' December 31; lg 39 Minutes of an adjourned regular meeting of the.Common Counei'1 of the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City, on December llfa-,1939- f President Lemmon called -the meeting to order at 7:30 o'clock P-M-, the following members being present: Lemmon, Amundsen, Fryer, Green, Moody, Mrachek, Williams. Absent: None. President Lemmon stated this as being the time and place set for a hearing on the levying of special assessments for the following described improvements: The Grading of Fourth Avenue Southeast from Fourth Street Southeast to Sixth Street. Southeast ; The construction of a sanitary sewer in Fourth Avenue Southeast from Fourth Street Southeast to Sixth Street Southeast; The construction of a sanitary sewer in Fourth Street Southeast from the .West line of Lot 14, Auditor's Plat"A" to the East line of Lot 29, Sanderson's Second Addition; ' The construction of a sanitary sewer. and water"•maiii in Twelfth Avenue Northeast from Ninth Street Northeast to Tenth Street Northeast, in Thirteenth Avenue Northeast from Ninth Street Northeast to Tenth Street Northeast, and .in, Ninth Street Northeast from Eleventh Avenue Northeast to Thir.teeAth Ave.nue Northeast; , . The construction of a sanitary sewer in Eleventh Street Southeast' from Fifth Avenue Southeast to Sixth Avenue Southeast. President Lemmon, asked if any one. present wished to! be heard concerning__.. the levying of special assessments on either or any, of the above described improvements. No one present wished to be heard. President Lennon stated this as being the time and place set for a hearing' on the construction of a water main in Sixth Avenue Northwest from Tenth Street Northwest to Eleventh Street Northwest, and asked if any one present wished to be heard concerning the said improvement. No one present wished -to be heard.. President Lemmon, 'stated this as being the time and place set for a hearing on the construction of a sanitary sewer and water main in Fifth Street Southeast from Twelfth Avenue Southeast to Thirteenth.Avenue Southeast, and asked if any one present wished to be heard concerning the said improvement. No one present wished to be heard. James T.S.pillane appeared before the Council regarding' fill over the, sanitary sewer running through St.John's cemetary, and upon motion by Amundsen second by Green the matter was referred to the Seder Committee and the City:: Engineer. a The report of the Commissioners in the condemnation of Lot 15,Block 2, Sunnyside Addition, and Lot 15, Block 3, Sunnyside Addition, which was considere at a meeting held December 4tr,1939,at .which time hearing and further action in said matter was adjourned until this date, was considered at this time. Alderman Williams introduced the following resolution, which was read: Record of Official Proceedings of the Common Council of the City. of Rochester, Minn., December 11,1939. - "WHEREAS, Theo.A.Schacht, Vim. Mercer, and Jack Marsh, the Commissioners appointed on October 2nd,1939, in and by resolution of the -Common Council of the City of Rochester, Minnesota, to ;view the lands and premises and to assess the damages occasioned by the condemnation and taking by ,said City of Rochester, Minnesota, for use of said City as a public highway, thereon and thereat, j�the lands described in said resolution of appointment, being, to tit: Lot 15, in Bloch 2, and Lot 15, in Block 3, Sunnyside Addition to the City of Rochester, Olmsted County, Minnesota, and i 1AMiREAS, The City Clerk on November 24th,1939, did publish a r_oticd to all Dersons interested !:in said lands, in the Rochester Post-D-0--l_e-tin the official newspaper of said City to the effect that the report and award of damages had been made and filed in his office and unless written objections were made thereto by persons interested in said lands, the said report and award of damages would be confirmed by the Common Council of said City of Rochester, Pliinnesota, at a meeting !,of said Common Council to be held at 2:00 o1clock P.L1., on December 4th,1939, in the Council Chambers, in the City Hall, in said City; and the said notice was published in said newspaper for at least ten (10) days prior to the date of said meeting held on December 4th,1939, and ?',MEREAS, The said Common Council duly met at said time and.place and heard and duly con- sidered all objections offered and interposed by persons interested in the said lands and. duly considered the said report and the award of,damages therein made by the said Commissioners; and WEE REA.S, No written objection has been made to the report of the Commissioners and the award ��of damages made by the said Clmmissioners, and the same has been duly considered by this Common ,Council, and SO THEREFORE, Be it and it is hereby resolved by the Common Council of the City of Rochester Minnesota: That the report of said Commissioners made and filed as aforesaid and the award of damages therein contained and set forth be, and the same are hereby in all things confirmed, the said award of damages being to F.W.Duquette a total sum of $500.00, and to Albert O.Fahrman a total s sum of $500.00, and Be it further resolved by the said Common Council: `What there is hereby appropriated from the General Fund of said City the sum of $500.00 for payment to F.W.Duquette for the condemnation and taking of Lot fifteen (151 Block two (2)) Sunnyside Addition to the City of Rochester, Olmsted 'County, Minnesota, and Be it durther resolved -by the said Common Council: That there is hereby appropriated from the General Fund of said City, the sum of $500.00 for payment to Albert O.Fahrman for the condem- nation and taking of Lot fifteen (15) Block three (3) Sunnyside Addition of the City of Rochester, (Olmsted County, Iliinnesota, and Be it further resolved by the -said Common Council: That there is hereby appropriated from ithe General Fund.of said City, the sum of 15.00 for payment to said Commissioners for their !services in said matter, being $5.00 each, and the Mayor -and City Clerk of said City are hereby ,authorized and directed to draw warrants upon the City Treasurer for said sums and cause payments Ito be made to the persons'above mentioned and to the said Commissioners." An invitation from the Executive Secretary of the League of P"Zinnesota•II:unicipalities for 11officials of the City of Rochester to attend the Regional conference of the League to be held !:on December 13th, 1939, at Chatfield,'was read, and President Lemmon ordered that the same be i .:placed on file. The report of the Building Inspector in regard to the Perry Miller garage at 10 10� Street !Southeast, was read, and President Lemmon ordered that the same be placed on file. 'n A notice of appeal from the decision of the Building.Inspector in refusing to grant a j1permit for the construction of a public garage up to the pr6perty line on Lot 1 Block 7, i'Original Plat,said appeal being signed by Carl West, was read, and Upon motion by Fryer second � by Williams, said notice of appeal was referred to the Zoning Board. Record of Official Proceedings of the Common Council of the City of Rochester, Minn., December - 11,1939. A communication from T.B.Magath, Health Officer, recommending various chances in the, ordinances governing the City Scavenger and Dog hatcher, and recommending a fixed monthly salary for said Scavenger and Dog Catcher, was read, and upon motion by Green second by N!oody, the said report and recommendation was accepted, and the City Attorney instructed to prepare ordinance amendments accordingly. A communication from James H.Starkey,Secretary of the Board of Park Commissioners, conveying to the Council the Park Board's recommendation that the F.E.Williams Estate cottage at 119 Fourth Street Southwest be offered for sale at a price of not less than six thousand dollars, provided that such an offer is received before January lst,1940, was read, and upon motion by Fryer second by Amundsen said recommendation was referred to the Public Grounds Committee and the City Attorney. The report of the Finance Committee stating that said Co..,Tpittee had checked the reports of the Building and Plumbing Inspector, the Electrical Inspector, and the City Weighmaster for the month of November and found the same correct, was read, and President Lemmon ordered that the same be placed on file. The Trial balance of the City Engineer's Department for the.month of November,1939,was read and President Lemmon ordered that the same be placed on file. The report of the Clerk,of.the Municipal Court for the week ending December llth,1939, showing criminal fines and costs collected $333.40, civil fees received $21.05, and conciliation court fees received �'9.25, vaas"read, and having been previously approved by the City Attorney, President Lemon ordered that the same be placed on'file. The first and final estimate by the City:.Engineer-in favor of Wm.C.Fraxer Son, showing the sum of $216.13 as being due the said contractor for laying a water main in Sixth Avenue Northwest from Eighth Street Northwest to a point, 135•feet north,•was read, and President Lemmon. ordered that the same be placed on file. The first and final estimate by the City Engineer in favor of Vdra.C.Fraser & Son, showin` the sum of i�'1397.16 as -being due the said contractor for construction of a water main in Fourteenth Avenue Southwest from Seventh Street to Eighth Street Southwest, and in Eighth I Street Southwest from Fourteenth Avenue Southwest to the alley, was read, and President Lemmon ordered that the same be placed on file. An ordinance regulating the construction, maintenance and operation`"of public automobile, trailer and tourist camps, in the City of Rochester, Minnesota, introduced and given.its first reading October 2nd,1939, its second reading November 6th,1939, was given its•third and final readi ng . Upon motion by Fryer second by Amundsen, that the- said ordinance be adopted as read, and I� upon roll call all mambers voting in favor thereof, President Lem;aon declared the said ordinance duly passed and adopted. Record of Official Proceedings of the Common Council December 11,1939.- of the City of Rochester, Minn., N i An ordinance regulating the use of automobile trailers and camp cars in the City of i, Rochester, Minnesota, introduced and given its first reading October 2nd,1939, its second ;!reading November 6th,1939, was given its third and final reading. Upon motion by Mrachek second by Williams, that the said ordinance be adopted as read, and upon roll call all members voting in favor thereof, President Lemmon declared the said ordinance duly passed and adopted. Joseph Mackey appeared before the Council again in regard to his petition for a sanitary sewer but -no further action was taken thereon. I At the request of Alderman Green Mr. A.A.Urness appeared before the Council in connection iwith one of the Lots in Sunnyside Addition being condemned for street purposes. 7 - Copies of resolutions passed and adopted by the Commissioners of the Sinking Fund, purchasing $5,000.00 Olmsted County, Minnesota, Independent School Dist.Vitt No.8 1.80�. bonds !due December lst,1946, $rom Kalman & Company; purchasing $20,000.00 State of Minnesota, 41. 1 ;Rural Credit bonds due December 15th,1943, on a .9(11. basis from Bigelow Webb & Company; and ; ;purchasing $$20,000.00 Independent School District No.8 1.81. bonds due $10,000.00 on December i 'lst,1952 and $10,000.00 on December 1,1953, from Wells -Dickey Company, for Sinking Fund r investments, were each read, and upon motion by Green second by Amundsen, the actions set w forth therein were approved. Alderman Williams introduced an ordinance regulating the installation, operation and .'maintenance of electric wires, apparatus and machinery, within the City of Rochester, Minnesota, .was given its first reading. Alderman Moody introduced a resolution appropriating $228.60 from the General Fund, and !'$29.15 from the Permanent Improvement Revolving Fund, and ordering payment made to the Rochester ,Post -Bulletin, for official publications and printing during November,1939 which was read. Upon motion by Fryer second by Amundsen, that the said resolution be adopted as read, and li ;all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman bloody introduced a resolution appropriating $294.75 from the Street and Alley Fund, i I . ,'and ordering payment made to Morse Brothers, for sand and gravel furnished during November,1939, !I which was read. �i Upon motion by Moody second by Amundsen, that the said resolution be adopted as read, and a ;all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. ! Alderman Moody introduced a resolution appropriating $706.53 from the Street and Alley Fund, Land ordering; payment made to the Street and Alley Fund, for use of equipment during November,1939, iwhich was read. I! Ypon motion by Green second by blrachek, that the said resolution be adopted as read, and all i,voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. December. 11,1939. 4., Alderman Green introduced a resolution appropriating $278.20 from the Park Improvement Fund and ordering payment made to Peterson Electric Company, for electrical work at VTilliams Estate which business building,/was read, an d- Upon motion by Williams second by Green that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted Alderman Green introduced a resolution appropriating 866.81 from the Park Improvement Fund, land ordering payment made to the City of Rochester, Light, Water and Steam Department, for electricity, water and steam furnished at the Mayo Civic Auditorium in accordance with billings November 25th,1939,which was read. Upon motion by Green second by Amundsen,that the said resoltution be adopted as read, and fall voting in favor thereof, President Lemmon declared the said resolution duly passed and ladopted. Alderman Green introduced a resolution appropriating $1397.16 from.the Permanent Improvement Revolving Fund, and ordering payment made to Vlm.C.Fraser & Son, for first and final estimate on contract for the construction of a water main in Fourteenth Avenue Southwest from Seventh Street Southwest to Eighth Street Southwest, and in Eighth Street Southwest from Fourteenth Avenue Southwest to the alley, which was read. Upon motion by Y-rachek second by Williams, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmoh declared the said resolution duly passed and ado Alderman Amundsen introduced a resolution appropriating $216.13 from the Permanent Improvee ment Revolving Fund and ordering payment made to Vdm. C.Fraser & Son, for first and final estimate contract for the construction of a water main in Sixth Avenue Northwest, from Eighth Street Northwest to a point 135 feet north, which was read. Upon motion by Amundsen second by Breen that the said resolutionbe adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopt Alderman Fryer introduced a resolution granting public dance permit to Dale Hess f'or the Armory, December 9th,1939, and fixing the fee at $3.00,which was read. Upon motion by Green second by Fryer that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Fryer introduced a resolution gppnting public dance permit to John Bray (Local jr-%4) for the W6&dm6n Hall, December 9th,1939, and fixing the fige at $3-00,which was read. Upon motion by Mrachek second by Green that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced a resolution adopting plans, specifications and -estimate of cost for the construction of a sanitary sewer and water main in Fifth Street Southeast from Twelfth Avenue Southeast to Thirteenth Avenue Southeast, ordering that the same be placed on file, and ordering a hearing on the said improvement to be held at $:00 otclock P.II., on January 2nd,1940, and ordering advertisement for bids to be received and opened at 2:00 otclock P.r.I. , on January 2nd,1940, which was read. Upon motion by Williams, second by Green that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopt Alderman Williams introduced a resolution ordering plans, specifications and estimate of c for the construction of a water main in Sixth Avenue Northwest from Tenth Street Northwest to Eleventh Street jorthwest, which was read. Northwest, ordering that the same,be,placed on file, ordering twat, a public heaarinE on.said improvement be held at 2:90 otclock P.M., on January 2nd,1940, and ordering advertisement for sealed bids to be received and opened at 2:00 o'clock P.14.,.on January 2nd, 1940, which was read. Upon motion by Fryer second by Amundsen that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted.
