Council of the City: of Rochester, Minn., November 13 ,19 3 9 j Minutes of an adjourned regular meeting of the Common Council of the City !'of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said ',City, on November 13th,1939i ' • President Lemmon called the meeting to order at 7:30 o'clock P.M., the following members being present: it Mrachek, Williams. Absent:• None; Lemmon, Amundsen, Fryer, -Green, Moody, President *Lemmon stated this -as being the time and place set for a hearing:• ion the vacation of the east three feet of the alley running north and south �I through Block 24, Cummings Addition, and asked if any one -present wished to be' heard concerning the said vacation. No-one present wished to be heard. President Lemmon stated this as being the time and place set for a hearing on the construction of a water main commencing at or ,near the center of the !intersection of Seventh Street Southwest and Fourteenth Avenue Southwest and running thence south•in said Fourteenth Avenue Southwest to a point at or near the center of the intersection of said -Fourteenth -Avenue Southwest -with Eighth - Street Southwest; and running thence east; at -or-near--the center -of -Eighth Street Southwest to a point -opposite and immediately south of -the southeast corner of ,Block 1, Parkin"s Sub -division. No one present wished to be -heard -concerning the said water main.` j A communication from Clarence R.Thompson regarding work being done on his ,',property and requesting an extension of time to carry out certain provisions of ,�a.previous agreement, was read, and iipon motion -by Moody second by Green the , City Attorney was instructed to dismiss his action in the matter and-Mr.Thompson P was allowed an extention of time untii'July 1,1940, under -his request. I� The appointment by the Mayor of Peter Hanson as a Special Policeman for I� �i duty at the,A.O.U:W.Hall, he to serve without pay and to hold office until the rsecond Monday in Apri1,1940,uniess sooner removed, was read and President ��Lemmon orderd that -the same be placed on file. A communication from•the-Industrial Commission of Minnesota, regarding I reports of Medical treatment rendered 'employes tas read, and President -Lemmon ?referred the same to the Secretary of the Public Utility Board and the City Clerk. I• • ' A protest signed by nine property owners protesting against the assessment made for'sprinkling and/or oiling Twelfth Avenue Southeast from Center -Street east to Second Street Southeast, was read and President Lemmon referred the same to the sprinkling committee for report. The application of the Rochester Plumbing and Heating Company for a plumber's license, together with a surety bond in the sum of $1,000.00 with the National Surety Corporation as surety, were each read, and upon motion by Green , second by'Amundsen the license was granted, the bond approved, the surety thereon. accepted and it was ordered that the same be placed on file. The contract bonds of Wm. C. Fraser & Son in the sums of $276.4o, and - $59s.70, and of Morse Bros. in the sum of $920.00,-each with,the United States Guz antee Company as surety, were each read, and. .upon motion by Moody second by , (Amundsen said bonds were approved, the sureties thereon accepted and it was I ordered that the same be placed on file. The bond of the. Witte Transportation Company . in the sum of $11.52, with, lost (Harold L.Wheeler and.Mike.Higgins as sureties thereon, covering/Warrant +34 dated.July 31,1939,issued to Witte Transportation Company, was read, and upon. Imotion by Moody second-by.Amundsen said bond was approved, the surety thereon , accepted, the bond filed, and the City Clerk and Mayor authorized to draw a duplicate bf said warrant. The report of the Clerk of,the Municipal Court for the week ending November 6th,1939, showing; criminal f-knes and- costs collected $526.00, civil,fees- received $3.70, conciliation court -fees received $4.00, was. -read, and having been previously approved by the City Attorney, President, Lemmon ordered that the same be placed on file. ~ ' The report of the -Finance Committee that they had checked the October,1939 �ireports of the Building &.Plumbing Inspector, Electrical Inspector,,and the City Weighmaster,find found the same correct, was read and President Lemmon ordored that the same be placed on -file. A petition signed by 93oyd S.Gardner-and Fay D•.Gardner ksking that Second Avenue Northeast lying south of the south line of Fourt-eenth Street -Northeast and horth,of the north shore of Silver,Lake be vacated, was read„ and upon motion by Moody• second by Williams said, petition was .referred, to. the Street and.Alley i Committee and the. City Engineer. I - , -A copy of a -resolution-passed and adopted by the Sinking,Fun d Commission purchasing- $50,000.00 State of Minnesota, 2% Certificates of, Indebtedness, due July �30th, 1942 on a .60,E basis., was read, -and upon -motion by Moody - second by Mxachek the action set forth therein was approvedt- and it was ordered that the. same be placed on, file., Applications signed by Kenneth Angelici for Soft drink dealers license and an off sale non -intoxicating malt liquor license at 716 Fifth. Street Sputhwest, were' each read, - and upon motion by Moody second by Amundsen, licenses were grantee A report of receipts and expenditures in the Park Improvement Fund during the period April 1,1939 to October 31,1939, was presented to the Council and President Lemmon ordered that the same be placed on file. Record of Official Proceedings of the- Common Council of the City of Rochester, Minn., November 13 ,19 3 9, Upon motion by Green second by Fryer that the said resolution bye adopted as read; and all voting in favor thereof, President Lemmon declared the said resolution duly passed 'and adopted. - Alderman Mrachek int ro ddee'd a resolution appropriating $18, 857.E+8 from th'e' -Street and Alley Fund -and ordering payment- made to Roxanda Mines,, Inc., for estimate number one for resurfacing of .streets, which was read. ` Upon motion by Fryer second -by Amundsen that the said resolution be adopted as read, and all voting in favor thereof; President Lemmon declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $669.93 from the Street and Ailey Fund and ordering payment made to the Permanent Improvement Revolving Fund, for cost of sidewalk construction on Second Street Southwest' widening job, which was read. Upon motion by Willi-ams second by Moody that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Green introduced a resolution appropriating $2434.94 from the Permanent Improvement Revolving Fund and ordering payment made to Wm. C. Fraser & Son, for first -and final estimate on contract for construction of a sanitary sewer in Twelfth Avenue Northeast Thirtebnth Avenue Northeast and Ninth Street Northeast, which was read. Upon motion by' Mrachek second by Amundsen that the said resolution be adopted as read, and all v-ot ing in f avor thereof, President Lemmon declared the said resolution duly passed -and adopted;. Alderman Green introduced a resolution granting public dance permit to Dale Hess for the Armory November llth and 18th,1939, and fixing the fee at $6.00, which was read. Upon motion by Moody second by Williams, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution' duly passed and adopted. Alderman Fryer -introduced a resolution ordering plans, specifications and estimate of cost for the construction of a water -main in part of Fourteenth Avenue Southwest and Eighth Street Southwest, which' was read. Upon motion by Amundsen second by Moody that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted.` The City Engineer submitted plans, specifications and an estimate of cost for the construction of a water -main in Fourteenth Avenue Southwest from Seventh Street to Eighth Street and in Eighth Street Southwest'from Fourteenth Avenue Southwest east to the alley,which were read. 426 Record of Official Proceedings of the Common Council of the City of Rochester, Minn.; November 13 ,1939. ---- - -- -- ----- --- f Alderman Fryer introduced a resolution adopting the plans, specifications :and estimate of cost for the construction of a water main in Fourteenth Avenue ij Southwest and Eighth Street Southwest, as above described, ordering a hearing on !:`the said improvement to be held at 7:30 o'clock P-11., on November 27th, and :ordering advertisement for bids to be received and opened at 7:30 o'clock P.M., i ,on November 27th,1939, which was read. is i� Upon motion by Green second by Fryer that the said resolution be adopted :as read, and all voting in favor thereof, President Lemmon declared the said ,resolution duly passed and adopted. i Alderman Moody introduced a resolution vacating the east three feet of 'the alley running north and south through Block 24 Cummings Addition, which was read. Upon motion by Fryer second by Mrachek that the said resolution be adopted !as read, and all voting in favor thereof, President Lemmon declared the said re.so :`lution duly passed and adopted. Alderman Mrachek introduced a resolution correcting a resolution levying ':special assessments for the construction of a sanitary sewer in Seventh Avenue and 'Tenth Street Northwest, which was read. J Upon motion by Green second by Amundsen that the said resolution be adopted �,as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Amundsen introiuced a resolution ordering plans, specifications and, 'estimate of cost for the construction of a water main in Sixth Avenue Northwest from Eighth Street Northwest to a point 250 feet north, which was read. Upon motion by Moody second by Williams, that the said resolution be adopted' 1�as read, and all voting in favor thereof, President Lemmon declared the said ;,resolution duly passed and adopted. T]}e City Engineer submitted plans, specifications and estimate of cost for ythe construction of a water main in Sixth Avenue Northwest as above described. i' I, Alderman Amundsen introduced a resolution adopting the plans, specifications,' rand estimate of cost for the construction of a water main in Sixth Avenue Northwest, I'as above described, ordering a hearing on the said improvement to be held at 7:30 `,o'clock P.M. on November 27th, and ordering advertisement for bids to be received land opened at 7:30 o'clock P.M., on November 27th,1939, which was read. u Upon motion by Williams second by Green that the said resolution be adopted i'as read, and all voting in favor thereof, President Lemmon declared the said it ;;resolution duly passed and adopted. Alderman' Mrache'k introduced a resolution kpproving; the tax levy of School District No.g, in the aggregate amount of $322,946.00, which•was read. Upon motion by Williams second by Mrachek that the said resolution be. adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. - Upon motion by Williams second by Green the" -Common Council adjourned until 7:30 o'clock P.M., on November 20th,1939. - City Clerk.
