Minutes of a regular meeting of the Common Council of the'City of Rochester, Minnesota,
held in the Council Chambers, in the City Hall, in said City, on July 3rd,1939.
President Lemmon called the meeting to order at 2:00 o'clock P.M., the following
members being present: Lemmon, Amundsen, Fryer, Moody, Richman, Williams. Absent: Green.

Upon motion by Moody second by Richman, the minutes of the meeting of June 19th,1939,
were approved.
President Lemmon announced this as the time and place fixed for a hearing on the
construction of a sanitary sewer in llz Street Southeast from First Avenue Southeast east to
the east line of Lot 21,Block 8, Sunnyside Addition, and asked if any one present wished to
be heard concerning the said improvement. No one present wished to be heard.
President Lemmon stated this as being the time and place set for a hearing on the
construction of a sanitary sewer and water main in Sixteenth Avenue Southwest from Second
Street Southwest to Fifth Street Southwest, and in Second Street Southwest from the west line

of Riege's Addition to Sixteenth Avenue Southwest south of Second Street, and asked if any one
present wished to be heard concerning the said improvement. No one present wished to
be heard concerning the said improvement.
President Lemmon stated this as being the time and place set for receiving and opening
bids for the construction of a sanitary sewer and water main in Sixteenth Avenue and Second
Street Soutlgviest, as above described. The following bids were received and opened at this
time:

President Lemmon referred the above bids to the City Engineer and the Sewer Committee
for tabulation and recommendation.
President Lemmon stated this as being the time and place fixed for receiving and opening
bids for the grading,bituminous treatment, and extension of the Alley South of Second Street
Southwest between Fourteenth Avenue and Fifteenth Avenue Southwest, and the City Clerk stated
that no bids had been received.
Upon motion by Richman second by Fryer The City Engineer was authorized and directed to
secure the necessary labor, materials, etc., and improve and extend the above described alley
by City Force Account, in accordance with the plans and specifications for the said improvement
which are on file in the office of the City Clerk of said City.
An ordinance providing for appointment of a Dog Catcher, prescribing his powers and duties,
and prohibiting dogs running at large except during the period from November 1st each year,
to March 1st, each year following, in the City of Rochester, Minnesota, excepting upon the
property occupied by the owner or person in control of said dog, and providing for
control of dangerous and vicious dogs and repealing Ordinance No.158, introduced and given its
first reading on May 29th,1939, its second reading on June 5th,1939, was given its third and

The following communication was read and President Lemmon ordered that.the same be placed

To The Mayor and Common Council
City of Rochester:
Gentlemen:
Your ordinance that you have up in regard to keeping dogs tied or penned
up for a certain number of months in the year. I am very much opposed to same and.1 have
talked to others and they feel the same. In the part of the City that I live there are
but a very few homes that do not have a dog and others have two or move* and as far as it
goes I have not seen that the dogs that are at liberty do very much harm. Any way not as
much as some humans that climb over fences and tramp thru gardens,etc.
I am in favor to have dogs licensed and let them have their freedom, and dogs
that are bad disposition I think that the average one that has one will either keep it
in bonds or dispose of same.
I think if you pass your ordinance you are just causing trouble for yourselves
and others in your position in the future.

The following copy of a resolution passed and adopted by the Rochester Kennel Club was
read and President Lemmon ordered that the same be placed on rile:
"ROCHESTER KENNEL CLUB
June 27, 1939
Resolution passed by the Rochester Kennel Club at its"meeting June 27th,1939•
RESOLVED THAT we recommend to the Common Council of the City of Rochester that:
1. Present ordinance relative to licensing of dogs be more adequately enforced.
AND BE IT FURRIER RESOLVED that we recommend that in the event of damage done
by a dog to anotherts property that action may be brought through proper channels by the
plaintiff against the owner of the dog doing damabe by the person dammed.

Twenty four petitions together bearing 605 signatures and headed as follows were presented
to the Council and President Lemmon ordered that the same be placed on file:
"To the Honorable
Common Council of the City of Rochester
We, the undersigned, oppose the passage of the proposed dog ordinance for the
following reasons:
1. The new ordinance c-annot be enforced, and the penalty is too severe.
2. The present ordinance is adequate to take care of any dog which may
become a nuisance.
3. A dog that is constantly tied up soon becomes noisy and ugly.
4. The passage of this ordinance would, by its extreme penalty for
violation, make it impractical to have any pet dogs in Rochester,
and what could we find to take their place in the hearts of the men,
women and children of this city. "
A motion by Moody seconded by Fryer that the foregoing ordinance be not adopted as read
carried by all voting in favor thereof, and President Lemmon declared the said ordinance not
adopted.
Mr. L.N.Ekstrand appeared before the Common Council and presented twelve petitions signed
by business people in the City; and urged that favorable consideration be given to these
petitions. Said petitions being headed as follows:

"TO HUNORABLE MAYOR AIM COO! AON COUNCIL,
City of Rochester, Minnesota.
Gentlemen:
We, the undersigned businessmen and women of Rochester, hereby petition your
Honorable Body to amend the present parking ordinance so as to provide for one (1) hour
parking limitation in the business district, instead of the present two (2) hour limi-
tation. We believe that this change will be of great benefit to all owners of automo-
biles and business houses, as well as to the visitors to Rochester, and feel sure that
it will provide a larger number of available parking places in the business area, due
to the faster turn -over and movement of parked vehicles."

Upon motion by Fryer second by Richman the City Attorney was instructed to draw an
amendment to the traffic ordinance designating the down town parking limitations to one hour
from 8:00 o'clock A.M. to 6:00 o'clock P.M. on week days except Saturdays when the one hour
parking limitation shall be from 8:00 o'clock A.M. to 9:00 o'clock P.M.
An ordinance repealing an ordinance providing for the appointment of one person for both
the office of Building and Electrical Inspector and prescribing his duties and powers and the
was given
amendment thereto, introduced and given its first reading on June 19th,1939,/its second
reading.
Upon motion by Fryer second by Williams, and all voting -in favor thereof, the rules were
suspended and the said ordinance was given its third and final reading.
Upon motion by Williams second by Fryer, that the said ordinance be adopted as read, and
j all voting in favor thereof, President Lemmon declared the said ordinance duly passed and
adopted.
An ordinance providing for the appointment of one person to the office of Building and
Plumbing Inspector and prescribing his powers and duties, introduced and given its first
reading on June 19th,1939, was given its second reading.
An ordinance providing for the appointment of an electrical inspector and prescribing his
duties, introduced and given its first reading on June 19th,1939, was given its second reading.

Alderman Fryer introduced an ordinance an ordinance regulating traffic, the operation and
;parking of vehicles, the use of streets for driveway entrances, and designating arterial
highways in the City of Rochester, Minnesota,the samb being ordinance No.488, which was given
its first reading.
Upon motion by Fryer second by Richman, and all voting in favor thereof, the rules were
suspended and.the-said ordinance was given its second reading.
The report of the Sanitary Inspector for the month of Ivlay,1939, showing that twalve
notices had been served on property owners to clean up and remedy unsanitary conditions existing
on their premises, and that ten notices had been sent out to property owners to make correc-
tions to outside toilets in order to comply with the state regulations and city ordinances,was
read and President Lemmon ordered that the same be placed on file.
A communication from.•.Geo.F.Strifert, Sanitary Inspector recommending the passage of an
ordinance providing for the protection of public health through properly installed plumbing in
all places where meals or lunches are served to the publics was read and President Lemmon
ordered that the same be placed on file.

An assignment signed by T.J.Costello, Jr. to'the First National Bank in the sum of $99.00
was read, and upon motion by Amundsen second by Williams the said assignment was accepted and
the Mayor and City Clerk were instructed to draw a warrant accordingly from funds due T.J.
Costello, Jr. and it was ordered that the said assignment I)e placed on file.
A confirmation that the display of fireworks to be fired for the City of Rochester on
July 4th,1939, is covered by liability insurance in the form of a blanket Policy, Policy No.
A025072, Ref. No.27503 held by the Unexcelled Manufacturing Company, Inc., and Paints Fireworks
Disply Company, Inc., to indemnify against loss from an accident resulting in bodily injuries
or death to a person or persons, was read and president Lemmon ordered that the same be placed
on file.
A communication from M.Brataas to the City Engineer regarding the construction of
splash boards on North Broadway Bridge was read and President Lemmon ordered that the same
be placed on file. '
Applications signed by Hugh %inter and Harold F.Biederwolf for appointment as Radio
operator for the City of Rochester, were each read and President Lemmon ordered that the same
be placed on file for future consideration.
A copy of a requisition by the Health Officer upon St.Maryts Hospital for the isolation
of Dale'Corfits diagnosed to be suffering from typhoid fever, was read and President Lemmon
ordered that the same be placed on file. '
A copy of a resolution passed and adopted by the Commissioners of the Sinking Fund of the
City of Rochester appropriating $18,000 from the Sinking Fund and ordering payment made to
the First National Bank for the July lst,1939,maturity of Rochester Light and Water bonds,'
was read, and upon motion by Moody second by Amundsen the action of the Sinking Fund Commission
was approved and it was ordered that the copy of the resolution be placed on file.
Ed Wobschall presented and read a petition bearing 9$ signatures of residents and
property owners on Second Street Northwest, and President Lemmon ordered that the same be
placed on file. Said petition being headed as follows:
"We, the undersigned, residents and property owners on Second Street Northwest,
between Second Avenue and Eleventh Avenue, respectfully petition the Honorable Mayor and
the 0ommon Council of the City of Rochester, Minnesota, as follows:
That the improvements now planned for Second Street -Northwest in the City of
Rochester be completed, except that the street be widened no more than eight (9) additional
feet. That in the opinion of the petitioners the taking of more than four (4)'feet from each
boulevard would greatly reduce the value of the properties and serve no pmacticable purpose."
Mr. Shonyo protested widening Second Street Northwest over eight feet.
Mr. Keller suggested that a few feet be left on each side for a boulevard.
Mr. Fitzpatrick also protested widening Second street fearing that the street would
be used for truck and bus traffic, and Mr. H. H. Kane inquired as to whether or not Second
Street Northwest would be used for a trunk highway.
Alderman Moody recommended that since there was no objections improving the street, and
since most of the objections were to the widening only, that the raised crossings be taken out
and the street be resurfaced only.
Alderman Williams favored a 40 foot street.
A motion by Fryer seconded by Amundsen carried that further action on the proposed
improvement of Second Street Northwest be deferred until July 17th,1939, all voting in favor

thereof except Alderman Williams who voted "No."
The application of Lloyd Bennett for a plumbers license was read, and upon motion by
Amundsen secnnd by Moody license was granted.
Applications signed by Vim. Gernes and Biltgen Brothers, Inc., for licenses to sell
non -intoxicating malt liquor, were each read, and upon motion by Richman second by Amundsen
Licenses were granted.
117e application of Harold Golod for a license to sell soft drinks was read, and upon
motion by Richman second by Amundsen, license was granted.

The application of Philip H. Barck/to connect with sewers and drains, was read,together
with a surety bond in the sum of �1,000.00 vrith the Seaboard surety Company as surety thereon
which was also read, and upon motion by Amundsen second by Richman the license was granted,
the bond approved, the surety thereon accepted and it was ordered that the same be placed on
file.
An application for transfer of On Sale license No.292 and Off Sale license No.485 for
selling non -intoxicating malt liquor from Louis Hanger to Harold Golod was read, and upon
motion by Moody second by Amundsen, the transfer was granted.
The official bond of Paul F. Dornack as Second Assistant Superintendent of the Dumping
iGrounds, with the American Surety Company as surety thereon in the sum of $p500.00, and the
t contract bonds of Harty T. Earle in the sum of $1025.00 with the Western Casualty and Surety
Company as surety; of Lorenz Schwanke in the sum of $1100.00 with the Standard Accident
Insurance Company as surety; and of Udm. C.Fraser & Son, in the sums of $ 1400.00, $1750.00,
$1000.00, $2300.00, $1700.00, $1200.00,each with the United States Guarantee Company as surety,
were each read, and upon motion by Richman second by Williams the bonds were approved the
sureties thereon accepted and it was ordered that the same be placed on file.
The report of the Clerk of the 1.4unicipal Court for the week ending June 26th,1939, showing
criminal fines and costs collected $211.30, civil fees received $5.60, conciliation court fees
received $2.50, waseread, and having been. previously approved by the City Attorney, President
Lemmon ordered that the same be placed on file.
The report of the City Weighmaster for the month of Tune,1939, showing 64 private loads
weighed and total receipts of $6.40, was read and President Lemmon referred the same to the
Finance Committee.
The report of the Building,EleIItrical and Plumbing Inspector for the month of Tune,1939,
showing building permits issued $441.00, Electrical permits issued $41.00, and plumbing permits
issued $106.00, was read,and President Lemmon referred the same to the Finance Committee:

The City Engineer's trial balance sheet for the month of May,1939, was presented to the
Council and President Lemmon ordered that the same be placed on file.
The City Engineers report for the month of Tune,1939, showing expenditures for labor
from the General Fund in the.sum of $889.54, from the Street and Alley Fund 91895.04, from
the Sewer Fund $680.14, and from the Bridge Fund $29.08, was read and President Lemmon
ordered that the same be placed on file.

A petition for placing bituminous treatment on Fifth Avenue Southeast from Sixth Street
Southeast to Tenth Street Southeast was read, and President Lemmon ordered that the same be
placed on file.
Upon motion by Fryer second by Amundsen the City Engineer was instructed to prepare plans,
etc. for the widening of Second Street Northwest.
The following communication was read and President Lemmon ordered that the same be placed
on file:
"Honorable Mayor and Common Council
City of Rochester, Minnesota.
Gentlemen:
The Municipal Employees Hospital Association was organized on June 23,
1939, in the City of Rochester, Minnesota.
We are submitting signed salary deduction cards for your consideration
and approval.
Respectfully submitted;

Upon motion day li=dsen second by jt yer the COUNCIL approved the above mentioned
assignments of salary deductions for members of the Municipal Employees Hospital Association,
and the Mayor dnd.City Clerk were authorized and directed to make such salary deductions
accordingly; all voting in favor of the motion except Alderman Williams,who voted "No."
The claim of Clements Chevrolet Company in the sum of $,91.50, for damages to two cars
on South Broadway February lst,1939, during the removal of snow from said street, was read,
and upon motion by Fryer second by Williams, the claim was allowed and the Mayor and City Clerk
were instructed to draw a warrant upon the City Treasurer and make payment accordingly.
A recommendation signed by the Sewer Committee, the Street and Alley Committee and the
City Engineer recommending that Holland's Grocery Store cooling; system be connected to
the storm sewer, was read and President Lemmon ordered that .the same be placed on file.
The following communication was read and President Lemmon ordered that the same be •placed

Dear Sir:- We wish to express to the City Council of Rochester our"deep regret
that action was taken to allow the sale of beer in a place of business directly
opposite our high school. By granting a license for the off -sale of beer at
420 Second Street Southwest you have taken,a step that cannot fail to make our
high-school students more susceptible to the drink evil. There is the danger,
too,;`that our students will court to accept the sale of beer in a grocery store
as a matter of fact and a matter of no concern.
The Women's Christian Temperance Union believes that our boys and girls
should have a chance to grow,,up•without becoming beer -minded, and we believe
that every effort should be made to keep the standards of our high school
students -on the highest possible level. The step.you have taken in granting
this license can in no way help to raise the standards of Rochester students,
and we believe the license fee can in no way condone your interest in granting
said license.
Alderman Richman is to be congratulated on his stand re the above case.

Honorable Common Council
City of Rochester, Minnesota
Gentlemen,
The Mayor and Purchasing Committee hake investigated the purchase of goods, wares
and merchandise by the Departments and Officers under the jurisdiction of the
Common Council and after such investigation make the following report and sugges-
tions, namely:
That all heads of Departments and Officers, now under the jurisdiction of the
Common Council, be directed to make no purchases for his Department nor incurr
any obligation exceeding $5.00 in price or value without first having obtained
the Consent and approval of the Purchasing Committee.
Reauisitions for all such purchases exceeding'5.00, showing the reasons therefor,
to be filed in the office of the City Clerk for examination by said Committee.
No purchases are to be made by employees unless first authorized by his or her
superior officer.
All office supplies and postage to be handled by the City Clerk and said Officers
are hereby directed to obtain the same from the City Clerk only.
Vie feel that if the foregoing is carried out it will be for the best welfare of
the City and recommend that these suggestions be adopted and the different
Departments and Officers be instructed accordingly.

Upon motion by Fryer second by Amundsen the sum of $199.00 was appropriated from the
General Fund and ordered paid to F.R.Finch,City Clerk, to set up a petty cash revolving fund
in the City Clerkts Office.

Mayor Grassle presented to the Council the resignation of C.O.Brown from the Police
Civil Service Commission, and upon motion by Fryer second by Amundsen, said resignation was

Upon motion by Fryer second by Richman the City Clerk was authorized to make changes in
accounting records and the form of warrant to be used as recommended by the state auditors.
The City Engineer stated that he had investigated the matter of storage for road ail
which the City had on hand and that a suitable used storage tank could be purchased for
$350.00, also space could be rented on railroad property at $15.00 per year. He recommended
the purchase and installation of this eC,_ipment. President Lem.mon referred the matter to

the Street and Alley Committee, Fire Chief and Engineer for report and recommendation at the
meeting to be held July 17th,1939.
Upon motion by Fryer second by Amundsen the City Clerk and Mayor were authorized and

instructed to write a letter to the State Highway Coimai ssioner in regard to installing railing
on the South Eroadway bridge.

Upon motion by Williams second by Fryer the City Clerk was instructed to reply to the

letter received from the W.C.T.U. regarding the issuance of a 3.2 bff sale beer licenst to
the Tauers Flld Store at 420 Second Street Southwest.

The Recommendation of the City Engineer and Sewer Committee that "the contract for
the construction of a sanitary sewer in parts of second Street Southwest and Sixteenth Avenue
Southwest, as above described, be awarded to Wm.C.Fraser & Son, for the sum of $3100.35,°was
Tread and President Lemmon ordered that the same be placed on file.
Alderman Fryer introduced a resolutionaccepting the bid and proposal of VIm.C. Fraser &
Son, in the sum of $3100.35, for the construction of a sanitary sewer in parts of Sixteenth
Avenue and Second Street Southwest, which was read.
Upon motion by Fryer second by Williams that the said resolution be adopted as read, and
all voting in favor thereof, President Lemmon declared the said resolution duly passed and
adopted.
