' Minutes of an adjourned regular meeting of the Common Council of the City of
;City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in

(said City on August 21,1939.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
;following members being present: Lemmon, Amundsen, Fryer, Green, Moody, Mrachek,
Williams. Absent: None.
Upon motion by Fryer second by Amundsen, the minutes df the meetings held
IGAugust $th, and 17th, were each approved.
President Lemmon stated this as being the time and place set for adjourned
�'hearing and action on the construction of a sanitary sewer and water main in
Twelfth Avenue Northeast from Ninth Street to Tenth Street Northeast, in Thir-
teenth Avenue Northeast from Ninth to Tenth Street Northeast, and in Ninth

Street Northeast from Eleventh Avenue Northeast to Thirteenth Avenue Northeast,
and asked if any one present wished to be heard concerning the said improvements.
,'One person spoke in favor of the said sanitary sewer and water main.
A delegation representing the Safety Council of the Chamber of Commerce
appeared before the Council regarding the one hour parking ordinance which was
,;defeated at the meeting of August 7th,1939. James T.Spillane, Erwin Briese, and
','Dr. Montgomery mere spokesmen for the said delegation and urged that this
;!ordinance be reconsidered and favorable action taken thereon to relieve the
'traffic and parking conditions on Broadway Street. Mr. C.H.Getchell of the
'Minnesota Highway Department also appeared before the Council and reported on

a survey which his department had made of the parking of automobiles on Broadway.
A motion by Fryer second by Amundsen carried that this ordinance be

!'re -written and given its first reading at this meeting.
A petition asking that a sanitary sewer be constructed in Ninth Avenue
Southeast from Seventh Street Southeast to Eighth Street Southeast, was read

and President Lemmon ordered that the same be placed on file.
A petition asking that Second Street Northwest from Second Avenue to Third
Avenue Northwest be widened to a width of 46 feet, was read and President Lemmon
ordered that the same be placed on file.
Copies of resolutions passed and adopted by the Public Utility Board
requesting authority' to enter into contracts with B.J.Carney for poles, and
with Ellis Motor Company for a half ton pick-up truck, were each read and
(President Lemmon ordered that the same be placed on file.
A communication from R.A.Radford, Regional Director of PTA regarding
payment of
Docket No.1515-F,and/final requisition thereon, was read and President Lemmon
ordered that the same be placed on file.

A communication from Mary A.Burns regarding the connection of a cooling syste
in her property on Broadway to the storm sewer, was read and President Lemmon
referred the same to the City Attorney.
A recommendation to the Common Council from the Zoning Board that the
petition of Frank Satoris to have lots 19 and 19 in Block 5, Elm Park Addition
made a Commercial zone be not branted was read and upon motion by Green second
by Fryer the said recommendation was accepted and ordered placed on file.
A recommendation to the Common Council from the Zoning Board that Nat V.
Ranney be granted a building permit for completion of remodeling in his apartment
building, was read, and upon motion by Amundsen second by Moody the said recommenc
ation was accepted and the Building Inspector was instructed to issue said permit
to Nat V. Ranney.
The applications of J.Melvin Laskey and R.A.MacDowell for appointment
as Electrical Inspector were each read and President Lemmon ordered that the
same be placed on file.
The request of the Secretary of the Firemen's Relief Association for
approval by the Council of a loan of $1380 to Royal Nunamaker, was read and
President Lemmon referred the same to the Finance Committee.
The request of the City. Engineer for an appropriation of $3,000.00 from
the Street and Alley Fund, and $2,000.00 from the General Fund, for use of the
Street and Alley Committee was read and President Lemmon ordered that the same
be placed on file.
A summons and complaint in the case of Mrs. John Dooley vs. City of Rocheste3
Minnesota, was presented, and upon motion by Fryer second by Green it was referree
to the City Attorney.
An opinion by the City Attorney on certain claimssfor supplies, was read
and President Lemmon ordered that the same be placed on file.
The reports of the Clerk of the Municipal Court for the week ending August 4,
1939, showing criminal fines and costs collected $148- 50, civil fees received
$9.10, conciliation court fees $5.35; for the week ending August 7th,1939,.
showing criminal fines and costs collected $169.90, civil fees received $11.60,
conciliation court fees received $5.00, and for the week ending August 14th,
1939, showing criminal fines and costs collected $364.95, civil fees received
$13.30, and concilation court fees $6.50, were each read, and having been
previously approved by the City Attorney, President Lemmon ordered that the same
be placed on file.
The report of th4 Finance Committee recommending the approval by the Council
of a Loan of $1390,00 from the Firemen's Relief Association to Royal Nunamaker
for purchase of a home at 1019 Eighth Avenue Southeast, was read, and upon
motion by Green second by Amundsen, the said Committee report was accepted and

The report of Finance Committee on the reports of the City Weighmaster
and Building,Electrical and Plumbing Inspector for the month of July,1939, was
read, and President Lemmon ordered that the same be placed on file.
I. A copy of a resolution passed and adopted by'the Commissioners of the Sinking
Fund, appropriating $1,000.00 from the Sinking Fund and ordering"pay#mnt made to
,'the First National Bank, for the September 1, 1939, maturity of City of Rochester,
3% Repaving Bonds Numbers 22 to 29,inclusive, was read and President Lemmon
ordered that the same be placed on file.
An application by the -Northwestern Plumbing & Heating Company for a
'plumbers license was read, and upon motion by Green second by Amundsen, the
license was -granted subject -to their filing the required surety bond.
The application of T.J.Daly,-for a plumbers license together with a surety
bond in the sum of $1,000:00 with the Western Surety Company as surety, and the
,application of The Sanitary Company for a plumbers license together with a surety
',bond in the sum -of $1,000.00 with the Aetna Casualty and Surety -Company as surety,
!were each read.- and upon motion by Green second by Amundsen, the licenses were
granted, the bonds approved, "the sureties thereon accepted, and ordered placed
on file.

The application of Emil J. Neitz for an Electrician's License, was read
,.and upon motion by Williams second by Amundsen, license was granted subject to
,!the filing of the required surety bond.
The application of Don E. Postier for an electrician's license, together

l'with a surety bond in the sum of $1,000.00 with the Fidelity & Casualty Company
,as surety, were each read, and upon motion by Williams second by Amundsen, the
license was granted, the bond approved, the surety thereon accepted, and it was
'ordered that the same be placed on file.

The application of J.O..Dalsbo for a pinball machine owners license was
(!read, and upon motion by Moody second by Amundsen, license was granted.
The application of Roy-Hardtke for a pin ball machine operators license
Iat No.1.3 Second Street Southeast; was read and upon motion by Green second by
Fryer, license was granted.
An application signed by the Yellow Cab dompany, for transfer of taxicab

License NO-3 to a new automobile, was read, and upon motion by Moody second 'by
Green transfer was granted.

The bond of L.M.Feller Company covering their contract for the widening of
;Second Street Northwest from Broadway to Eleventh Avenue Northwest, was read,
and upon motion by Moody second by Green the surety thereon was accepted and
;the bond approved and it was ordered that the same be placed on file; said
bond being in the sum of $11,646.00 and having the Seaboard Surety Company as

;surety thereon.

A communication f rom'the City Attorney giving his opinion'as to the proper
1persons who should receive the money left with the City of Rochester by Clarence
IL.Fischer and Wm. biekh6ff for sewer connections,was read and upon`motion-b y
Mooay second by Amundsen said attorneys opinion was accepted -and the City Clerk
linstructed`to'make payments accordingly. '
A petition asking that Fourth Avenue' Southeast from Twelfth' Street Southeast
to Thirteenth Street §outheast be graded to an established grade; was read.
The City Engineer estimated the cost of this improvement at $5.0.0'per lot, and
upon motion by Fryer second by Mo6dy the City Engineer was instructed -to secure
the necessary labor, etc.,"an1 make the said improvement.
The following claims' were read, and upon motion by Fryer second by Green, -
and all` voting in favor thereof, the same were allowed and the Mayor and City
Clerk were authorized and directed to draw warrants upon the City TreasiTer and
make payments accordingly:

Alderman Williams introduced•the following resolution, which was read:
"WHEREAS, On August 6th, 1939, death called from our midst- our beloved
friend and co-worker, George H. Richman, an`d
WHEREASFrom the first day of, April 1935 to August 6th, 1939 he 'fi'lled the
office of -Alderman of the Third Ward of our City, and
WHEREAS, As a public official of the City of Rochester, he gave willingly
and freely of his time and talents and faithfully carried out 'the duties of his
office.
NOW THEREFORE,. Be it resolved by the Common Council of the City of Rochester;
Minnesota, that in the death of George H.Richmaii� the City of Rochester has lost
a citizen and public official whose services will be deeply missed.

Be it further resolved: That the said resolution be entefed upon the records
of the City of Rfthester and that a certified copy lie delivered to Mrs. Richman,
j his surviving wife, and the sympathy of the Mayor and Common Council of said
City is hereby expressed to her and the other members of the family in this hour
of sadness.;"
Upon motion by Fryer second by Amundsen that the said'resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
L Alderman Williams introduced a resolution granting public dance permit to
Dale.Hess fo.r the Woodman Hall, August 19th and 26th,1939, and fixing the fee
at $6.00, which was read.
Upon motion by Green second by Moody that the said resolution be adopted
as read, and all voting.in favor thereof, President Lemmon declared the said
resolution duly passed and adopted .
Alderman Williams introduced a resolution appropriating $3,000.00 from the
Street and,Alley Fund and $2,000.00 from the General Fund for use of the Street
& Alley Committee, which was read.

as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.

Alderman Williams introduced a resolution authorizing the Public Utility
Board to enter into contract with the Ellis Motor Company for the purchase of
a half ton pick-up truck for the sum of $690,50, less allowance of $190.50 for
the 1931 Ford pick-up truck, which was read.
Upon motion by Rilliams second by Moody that the said resolution be adopted
as read, and all voting in favor thereof, .President Lemmon declared the said
resolution duly passed and adopted.
Alderman Williams introduced a resolution authorizing the Public Utility
Board to enter.into.contract. with B. J..Carney Company for the furnishing of
100 western Red Cedar pol&s for the sum of $10.90, which was read.
Upon motion by Moody second by Fryer that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $543.23 from the
General Fund and ordering payment made to the.Public Health & Welfare Fund, for
transf.er,of funds received in the June 1939 tax settlement for garbage assessments
collected, which was read.
Upon motion by Amundsen second by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mrachek intrpduced a resolution appropriating $393.62 from the
General Fund and $10.00 from the Street and Alley Fund and ordering paymentmade
to the Standard Oil Company for one tank car of road oil furnished, which was

Upon motion by Green second by Fryer that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $429.32 from the
General Fund and ordering payment made to George C.-Peterson Company for 8063 gall-
ons gasoline furnished in tank Car No.HTCX 639, which was read,

as read, and all voting in favor thereof, President Lemmon declared the said

Alderman Mrachek introduced a resolution appropriating $314.38 from the
General Fund.and ordering payment made to the State of Minnesota Oil Inspection
Division for inspection fee and state tax on gasoline purchased in Car HTCX 639,
which was read.
Upon motion by Fryer second by Williams that the said reso.ltttion be adopted
as read, and all voting in favor thereof,, President Lemmon declared the said
resolution duly passed and adopted.

Alderman Mrachek introduced a resolution appropriating $273.15 from the
Street and Alley Fund and ordering payment made to Wm. L. Har for construction
of private sidewalks, which was read. a
Upon motion by Green second by Amundsen, that the said resolution be
adopted as read, and all voting 'in favor thereof, President Lemmon declared the
'said resolution duly passed and adopted.,
Alderman Moody introduced a resolution appropriating $591.29 from the

Street and Alley Fund and ordering payment made to the General Fund, for gas
furnished from the City Filling .Station, May 26th to July 9th,1939, which was
read. _.
Upon motion -by Williams second by Amundsen that the said resolution be

adopted as read and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Moody introduced a resolution appropriating $214.94 from the Street
'I & Alley Fund and ordering payment made to the Lyle Culvert & Pipe Company for
�! 4 #1 Armco Arches and 4 bands for culverts and waterways, which was read.
Upon motion by Green second by Fryer that the said•resolution be adopted
i' as read, and all voting in favor thereof, President Lemmon declared the said
:resolution duly passed and adopted.
Alderman Moody introduced a resolution appropriating $252.00 from the
Street and Alley -Fund and ordering payment made to J.D.Adams Company for 25
blades for the caterpillar tractor, and 25 blades for -the Grader #2, which was
'k read.
Upon motion by Amundsen second by Green that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon. declared the said

Alderman Moody introduced a resolution appropriating $1044029 from the
Permanent Improvement Revolving Fund and ordering payment made to Lorenz Schwanke
for final estimate on contract -for construction of curb and gutter in Eleventh
!'Street Southwest and Tenth Street Southwest; which was read.
Upon motion by Moody second by Fryer that the said resolution be adopted as
read, and all voting in favor thereof, President Lemmon declared the said ,resolu-
tion duly passed and adopted.
Alderman Moody introduced a resolution appropriating $2223.69 from the
;Permanent Improvement Revolving Fund and ordering payment made to Wm. C. Fraser
& ,Son, for first and final estimate on contract for the coYstruction of a water
main in Eighth Avenue Northwest and Tenth Street Northwest, which Sias read.
Upon motion by Williams second by Green that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.

Alderman Green introduced a resolution appropriating $761.51 fromthe Sewer
Fund and $13..50 from the Lighting Fund and ordering payment made to the City of
Rochester, Light Department, for electricity furnished at the Sewage Disposal
Plant Sewage Lift Station, and Dumping Grounds, in accordance with billings of
August 15th,1939,which was read.
Upon motion by Amundsen second by Moody that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Green introduced a resolution appropriating $225.25 from the Park
Improvement Fund and ordering payment made to the Rochester State Hospital for
cuushed rock and screenings for Soldier Field and Mayo Park, which was read.
Upon motion by Fryer second by Green that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Green introduced a resolution appropriating $2624.24 fromthe
Park mprovemeht Fund and ordering payment made to the Mayo Trust Fund, for
payrolls for labor Suring the half month ending August 15th, 1939, which was
read.
Upon motion by Fryer second by Williams that the said resolution be.adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Amundsen introduced a resolution ordering plans, etc.; for a sanita
_sewer and water main in Twelfth Avenue Northeast from Ninth Street to Tenth Stree
Northeast, in Thirteenth Avenue Northeast from Ninth Street to Tenth Street
Northeast, and in Ninth Street Northeast from Eleventh Avenue to Thirteenth

Avenue Northeast, which was read.
Upon motion by Fryer second by Green that the said resolution be adopted as
read, and all voting in favor thereof, President Lemmon declared the said resolu-
tion. duly passed and adopted.
Alderman Fryer introduced a resolution ordering a hearing on the construc-
tion of.a sanitary sewer in Ninth Avenue Southeast from Eighth Street Southeast
to Seventh Street Southeast, said hearing to be held at 2:00 o'clock P.M.,. on
September 5th,1935, which was read.
Upon motion by Moody second by Amundsen that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Amundsen introduced a resolution ordering hearings on the levying
of special assessments for the following described public improvements, which

Alderman Fryer introduced a resolution appropriating $210,00 from the

Upon motion by Williams second by Moody that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
!resolution duly passed and adopted.
Alderman Amundsen introduced an ordinance amending an ordinance regulating
'f
;traffic, the operation and parking of vehicles; the use of streets for driveway
entrances, and designating arterial highways in the City of Rochester,Minnesota,
!the same being ordinance No.499,which was given its first reading.
Upon motion by Fryer second by Green the possibility of the City of Rochester
,doing some black dtop work on the streets of the city with the equipment now at
the airport was referred to the Street and Alley Committee and the City Eng$neer
for investigation and report as to the cost and funds a$ailable for such purpose.

A committee report regarding appointment of an Electrical Inspector was read
and President Lemmon ordered that the same be placed on file.
Paul Grassle, Mayor, urged that the Council take action in appointing an
Electrical Inspector for the City of Rochester.
A motion by Williams second by Amundsen to defer action thereon until
September 5th,1939, was withdrawn.
Upon motion by Fryer second by Amundsen, Mat Walz was appointed Electrical
Inspector of the City of Rochester for the balance of this fiscal year, said
appointment b.eing effective October lst, 1939, at a salary of $1755.0.0 per months
all voting in favor thereof except Alderman Williams who voted "No(".
Upon motion by Amundsen second by Williams the City Engineer was instructed
to have the dumping grounds kept open from seven to nine in the winter months
and from s➢ix to nine in the summer months.
Upon motion by Moody second_by Fryer the City Engineer was instructed to
prepare plans and specifications for the painting of the Center Street bridge.
Upon motion by Fryer second by Williams the items in the bridge fund were
combined in one code.

Upon motion by Williams second. by Fryer the Finance Committee and the
City Clerk were instructed to check the, various code divisions. of all the funds
and make recommendations for transfer of balances.
,Upon motion by Fryer second by Amundsen the matter of flags, poles: and
holders was referred to the Purchasing Committee and the Chief of.the Fire.
Department.
Upon motion by Fryer second by Green the City Attorney was authorized to
employ legal assistance in -the taking of the" deposit ion. of --Dr. Govan at
Pawhuska, Oklahoma, in connection with the zotionfof Nelson vs. City of
Rochester,Minnesota.
Upon motion by Williams second by Green the Common Council adjourned.
