Common Council of the..City. of Rochester, Minn., October, 2 3 ,19 3 9 405 I Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City, on October 23rd,1939. President Lemmon called the meeting to order at 7:30 o'clock P.11., the following members being present: Lemmon, Amundsen, Fryer, Green, Moody, Mrachek, Williams. Absent: None. Upon motion by Williams second by Amundsen the minutes of the meetings of October 2nd, 1939, October 4th,1939, and October 16th,1939, were approved. President Lemmon stated this as being the time and place set for a•hearing on the constriiction of a sanitary sewer in Eleventh Street Southeast from Fifth Avenue Southeast to Sixth Avenue Southeast, and asked if any one present wished to be heard concerning the said improvement. No one present wished to be heard. President Lemmon stated this as being the time and place set for a hearing on special assessments levied for sprinkling, flushing and oiling of streets during the 1939 season, and asked.if any one present wished to be heard concerning either of any of the said sprinkling assessments. No one present wished to be heard. A communication from Walter G.Berger asking when action will be taken by tge Council and Zoning Board to change the classification of Lot 3,Block 2, Westlawn Addition to a Commercial District, was read, and upon motion by Williams second by Amundsen, the.Mayor and City Clerk were instructed to write to Mr. Berger informing him that an ordinance covering changes in the Zoning Ordinance will be drawn and presented to the Council at an early. date. Communications from the Graybar Electric Company, Inc., regarding a balance d-�ie.on police radio equipment were read, and upon motion .by Fryer second by Mrachek the Mayor and City Clerk were instructed to notify said Graybar Electric Company,Inc., that payment ::ill be made at such time as said equipment is satisfactory to the Electrical Inspector. Applications signed by T-I.L.Priebe for two pinball machine owia-,rs licenses ;ere read and upon motion by Green second by Amundsen, licenses were granted. The application of Geo.Wiltgen for two pin ball machine operators licenses at 16 First Street Northwest, was read and upon motion by Amundsen second by Moody licenses were granted. A petition asking that a curb and gutter be constructed in Second-S-treet Southeast from Eleventh Avenue Southeast to Thirteenth Avenue Southeast, was read, and President Lemmon ordered that the same be placed on file. 406 Record of Official Proceedings of the Common Council of the _City_ of .Rochester, Minn.,. Upon motion by Fryer second by Moody further action on the above petition was deferred until next spring. i The following tax levy budgets were presented and read: Fire Department $g4, 44o.00; Band Committee $5, 500.00, Board of Public Health & Welfare $16, 360.00 Police Department $58,100.00, Library Board $22,950.00 and $1500.00 for light fixtures, City Engineer $55,650.00 for the Street and Alley Fund, $32,500.00 for the Sewer Fund, $1500.00 for the Bridge Fund, and $27,200.00 for street widening and resurfacing projects, Park Board $40,985.00 for parks and $6,500.00 for lighting. Alderman Williams introduced a resolution appropriating $1092-.20 from the Permanent Improvement Revolving Fund and ordering payment made to Harry Earle for first and final estimate on the.contract for construction of curb and gutter in Twelfth Avenue Southeast from Center Street East to Second Street Southeast, which was read. Upon motion by Amundsen second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly'passed and adopted. Alderman Mrachek introduced a resolution appropriating $493.35.' from the i General Fund and $97.15 from the Permanent Improvement Revolving Fund and ordering payment made to the Rochester Post Bulletin, for official publications and - printing during September, 1939,which was read. Upon motion by Green second -by Moody that the -said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. - Alderman Moody introduced a resolution appropriating-$372.07 from the Permanent Improvement Revolving Fund and ordering payment made to Wm.C•Fraser r & Son, for first and final estimate on contract for construction of a sanitary sewer in Ninth Avenue Southeast from Seventh Street to Eighth Street Southeast, which was read. Upon motion by Moody second by Amundsen that the said resolution be adopted as 'read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Green introduced a resolution appropriating $236.74 from the Street L. Alley Fund and ordering payment to the Firestone Auto Supply Company, for tires and tubes for Caterpillar, C-1 truck, and Flusher #5, which was read. Upon motion by Mrachek second by Green that the said resolution be adopted as read, and 'all voting in favor thereof, President Lemmon declared the said e g resolution duly passed and, adopted. i Alderman Fryer introduced a resolution appropriating $595.10 from the Sewer F Fund, and $9.90 from the Lighting Fund and ordering payment made to the City of i Record of Official Proceedings- of the Common Council of -the City of Rochester, Minn., -October 2 3, 1939 407 Rochester Light and.Water Department, for electricity and fater furnished at the Sewage Disposal Plant, Sewage Lift Stations, and Dumping Grounds, in accord- ance with billings of October. 15th, 1939, which was read. Upon motion by Moody second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. . Alderman Amundsen introduced a resolution adopting the plans, specifications and estimate of cost for the grading.cofoFourth Avenue Southeast from FV$rth Street to Sixth Street Southwest, which was read. Upon motion by Williams second -by Amundsen that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced a resolution adopting the plans, specifications and estimate of cost for the construction of a sanitary sewer in Fourth Avenue Southeast from Fourth Street Southeast to Sixth Street Southeast, and ordering a hearing on the said improvement to be held at ?:00 o'clock P.M., on November 6th, 1939, and ordering advertisement for bids to be received' and opened for the construction of said sanitary sewer, said bids to be received and opened at 2:00.o'elock P.M., on November At2,1939, which was read. Upon motion by Moody second by..Green that the said.resolution be adopted as read, and�all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. . . , Alderman Fryer introduced a resolution confirming the sprinkling assessments levied October 16th,1939, which was read. Upon motion by -Fryer second by Green that the said resolution be adopted as read, and all voting in favor thereof,.President Lemmon declared.the said resolution duly -passed and adopted. Alderman Amundsen introduced a resolution appropriating $400.00 from the General Fund and ordering payment made to the Dark Improvement Fund, for transfer of funds for painting bridges and repairing steps.to St. ary's Park,, which was read. Upon motion by Williams -second by -Fryer that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the.said resolution duly passed•and adopted. Alderman Amundsen introduced a resolution granting public dance permit to Dale -Hess for the Woodman Hall, October 21st,1939, and fixing the.fee at $3.00, which was read. Upon motion. by. Green second by Amundsen that the said resolution be adopted as read, and all voting in favor thereof, President. Upon motion by Green second by Amundsen the City Clerk and special committee on zoning were requested to add the Kepp and Rubow property to changes recommender in the zoning ordinance. Upon motion by Fryer second by Amundsen, the City Attorney, Alderman Williams, the special Committee on Zoning, the Building Inspector and the Board of Zoning, were authorized to drag an ordinance amending the Zoning Ordinance to cover the recommended changes in classification of property. President Lemmon referred the matter of an amendment to the ordinance setting up the Police Department, to the 114ayor, Chief of Police, City Attorney, and the Police Committee. Upon motion by Amundsen second by Williams, the Common Council adjourned until 7:30 o'clock P.M., on October 30th,1939. City Clerk. M
