Minutes of an adjourned regular meeting of the Common Council of the City
of Rochester, Minne..sota, held in the Council Chambers, in the City Hall, in
said City, on November 27th,1939.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
following members being present: Lemmon, Amundsen, Fryer, Green, Moody.

Upon motion by Amundsen second by Williams, the minutes of the meetings
of October 30th, November 6th, November 13th, and November 20th,1939, were
approved.
President Lemmon dtated this as being the time and place set for a hearing
on the construction of a water main in Sixth Avenue Northwest, from Eighth
Street Northwest to a point 250 feet north, and asked if any one present wished
to be heard concerning the said improvement. No one present wished to be heard.
President Lemmon stated this as being the time and place set for a hearing
on the construction of a water main commencing at or near the center of the
intersection of Seventh Street Southwest and Fourteenth Avenue Southwest, and
running thence south in Fourteenth Avenue Southwest to a point at or near the
center 'of the intersection of said Fourteenth Avenue Southwest with Eighth Street
Southwest, and running thence east at or near the center of Eighth Street South-
west to a point opposite and immediately south of the southeast corner of Block
1,Parkin's Sub -Division, and asked if any one present wished to be heard
concerning the said water main. No one present wished to be heard.
President Lemmon stated this as being the time and place set for r.ece:kving
aid opening bids for the construction of a water main in Sixth Avenue Northwest,
from Eighth Street Northwest to a point 250 feet north; the following bids
_were received and opened at this time: Wm. C.Fras.er & Son $190.00, Martin
Paulson $214.90. Each of said bids being for the construction of 135 feet of
said water main. President Lemmon referred the said bids to the Sewer Committee
and the City Engineer for recommendation.

President Lemmon stated this as being the time and place set for receiving
and opening bids for the construction of a water main in parts of Fourteenhh
Avenue Southwest and Eighth Street Southwest, as above described. The
following bids were received and opened at this time: Martin Paulson $1299.90,
Vdm.C.Fraser & Son $916.00. President Lemmon referred the said bids to the
Sevier Committee and the City Engineer for recommendation.
The report of the Clerk of the Municipal Court for the week ending
November 27th,1939, showing criminal fines and costs collected $376.30, civil
fees received $5.95, and conciliation court fees received $10.00, was read, and
having been previously approved by the City Attorney, President Lemmon ordered

that the same be placed on file.

Applications signed by M.L.Priebe, for two pin ball machine owners licenses,'
andJohn Whited for two pin ball machine operators licenses, were read, and
upon motion by Moody second by Fryer, licenses were granted.
A warranty deed given by Louise Adler to the City of Rochester, conveying
to the City of Rochester a strip of land commencing for place of beginningat
the intersection of the west line of Sixth Avenue Northwest and the north line
of Eighth Street Northwest in the City of Rochester in said County, for a place

of beginning, thence north One hundred Thirty five feet, thence east Ten feet,
thence south One hundred and Thirty five feet, thence west ten feet to place of
beginning, for public street purposes, was read, and - upon motion by Moody second
by Williams said warranty deed was accepted and the City Clerk was instructed
to have the same recorded.
A copy of a resolution passed and adopted by the Sinking Fund Commission
appropriating $32,000.00 from the Sinking Fund and ordering payment made to
the First National Bark of Rochester, Minnesota, for the Becember lst,1939,
maturity of City of Rochester bonds, was read, and upon motion by Green second
by Amundsen the action set forth therein was approved and it was ordered that
said copy of resolution be placed on file.
A petition asking that a sanitary sewer and water main be constructed in
Fifth Street Southeast from Twelfth Avenue Southeast to Thirteenth Avenue
Southeast, was read, and President Lemmon ordered that the same be placed on
file.
A communication from the Secretary of the Firemen's Relief Association,
requesting the Council's approval of a loan of $400.00 to Carl Lee on his
hmme uts read, and upon motion by Fryer second by Green the Council approved
said additional loan to Carl Lee.
A petition asking that a water main be constructed in Sixth Avenue North-
west from Tenth Street Northwest to Eleventh Street Northwest was read, and
President Lemmon ordered that the same be placed on file.
Alderman_ Amundsen introduced a resolution appropriating $5,739.04 from the
General Fund and ordering payment made to the Public Health and Welfare Fund,
for transfer of funds received in the November,1939,tax settlement for salaries
and expenses of operation of Health Department,which was read.
Upon motion by Moody second by Fryer, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $549.19 from the
General Fund and ordering payment made to the Public Health and Welfare Fund,
for4 garbage assessments collected and received in the November,1939,tax
settlement, which was read.

Upon motion by Mrachek second by Williams, that the said resolution be
adopted as read, and all voting in favor thereof, Presidert Lemmon declared the
said resolution duly passed. -and adopted.
Alderman Amundsen introduced a resolution appropriating $400.00 from the
General Fund and ordering payment made to the Rochester Chamber -of Comrierce,
for helping to defray the cost of publishing booklet °Rochester°, which was
read.

as read, 'and all voting in favor thereof, President Lemmon declared the satld
resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $4,590.19 from, the
Street and Alley Fund and ordering payment made to the Roxanda Mines, Inc., for
estimate Nb.2 onthe resurfacing of Second Street Northwest, First Street North-:
west, First Avenue Southwest, and Fourth Street Southwest, which was read.
Upon motion 'by Green• second by .Amundsen, that the said resolution be adopted
as read, and all voting in favor thereof, P-resident Lemmon declared the said
resolution duly passed and adopted.
Alderman Fryer introduced ta, resolution appropriating $2974..29from the
Permanent Improvement Revolving Fund and ordering payment made to Martin Paulson
for first and 'final estimate on his contract for laying water main in Twelfth
Avenue Northeast from Ninth to Tenth Street, in Ninth Street Northeast from
Eleventh Avenue to Thirteenth Avenue, and in Thirteenth Avenue Northeast, f rom
Ninth Street Northeast to Tenth Street Northeast, which ways read.
Upon motion by Fryer second by Amundsen that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted. I
Alderman Green introduced a resolution appropriating $579.26 from the
Permanent Improvement Revolving Fund and=ordering payment made to Wm.C.Fraser
& Son, for first and final estimate on contract for construction of, a sanitary
sewer in Fourth Avenue Southeast from Fourth Street Southeast to Sixth Street
Southeast, which was read.
Upon motion by Green second by Mrachek that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution drily passed 'and tadopted.
Alderman Green introduced a resolution appropriating $244.91 f roii the
Permanent Improvement Revolving Fund, and ordering payment made to Wm.C.Fraser
& Son,. for first and final estimate on contract for construction of `a sanitary
sewer in Eleventli Street Southeast from Fifth Avenue Southeast to' 210 feet'east,
which w,.s read.

Upon motion by Moody second by Fryer that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Moody introduced a resolution appropriating $3012.05 from the
Permanent Improvement Revolving Fund, and ordering payment made to Martin
Paulson, for first and final estimate on contract for the construction of a
sanitary sewer -in Fourth Street Southeast from the :vest line of Lot 14,
Auditor's Plat "A", to the east line of Lot 29, Sanderson's Addition, which was
read. -
Upon motion by Green second by Amundsen that the said resolution be adopted
as read; and al•1 vo,ting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Moody .introduced a resolution appropriating $507.50 from the:
Permanent Improvement Revolving Fund ar_d ordering payment made to the First

National Bark, for the December 1st, 1939, maturity of P. I.R:Fund Bond r97, and
the interest thereon, which was read.
Upon motion by Williams second by Mrachek that the said resolution be
adopted as -read,, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mracken Introduced a resolution appropriating $5466.25 from the
Snterest Fund, and ordering payment made to the First National Bank, Rochester
Minnesota, for th-e December lst,1939,maturity of interest on City of Rochester
Bonds, which wars read.
Upon motion by Amundsen second by Fryer that the said resolution be adopted,

resolution duly passed and adopted.
Alderman Mrachek introduced a resolution granting public dance permit to
Dale Hess for the Armory November 25th, and December 2nd,1939, and fixing the
fee at $6.00, which was read..
Upon motion by Mrachek second by Williams, that the said resolution be
adopted as read, and all voting in -favor thereof, President Lemmon declared the :
said resolution duly passed and adopted.
Alderman Williams introduced a resolution ordering a hearing on the levying
of special assessments for the following improvement, said hearing to be°held
at 7:30 o'clock 1�.M., on December llth,1939:
The gradixjg of Fourth Avenue Southeast from Fourth Street Southeast to Sixth
Street Southeast ;
The construction of a sanitary sewer in Fourth Avenue Southeast from Fourth
Street Southeast to Sixth Street Southeast;
The construction of a sanitary sewer in Fourth Street Southeast from the west
line of Lot 14, Auditor's Plat "A", to the east line of Lot 28 Sanderson's Second
Addition;

The construction of a sanitary sewer and water main in Twelfth Avenue Northeast
from Ninth Street Northeast to Tenth Street Northeast, in Thirteenth Avenue
Northeast from Ninth Street Northeast to Tenth Street Northeastj, and in Ninth
Street Northeast from Eleventh Avenue Northeast -to Thirteenth Avenue Northeast;
The construction of a sanitary sewer in Eleventh Street Southeast from Fifth
Avenue Southeast to Sixth Avenue Southeast;
which was read.
Upon motion by Green second by Fryer that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said .
resolution duly passed and adopted.
The rrecommendati.on of the Sevier Committee and the City Engineer, that the
contract for the laying of a water main in Sixth Avenue Northwest from Eighth
Street Northwest to 135 feet north be a:varded to Wm.C.Fraser & Son for the
sum of $190..00, was read.
Aldernan Williams introduced, a resolution accepting the bid of Wm.C.Fraser
& Son, in the sup of $190.00 for the construction of a water main in Sixth

Upon motion by Fryer second by Amundsen that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said.,
resolution duly passed and adopted.
The recommendation of the Sewer Committee and the City Engineer that the
contract for the laying of a water main in Fourteenth Avenue Southwest from
Seventh Street Southwest to Eighth Street, Southwest, and in Eighth Street
Southwest from Fourteenth Avenue Southwest east to the alley, be awarded to
Wm.C.Fraser & Son for the sum of $916.00, was read.
Alderman Williams introduced a resolution accepting the bid of Wm.C.Fraser
& Son, for the eanstruction of a water main in Fourteenth Avenue and Eighth
Street Southwest, as above described for the sum of $916.00, which was read.
Upon motion by Amundsen second by Green that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the saiid ,
resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $292.90 from the
General,F and and ordering paymen-t made to 0.1l.Nelson, for verdict against
the City of Rochester, rendered Septepber 29th,1939,which was read.
Upon motion by Williams second by Mrachek that the said resolution be
ado;ptetl as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and adopted.
Alderman Williams introduced a re.solution ordering that t, sanitary sewer
and water main be constructed in Fifth Street Southeast from Twelfth Avenue
Southeast tolThirteenth Avenue Southeast, and ordering a hearing on the said
improlemeht to be held at 7:30 oldock P.M., on December llth,1929, which was
read.

Upon motion by Moody second by Amundsen that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Williams introduced a resolution ordering that a water main be

Street Northwest, and ordering a hearing on the said improvement to be held at
7:30 o'clock P.M., on December llth,1939, which was read.

Upon motion by Fryer second by Moody that the said resolution be adopted

as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Mr. Joseph Mackey appeared before the Council in regard to action taken l
in the matter of constructing a sanitary sewer to serve his property. The Mayor,
reported -on a conversation he had had with Mr. Galpin, and upon motion by Moody
second by Fryer the City Engineer was instructed to send to Mr. Boyd Galpin
such information -as is necessary to make said matter clear.
Upon motion by Williams second by Fryer the City Attorney was instructed to'
take the proper action to collect the bill for repairs to a truck damaged by
Harry Earl.
Upon motion by Fryer second by Moody the certified checks which accompanied
the proposals of unsuccessful bidders on water main improvements, were ordered
returned to said unsuccessful bidders.
Upon motion by Amundsen second by Moody the matter of painting the cell
room in the Jail, was left with the Public Grounds Committee, which Committee
was also requested to have the picture screen in the Community Room painted
White.
. The following claims were read, and upon motion by Fryer second by
Amundsen, the same were allowed and the Mayor and City Clerk were authorized
and directed -to draw warrants upon the, City Treasurer and make payments,
accordingly:

President Lemmon referred the matter of a public -,address system to the
Public Grounds Committee.
Upon motion by Amundsen second by Mrachek the matter of shelving in
the vaults in the City Hall was left in the hands of the Public -Grounds Committee
Upon motion by FrSTer:. second by Amundsen, the City Engineer was
instructed to proceed in figuring the assessments for improvements done under
P.W.A.Docket No.1515-F disregarding the questionabi&ereceipt of $592.00 addi-
tional grant.
