HomeMy WebLinkAbout05-15-1939244 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., May 15.1939 Minutes of an adjourned regular meeting of the Common Council of the City of ,Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City on May 15th,1939• President Lemmon called the meeting to order at 7:30 o'clock P.M., the following members being present: Lemmon, Amundsen, Fryer, Green, Moody, Richman, Williams. Absent: None. Upon motion by Moody second by Richman, the minutes of the meeting of May lst,1939, were approved. President Lemmon announced this as being the time and place fixed for a ; hearing on the construction of a water main in 91 Avenue Southeast, and asked heard V if any one present wished to be/concerning the said improvement. No one present wished to be heard. President Lemmon announced this as being the time and place set for a hear- ing on the construction of a sanitary sewer in Eleventh Street Southeast from Fourth Avenue Southeast to a point 115 feet east, and asked if any one present wished to be heard concerning the said improvement. Mr. S.J.Wentworth appeared before the Common Council in opposition to the said sanitary sewer,but asked the approximate cost of the same and how it would be assessed, He stated that his property already had sewer service from Fourth Avenue Southeast and that they did not need any service on Eleventh Street Southeast. Alderman Moody stated -that possibly the assessment against the Wentworth property could be set up as a book account to be paid at such time as they wish to connect to same. George Allen, Attorney, representing Harvey W.Harrison, et. al., appeared !before the Common Council in support of the petition to have nest Lawn Addition annexed to the City of Rochester. A petition asking that a curb and gutter be constructed on Eleventh Street Southwest from Sixth Avenue -Southwest to Seventh Avenue Southwest, and on Tenth Street Southwest from Seventh Avenue Southwest to Eleventh Street South- west, and a petition asking that bituminous treatment be applied on Eleventh Street Southwest from Sixth Avenue Southwest to Eighth Avenue Southwest, and on Eighth Avenue Southwest from -Tenth Street Southwest t-o .eleventh Street Southwest, and on Ten and one-half Street Southwest from Eighth Avenue Southwest t6the end of street, and on Tenth Street Southwest from Seventh Avenue Southwest to Eleventh Street Southwest, were each read. Each of said petitions were signed .by Mayo Properties Association, J. A. Paulson, Max Kjerner, e$. al. Dr. J. A. Paulson appeared before the Common Council and urged that each of said improvements be proceeded with. Minn., ` May-15,193 9- ty.:.. 245 "We, the undersigned owners of real property in the city of Rochester, Minnesota, do hereby petition the Honorable Common Council of the City,of ;Rochester, to give due consideration to our petition of April 27th,1939, .rela- tive to improvement of alley between 14th and 15th Avenues, S.W. between 2nd and 4th Streets, S.W. and to extend alley west from 4th St.S.W. to 15th Ave. S.W. We also find upon investigation that a counter petition, opposir_g.this improvement, has some signatories who are only tenants and not owners of the 'real property affected; that it also has signatories of individuals owning property removed from and not adjacent to, the affected property, and that only a small minority whose property adjoins or abutts the alley in question, oppose this improvement and extension. We therefore petition the Honorable Council to take favorable action on the petition presented, referred to above and asking this im-orovement.n - Archie Armstrong and Everett L.Weinrich were before the Council and urged that the improvement and extension of the said alley be proceeded with as originally petitioned for. A communication from the City Engineer requesting an appropriation of $3,000.001f rom the Street and Alley Fund for use of the Street and Alley Committee was read. Communications from•Aug.g.Andresen, and Henrik Shipstead, regarding ,a-�propriations for P.W.A, were each read and President Lemmon ordered that the same be placed on file. The applieation of Edward Fallon for a position at the City Dumping Grounds, was read and President Lemmon ordered that the same be placed on file. Requisitions by the Health Officer, upon Saint Mary's Hospital for the isolation of Margaret Behme diagnosed to be suffering from measles, and of .Mrs. Jennie Healey, diagnosed to be suffering from Erysipelas, were each read, and President Lemmon ordered that the same be placed on file. The following copy of -`.a resolution passed and adopted by the Public Utility Board was read and President Lemmon ordered that.the same be placed on file: "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota That the Hon.Common Council be and is hereby requested to authorize the said Board to enter into a contract with the Kruse Company for the furnishing, in accordance with specifications, - 80 poles - Class 3 51 ® $10. 5 each - - - 844.00 10 poles - Class 3 - 0-1 ® 12. 5 each - - - 124.50 10 poles - Class 3 - 45' Q 15.90 each - - - 159.00 20 poles - Class 5 - 30' 7.90 each - - - 158.00 or a total lump sum price of - - - - - - - - - - - -$1,285.50 - the said Kruse Company being the lowest responsible bidder." 246 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., May 15,1939 • The following communication was read and President Lemmon ordered that the same be placed on file: ROCHESTER AUTOMOBILE DEALERS' ASSOCIATION, Rochester, Minnesota. May 15th, 1939 Honorable Mayor and Common Council, City of Rochester, Minnesota. Gentlemen: - May we request the repeal of Ordinance No.529, a license to sell second hand Motor Vehicles in this City?. This Ordinance is no.longer necessary, since the State of Minnesota's used Car Importation Law became effective recently. i Respectfully submitted, R. L. Gentlemen: I wish to have my name stricken from the petition to extend the alley, due to the fact that when I signed, the petition was pepresented as requesting only the improvement of the present alley. A warranty Deed signed by the Mayo Properties Association, conveying to the City of Rochester parts of Lots 20, 21 and 22 in Block 2, in Williams, Healy &' Cornforth's Addition, was read and upon motion by Amundsen second by Green, t said warranty deed was accepted and the City Clerk instructed to have the same put on record. Applications of Universal Motors and Boardman's Ice Cream for permits to place and maintain signs, were each read, and upon motion by Amundsen second by Moods permits were granted. The application of Harry Vinton for a drivers license was read, and upon motion by Green second by Williams, license was granted. Applications signed by Gamble -Robinson Company, Matt R.Smith, Hartley A. Swenson, and R.M.Tauer and Howard E.H111 for off sale licenses to sell non- { intoxicating malt liquor, were each read, and upon motion by Richman second by Williams licenses were granted* an off sale The application of Geo.B.Tauer for. license to sell non -intoxicating malt liquor at 420 Second Street Southwest, was read but no action was taken thereon. The application of Sam DeFosse for a pin ball machine operators license at 304 Twelfth Street Southeast, was read and upon motion by Green second by Richman, license was granted. The following applications for licenses as soft drink dealers were each read and upon motion by Green second by Moody licenses were granted: Ernest Fitting, Martin L.Bloom, S.A.Boelter & Ernest Predmore, Martin L..Bloom, Strieff & Ranfranz, Hartley A.Swenson, Geo.B.Tauer, and R.M.Tauer. The application of Barney M.Davis for a transient dealers license,was read, and upon motion by Williams, second by Richman license was granted. The application of John Hennessey and M.L.Priebe for transfer of pin ball machine owners license No.113 to M. L.. The application of Fellows and Hilmer for Auctioneer License, was read, and upon motion by Williams second by Amundsen, license was granted. The official bonds of George Wood, Manfred HoW aldron, W.E.Mitchell, and Edna Oesterreich, each in the sum of $500.00 and with the Fidelity and Deposit Company as surety thereon, were read, and- theofficial bond of Ral}bh I. LaPlant as City Assessor with the Fidelity and Casualty Company as surety in the sum of $500.00, was read, and upon motion by Moody second by Green, the bonds were approved, the sureties thereon accepted, and it was ordered that the same be placed on file. The surety bond of the Rochester Post -Bulletin Company in the sum of $1,000.00 with the Fidelity & Casualty Company as surety, and the surety bonds of Martin Paulson in the sum of $1,000.00 each, covering his contracts for the construction of sanitary sewer in part of Eleventh Street Northeast, and in 92 Avenue Southeast, with the Fidelity & Casualty Company as surety thereon, were each read, and upon motion by Moody second by Green, the said bonds were approved, the sureties thereon accepted and it was ordered that the same be placed on file. The automobile liability insurance policy of Howard A.McGoon covering a packard sedan licensed as a taxi cab,was read and President Lemmon reverred ,the same to the City Attorney and the Chiefs of Police. A petition asking that Sixth Street Southwest from Fifteenth Avenue tp the highway be oiled, and a petition asking that Eighth Avenue Southwest from Ninth Street Southwest to Tenth Street Southwest be oiled, were each read a$d President Lemmon ordered that the same be placed on file. A petition asking that a sanitary sewer be constructed in 101 Street Southeast from the manhole between First Avenue and Third Avenue SoutIm ast to First Avenue Southeast, was read, and President Lemmon ordered that the same be placed on file. A petition asking that a sanitary sewer be constructed on Twelfth Street Southeast from Eighth Avenue Southeast to Ninth Avenue Southeast, and on Ninth Avenue Southeast from Twelfth Street Southeast to Thirteenth Street Southeast, was read, and President Lemmon ordered that the same be placed on file* The petition of the Mayo Properties Association requesting permission to construct curb. -and gutter, and a sanitary sewer, at their own expense, in parts of Eighth Avenue Southwest, t& grade 102 Street Southwest, and construct a curb and gutter on the north side of Eleventh Street Southwest from Seventh Avenue to 'Ninth Avenue Southwest and on Eighth Avenue Southwest and 102 Street Southwest, was read, and upon motion by Green second by Williams permission was granted, provided that the said work is done under the supervision of the City Engineer. A petition signed by Harvey W.Harrison, et.al.,, for annexation of Westlawn addition to the City of Rochester, was read,;, and_ Bpesident Lemmon ordered that the same be placed on file. The report of the Peoples Natural Gas Company, formerly the Minnesota Northern Natural Gas Company, on -their business.for the year ending December 31, 1939, was read and upon motion by Green .second by`Richman said report was aceepte and ordered .placed on file. The City Engineer's trial balance for the month of April,1939, was read and President Lemmon a:rdered that the same be placed on file.. The reports of the Clerk of the Municipal Court for the week ending. May lst,1939,showing criminal fines and costs collected $220.75, civil fees received $5.65, and conciliation court fees received $7.50; for the week ending May Sth,1939, showing criminal fines and costs collected $603,05, civilvfees received $8.9.5, and conciliation court fees received $2.50; and for the week ending May 15th,1939, showing criminal fines and costs collected $452.95, civil fees received $7.35, and conciliation court fees received $5.95, were each read and having been previously approved by the City Attorney, President Lemmon ordere� that the same be placed on file. The report of the City Weighmaster for the month of Apri1,1939, showing 91 private loads weighed and receipts $9.10, was read and President Lemmon referred the same to the Finance Committee. The City Engineer's final estimate showing the sum of $404.06 being due Wm. C.Fraser & Son on their contract for the construction of a sanitary sewer in Seventh Avenue Northwest and Tenth Street Northwest, was read, and Rpesident Lemmon ordered that the same -be placed on file. A supplemental report by the Finance Committee on their recommendation for transfer of $15,000.00 to the Park Improvement Fund, making $5,000.00 available on June 1st,1939,- instead of January 1st,1940, was read and President Lemmon ordered that the same be placed on file. The rpport of the Finance Committee stating that they had checked the report of the City Weighmaster for April, 1939, and found the same to be correct was read and upon motion by Green second by bloody said report was accepted. A report by the Public Grounds Committee, City Attorney and the City' Engineer on possibility of Improving and using the old Y.M..C.A.lot for parking purposes was read, and upon motion by Williams second by Green the matter was referred to the Board of Public Health and Welfare, with power to act.. Alderman Amundsen introduced an ordinance repealing an- ordinance entitled "An ordinance providing for the licensing and regulating of dealers in second hand motor. vehicles within the City _of Rochester, Minnesota" the same being ordin- ance No.529, which was given. its first reading. Upon motion by_ Green second by R'ichman., a.nd all voting in favor thereof, J, , the rules were suspen.ded, and the said` ordinance' given its •second reading. Upon motion by Moody second by Amundsen, tnd all voting in favor thereof, _ the rules were suspended. an.d the said ordinance given .its thi.rd and final reading. Upon motion by -Williams' second by Richman, that the said.ordinance be adopted. as read, and all voting in favor ther-eof., President Lemmon declared the said ordinance' duly` passed and adopted. Alderman Amundsen introduced an ordinanceF, annexing to the City of Rochester all of Block 11, the east half of Block 2, and the adjacent streets and alleys in Nest Lawn Addition, which was given its first reading. ' Upon motion by Green second by Amundsen, and all voting in favor thereof, the rules were suspended and the said ordinance given its second reading.'
