if any one present wished
to be heard concerning said improvement. No one present wished to be heard.
President Lemmon announced this as being the time and place fixed for
a hearing on the construction of a sanitary sewer in Eleventh Street Northeast,
from the alley between Broadway Street North and First Avenue Northeast to
the west line of Lot 3,Block 42 Northern Addition, and asked if any one present
4 wished to be heard concerning said improvement. There was no one present who
wished. to be heard.
President Lemmon announced this as being the time and place fixed for a
hearing on the construction of a new sidewalk on and.widening of Second Street
,
Southwest from Eleventh Avenue to Twelfth Avenue Southwest, and asked if any
one present wished to be heard concerning said improvement. No one present
wished t o be heard.
President Lemmon announced this as being the time and place set for aeceivirig
and opening bids for the furnishing of road oil, asphalt, and tar. The following
bids were received and opened at this time: i
Socony-Vacuum Oil Company, Road oil grades 1, 2, 3, and 4 S.C. $.O41g per
gallon, Cutback asphalt Grade MC 2,3 and.+ $.0520 per gallon, and grades
!' RC2,3 and 4 $.0540 per gallon. No bid on tar.
Standard Oil Company: Road oil grades 1,2,3,and 4 SC $.0405 per gallon,

Cutback: Asphalt Grade MC 2,3 and 4, $9.0549 per gallon, and Grade RC 2, 3, and 4,
$•0553 per gallon. No bid made on tar.
President Lemmon referred the above bids to the City Engineer for
tabulation and recommendation.

President Lemmon announcecl.this as being the time and place fixed ,for
receiving and opening bids for the construction of a sanitary sewer in 91 Avenue
Southeast from Eleventh Street to Twelfth Street. The following bids were
received and opened at this time:
Wm. C. Fraser & Son, $1049.40;
Martin Paulson, $909.15;
President Lemmon referred the above bids to the City Engineer for
tabulation and recommendation.'
The following communication was read and upon motion by Fryer second by
Rchman the authority requested was granted:

Gentlemen:
Subject to your approval, I recommend that each one of
the 21 men you authorized me to hire work 210'0 hours per year.

The appointment by the Mayor of P.D. Claude as a Special Policeman for duty
at the City Dumping Grounds, hesto<:se.rve without pay and to hold office until
the second Monday in April, 1940,unless sooner removed, was read and President
Lemmon ordered that the same be placed on file.
The following communicationwas read and upon motion by Fryer second by
Williams, the appointment mentioned therein was accepted and it was ordered that
the said communication be placed on file:

Gentlemen,
Harold A.HoffmaA has been certified by the Police Civil Service
Commission as a member of the Police department effective
April 6, 1939, This appointment fills a vacancy in the depart-
ment that was caused by the death of Chief L.J.Claude. Harold
A Hoffman is certified as a Patrolman without previous exper-
ience.

The appointment by the City Clerk of Lillian R.Sveom as City Clerk's
i Stenographer and Clerk of Registration, and Russell Sanders as Second City
Clerk's Stenographer and Clerk of Registration, was read and upon notion by
Richman second by Amundsen the said appointments were approved.
A communication from the director of recreation at the Civic Center
stating that Stephen Flynn had been appointed to the position of Assistant
Director as of March 23rd,1939, and requesting that he be paid a salary of
$25.0.0 from the F:E.Williams Estate Funds, was read and upon motion by i

Fryer second by Green said request was granted.
The following communication was read, and President Lemmon referred the
matter to the Street and Alley Committee, the Commercial Club, and the City
Ehgineer, with the request that said committee make an early report:

Members of the Hawthorne Mothers Study Club wish to draw
your attention to the dangerous condition existing at present at
the junction of 9th Place Southeast and the Highway:
We wish to recommend that either an underpass, overpass
or three (3) way stop sign be placed at said junction.

The following copy of a resolution passed and adopted by the Public '
Utility Board was read and President Lemmon ordered that the same be placed on
file.
"Be it and it is hereby resolved by the Public Utility Board of the City of

The reports of the Weighmaster for the month of I'larch,1939 showing 229
private loads weighed and receipts in the amount of $22.90,'and for.the period
April lst,1939 to April 9th,1939, showing 77 private.loads weighed and receipts
in the sum of $7.40, were each read, and President Lemmon referred the same to
the Finance Committee.
The report of the Clerk of the Municipal Court for the meek ending April
3rd,1939, showing criminal fines and costs collected $322.95, civil fees
received $5.05, and conciliation court fees received.$2.50, was read and having
been previously approved by the City Attorney, President Lemmon ordered that the

The/ City Engineer's trial balance for the month of March 1939, was read

and President Lemmon ordered that the same be placed on file:

Remittances from the Treasurer of the United States in the sum of $1018.00
based on 7/9ths of maximum grant on.Docket No.1516-F,-and $3616.66 being 15;•
of grant on Docket No.1515-F, were pr.e.s.ented to the Council, and the City
Treasurer was instructed to receive t-he amme and deposit the said remittances
in the respective construction accounts for said projects.
The City -Clerk- transmitted to the Council the request of Bremer & Kleckner
for cancellation -of their Off Sale 4oti-intoxicating malt liquor license No.473;
and upon motion by Green second by Fryer the said off sale license was cancelled
and it was ordered that the fee be returned upon theirmaking a proper claim
for same.
The application�of Geo. H. Ross for appointment as Second Assistant at
the City Dumping -Grounds at such time as there is a vacancy there, was read, -
and upon motion by Fryer second by Green the said application was ordered placed
on file for future reference.
A petition asking that Fourth Avenue Southeast from Thirteenth to Fourteenth
Street Southeast -be graded, said petition having -been signed by ten property -
owners, was read.and President Lennon referred the same to the City Engineer and
the Street and Ailey Committee.
A communication together with a copy of a resolution passed and adopted
by the Board of Park Commissioners requesting authority to enter into a contract
with C.C.Pagenhart for the construction of sidewalks, curb and gutter, and
storm sewers in Alayo Park, was read and President Lemmon ordered that the same
be placed on file. -
Applications for soft drink dealers licenses, signed by Leonard Broich,
Howard E.Hill, Albert F.Spiess, Donald Nelson, M.A.Hamilton, Donald D.Murray,
J.K.Williams, Wesley,J.Williams, Joseph Leiferman, and Matt R.Smith, were
each read, and upon motion by Richman second by Amundsen, licenses were granted.'.
Applications for off sale non -intoxicating malt liquor licenses signed by.
Wesley J.Williams, Joseph M.Leiferman, Donald Nelson, A•C.Yackel, Albert F.
Spiess, were each read, and upon motion by Fryer second by Green, licenses
were granted.
The application of J.J.Fitzgerald for a plumbers license, together with
a surety bond in the sum of $111000.00 with the Fidelity & Casualty Company as
surety thereon, were each read, and upon motion by Moody second by Crean.%
the license was granted, the bond approved, the surety thereon accepted and
it was ordered that the same be placed on file.
The application of O.S.Cummens for an electricians license,together with
a surety bond in the sum of $1,000.00 with the United States Fidelity &
Guaranty Company as surety thereon, were each read, and, and upon motion by
Fryer second by moody, the license was granted, the bond approved, the surety

thereon accepted and it was ordered.that the same be placed on file.
The application of the H. & H.-Electric Company for an ele-etrician+s
License, was read, and upon motion by Amundsen second by Fryer -the license
eras. granted subject to their filing a satisfactory surety bond. -
The application of Albert Wade for a drivers license was read, and upon
motion by Green second by Richman, license was granted.
The applications of McConnell and Sullivan for licenses to -operate nine
pin ball machines, and the application of John Hennessey fox a license to
operate one pin ball machine, ware read, and upon motion'by Richman second by
F.ry.er, licenses were granted.
Applications for permits to place and.- maintain signs, said -applications
hay.ing been examined and. approved by the Building Inspector., we -re read, and
upon motion by Fryer second by Moody, permits were granted..

asking a raise in salary of $120 for Donald Kruger and $60 for Mrs.

At the last regular meeting of the Board of Health and
Welfare appointments for. various positions under the jurisdiction
of the Board were considered and the Board nominates for appoint-
ment, at the salaries indicated, the following:
Deputy Health Officer, Dr. D.C.Lochead............. $ 3.600.00

It is to be noted that these salaries are the same as provided
last year and as set up in the budget as previously submitted, with the !
exception of the salary for Agnes Corrigan. Miss Corrigan has been here
a number of years wilthout any adjustment of -salary whatever. She is
required to use her own car for transportation and to pay all of the
up -keep on it. For that reason we -feel that it is justified to make an
adjustment in her salary of ten dollars per month and accordingly recommend,
it. The. salaries o.f the Deputy Health Officer, Sanitary Inspector, two
i' nurses, and the Milk Inspector, include an allowance for transportation.,

The report of the Finance Committee stating that they had checked the
reports of the Building,Electrical and Plumbing Inspector and the City Weigh -
master for the month of March and found the same to be correct, and that they
had checked the report of the Weighmaster for the first nine days of April,1939,
and found the same to be correct, was read and upon motion by Green second by
Richman it was ordered that the said report be accepted and placed on file.
The annual report of the Public Utility Board was presented to the
Common Council and President Lemmon ordered that the same be placed on file.
The license bend of Arthur A.Brown covering his &lectrician's license,
with the Western Surety Company as surety thereon in the sum of $1,000.00, was
read, and upon Fryer, second by Green, the bond was approved, the surety thereon,'

accepted and it was ordered that the same be placed on file.

Gentlemen:
At a meeting of the Board_ of Park Commissioners held April loth,
1939,'the following resolution was adopted:
$BE IT RESOLVED that the salaries of employees of the
Board of Park Commissioners be set at the following -amounts
per month: Superintendent,$250.00; Foreman $150.00; Florist,
$162.50; Florist's Assistant,$130.00; Seimming Pool Operator
and Repairman, $137.50; and Utility Man, $120.00; Seasonal
Employees as required by the Superintendent $125.00.
Manager, Mayo Civic Aua.itorium,$300.00; Stage Electrician
$173.33; Engineer $150.00; Second Engineer $137.50_; Third
Engineer $120.00; Ice Rink Caretaker $110.00; Concession
Manager,$110.00; Head Janitor $115.00; Janitors $110.00;
Stenographer $75.00.
All the above salaries to be paid semi-monthly from the
Mayo Trust Fund during the time such. services are' required.
BE IT FURTHER RESOLVED that the Secretary of the Board
of Park Commissioners shall receive $70.00 per month for
_extraordinary services, to be paid semi-iponthly from the
Mayo Trust Fund.'
It is respectfully requested that your Honorable Body
approve the above resolution as adopted by,this.Board.

Alderman Williams introduced a resolution ordering plans and specifications,
for the construction of a new sidewalk and widening of the paving on Second
Street, Southwest from Eleventh Avenue to Twelfth Avenue Southwest, which was read.
Upon motion.by Amundsen second by Williams, that the said resolution be
adopted as read, and all voting in favor thereof, President"Lemmon declared the
said resolution duly passed and adopted:
Alderman Williams introduced a resolution ordering plans and specifications
and estimate of cost for the construction of a sanitary sewer in Eleventh Street
Northeast, from the alley between Broadway Street North "and First Avenue North-
east to the crest line of Lot 3,Block 42, Northern Addition, which was read.
Upon motion by Fryer second by Green that the said resolution'be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
The City Engineer submitted plans, specifications and estimate of cost
f6r the construction of the above described sanitary sewer in Eleventh Street
Northeast, the said estimate of cost being $15s4.50.
Alderman Ri&EAnans introduced a resolution adopting the plans, specification;
and estimate of cost for the construction of a sanitary sewer in Eleventh Street

Northeast, from the Alley between Broadway Street North and First Avenue
Northeast to the west line of Lot 3,Block 42, Northern Addition, ordering that
the same be placed on file in the office of the City Clerk of said City,
ordering that the said improvement be made and done and that the �rhole cost and
expense thereof be paid by special adsessments levied as provided'by law,
ordering a hearing on said improvement to be held at 7:30 o(clock P.M. April
24th,1939, and ordering advertisement for bids to be received and opened at a

meeting to be held, at 7:30 o'clock P.M. April 24th,1939, which was read.
Upon motion by Richman second by Moody that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said

resolution duly passed and a3.opted.

A recommendation from the Street and Alley Committee and the City Engineer
that the bid of the Standard Oil Company for furnishing 140,000 gallons road �
oil, grade S.C. at $.O405 per gallon be accepted, was read and President Lemmon
ordered that the same be placed on file.
Alderman Amundsen introduced a resolution accepting the bid and proposal
of the Standard Oil Company for furnishing 140,000 gallons Grade S.C.rodd Oil
at $.0405 per gallon and fixing the amount of the surety bond to be given by
the said contractor at the sum of $6,300.00, which was read.

Upon motion by Amundsen second by Moody that the said resolution be

adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
A recommendation from the Street and Alley Committee and the City Engineer
that the bid of the Socony Vacuum Oil Company be accepted for the furnishing
of approximately 20,000 gallons Cutback Asphalt, Grades MC at $.0520 per gallon
and grades RC at $.0540 per gallon, be accepted, was read and President Lemmon
ordered that the same be placed on file.
Alderman Richman introduced a resolution accepting the bid and proposal
of the Socony-Vacuum Oil Company for the furnishing of 20,000 gallons cutback
asphalt grades MC at $06520 per gallon, and grades RC at $.0540 per gallon, and
fixing the dmeunt of the surety bond to be given by said contractor at the
sum of $2lbO.00, which was read.
Upon motion by Fryer second by Richman that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and adopted.
A recommendation from the SbrertCOmmittee and the City Engineer that the `
bid of Martin Paulson in the sum of $909.15 be accepted for the construction
of a sanitary sewer in 92 Avenue Southeast, was read and President Lemmon
ordered that the same be placed on file.

Alderman Amundsen introduced a resolution accepting the bid and proposal
of Martin Paulson `for the furnishing of all lhbor,materials, equipment,etc..,
necessary for the construction of a sanitary sewer in 9L Avenue Southeast
from Eleventh Street to Twelfth Street Southeast, for the sum of $90a.15, and
fixing the amount `of the surety bond to be given by the said contractor at the
sum of $908.15', which was read.
Upon motion by Fryer second by Green that the said resolution be adopted
as read and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman $ichman introduced a resolution designating streets, avenues and
alleys to be sprinkled, flushed, or treated during the season of 1939, ordering
that saidsprinkling, flushing or .treating be done, and authorizing the
City Engineer to sec.ur.e.the necessary labor and materials for doing the said

and the Mayor and City Clerk' are hereby authorized and directed to draw warrants
upon the City Treasurer and make payments accordingly. 11

enter into contract with C.C.Pagenhart for the construction of sidewalks,
curb and gutter and storm sewers in Mayo Park, for an estimated total sum of
$3165.00, which was read.

as read, and all voting in favor thereof; President Lemmon declared the said
resolution duly passed and adopted.
Alderman Fryer introduced a resolution authorizing the Parr. Board to enter
into contract with the Toro Manufgaturing Company for the furnishing of a
tractor and mowing equipment, for the sum of $1185.13, which was read.
Upon motion by Moody second by Amundsen, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Upon motion by Fryer second by Richman, the City Clerk was instructed to
prepare a resolution expressing the appreciation of the Common Council for the
splendid service rendered by Harold Thompson as President of the Park Board
for the past four years.
Alderman Fryer introduced a resolution ordering a hearing on the grading of
Fourth Avenue Southeast from Thirteenth to Fourteenth Street Southeast,- said
hearing *t o be held at 7:30 o'clock P.M., on April 24th, 1939, which was read.
Upon motion by Green second -by Richman that the said resolution be adopted
as read, and -all voting in favor thereof, President Lemmon declared the said

Mr. Harold Stewart, representing the Junior Chamber of Commerce, appeared
before the Common Council,: with the request for finanei&l assistande in
the annual Gypsy Frolic,which the said Junior Chamber of Commerce sponsor for
their 4-H 02Lub work, and upon motion by Amundsen second by Fryer the Common
Council went on record as being willing to approve -and allow a claim for music
furnished at said Gypsy Frolic in an amount not to exceed that allowed in 1939-
Upon motion by Williams second by Amundsen, the City Attorney was instructee
to redraft the pinball ordinance.
Alderman Williams reported that the Post -Bulletin had agreed to phhlish
City ,printing at not to exceed $.66 per folio inch, and upon motion by Fryer
.second by Williams, the Rochester Post-Bull6tin was designated the official paper
for the ensuing year,
Alderman Williams stated that Gao.Barbes has requested a new lease with the
City of Rochester and Simon Stensrud, for the Barbes Cafe in the Williams Estate
business building, and upon motion by Fryer second by Moody, the Public Grounds
Committee were authorized and instructed to proceed and have executed a new lease

I for the Barbes Cafe, the terms of said lease to be.similar to -the terms of

the lease recently executed for the Community Oil Company.
Alderman Moody called the attention of -the Co�imon Council to the necessity
for widening Eleventh Avenue Southeast north of Fourth Street Southeast, and
various other places -where streets required widening, and President Lemmon
referred the matter to the Finance Committee, to -determine what funds might be
available. for making such improvements.,
A..motion.by Fryer second by Amundsen carried that the Acting Chief of Police
receive the salary as' set for the Chief of Police during such time as he is
Acting Chief of Police.
An egtimate of cost for.regiring the City Hall, in the sum of $450.00,
submitted by Earl R-Warnes of the Publit Utility Department to the Acting Chief
of Police and Custodian of the,City Hall, was read, and Rr:eaidentc,Lempon referred
the matter -to the Public Grounds Committee for -investigation and report.
Richard Manahan, Attorney for Kathleen Rosemary Fitzgerald, appeared before
the Common Council regarding the transfer of property to I{athleen Fitzgerald.
The City Attorney made a lengtjty report on transfers of property made
between Wm. A.Fitzgerald and the City of Rochester in the past, and made a
suggested transfer at this time to correct former irregularities in transfers of
property.
Alderman Green introduced the follQwiAg resolution, which was read:
"WHEREAS, On March 31,1930, one William A.Fitzgerald and Kathleen Rosemary,
his wife, conveyed certain lands to the City of Rochester by deed dated on that date and
and recorded in the office of the Register of Deeds on•November 15,1930,, in Book 153
on Page 189, conveying all of that part of Block 106 lying West of Perrin Street
and that pa rt of Block 107 lying West of an.extension of the West lime of said
Street through said Block 107, all being in Willson's Addition to the City of
Rochester to be used for park purposes; also a strip 'of land 95 feet in .width
running North and South through Block --105 to form an extension of First Avenue
Southwest to said Block 105 to the south line thereof, to be used to street
purposes. Said Deed being made upon condition that the Grantee deed to the
Grantors all that part of Block 107 lying North of the River and east of said
extension of Perrin Street through said Block 107.
AND WHEREAS, Thereafter on April 17,1930, by deed of conveyance dated on
that date and recorded May 9,1930, in Book 147 on Page 293, the City of Rochester
conveyed to Wm.A.Fitzgerald all that part of Block 107, Willson's Addition to the
City of Rochester, lying East of the Eaat line of Alley running North and South
through said Block, which said Deed of Conveyance was presumed to be in fulfill-
ment of the Deed first above mentioned.
AND WHEREAS, the said Wm. A. Fitzgerald is.now deceased and his wife,
Kathleen Rosemary Fitzgerald, has become the owner of said real estate.
AND WHEREAS, A mistake has been made in the above described deed from said
City of Rochester in describing the real estate.intended to be so conveyed.
m And WHEREAS, the correct description of the real estate is.as follows, viz:
Commencing at a point on the south line of 6 Street Southwest, in said City
of Rochester, 159 feet east of the intersection of said south line of said 6

to move a barn which is.located on her.property and extends into the Street abou
seven or light feet, and after considering the matter Alderman Fryer moved that
the,City Engineer be instructed to inform Mrs. Rommel that the City has not
available at this t�me.funds for moving said bard. The motion was seconded by
