Minutes of a regular meeting of the Common Council of the City of Rochester, ;Minnesota, held in the Council Chambers, in the City Hall, in said City, on q September 5th, 1939- President Lemmon called the meeting to order at 2:00 o'clock P.M., the follow- ing members being present: Lemmon, Amundsen, -Fryer, Green, Moody, Mrachek, �i Williams. Absent: None. Upon motion by Amundsen second by Fryer, the minutes of the meeting.hdld on August 21st,1939, were approved. President Lemmon stated this. as being the time and place set for public i' ;hearings on the levying of special assessments for the cost and expense of the following Public improvements, and asked if any one present wished to be heard concerning either or any of following improvements, viz: The construction of a sanitary sewer in First Avenue Southwest from Fifth Street Southwest to Sixth Street Southwest (PWA Docket 15164F); !!The construction of a sanitary sewer in 112 street Southeast - from First Avenue 'Southeast east to Lot 21, Block.9, and Lot S, in Block ll,Sunnyside Addition; The construction of a sanitary sewer in Eleventh Street Southeast from Fourth Avenue Southeast to a point 115 feet east; The construction of a sanitary sewer in 10L Street Southeast from the manhole between First Avenue Southeast and Third Avenue Southeast to First Avenue Southeast; .The construction of a sanitary sewer in Seventh Avenue Northwest from Tenth Street Northwest to Seventh Street Northwest, and in Tenth Street Northwest from Sixth Avenue Northwest to Seventh Avenue Northwest; IThe construction of a sanitary sewer in Eleventh Street Northeast from the alley between Broadway and First Avenue Northeast east to Lot 3,Block 42,Northern Addition; The construction of a sanitary sewer and water main in Twelfth Street Southeast from Eighth Avenue Southeast to Ninth Avenue Southeast, and in Ninth Avenue Southeast from Twelfth Street Southeast to Thirteenth Street Southeast;. The construction of a sanitary sewer and water main in Eighth Avenue Northwest from Tenth Street Northwest to Ninth Street Northwest and in Tenth Street North- 1west from Seventh, Avenue Northwest to Ninth Avenue Northwest; The construction of a water main from Eleventh Street Southwest, north along r Eighth Avenue Southwest to 101 Street Southwest and west along 101 Street South- west intersecting the main in Eighth Avenue Southwest and forming a loop at the west end. of said 101 Street Southwest; ;The construction of a sanitary sewer and water main in 92 Avenue Southeast from Eleventh Street to Twelfth Street Southeast; ,:The widening of the pavement on Second Street Southwest from Eleventh Avenue to jTwelfth Avenue Southwest, two and one half to .three feet on the north side, and the construction of a new sidewalk on the north side of said part of Second Street I� Southwest; i� J: The construction of curb and gutter on Eleventh Street Southwest fro#t Sixth ;Avenue Southwest to Seventh Avenue Southwest, and on Tenth Street Southwest, from Seventh Avenue Southwest to Eleventh Street Southwest. i ' There was no one present who wished to be heard concerning either or any of G the above described improvements. i� President Lemmon stated this as being the time and place set for a hearing . on the construction of a sanitary sewer in Ninth Avenue Southeast from Seventh i Street Southeast to Eighth Street Southeast, and asked if any one present wished � to be heard concerning the said improvement. City..of Rochester, Minn., Septembe'T 3th,'1939'- 355 An ordinance amending an ordinance regulating traffic, the operation and parking of vehicles, the use of streets for driveway entrances, ' and designating arterial highways in the City of Rochester, Minnesota, introduced and given its first Reading August 21;1939, was given its second reading. Mr. James T.Spillane and Oscar Ronken appeared before the Council and spoke in favor of the passage of said ordinance. A motion by Fryer second by Mrachek to suspend the rules and give the said ordinance its third and final readingereceived the following vote: Ayes: Amunds Fryer, Green, Mrachek, an& Williams. No: Moody. The discussion on said ordinance was, however, continued, after which Alderman Moody withdrew his negative vote on the suspension of rules and voted �gye. -The said ordinance was accordingly given its third and final reading. Upon motion by Green second by Amundsen that the said ordinance be adopted as read, and upon roll call all voting in favor thereof except Alderman Moody lwho voted "No", President Lemmon declared the said ordinance duly passed and adopted. A copy of a requisition by the Health Officer upon Saint Maryls Hospital for the isolation of Helen Bonk diagnosed to be suffering from Scarlet Fever, lwas read and President Lemmon ordered that the same be placed on file. A petition signed by G.Dewey Nelson, et, al., asking that Lots 6, 7, 9, 9; 10, and 11, in Block 1 of Parkin's Sub -Division of a part of the Northeast of Sec. 3-106-114, be annexed to the City of Rochester, Minnesota, was read and lPres-ident Lemmon ordered that the same be placed on file. Alderman. Amundsen introduced an ordinance annexing to the City of Rochester, Lots Nos. 6, 7, S, 9, 10, 11, in Block 1, in Parkin's Sub -Division of a part of the northeast quarter Q) of Section No. -Three (3), in Towhship No. One hundred Six (106) North of Range No. Fourteen (14) West, in Olmsted County, Minnesota, which was given its first reading. Upon motion by Moody second by Fryer, and all voting inIfavor thereof, the rules were suspended and the said ordinance was given its second reading. , Upon motion by Fryer second by Williams, and all voting in favor thereof, the rules were suspended an$ the said ordinance was given its third and final . reading. Upon motion by Amundsen second by Moody,that the said ordinance be adopted as read, and upon roll call all voting in.favor thereof, President Lemmon declarec the said ordinance duly passed and adopted. A petition asking that Second Street Northwest from Third Avenue Northwest to Fourth Avenue Northwest be widened to a width of 40 feet, was read and I (President Lemmon ordered that the same be placed on.file. Mr. Edward A.Wobschall, re -presenting a delegation of property owners on I Second Street Northwest,spoke in opposition to the widening of said street to a width mor6 than 35 feet west of Fourth Avenue Northwest. A motion by Green second by Moody carried that no change be made in the specified 35 foot width for the widening of Second Street Northwest. A petition asking that the east half of Block 95 of Moe and Old's Addition be classified as a commercial zone, was read, and upon motion by Green second by Moody said petition was referred to the Zoning Board. A communication from the State Examining Department setting forth the !'proceedure for making certain financial reports of the City business to that department was read and President Lemmon ordered that the same be placed on file. ! A communication from the League of Minnesota Municipalities, with a questionnaire attached, in regard to holding a county or aeea school for peace ;!officers was read and upon motion by Amundsen second by Fryer, the Mayor was authorized to complete the questionnaire favoring the holding of said school in Olmsted County. i . j The,f.ollowing communication was read and President Lemmon ordered that the ;same be placed on file: n August 24,1939- Mr. Fred R.Finch City Clerk Rochester, Minnesota Dear Sir: In reconciling the balance remaining in the Park Improvement Fund according to our accounts with the balance shown on your statement of July 31st., we find that the following items have been charged in error against this fund: r I` I' Parkhill Bros: in the aihount of $445,74 is charged against #3, Mayo Park Improvement; and, Boutells, in the amount of $13,25 is charged against #3, Mayo Park Maintenance. We believe these items should hate been charged against the Park Band Fund. Will you please make these corrections so that our accounts will balance. Applications signed by B.C.French and Herman guhfus and Fred Ohm for transfer of non -intoxicating malt liquor licenses No.299 and 492 to Fred Ohm were each read and upon motion by Amundsen second by Green transfer was g'ranted. The applications of Wm. M.. Gernes and Shell Oil Company for permits to place and maintain signs were each read sn d upon motion by Amundsen second by Moody permits were granted. F The license bonds of Emil J. Neitz in the sum of $1,000100, with the Western. Surety Company as surety; Edward J. Heaty, doing business as the Northwest Plumbing &.Heating Company in the sum of $1,000.00 with the Seaboard Surety Company as surety, and. of Geo_. H. Popple in the sum of $1,.000.00 with the National Surety Corporation as surety., were. each read, and upon motion by Green se"a)nd by. Amundsen, the bonds were approved, the sureties thereon accepted and it was ordered that the same - be placed on file. A duplicate Automobile liability policy, No.AS 207100 written by the Anchor Casualty Company and issued to the Rochester Bus Line, Inc., covering their buses licensed by the City of Rochester, was read, and upon motion by Moody second by Fryer; the said policy was accepted and ordered placed on1file: The, report of the Clerk of the Municipal Court for' the week- ending August 28th,1939, showing criminal fines and - costs collected $150.4o, ""civil fees' received $5.304conciliation court fees received $6.00, was: ..'.;. read; and ha•ving;:,been previously approved by the � City Attorney, President Lemmon ordered that the. same be placed on file. The recommendation of the Street and Alley Committee and the City Engineer, j i that a sidewalk be constructed on the east half of Lot 9, and on the north side, j,of Lot 13, in Laura Domke's Sub -Div. was read and upon motion by Moody second jby Williams said recommendation was accepted and the,City Engineer instructed ito order the said sidewalks constructed, accordingly. !' A communication,from Dr. W.L.Benedict of the.Mayo Clinic, regarding an ,;injury to the left eye of Arthur Dornack,. sustained wile employed by the -City on a sewer project, ,of Rochester,/was read, and President Lemmon referred the same to -the Street land Alley Committee, the City Engineer and.the City Attorney. Upon motion by Fryer second by Green that the said resolution be adopted y as read,and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Fryer introduced a resolution fixing the salery of the Electrical ' Inspector for the balance of this official year at $2100.00 per year, which was read. i J Upon motion by Fryer second by Green that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Fryer introduced a resolution fixing the salary of the Building and iPlumbing. Inspector for the balance of this official ,year at the sum of $i920.00 per year, which was read. Upon motion by Fryer second by Amundsen that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. I. Alderman Moody introduced a resolution granting public dance permit to li Dale Hess for the Woodman Hall, September 2nd and 9th,1939, and fixing the fee at $6.00, which was read. Upon motion by Mrachek second by Moody that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $1355.72 from the Street and Alley Fund, and $2762.00 from the Permanent Improvement Revolving (Fund, and ordering payment made to L.M.Feller, for estimate No.l on contract' for the widening of Second Street Northwest, from Broadway to Eleventh Avenue Northwest, which was read. Upon motion by Fryer second by Williams that the said resolution be adopted �as read, and all voting in favor thereof,,President Lemmon declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $264._20 from the Fire Protection Fund and,$5.29 from the General Fund and ordering payment made to the National Bushing & Parts Company, for equipment repairs, etc., which was read. Upon motion by Amundsen second by Green that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced a resolution authorizing the Public Utility Board to enter into contract with E.A.Danewick for painting and cleaning,. the exterior and interior of two steel stand pipes and painting.ladder leading to the top of the conerete tower for the sum of $1993.00, which was read. _ Upon motion by Amundsen second by Mrachek that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced a resolution authorizing the Public Utility Board to enter into contracts with the Sterling Electric Company for the furnish- ing of 44 Marrin Foundry street lighting standards for the sum of $2365.00, and to enter into contract with the Jobbers Supply Company for the furnishing of 44 ornamental luminaires for the sum of $548*24, which was read. Upon motion by Green second by Amundsen that the said resolution be adopted as read, and all votingin favor thereof., President Lemmon declared the said resolution duly passed and adopted.. Alderman Amundsen introduced a resolution ordering a hearing on the vacation of Seventh Street Southeast from Ninth Avenue Southeast to Tenth Avenue Southeast, said hearing to be held at 7:30 o'clock P.Mo on October 16th,1939, in the, Council Chambers, in the City Hall in said.City, which was read. 736--2 Record of Official Proceedings of the -Common Council of the -City of Rochester, Minn., September 5,1939. I, Upon motion by Mrachek second by Williams that the said resolution be adopted as read, and all voting 'in favor thereof, President Lemmon declared the said'resolution duly passed and adopted. The City Engineer submitted plans, specifications and estimate of cost for the construction of a sanitary sewer and water main in Twelfth Avenue Northeast from Ninth Street to Tenth Street Northeast, in Thirteenth Avenue Northeast from Ninth Street to Tenth Street Northeast, and in Ninth Street Northeast from E Eleventh Avenue Northeast to Thirteenth Avenue Northeastt said estimate of cost being $6, 406.03. Alderman Amundsen introduced a resolution adopting the plans, specifications, and. estimate of cost, etc., for the construction of a sanitary sewer and water it main in Twelfth Avenue, Thirteenth Avenue, and Ninth Street Northeast, as above described, ordering that the same be placed on file in the office of the City Clerk of said City, ordering a hearing on the said improvement to be held at 7:30 o'clock P:M.,'on September 18th,1939, and ordering advertisement for bids to be received and opened at a meeting to be held at 7:30 o'clock P.M., on September lgth,1939,"which was read. Upon motion by Moody second by Amundsen that the said resolution'be adopted as read, and all voting in favor thereof,, President Lemmon declared the said !resolution duly passed and adopted. li j' A petition asking that a sanitary sewer be constructed on Fourth Street � Southeast from the west line of Lot 14 Audit'oe's Plat "A", to the east line of !' Lot 28, Sanderson's Second Addition, was read and President Lemmon ordered that i the same 'be placed on file,' Alderman Fryer introduced a resolution ordering a hearing on the construc- ' tion of a sanitary sewer in Fourtih Street Southeast from Lot 14 Auditor's Plat "A" to Lot 28, Sanderson's Second Addition, said hearing to be held at 7:30 o'clock P.M., on September 18th,1939, which was read. Upon motion by Moody second by Mrachek that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Fryer introduced a resolution levying special assessments for the construction of a sanitary sewer in Eleventh Street Northeast from the alley between Broadway and First Avenue Northeast to the west line of Lot 3,Bloc$ 42 Northern Addition, which was read. Upon motion by Green second by Mrachek that the said resolution be adppted :�'as read, and all voting in favor thereof, President Lemmon declared the said !! resolution duly'passed and adopted. ' 1! Street Southwest north along Eighth Avenue Southwest.to 101 Street Southwest and west along said 102 Street Southwest intersecting the main in Eighth Avenue Southwest and forming a lopp at the west end of said 10, Street Southwest, which was read. Upon motion by Mrachek second by Amundsen, that the said resolution be adopt e4 as read, and all voting in favor thereof, President Lemmon declared the,:said resolution duly passed and adopted. Alderman Amundsen introduced a resolution levying special assessments for the construction of a sanitary sewer and water main in Twelfth Street Squtheast from Eighth Avenue Southeast. to Ninth Avenue Southeast and in Ninth Avenue Southeast from Twelfth Street Southeast to Thirteenth Street Southeast, which was read. Upon motion by Fryer second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon. declared the.`, said resolution duly passed and adopted. Alderman Ameen introduced a resolution levying special. -assessments for the construction of a sanitary sewer in First Avenue Southwest from Fifth Street. -Southwest to Sixth Street,Southwest, which was read.
