President Lemmon called the meeting to order at 2:00 o'clock P.M., the following members being present: Memmon, Amundsen, Fryer, Green, Moody, Mrachek and Williams, Absent-: None. President Lemmon stated this as being the time and place set for a hearing on the construction of a sanitary sewer in Eleventh Street Southeast from Fifth Avenue to Sixth Avenue Southeast, and asked if any one present wished to be heard concerning the said improvement. No ore present wished to be heard. President Lemmon stated this as being the time and place set for a hearing Ion the construction of a sanitary sewer in Fourth Avenue Southeast from Fourth Street to Sixth Street Southeast, and asked if any one present wished to be heard concerning the said improvement. President Lemmon stated this as being the time and place set for a hearing on the grading of Fourth Avenue Southeast from Fourth Street Southeast to FSioxth Street Southeast and asked if any one present wished to be heard concerning the said improvement. No one present wished to be heard. President Lemmon stated this as being the time and place set for receiving land opening bids for the construction. of a sanitary sewer in Eleventh Street Southeast from Fifth Avenue Southeast to Sixth Avenue Southeast. The following (bids were received and opened: Martin Paulson $299.50, Wm. C. Fraser & Son $276, President Lemmon stated this as being the time and place set for receiving and opening bids for the construction of a sanitary sewer in Fourth Avenue Southeast from Fourth Street Southeast to` Sixth Street Southeast.- The following bids were received and opened at this time: Wm. C• Fraser & Son $599.70, Martin Paulson $693.00. President Lemmon referred the above bids to the Sewer Committee and the City Engineer for tabulation and recommendation. President Lemmon stated this as being the time and place set for receiving and opening bids for the -grading of Fourth Avenue Southeast from Fourth Street Southeast to Sixth Street Southeast. The following bids were received and opened at this time: Morse Brothers $920.00, Le"itzen Concrete Products $920.00, and Leon Joyce $920.0.0. President Lemmon referred the above bids to the Street and Alley Committee sand the City Engineer for recommendation. A communication from the League of Minnesota Municipalities regarding a short course for assessors to be given by the League, was read, and President Lemmon ordered that the same be placed on file. 416Record of Official Proceedings of the Common Council of the_ . A report from a committee investigating the electrical code and inspector !«as - read, and upon motion by Mrachek second by Amundsen said report was accepted I� and the Electrical Inspector authorized to work under the recommendations con- j1tained in said report until such time as a new electrical code is adopted. The reports by J.T.Langlais, Public Examiner, on the books and affairs of the City of Rochester, for the fiscal year ended March 31,1939, were presented to the Council, and President Lemmon ordered that the same be placed on file. The application of R.S.Plaak for an off sale non -intoxicating malt liquor �c !license, at 501 Fourth Avenue Northwest, was read and upon motion by Green second; I, by Williams, license was granted. A communication from C.C.Pagenhart regarding the possibility of securing a permit to move a house, was read, and upon motion by Green second by Fryer 'the Council went on record as favoring the granting of such permit if applica- tion is made therefor. The reports of the Building and Plumbing Inspector, and the Electrical if Inspector for the month of October,1939, were each read, and President Lemmon ;j referred the same to the Finance Committee. The report of the City Engineer for the month of October,1939, showing !expenditures for labor from the General Fund $499.67, Street and Alley Fund j $2,019.56, Sewer Fund $44o.26, Permanent Improvement Revolving Fund $1.56, !Bridge Fund $54.95, was read, and President Lemmon ordered that the same be placed on file. The City Engineer's trial balance for the month of October, 1939, was i; read, and President Lemmon ordered that the same be placed on. The report of the Clerk of the Municipal Court for the xeekhending ljOctober 30th,1939, showing criminal fines and costs collected $306.4o, Civil ilfees received $1*40, Conciliation Court fees $6.00, was read, and having been ;previously an -Droved by the Citv Attorney. President Lemmon ordered that the same be placed on file. The report of the City Weighmaster for the Month of October,1939, showing 266 private loads weighed and receipts in the sum of $26.60, was read, and President Lemmon referred the same to the Finance Committee. A .4uitrcl:aip deed given by Joe Bean and Bessie M.Bean to the City of Rochester, covering a piece of land. to be used for street purposes (Sixth Avenue Northwest) was presented, and upon motion by Moody second by Amundsen the said deed was accepted and the City Clerk instructed to have the same recorded with the Register of Deeds. An ordinance regulating the construction, maintenance and operation of public automobile, trailer and tourist camps, introduced and given its first reading October 2nd,1939, was given its second reading. Record of Official Proceedings of the Common Council of the City of Rochester, Minn., November 6 , 19 3 9 . - 41� An ordinance regulating the use of automobile trailers and camp cars in the City of Rochester, Minnesota, introduced and given its first reading on October 2nd, 1939, was given its second reading. The recommendation of the Finance Committee regarding the 1939 tax budget of School District No.9, was read and President Lemmon ordered that t lie same be placed on file. Allen J.Furlow, Attorney, appeared before the Common Council representing the Independent Truck Drivers Organization, and recommended that the Common Council appoint some employee of the City of Rochester, as Labor Inspector. Joseph Ple#ling, Attorney, appearing for the Continental Oil Company, presented a petition asking permission, until July 1,1940, to construct two 25 foot driveways on Second Avenue Southwest, and two 24 foot driveways on Fourth Street Southwest, which was read. Upon motion by Green second by Amundsen the Continental Oil Company was granted permission to construct the driveways mentioned in the above petition, provided however, that the same shall be constructed and placed under the direction and supervision of the City Engineer. A..H. Clemens, Attorney, appeared for the Rochester Bus Line, and requested permission to run their busses bo_and on Thirteenth Street Northwest, and on.Sixteenth Avenue Northwest and Southwest, and upon motion by Fryer second by Amundsen said request was granted for the time bekng. A petition signed by G.Dewey Nelson, et -al., asking that a water main be constructed in parts of Eighth Street and Fourteenth Avenue Southwest, was read, and President Lemmon ordered that the same be placed on file. Alderman Moody introduced a resolution deeming it expedient that a water main be constructed commencing at or near the center of the intersection of Seventh Street Southwest and Fourteenth Avenue Southwest and running thence t south in said Fourteenth Avenue Southwest to a point at or near the center of the intersection of said Fourteenth Avenue Southwest with Eighth Street Southwest and running thence east at or near the center of Eighth Street Southwest to a point opposite and immediately south of the southeast corner of Block 1 in Parkin's Sub —divisions and the cost and expense thereof to be paid by special assessments levied as provided by law, -andco.rde.ring a hearing on the said improve ment to be held at 7:30 o'clock P.M., on Uovember 13th,1939, which was read. Upon motion by Fryer second by -Amundsen said report was accepted. The recommendations of the Sewer Committee and the City Engineer that the contract for the construction of a sanitary sewer in Fourth Avenue- Southeast ,�f rom Fourth Street Southeast ' t o Sixth Street Southeast be awarded to Wm. C. :!Fraser & Son for the sum of $598.70, `and that the contract for the construction �i iof a sanitary sewer in Eleventh Street Southeast from Fifth Avenue Southeast to 210 feet east be awarded to Wm. C. Fraser. & Son for the sum of $276.40, were ;each read and President Lemmon ordered that the same be placed on file. 'I �i Alderman Williams introduced a resolution accepting the bid of Wm. C. Fraser', ii & Son for the construction of a sanitary sewer in Eleventh Street Southeast as "above described for the sum of $?76.40, which was read. I' Upon motion by Amundsen second by Fryer that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said 'resolution duly passed and adopted. I; Alderman Mrachek introduced'a resolution accepting the bid of Wm. C. Fraser l� & Son for the construction of a sanitary sewer in Fourth Avenue Southeast from ,,Fourth Street Southeast to Sixth Street Southeast, for the sum of $59g.70, which ;.was read. - I' Upon motion by Williams second by Green that the said resolution be adopted ,as read, and all voting in favor thereof, President Lemmon declared the said �i i` ':resolution duly passed and adopted* i Alderman Amundsen introduced a resolution accepting the bid of Morse Brothers 1' , :;for the grading of Fourth Avenue Southeast from Fourth Street Southeast to Sixth f ,',Street Southeast, for the sum of $920.00, which was read. I y' Upon motion by Green second by Williams, that the said resolution be adopted tas read, and all voting in favor thereof, President Lemmon declared the said I , Ilresolution duly passed and `adopted. ` Upon motion by Fryer second by Amundsen, the City Clerk was instructed to jIreturn the certified checks of the •unsucc`essful bidders on the above projects. Alderman Williams introduced a resolution appropriating $490.50 from the I ',Geneval Fund and ordering payment made to the Whiting Presp, Inc., for 50,000 engraved letterheads and envelopes, which was read. ii �i I Record of Official Proceedings of the Common Council of -the City of Rochester, Minn., November 6,1939. 419 Upon motion by Amundsen second by Williams, that the said resolution be adopted as'read, and all voting in favor, thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced a resolution appropriating $370.30 from the General Fund and, ordering payment made to Adams Book & Art Shop for 228 flag - holders 175. flags and 224 poles which was read. Upon motion by Moody second by Mrachek that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted, Alderman Mrachek introduced a resolution appropriating $2,135.07 from the General Fund and ordering payment made.to the State of Minnesota, for per diem and expenses of examination of the books and -records of the City of Rochester. for the year ending March 31,1939, by the Public Examiner, which was read. Upon motion by Williams second by Green that the said resolution be adopted as read, and all voting in favor thereof,'President Lemmon declared the said resolution duly passed and adopted. Alderman Mrachek introduced a resolution appropriating $957.30 from the. General Fund and ordering payment made to the Street and Alley Fund, for use of equipment during October,1939,which was read. Upon motion by Green second by Amundsen that the said resolution be adopted as read, and all voting in favor thereof, President Lemtion declared the said resolution duly passed and 'adopted. Alderman Moody introduced a resolution appropriating $569.95 from the Street and Alley Fund and ordering payment made to the Street and Alley Fund, for use of equipment during October,1939, which was read. Upon motion by Mrachek second by Moody that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $204.57 from the Street and Alley Fund and ordering payment made to the West Motor Company. for automobile repairs during October,1939,which was read. Upon motion by Williams second by Amundsen that the said resolution be adopted as read, and all voting in ,favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Green introduced a resolution appropriating $279.90 from toe General'Fund and $63.35 from the Permanent Improvement Revolving Fund, and ordering payment made to the Rochester Post -Bulletin, for official publications and printing during October,1939,which was read. 420 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., November 6, 1939. Upon motion by Fryer second by Mrachek that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Green introduced a resolution appropriating $1659*97 from the Park i!Improvement Fund and ordering payment made to the Mayo Trust Fund, for payrolls for labor during the half month ending Gotober 31,1939,which was read. Upon motion by Green second by Amundsen that the said resolution be adopted �I as read, and all voting in favor thereof, President Lemmon declared the said li resolution duly passed and adopted. I� Alderman Williams introduced a resolution appropriating $35 4.46 from the !!Park Improvement. Fund and ordering payment made to the General Fund, for sprinkling assessments against park property for the year 1939,which was read. i Upon motion by Williams second by Moody that th.e said resolution be adopted las read, and all voting in favor thereof, President Lemmon declared the said ;resolution duly passed and adopted. , i' j; Alderman Fryer introduced a resolution ordering a hearing on November.20th, ;1939, at 7:30 of.clock P.M., on the levying of special assessments for the grading of Fourteenth Avenue Northeast from Fourth Street Northeast to Fifth Street Northeast; for the construction of curb and gutter on Twelfth Avenue Southeast from Center Street East to Second Street Southeast; and for the construc- ' tion of a sanitary sewer in Ninth Avenue. Southeast from Seventh Street Southeaat to Eighth Street Southeast, which was read. Upon motion by Mrachek second by Fryer that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. , Alderman Fryer introduced a resolution levying special assessments for ;scavenger service rendered during the period December 5th,1939 to, September 11, I; 1939, which was read. Upon motion by Amundsen second by Fryer that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said ,,resolution duly passed and .adopted. Alderman Amundsen introduced a resolution levying special assessments for ,sidewalks constructed and rebuilt during 1939, which was read. Upon motion by Green second by Willi.am.s. that the said resolution be adopted ilk as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. i' Erwin Briese, Secretary, of the Chamber of Commerce, appeared before the i Council and requested an appropriation of $400.0,0 for the cost of the "Rochester !iBooklet% and upon motion by Fryer second by Amundsen the City Clerk was instructed i;to prepare a resolution appropriating said amount to the Chamber of Commerce.
