Rochester, Minn., J u ly 1.1 T, 19.3 9. 317 Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota,. held in the Council Chambers, in the City Hall, in said City, on July 17th, 1939- President Lemmon called the meeting to order at 7:30 o'clock P.M., the following members being present: Lemmon, Amundsen, Fryer, Green, Moody, Williams. Absent: Richman. Alderman Richman being absent on' account of the illness of himself. Upon motion by Moody second by Amundsen the minutes of the meeting of July 3rd, 1939, were approved. President Lemmon stated this as being the time set for adjourned action on the widening of Second Street Northwest from Broadway to Eleventh Avenue North- west, and asked if any one present wished to be heard concerning.these proposed improvements. t Edw.Wobschall presented to the Council two petitions bearing sixty signa- tures, and asking that the proposed improvements on Second Street Northwest be completed except that the street be widened no more than nine additional feet as they felt that a 35 foot street was a sufficient width for said Second Street Northwest. President Lemmon ordered that the said petitions be placed on file. Mrs. -Lehner and.Mrs. Schornstein protested the widening of the street but approved the resurfacing of said street. H. J. Penz expressed his opinion that it was unnecessary to widen said street beyond Fourth or Fifth Avenue Northwest. Mr. Shonyo expressed his opinion that the street should not be widened more than �I 32 feet on each side and very much opposed'a residential street wider than 34 feet. Chris Hare also protested the widening of Second Street to over 36 feet. Alderma Fryer stated that he felt that the street should be widened to 35 feet. Alderman Moody stated that in his opinion all that should be done at this time would be to remove the raised crossings and resurface the street and then,if necessary, at some future time, widen the street to a proper width. A motion by Fryer second by Amundsen carried that the Council proceed to widen Second Street Northwest from Second Avenue to Eleventh Avenue to 35 feet and from Broadway to Second Avenue to 50 feet. The matter of sanitary sewer service for property owned by Francis Chase 710 sh/Seventh Street Southwest was referred to the Sewer Committee and City C Engineer. A communication from H.N.Tompkins, Chief of Police, regarding the parking of second hand automobiles was read and upon motion by Fryer second by Amundsen his report was accepted and ordered placed on file. A communication from N.N.Tompkins regarding the pedestrian signs on South Broadway was read and President Lemmon ordered that the same be placed on file. A change of car endorsement for the insurance policy of the Rochester Bus Line, Inc., was presented and President Lemmon ordered that the same be p]a.ced on file. 731-8 Record. of Official Proceedings of the Common Council of .the City of Rochester, Minn., July 17 ,19 3 9 . The application of Paul F.Plantz for appointment as an Electrical Inspector for t the City of Rochester, was read and President Lemmon ordered that the same be placed on file for future reference. I A letter of recommendation from the Bureau of Criminal aprehension regarding' Hugh Winter, an applicant for appointment as an Electrical Inspector and Radio Engineer for the City of Rochester, was read and President Lemmon ordered that the same be placed on file. Copies of resolutions passed and adopted by the Commissioners of the Sinking, Fund of the City of Rochester, transferring $5491.00 from -the Sinking Fund to the Interest Fund, and $9497.62 from Code 5 to Code 13 of the Sinking Fund, and $1,000.00 from Code 21 to Code 14 of the Sinking Fund, to make -said -funds available for payment _of the July lst,1939,maturity of interest and principal on City of !Rochester Light and Water Bonds, were read, and upon motion by Green_second I - Iby Moody the actions of the_Sinking Fund Commissioners were approved. I A communication from the Graybar Electric Company, Inc. regarding the - I balance of $947.61 due on Police Department radio equipment was read and Presi-' !dent Lemmon ardered that the same be placed on file. A petition asking that Fourth Avenue Southeast from Twelfth Street South- i east to Thirteenth Street Southeast be oiled, also that the grade of said street be lowered before it is oiled, the City to pay for the grading and lowering, was !read and President Lemmon referred the same to the Street and Alley Committee I land the City.Engineer for report at the meeting to be held at 7:30 o'clock P.M. July 24th,1939. . . A petition asking that a water main be constructed in Fourth Avenue Northwest from Eleventh Street to Twelfth Street Northwest, was .read, and Presi- !dent Lemmon ordered that the same be placed on file._ A communication signed by the Secretary of the Board of..Zoning of the City !of Rochester, recommending that certain .descriptions of property be omitted from the recommendation of the city -wide -zoning committee appointed by the President iof the Council, was read andPresident Lemmon ordered that the same be placed on file. The trial balance of the City Engineer's Department for the month of IJune,1939, was read and President Lemmon ordered that the same be placed on file. The reports of the Clerk of the Municipal Court for the week ending IJuILy 3,1939, showing criminal fines and costs collected $279.70, civil fees received $7.90, and conciliation Court fees received $4.75; for_the week ending July 10th,1939, showing criminal fines and costs collected $209.00,_civil fees ireceived $13.60, conciliation court fees received $2.25; and for the week ending ;July 17th,1939, showing criminal fines and costs.collected $249.40, civil.fees I ireceived $11,75, and conciliation court fees received $9.00, were each read and 1having been previously approved by the City Attorney President Lemmon ordered that the same be placed on file. The applications of M.L..Priebe for two pin ball machine owners licenses and the applications of Michael Weinzette and Harold Golod for pin ball machine operators licenses were each read and upon motion by Moody decond by Williams licenses were granted. The application of Herman Kufus for a pin ball machine operators license was read and upon motion by Moody second by Williams license was granted. The application of Wm. C. Fraser & Son for a license to connect with sewers and drains, together with a surety bond in the sum of $1,000.00 with the New Amst dam casualty Company as surety, were each read, and upon motion by Amundsen second by Green, the license was granted, the bond approved, the surety thereon accepted and it was ordered that the same be placed on file.. The application of Oliver Polikowski for a drivers license was read and upon motion by Williams second by Moody, license was granted. Applications of Manhattan Bar, Geo.Hentges, Postal Telegraph Company, and Raymond L,Karns, for permit's to place and maintain signs, were each read, and upon motion by Amundsen second by Fryer, ])*emits were granted. The application of the Draper Electric Company for an electrician's license together with a surety bond in the sum of $19060.00 with the St.Paul Mercury and Indemkity Company as surety, were each read, and upon motion by Green second by Williams, license was granted, the bond approved, the surety thereon accepted, and it was ordered that the same be placed on file; The surety bond of Martin Paulson in the sum of $2667.14 covering his contract for construction of water main in parts of Second Street Southwest and Sixteenth Avenue Southwest with the Fidelity and Casualty Company as surety thereon, and the surety bond of Wm.C.Fraser & Son, in the sum of $3200.00 with thi United -States Guarantee Company as surety, covering his contract for construction of a sanitary sewer in parts of Second Street Southwest and Sixteenth Avenue Southwest, were each read and upon motion by Pryer second by Green, the bonds were approved, the sureties thereon accepted and it was ordered that the same be placed on file.. A communication from W.J.Halling favoring the widening of Second Street • Northwest four feet. on each side, but objecting to making said street an arterial highway, was read and President Lemmon ordered that the same be placed on file. A petition bearing five signatures asking kkak the Council not to change Block 6 Sunnyside Addition from a residential to an industrial district, was read and President Lemmon ordered that the same be placed on file. Upon motion by Fryer second by Green that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said �res'olu'tion duly passed and adopted. Alderman I Moody introduced a resolution appropriating $1310.70 from the General Fund and ordering payment made to the Street and Alley Fund, for use of equipment during June,1939,which was read. Upon motion by Amundsen second by Fryer that the said resolution be jadopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $912,69 from the General Fund and ordering -payment made to the Standard Oil Company for two tank cars of i road oil, which was read. Alderman Green introduced a resolution appropriating $726.90 from the Park Improvement Fund and ordering payment made to Leitzen Concrete Products for black dirt, sand and _gravel, and use -of equipment,. for Mayo Park and Soldier Field, which was .read. Alderman Green introduced a resolution appropriating $2097,90 from -the Park Improvement Fund and ordering .payment made to C,. C.Pagenhart_ for balance due on contract for construction of sidewalk, curb and gutter and aew,er in. Mayo Park, which was read. Upon motion by Fryer second by Amundsen that the said resolution be adopted j as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution appropriating $1131.41 from the Permanent Improvement Revolving Fund and ordering payment made to Wm.C.Fraser & -Son, for final estimate on contract for construction of a water main in 92 Avenue Southeast, which was read. ! Upon motion by Moody second by Williams that the said resolution be adopted as read, and all voting in favor thereof,` President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced a resolution accepting the work done by the Contractor on PWA Docket #1515-p,'which was read. Upon motion by Fryer second by Green that the said resolution be adopted as read and all voting in favor thereof, President Lemmon declared'the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution authorizing the City Engineer to make application to the United States thru the Federal Emergency Administration of Public Works for a grant to aid in financing construction of paving, sidewalks and laterals in the City of Rochester, Minnesota, (Minn-PWA Docket 1515-F),which was read. t Upon motion by Moody second by Fryer that the said resolution be adopted as read, and all voting in favor thereof,'President Lemmon declared the said :resolution duly passed and adopted. Alderman Amundsen introduced a resolution adding 1940 sq. fte to original contract with Anderson & Sons,Inc. on PWA Docket No.1515-F contract for an i incbease of $369960 in the contract price, which was read. Upon motion by Green second by Moody that the said resolution be adbpted as read and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution appropriating $1399.95 from the PWA .Construction Account Docket No.1515-F, and ordering payment made to Anderson & Sons,Inc. for final estimate on Contract "c" on 1515-F,which was read. i Record `of Official Proceedings -.of the Common Council of the._ City,. -of -Rochester, Minn., July 17,1939 3.251 Upon motion by Williams second by Amundsen that the said resolution be adopted as read, and all voting in favor -thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution granting public dance permit to Dale Hess for the Woodman Hall July 15th and 22nd, 1939, and fixing the fee at $6.00, which was read. Upon motion by Green -second by Moody that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced'a resolution ordering a hearing on the widening of Second Street Northwest, from. Broadway to Eleventh Avenue Northwest, said hearing to be held at 7:30 o'clock P-M., on July 24th,1939,in the Council Chambers,in the City Hall in said City, which was read. Upon motion by Fryer second by Moody that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced'a resolution ordering a hearing on the const tion of a water main in Fourth Avenue Northwest from Eleventh Street to Twelfth Street Northwest, said hearing to be held at 7:30 o'clock P.M., on July-24th, 1939, which was read. Upon motion by Green second by Moody th4t the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Upon motion by Green secohd by Moody the matter of the construction of a sidewalk on Fourth Street Southeast from Fourth Avenue.to Sixth Avenue was referred to the Street and Alley Committee and the City Engineer for report thereon on July 24th,1939- The Mayor submitted a letter from the Attorney General to the City Attorney containing an opinion on the status of Police Civil.Service Commissioners under the City Charter, and President Lemmon ordered that the same be placed on file. Mayor Grassle therefore appointed J.J.Adamson as Police Civil Service Commissioner to fill the vacancy of and for the unexpired term of'. C.O.Brown, resigned, and upon motion by Fryer second'by Amundsen the said appointment was approved. At the suggestion of Mayor Grassle the Purchasing Committee was added to the present committee studying a new building and electrical code for the City of Rochester. Mayor Grassle appointed Frederick Furlow, Dr. J.S.Lundy and Wm.
