Rochester, Minn.; June 12 , 19 3 9 Minutes of an adjourned regular meeting of -the Common Council of- the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City, at 7:30' O'clock P-M- , on June 12th, 1939. President Lemmon called the meeting to order, the following members being present-: Lemmon, Amundsen, - Fryer, Green, Moody, Richman, Williams. Absent : ,None'. Upon motion by Williams second by Amundsen, the minutes of the meetings of May 29th, June 1st and June 501,19,39, were each approved. President Lemmon announced this'as being the time'and place fixed for a hearing on the construction of a sanitary sewer and water main in Sixteenth Avenue Southwest from Second Street Southwest to Fifth Street Southwest and in Second Street Southwest from the west line of Riege's Addition to Sixteenth Avenue Southwest South of Second Street Southwest, and asked if any one present wished to be heard concerning this improvement. No one present wished to be heard concerning the said sanitary sewer and water main in Sixthenth Avenue Southwest. President Lemmon stated this as being the time and place set -for a hearing on the construction of a sanitary sewer in 111 Street Southeast from Firs't Avenue Southeast to the east line of Lot 21, Block 9, • Sunnyside Addition, and asked if any one present wished to be heard concerning this improvement. No one present wished to be heard. President Lemmon stated.this as being the time and place set for receiving and opening bids for the construction of sidewalks on parts of Sixth Street Southwest and First Avenue Southwest, and on First Avenue Southwest from Fifth Street to Sixth Street Southwest. -The-following bids were received and opened at this time: Anderson & Sons, Inc. $1021.25, H. T•. Earle $1075.00. President Lemmon-referred the above bids to the City Engineer and the Stre�e_t''' 4 Alley Committee for tabulation and recommendation. The Common Council at this time considered the paving of the alley in Block 6, Kutzky's First Addition, action on which was at a meeting June 5th,1939," deferred until this date. A number of persons appeared before the Common Council in regard to this improvement; one party spoke in favor of the improvement, and Walter Dodge, Mrs..Knowlton, Carl Nichols,Mr. Austin and Mrs:Johnson opposed it. A motion by Moody seconded by Fryer that the above project be abandoned, carried by -all voting in favor thereof. A petition with fifty-five signatures; (twelve of which -asked: -that their names be withdrawn from a former petition,)asking that the dump on Fifth Street Northeast be -kept open and used until such time as Fifth Street Northeast is filled in, was read. Mr. and Pars. A.G.Baddgor appeared before the Council and' urged that the Fifth -Street Northeast dump,be kept open. j 1. 286 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., June 12 ,19 39 Henry O.Christensen, Chairman of the Zoning Committee, submitted a report and recommended changes in the Zoning Ordinance of the City of Rochester, and President Lemmon, for the Council, t)aanked Mr. Christensen, and the! Committee members for their work on this committee, and ordered the laid report and recommendations placed on file for future consideration._ The requisition of the Deputy.Health Officer upon St.Mary's Hospital for ,the isolation of Ada Tekippe diagnosed to be suffering from Scarlet Fever was read and President Lemmon ordered that the same be placed on file. An emergency authorization given by the Mayor to the City Clerk for the purchase of approximately 9000 gallons gasoline for the City bulk station,was read and President Lemmon ordered that the same be placed on file. The bond of Wallace Mitchell in the sum of $7. 65, with L.D. Stoffer and Glenn E. Webster as sureties thereon, coverilig .warrant No.2066, dated July 1, 1936, drawn payable to Mrs. Lora Howery,.which said warrant has been lost, was read, and upon motion by Green second by Amundsen_, the said bond was accepted, the.sureties thereon approved, and .the bond ordered placed on file, and the Mlayor and City Clerk were authorized and directed, to- draw a duplicate of said warrant. The surety bonds of Mrs. Mable Fountain, Jose Bosley, and Joseph J. Schuster, 'each in the sum of $500.00 with the Fidelity and Casualty Company of New York as sureties thereon were accepted, the Bondsapproved., and it was ordered that the, same be -placed on file.. The report of the Building inspector regarding the residence at 520 First Avenue Northwest, together with a report from T.B.Magath regarding sanitation ;conditions at this location, were each read. Mr. and Mrs. Capps voiced objections to conditions at said location, and Mrs. Parker, the owner and occupant spo$e and gave a reasonable explanation for conditions at her home. After considering the discussions and reports of, Building Inspector and, -Health Officer,, the Common Council concluded that no action on the matter was necessary by the Council and rested the matter in the hands of the Building_Inspector. The report of the Finance Committee that they had checked the reports of the Building,Electrical and Plumbing Inspector, and the City Weighmaster for the month of May,1939, and found the same to be correct, was read, and President ,Lemmon ordered that the same be placed on file. The application of Maniel M.Drake for a drivers license was read, and upon -motion by Moody second by Amundsen, license wars granted. The application of Clarence Sattre fora license to sell soft drinks was read, and upon motion by Richman second by Fryer, license was granted. The applications of Clarence Sattre and Vern E.Kunz,,for transfer of pin ball machine operators licenses Nos. 91, 92, 83, and s4, to Clarence Sattre, were read, and upon motion by Amundsen second by Moody transfer was granted. r Record . -of Official Proceedings of the. The application of Sam DeFosse for transfer of his 3.2 beer license.f rom 304 to '306 Twelfth Street Southeast was. read, -and upon -motion by Fryer second by Green transfer was granted. The report of the Clerk of. the Municipal Court for -the week ending June 5, 1939, showing criminal fines and costs collected $414.60, civil fees received $2.05, and conciliation court fees $2.25, was read and having been previously that approved by the City Attorney, President Lemmon ordered/. the same be plaeed'.pn file. The surety bond of Mark B.Fuller as Constable of the Third Ward, vaas- read, said bond being in the sum of $500.00 with the -Fidelity & Casualty Company of New York as surety, and upon motion by Richman second by Green, the surety there- on was�approve.d the bond appeptecl and it was ordered that the same be placed on file. A petition asking that a sidewalk be constructed on Fourteenth Avenue Northeast from Fourth Street Northeast to F-ifth Street Northeast etas read and President Lemmon ordered that the same be`placed on file. A petition asking that Fourteenth Avenue Northeast from Fourth Street Northeast to Fifth Street Northeast be graded was read and President Lemmo-n ordered that the same be placed on file. Alderman Williams introduced a resolution ordering plans etc, for the construction of a sanitary sewer- in 111 Street Southeast from First Avenue South- east to the east line of Lot 21, Block S,-Sunr_yside Addition, which was read. Upon motion by Green second by Amundsen that the said resolution be adopted as read, and all voting it favor thereof, Presi dent 'Lemmon declared the said resolution duly passed and adopted. The City Engineer submitted plans, specifications and estimate of cost for the construction of a sanitary sewer in Ml- Street Southeast as above described. Alderman Williams introduced a resolution adopting the plans, specifications and estimate of cost for the construction of- a sanitary sewer in 113- Street Southeast, as above described, ordering that the said improvement be made and done, and ordering a hearing on same to be held at 2:00 o'clock P.M., on July 3rd, 1939,, which was read. Upon motion by Richman second by Williams, that the said resolution be adopted as read, and all -voting in f-avor thereof, President Lemmon declared the said resolution duly passed and adopted. Upon motion by Wilaiams, second by Richman that the said resolution be adopted as read, and all voting _in favor thereof, President Lemmon declared the ; said resolution duly passed and adopted. Alderman Amundsen introduced a resolution granting public dance permit to ;Dale Hess for the Woodman Hall, June 3rd and 10th,1939, and fixing the fee at $6.00, which was read. Upon motion by Green second by Amundsen, that the said resolution be adopted as read,. and all. voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution appropriating $18,292.04 from ,t#e Construction Account, P.W•A,Docket N•0.1515-F Fund, and ordering payment made to Anderson & Sons, Inc. for final estimate on contract for construction of ,paving and curb and gutter, and sidewalk under P.W.A.Docket No.1515-F, which was ,read., Upon motion by Fryer second by Green that the said resolution be adopted ;as read,•,and all voting in favor thereof,•President Lemmon declared the said resolution duly passed and adopted._ Alderman Williams introduced a resolution appropriating $300.00 from the General Fund and ordering payment made to Code 4 of the General Fund for, - 'transfer of funds to pay Dog Catcher's salary of $25.00 per month, which was reafd. Upon motion by Moody second by Richman that the said resolution be adopted has read, and all voting in favor thereof, President Lemmon declared the said jresolution duly passed and adopted. Upon motion -by Amundsen second by Fryer that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and _adopted. Alderman Green introduced a resolution appropriating $96.25 from the Street & Alley Fund and $149.75 from the Sewer Fund and ordering payment made to. Hayes -Lucas Lumber Company for car of.sewer pipe, which was read. Upon motion -by Fryer second by Williams, that the said resolution be adopted as read, and all voting -in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Green introduced a resolution appropriating $539.92 from the Park Improvement Fund and ordering payment made to the City of Rochester, Light Department for electricity furnished and water at city parks, per billings of May 2.5th, 1939, which was read. :Upon motion by Williams second by Amundsen that the said resolution be adopted as read, and all voting in favor thereof, -President Leirlmon declared the said resolution duly passed and adopted. Alderman Green introduced a resolution appropriating $617.25 from th& General Fund and ordering payment made to Phillips Petroleum Company for 8106 gall ons gasoline furnished in Car No.SWLX 80.51, which was read. Upon motion by Fryer second by Richman that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and ac?opted. Alderman Moody introduced a,resolution appropriating $1339.6.5 from the. General Fund and ordering payment made to -the Street and Alley Fund, for use of -equipment during May, 1939, which was read. Upon motion by Green second by Richman that the said resolution be adopted as -read, and all voting in favor thereof, President Lemmon declared the said .- resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $4OS.60 from the General Fund and ordering payment made_ to the Standard�0il Company for one tank car of road oil furnished, 10,O99 gallons, for oiling streets, which was read. Upon motion by Amundsen second by Moody that the said resolution be adopted as read, and all voting in favor thereof, President .Lemmon declared the said resolution duly passed and adopted. Alderman Richman introduced a resolution appropriating $2SS.75 from the i Park Improvement Fund and ordering payment made to Foster-Mrachek Electric Company for electrical work at the Mayo Civic Auditorium, which was read. Upon Lotion. by Moody second by Amundsen that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly _passed and -adopted. - I Alderman Richman introduced a resolution appropriating $9g4.95 from,the 1 Street and Alley Fund and ordering payment made- to- the Street and Alley Fund, for use of equipment during May,�939, which was read. Upon motion by Frye-r sec•ond•by Richman that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams,introduced a resolution appropriating $511.26 from the Street and Alley Fund and ordering,payment made to the Socony-Vacuum Oil Company for 10,040 gal. majahalt furnished in C•ar• N•o.UTLX 53390, which was read. ' Upon motion by Richman second by Williams•that the said -resolution be adopted as read, and all voting in favor thereof, President ­Lemmon declared the said resolution duly passed -and adopted. Alderman Williams introduced a resolution authorizing a change in P-17-A. Upon motion by Moody second by Amundsen that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared thesaid resolution duly passed and adopted.' A:Lreco.mmendation by the City Engineer that the contract for the construction of sidewalks and driveways on Sixth Street Southwest and First Avenue Southwest under PWA Docket No.1515-F be awarded to Anderson & Sons, Inc. for the sum of $1021.25, was read and President Lemmon ordered that the same be placed on file. T 'Upon motion by Green second by Williams the City Clerk was instructed to return the check of the unsuccessful bidder at such time as -he has proper authority from the Public Works Administration. CHARLES HORACE.MAY0 WIJEREAS, during ,the, active life of Dr. Charles Horace M,yo, he unselfishly. devoted his time, skill. and means for the general welfare of the City of Rochester, Minnesota; and , WHEREAS, During a pe.rigd of twenty five years he served as Health Officer of our City; and 'WHEREAS, He realized the need of many improvements which were impossible for our, City to supply, and with love and,dev-otion for our citizens he personally gave many gifts of great value and benefit to the City of Rochester for our welfare; and . Mayor Paul Grassle requested that an appropriation be made for the purchase f fireworks for' the July 14th celebration and upon motion by Fryer second by illiams an appropriation of $500.00 was made for the purchase of said fireworks, said amount to be paid upon presentation of a proper claim for furnishing said ireworks. Mayor Paul Grassle made recommendations and suggested changes in the resent methods of purchasing merchandise and supplies for the various departments of the City, and after a discussion on the subject it was informally agreed that all purchasing be made for the various departments through the Purchasing Committed of the Common Council, and the City Clerk was instructed to notify the heads of each department accordingly. Upon motion by Fryer second by Richman the City Attorney was instructed to raft an ordinance creating an Electrical Inspector for the City of Rochester. Alderman Moody stated that Mr. Diekhoff had paid his share of a certain amount of money agreed upon by the parties concerned in a sanitary sewer which is connected to the Fifth Avenue Southwest Sewer, and asked what the wishes of the Council were in regard to granting Mr. Diekhoff permission to connect to said sewer. A motion by Moody second by Amundsen, and all voting in favor thereof,, carried that Mr. Diekhoff be allowed to connect to said sewer,and the City Enginee as instructed to issue said permit. Upon motion by Fryer second by Amundsen Peter D. Claude was appointed first ,assistant superintendent of the dumping grounds for the balance of this official 1year. Upon motion by Williams second by Richman Paul Dornack was appointed second ,assistant superintendent of the dumping grounds for the balance of this official 5, ar,. The City Engineer submitted approximate estimate of cost on cons &mplated street widening program as follows: West Center Street from Second Avenue to Sixth Avenue Southwest $5, 249- 50, Second Street Northwest from Broadway to Eleventh Avenue Northwest $16, 269.00, Third Avenue Southwest from Center Street to First Street Southwest $135.00, Third Avenue Southeast from Fourth Street Southeast to Fifth Street Southeast $493.00. The City Engineer submitted approximate estimate of cost on contemplated street widening without-.resiirfacing as follows: West Center Street from Second t Avenue to Sixth Avenue Southwest $1611.00, Second Street Northwest from Broadway i to Eleventh Avenue Northwest $5332.00, Third Avenue Southwest from Center Street Ito First S%,aaet Southwest $135.00, and Third Avenue Southeast from Fourth Street j to Fifth Street Southeast $493.00. Upon motion by Green second by Richman the City Engineer was instructed to prepare plans, specifications, etc., for the widening of Second Street Northwest from Broadway to Eleventh Avenue Northwest. Henry Christensen, F.W.Cowan, and Gus Branvold appeared before the 8ommon Council in regard to the proposed widening of Center Street West, and urged that t Idue consideration be given to the construction of adequate storm sewer facilities in Center Street West before the said street is widened and improved. Upon motion by Green second by Richman The City Engineer and the Sewer ,Committee were instructed to investigate the surface drainage sewer necessities .on the streets proposed to be widened. i Upon motion by Richman second by Williams the Common Council adjourned ,until 7:30 o'clock P.M., on Jude 19th,1939.
