Minutes of an adjourned regular meeting of the Common Council of the City
„of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in
;!said City, on October 30th,1939.
President Lemmon called the meeting to order at 7:30 otclock P.M., the
i;
;'following members being present: Lemmon, Amundsen, Fryer, Green, Moody,
'I
Mrachek; Williams. Absent: None.
,
Upon motion by Moody second by Williams, the minutes of the meeting of
!:October 23rd,1939, were approved.
President Lemmon stated this as being the time and place set for a hearing
,on the levying of special assessments for paving, curb and gutter, and lateral
'connections and sidewalks on First Avenue Southwest from Fifth Street to Sixth
Street Southwest, and on Sixth Street Southwest from Broadway Street South to
!Second Avenue Southwest, and asked if any one present wished to be heard in
!
regard to the said improvements. No one present wished to be heard.
Upon motion by Moody second by Green the hearing on the levying of the

i�assessments for the above described improveaents in First Avenue Southwest and
.'Sixth Street Southwest, was adjourned and continued until the next meeting of
`!this Common Council.
i!
President Lemmon stated this as being the time and place set for receiving
:'proposals for the furnishing of labor and materials for Christmas street
!`lighting. The City Clerk reported that no bids had been received, and President
Lemmon referred the matter to the Street nand Alley Committee and the 'Electrical
,'Inspector.
James Coon, representing the various trades unions, appeared before the
!:Council and asked that a labor inspector -be appointed for the City of Rochester,
;sand upon motion by Fryer second by Green the Council went on record as favoring
the appointment of such a labor inspector.
Mrs. bunion appeared before the Council in regard to the construction of

la sidewalk in front of their residence at 425 Eighth Avenue Southeast, and upon
i
!motion by Fryer seconded by Amundsen the matter was referred to the City Engineer',,
Viand the Street and Alley Committee for a report at the next meeting of the
Common Council. Mr. Zimmerman stated that he was not in favor of building this
:,sidewalk.
I Mrs. Minters requested permiLssion to complete the remodeling of her house
<:oh Eighth Street Northeast, which remodeling had been stopped by a restraining
:,order issued by the District Court, and upon motion by Williams second by Fryer
the matter was referred to the City Attorney and the Building Inspector.

The appointments by the Mayor of George Schmelzer, and Ed. Siem as special
;Policemen, were each read, and Bresident Lemmon ordered that the same be pladed

Copies of requisitions by the Health Officer upon St.Mary's Hospital for the
isolation of Christine Schmidt and Mrs. .Jennie Healy diagnosed to ,be suffering
from Erysipelas, and for the isolation of Janet Proud diagnosed to -be •suffering
from scarlet fever, were each read, Land President Lemmon ordered that the same

A communication from Peter J.Chamales, Regional Counsel of the Federal Works
(Agency of Public Works Administration, acknowledging receipt of certified papers
lin connection with the acceptance of the Governmentfs Amendatory Offer, was read
and President Lemmon ordered that the same be placed on file.
A communication from the Western Surety Company regarding the cancellation
of the license bond of John Kelley, was read, and upon motion by Green second
lby Williams, the City Clerk was instructed to notify John Kelley that his
license to connect with sewers and drains would be revoked in 30 days.
A copy of a resolution passed and adopted by the Public Utility Board,
requesting authority to enter into contracts with John A.Clark Electric Company
and with the General Electric Supply Corporation, was read and President Lemmon
ordered that the same be placed on file.
A communication from the City Engineer requesting an appropriation --of
$1,000.00 from the General Fund for use of the Street and Alley Committee was
read and President Lemmon ordered that the same be placed on file.
The application of the Hanke Plumbing and Heating Company for a plumbers
license together with a surety bond in the sum of $1,000.00 with the Saint Paul
Mercury Indemnity Company as surety thereon, were each read, and upon motion by
Green second by Moody, the license was granted, the bond approved, the surety
thereon accepted and it was ordered that the same be placed on file*
three petitions opposing the -placing of Block 3, Cummings Addition, Block
69 Original Plat, and Block 6, Elliott's Re -Subdivision in the industrial zone
were each read, and President Lemmon ordered that the same be placed on file.
The report of the Building Inspector on his inspection of the building
located at 410 First Avenue Northeast, owned by the Rochester Egg & Poultry
Company, and recommending that the south part be taken down, was read, and the
Council agreed to support the Building Inspector in taking the necessary s6eps
to have the said building removed.
The recommendation of the Police Committee that the ordinance providing
for the formation of the Police Department be amended to provide that said
Police department shall consist of one Chief, one Assistant Chief, two Captains,
ninteen patrolmen,,One Juvenile Officer, Two detectives and one Jail Guard, was
read and President Lemmon ordered that the same be placed on file.

The report of the Glerk of the Municipal Court for the week ending
'!October 23,1939, showing criminal fines ancl costs collected $196.60, civil"fees rec
;i
!;received $9.00, conciliation court fees received $6.50, was read, and having
`been previously approved by the City Attorney, President Lemmon ordered that the
;same be placed on file. -
Mr. Satoris appeared before the Common Council and asked permission to move
Jhis bakery to his home, and -he was informally instructed by the Council to

petition the Zoning Board forIsuch per"mission. '
l Upon motion by dryer second by Amundsen the request of Mr. Ahrens and Walter
'Dodge that certain lots in West Lawn Addition be zoned as multiple dwelling, and
i;the request of Kepp and Rubow that their land, and Block CGriginal Plat be

included in the Commercial Zone, were approved, and ordered included in the
i`
;!new zoning ordinance changes.
Alderman Fryer introduced an ordinance regulating the Police Department of
,:the City of Rochester, Minnesota, which 'was given its first reading.
' Upon motion by Fryer second.by Moody, and all voting in favor thereof,'the
,rules were suspended and the said ordinance was given its second reading.
Upon motion by Moody second "by -Fryer, and all voting in favor thereof,
lthe rules were suspended and the said ordinance"was given its third and final
,,reading.
Upon motion by Green second by Amundsen, that the said ordinance be adopted
as read, and all voting in favor thereof, Prresident Lemmon declared the said
;ordinance duly passed and adopted.
Upon motion by Fryer second by Amundsen, the City Clerk was instructed to
'notify the Superintendent of the Dumping Grounds that he is authorized to

,employ extra men to work at the dumping grounds.until 11:00 o'clock A.M. on
;Thanksgiving, Christmas, New Years, Memorial Day, the Fourth of July, etc.

Alderman Moody introduced a resolution appropriating $610.27 from the
'.Street and Alley Fund and ordering payment made to the General Fund, for gasoline
I�furnished from the City Filling Station,which was read.
�U Upon motion by Fryer second by Williams, that the said resolution be adopted'

as read, and all voting in favor thereof, President Lemmon declared the said
"resolution duly passed and adopted.

Alderman Moody introduced a resolution appropriating $719.46 from the
Park Improvement Fund and ordering payment made to the City of Rochester, Light

;and Water Department, for electricity and water furnished at the Mayo Civic
(;Auditorium, in accordance with billings of September 25th,1939,which was read.

Upon motion by Mrachek, second by Moody that the said resolution b-e adopted
,as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly,passed and adopted.

Alderman Moody int'rdduced a resolution appropriating $390.19 from the
General Fund, $2.25 from'the Street and Alley Fund, and $3049-53 from the
Lighting Fund,' and ordering payment made to the City of Rochester, Light, dater
and Steam Departments, for electricity,water and steam furnished at public
buildings and ' g gro-ands and streets, in accordance with billings of October 25th,
1939, which was read.
Upon motion by Green second by Amundsen that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Moody introduced'a resolution authorizing the Public Utility Boa rd
to enter into contract with the John A. Clark Electric Company for furnishing
six transormers for the sum of $3047.34, and with the General Electric Supply
which
Corpp'ration for furnishing six transormers for the sum of $3935.20,/was read.

Upon motion by Williams second by Moody that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Moody introduced a resolution appropriating $1,c000.00 from the
General Fund, for us'e of the Street and Alley Committee, which was read.
Upon motion by Amundsen second by Fryer, that the said resolution be
adopted as read, and all voting.in favor thereof, President Lemmon declared the

said resolution duly passed and adopted.
Alderman Doody introduced a resolution granting public dance permit to
Dale Hess for the Armory October 29th,and November 4th,1939, which was read.
Upon motion by Green second by Amundsen that the said resolution be adopted'
as read, and all voting in favor tbrereof, President Lemmon declared -the -said
resolution duly passed and adopted.
A communication from the Health Officer, certifying th the Council the
list of garbage service accounts which are unpaid for assessment, was read
and President Lemmon ordered that the same be placed on file.
Alderman Mrachek introduced a resolution levying special assessments for
garbage service during the period ending October 30th,1939, which was read.
Upon motion by Green second by Mrachek that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
The following claims were read, and upon motion by Fryer second by Amundsen, ,
the same were allowed and the Mayor and City Clerk were instructed to draw
warrants upon the- City Treasurer and make payments accordingly:

Upon motion by Fryer second by Mrachek the matter of sidewalk and curb
;repairs nnsFirst Street Northwest and Eleventh Avenue Northwest, was referred to the
Street and Alley Committee and the City Engineer.
Upon motion by Green second by Williams, it was ordered that a sidewalk
in the wagoner Block be repaired or reconstructed.
Upon motion_by_Williams second by Fryer it was ordered that the residence
built by Mr. Thompson be removed from the public street.
Upon motion by Williams second by Amundsen the City Attorney was instructed
to notify the property owners to move their buildings out of the Alley in Block
ill Northern Addition unless the alley is vacated.
Upon motion by Williams second by Mrachek, the Common Council adjourned.
