Minutes of an adjourned regular meeting of the Common Council of the City of Rochester,
Minnesota, held in the Council Chambers, in the Ci-* Hall, in said City, on June 19th,1939.
President. Lemmon called the meeting to order at 7:30 o'clock P.M., the following members

being present: Lemmon, Amundsen, Fryer, Green, Moody, Richman, Williams. Absent:- None.

Upon motion by Moody second by Richman, the minutes of the -meeting of June 12th,1939,
were approved.
President Lemmon stated -this as being the time and place set for a hearing on the con-
struction of a sanitary sewer and water main in Twelfth Street Southeast from Eighth Avenue
to Ninth Avenue Southeast, and in Ninth Avenue Southeast from Twelfth Street Southeast to,
Thirteenth Street Southeast, and asked -if any one present wished to be heard regarding this
improvement. One man spoke in favor of the proposed sanitary sewer and wa-ter.main.
President Lemmon stated this as being the time.and place fixed for a hearing on the
construction of a water main in -Eighth Avenue Southwest from Eleventh Street Southwest
to 102 Street Southwest and in 10j Street Southwest to the end.of the street, and asked if any
one present wished to be heard regarding this improvement. No one present wished to be heard.
President Lemmon announced this as -the time and place set for a hearing on the construction
of a sanitary sewer and water main in Eighth Avenue Northwest from Ninth Street to Tenth Street
Northwest, and in Tenth Street Northwest from Seventh Avenue Northwest to Ninth Avenue Northwest
and asked if any one present wished to be heard concerning this improvement. No one present
wished to be heard.
President Lemmon stated this as being the time and place set for a hearing on the con-
struction of curb and gutter on on Eleventh Street Southwest from Sixth Avenue Southwest to
Seventh Avenue Southwest and in Tenth Street Southwest from Seventh Avenue to Eleventh Street
Southwest, and asked if any one -present T,vished to be heard concerning the said improvement.
No one present wished to be heard.
President Lemmon stated this as being the time and place set for a hearing on the
construction of a water main in 9, Avenue Southeast from Eleventh Street Southeast to Twelfth
Street Southeast, and asked if any one present wished to be heard concerning the said
improvement. No one present wished to be heard.
President Lemmon stated this as being the time and place set for a hearing on the
placing of bituminous treatment on Eleventh Street Southwest from Sixth Avenue Southwest to
Eighth Avenue Southwest,.and on Eighth Avenue Southwest from Tenth Street Southwest to Eleventh
Street Southwest, and on 10N Street Southwest from Eighth Avenue Southwest to the end of the
Street, and asked if any one present wished to be heard concerning the said improvement.
No one present wished to be heard.
President Lemmon stated this as being the time and place set for a hearing on the grading,
bituminous treatment and extension of the alley to Fifteenth Avenue Southwest, of the Alley
-South of Necond Street Southwest between Fourteenth Avenue Southwest and Fifteenth Avenue
Southwest, and asked if any one present wished to be heard concerning the said improvement.

Don Barrett asked how the costs for the extension of said alley to Fifteenth Avenue Southwest
would be assessed.

After consideration had been given to the manner of levying assessments for the cost of the
extension of the above alley, a motion by Moody seconded by Fryer, that the costs for the exten-
sion of the said alley be assessed pro rata to the frontages on the alley running north and
south, carried by all voting in favor thereof.
President Lemmon stated this as being the time and place set for a hearing on the
grading of Fourteenth Avenue Northeast between Fourth Street Northeast and Fifth Street North
east, and asked if any one present wished to be heard concerning the said improvement, No
one present wished to be heard.
President Lemmon stated this as being the time and place set for a hearing on the
construction of a sanitary sewer in 10� Street Southeast from the manhole between First
to First Avenue Southeast,
Avenue Southeast and Third Avenue Southeast,/and asked if any one present wished to be heard "
conderning the said improvement.
Upon motion by Moody Second by Richman the City Engineer was instructed to make a survey
and plat of Fourth Street Southwest from Fifteenth Avenue Southwest east to the Alley, and
set forth on said plat the parts of said Yourth Street Southwest which will not be used,for `
the extension of the alley to Fifteenth Avenue Southwest, and that proceedings be commenced to
j vacate said balance of Fourth Southwest.
Joe Bean appeared before the Common Council regarding the grading of Seventh Avenue
Northwest, and upon motion by Green second by Moody the matter was referred to the Street and
Alley Committee and the City Engineer.
A communication from the City Engineer requesting that $3,000.00 be appropriated from 1'
the Street and Alley Fund and ?'1,000.00 from the Sewer Fund for use of the Street and Alley
Committee, was read and President Lemmon ordered that the same be placed -on file.
The following communication was read, and President Lemmon ordered that the same be placed

Gentlemen:
The parking situation in front of Brinson home and barber sho�f'r has been
inspected and find that he has twenty two feet of yellow curb at the
entrance. We feel that some fresh paint be applied on curb that it will
take care of the situation.

A communication from G.H.Sanberg, Superintendent of Schools, requesting an appropriation

to School District No.8, for school band purposes, together with a report on the appearances
of the High School Band during the period June 1st,1938 to June lst,1939, were each read and
upon motion by Williams second by Amundsen, the said report and communication were ordered
placed on file, and the sum of $100.00 was appropriated from Code 3 of the Band Fund and
ordered paid to Independent School District No.8, for band purposes.
A petition asking that repairs be made in the alley between Second and Third Street

Southwest running from Fifth Avenue to Sixth Avenue Southwest, was read and President Lemmon
referred the same to the Street and Alley Committee and the City Engineer.
The City Engineerts first and final estimate showing the sum of $909.82 as being due
Martin Paulson on his contract for the construction of a sanitary sewer in Eleventh Street
Northeast from the alley between Broadway Street and First Avenue Northeast to the west line
of Lot 3,Block 42, Northern Addition was read and President Lemmon ordered that the same be
placed on file.
The City Engineerts first and final estimate, showing the sum of $846.98 as being due
Martin Paulson on his contract for the construction of a sanitary sewer in 9 Avenue Southeast
from Eleventh Street Southeast to Twelfth Street Southeast, was read and President Lemmon
ordered that the same be placed on file.
The application of Lyle C.Oviatt and Werner C.Folkert for drivers licenses were each read,
and upon motion by Green second by Amundsen, licenses were granted.
The application of Sam DeFosse for a pin ball machine operators license at 304 Twelfth
Street Southeast, was read, and upon motion by Richman second by Fryer, license was.granted.
The application of the Tri-State Improvement Company for a permit to place and maintain
a sign, was read and upon motion by Amundsen second by Moody, permit was granted.
The application of. Martin Paulson for license to connect with sewers and drains, together
with a surety bond in the sum of $$1,000.00 with the Fidelity & Casualty Company of New York
as surety, were each read, and upon motion by Green second by Richman, the license was granted
the bond approved, the surety thereon accepted and it was ordered that the bond be placed on
file.
The reports of the Clerk of the Municipal Court for the week ending June 12,,1939, showing
criminal fines and costs collected $140.80, civil fees received $10.90, andconciliation court
fees received $2.50; and for the week ending June 19th,19�9, showing criminal fines and costs
collected $223.50, civil fees received $8.40, conciliation court fees received $9.85, were each
read, and having been previously approved by the City Attorney Resident Lemmon ordered that
the same be placed on file.
A communication from William Toomey regarding assessments for a sanitary sewer in the east
and west alley between Seventh And Eighth Street Southwest from Fifth Avenue Southwest to the
Sewage Lift station in Soldier Field, was read, and President Lemmon referred the same to the
City Attorney.
President Lemmon announced this as being the time and place set for receiving and opening
bids for the construction of a sanitary sewer and water main in Twelfth Street Southeast and
Ninth Avenue Southeast, from Eighth Avenue to Ninth Avenue in Twelfth Street, and from
Twelfth Street to Thirteenth Street Southeast in Ninth Avenue Southeast. The following
bids were received and opened at this time:

President Lemmon stated this as being the time and place set for receiving and opening
bids for the construction of a water main in Eighth Avenue Southwest from Eleventh Street to
10j Street Southwest, and in 102 Street Southwest from Eighth Avenue to the end of the street,

President Lemmon stated this as being the time and place set for receiving and opening
bids for the construction of a sanitary sewer and water main in Eighth Avenue Northwest, from
Ninth Street to Tenth Street, and in Tenth Street Northwest, from Seventh Avenue to Ninth
Avenue Northwest. The following bids were received and opened at this time:

Pres President Lemmon stated this as being the time and place set for receiving and opening
bids'for the construction of curb and gutter on Eleventh Street Southwest from Sixth Avenue
Southwest to Seventh Avenue Southwest, and on Tenth Street Southwest, from Seventh Avenue
Southwest to Elbventh Street Southwest. The following bids were received and opened at this

President Lemmon stated this as being the time and place set for receiving and opening
bids for the construction of a water main in 92 Avenue Southeast from Eleventh Street Southeast
to Twelfth Street Southeast. The following bids were received and opened at this time;

President Lemmon announced this as being the time and place set for receivinIg bids for
the placing of bituminous treatment on Eleventh Street Southwest from Sixth Avenue Southwest
to Eighth Avenue Southwest, and on Eighth Avenue Southwest from Tenth Street Southwest to
Eleventh Street Southwest, and on 10 Street Southwest from Eighth Avenue Southwest to the
end of the street. The City Clerk reported that no bids had been received for the making
of these improvements, and no bids were received by the Common Council at this time.
President Lemmon referred all of the above bids to the Sewer Committee and the City
Engineer, for tabulation and recommendation.
Alderman Amundsen introduced a resolution ordering a hearing on the vacation of part of
! Fourth Street Southwest from Fifteenth Avenue Southwest to the alley east of Block 2 Hammer

i� Fannings Addition, said hearing to be held at 9:30 o'clock P.M., on July 24th,1939, in

the Council Chambers, in the City Hall in said City, which was read.
Upon motion by Moody second by Fryer that the said resolution be adopted as read, and
all voting in favor thereof, President Lemmon declared the said resolution duly passed and
adopted.
Alderman Green introduced a resolution ordering advertisement for bids to be received and
opened at 2:00 o'clock P.M., on July 3rd,1939, for the grading, bituminous treatment and j

extension to Fifteenth Avenue Southwest, of the Alley South of Second Street Southwest, between
Fourteenth Avenue Southwest and Fifteenth Avenue Southwest, which was read.
Upon motion by Green second by Richman that the said resolution be adopted as read, and
all voting,in favor thereof, President Lemmon declared the: -said resolution duly.passed and
adopted.
The recommendations of, -the Sevier. Committee and the City Engineer, that the contract for
the construction of a sanitary sewer and water main in Twelfth Street Southeast from Eighth
Avenue to Ninth Avenue, and in Ninth Avenue Southeast from Twelfth Street to Thirteenth,

the Water main; were read and President Lemmon ordered that the same be placed on file.
Alderman Green introduced a resolution accepting the bid and proposal of Wm. C.Fraser
& Son for the construction of the above described sanitary sewer and viater main in Twelfth
Street Southeast and Ninth Avenue Southeast, for the sum of $986.80 for the sewer and $1742.00
for the water main, which was read.
Upon motion by Green second by Miliams that the said resolution be adopted as read, and
all voting in favor thereof, President Lemmon declared the said resolution duly passed and
adopted.
The recommendation of the Sevier Committee and the City Engineer that the bid and proposal
of Wm.C.Fraser & Son in the sum of $1394.00 for the construction of a water main in Eighth
Avenue Southwest from llth Street to 10 Street, and in 10j'� Street Southwest to the end of
the street, be accepted, was read, and President Lemmon ordered that the same be placed'on file.
Alderman Amundsen introduced a resolution accepting the bid and proposal of Wm.C.Fraser
& Son in the sum of 91394.00, for the construction of a water main in Eighth Avenue and 102
Street Southwest as above described, which was read.
Upon motion by Fryer second by I,.ioody that the said resolution be adopted as read, and
411 voting in favor thereof, President Lemmon declared the said resolution duly passed and
adopted.
The recommendations.of the City Engineer and the Sever Committee, that the contracts for
the construction of a sanitary sewer and water main in Eighth Avenue Northwest from Ninth Street!
to Tenth Street Northwest, and in Tenth Street Northwest from Seventh Avenue Northwest to -
Ninth Avenue Northwest, be awarded to Wm. C. Fraser & Son, were read and President Lemmon
ordered that the same be placed on file.
Alderman Amundsen introduced a resolution accepting the bid and proposal of Vim. C. Fraser
BE Son, in the sum of $1640.24 for the sanitary sewer and $2298.00 for the water ;Hain, in
Eighth Avenue and Tenth Street Northwest, as above described, which was read.
Upon motion by Fryer second by Richman that the said resolution be adopted as read and
all voting in favor thereof, President Lemmon declared the said resolution duly passed and
adopted.
The recommendation by the City Engineer and the Sewer Committee that the contract for
the construction of curb and gutter in Eleventh Street Southwest, from Sixth Avenue Southwest
to Seventh Avenue Southwest, and in Tenth Street Southwest from Seventh Avenue Southwest to

Alderman Fryer introduced a resolution accepting the bid and proposal of Lorenz Schwanke
in the sum of $1058.40, for the construction of curb and gutter in Eleventh Street Southwest,

Upon motion by Williams second by Richman that the said resolution be adopted as read and
all voting in favor thereof, President Lemmon declared the said resolution duly passed and

the construction of a water main in 92 Avenue Southeast from Eleventh Street Southeast to
Twelfth Street Southeast be awarded to Wm.C.Fraser & Son for the sum of $1195.16, was read

Alderman Richman introduced a resolution accepting the bid and proposal of Wm.C.Fraser &
Son for the construction of a water main in 9z Avenue Southeast as above described, for the
sum of $1195.16, which was read.
Upon motion by Green second by Fryer that the said resolution be adopted as read, and
all voting in favor thereof, President Lemmon declared the said resolution duly passed and
j adopted.
Upon motion by Fryer second by Williams The City Clerk was instructed to return the
checks of the unsuccessful bidders.
Alderman Williams introduced a resolution ordering a hearing on the vacation of
the alleys between lots 8 and 11 and 7,and between Lots 6 and 12 and Lot 7, in Block 11,
Northern Addition, said hearing to be held at 7:30 o'clock P.M., on July 24th,1939, which
was read.
Upon motion by Green second by Fryer that the said resolution be adopted as read, and all
voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $4,000.00 for use of the Street
& Alley Committee, $3,000.00 from the Street and Alley Fund and $1,000.00 from the Sewer Fund,
which was read.
Upon motion by Williams second by Amundsen that the said resolution be adopted as read,
and all voting in favor thereof, President Lemmon declared the said resolution duly passed and
adopted.
Alderman Richman introduced a resolution appropriating t2885.30•from the Park Improvement
Fund and ordering payment made to the Mayo Trust Fund for payrolls for labor during the hall
month ending June 15th,1939, which was read.
Upon motion by Fryer second by Richman that the said resolution be adopted as read and
all voting in favor thereof, President Lemmon declared the said resolution duly passed and
adopted.

Alderman Richman introduced a resolution appropriating $322.87 from the General Fund and
ordering payment made to the Standard Oil Company for one tank car of road oil, 7972 gallons,
furnished tan.d@r invoice No.Q,12382, for oiling streets, which was read.
Upon motion by Amundsen second by Williams, that the said resolution be adopted as read,
and all voting in favor thereof, President Lemmon declared the said resolution duly passed
and adopted.
Alderman Moody introduced a resolution granting public dance permit to Dale Hess for the
Woodman Hall, June 17th and 24th,1939, and fixing the fee at $6.00, which was read.
Upon motion by Fryer second by Moody that the said resolution be adopted as read, and
all voting in favor thereof, President Lemmon declared the said resolution duly passed and
adopted.
Alderman Moody introduced a resolution ordering that a sidewalk be constructed on
Fourteenth Avenue Northeast, from Fourth Street to Fifth Street Northeast, which was read.
Upon motion by Richman second by Amundsen that the said resolution be adopted as read,
and all voting in favor thereof, President Lemmon declared the said resolution duly passed
and adopted.
Alderman Moody introduced a resolution authorizing and instructing the City Engineer to
secure the necessary labor and materials and construct a sanitary sewer in 10- Street South-
east from the manhole between First Avenue Southeast and Third Avenue Southeast to
First Avenue Southeast, which was read.
Upon motion by Moody second by Williams that the said resolution be adopted as read, and
all voting in favor thereof, President Lemmon declared the said resolution duly passed and

Alderman Moody introduced a resolution appropriating $$.909.82 fVcRn the Permanent Improvement
Revolving Fund and ordering payment made to Martin Paulson for first and final estimate on
contract for construction of a sanitary sewer in Eleventh Street Northeast from the alley
between Broadiaray Street and First Avenue Northeast to the west line of Lot 3,block 42, Northern
Addition, which was read.
Upon motion by Richman second by Amundsen that the said resolution be adopted as read, and
all voting in favor thereof, President Lemmon declared the said resolution duly passed and
adopted.
A Alderman Fryer introduced a resolution appropriating $846.98 from the Permanent Improvement
Revolving Fund and ordering payment made to Martin Paulson for first and final estimate on
contract for the construction of a sanitary sewer in 91 Avenue Southeast from Eleventh Street tol
Tvrelfth Street Southeast, which was read.
Upon motion by Williams second by Green that the said resolution be adopted as read and
all voting in favor thereof, President Lemmon declared the said resolution duly passed and
adopted.

Alderman Green introduced a resolution appropriating $558.64 from the Street and Alley
Fund and ordering payment made to the General Fund, for gasoline furnished April 6th to May
26th,1939, which was read.
Upon motion by Green second by Fryer that the said resolution be adopted as read, and
all voting in favor thereof, President Lemmon declared the said resolution duly passed and
adopted.

Alderman Fryer introduced a resolution ordering plans, specifications and estimate of
cost for the grading of Fourteenth Avenue Northeast, from Fourth Street to Fifth Street

Northeast, which was read.
Upon motion by Green second by Richman that the said resolution be adopted as read, and
all voting in favor thereof, President Lemmon declared the said resolution duly passed and
adopted.
The following claims were read and upon motion by green second by Richman, and all voting ,

in favor thereof, the same were allowed and the Mayor and City Clerk were authorized and
directed to draw warrants upon the City Treasurer and make payments accordingly;

Upon motion by Fryer second by Richman the Chief of Police was authorized to send the
local departmentts pistol team to St.Paul on June 26th,1939.
President Lemmon stated that the City Clerk had reported that the Public Examiners
have recommended that James Starkey and IJIr. Murray should file official bonds, and that
the matter was b-9 -ng referred to the Park "oard.

The Mayor called the attention of the Council to the necessity of a more detailed and better
building code for the City of Rochester, and recommended that the National Building Code be used
or adopted in setting up an up to date code for the City of Rochester. President Lemmon referred
the matter to the Building Inspector and the Police C * tt e fo investi ati r1 and re rt.
Alderman Williams in.208.uced an ordinance entitled, if orddinance repealing an ordnance
entitled,tAn ordinance providing for the appointment of one person for both the office of
Building and Electrical Inspector and prescribing.his pourers and duties and the amendment
thereto", which was given its first reading.

inspector and prescribing his duties, which was given its first reading.
