Record of Official Proceedings of the Common Council
of the City of Rochester, Minn., January 2 ,1940.
Minutes .of .a regular. meeting of the Common Council of the City of Roches-
ter, Minnesota, held in the Council Chambers in the City Hall, in said City,
on January 2nd,1940. `
President Lemmon called the meeting to order at 2:00 o'clock P.M., the
following members being present: Lemmon, Amundsen, Fryer, Green, Moody, Mrachek,,'
Williams. Absent: None.
Upon motion by Fryer second by Amundsen the minutes of the meetings of
November 27th, December 4th, December llth, and December 22nd,1939, were
approved.
President Lemmon stated this as being the time and place set for a hearing
on the construction of a water main in Sixth Avenue Northwest from Tenth
Street Northwest to Eleventh Street Northwest, and asked if any one present
wished to be heard concerning the said water main. No one present wished to
be heard concerning the said improvement.
President Lemmon stated this.as being the time and place set for a hearing
on the construction of a sanitary sewer and water main in Fifth Street
Southeast from Twelfth Avenue Southeast to Thirteenth Avenue Southeast, and
asked if any one present wished to be heard concerning the said sanitary sever
and Water main. No one present wished to be heard concerning the said
improvement.
President Lemmon stated this as being the time and place set for a hearing
on the petition for the vacation of Second Avenue Northeast lying south
line
of the south/of Fourteenth Street Northeast and north of the north shore of
Silver Lake in the City of Rochester, Minnesota, and asked if any one present
wished to be heard concerning the said vacation of Second Avenue Northeast.
No one present wished to be heard.
President Lemmon stated this as being the time and place set for receiving
'; and opening bids for the construction of a water main in Sixth Avenue Northwest
from Tenth Street Northwest to Eleventh Street Northwest, and the construction
of a sanitary sewer and water main in Fifth Street Southeast from Twelfth

the bids for the construction of the above described water main in Sixth
Avenue Northwest, and the Sanitary sewer and water main in Fifth Street South-
east, be returned to the respective bidders unopened, and that the City Clerk
be instructed to readvertise for sealed bids for the said improvements in
the spring when the frost is out of the ground, said bids to be received and
opened at 2:00 o'clock P.M., on February 5th,1940.
Mr. Hilmer and Mr. Fellows appeared before the Council in regard to
charges being made for electric c&nnections in Golden Hill, Garden Acres, and

Bnollwood Acres, and upon mo.t.ion by. Fryer second by Amundsen the matter was
referred to the Lighting Committee of the Common Council and. the Public Utility
r
Board for a report.
A copy of a requisition by the. Health Officer upon St.Mary's Hospital for
the isolation of Mrs. Julius Hanson, diagnosed to be suffering from erysipelas
was read and President Lemmon ordered that the same be placed on file.
A communication from the Secretary of the Firemen's Belief Association
requesting the approval by the Council of a loan of $2,000.00 to Harold Brown
on his residence at 109 Eleventh Street Southeast, was read and President Lemmon
referred the same to the Finance Committee.
The recommendation of the Finance Committee that the Council approve the
above loan to Harold Brown, was read and upon motion by Green second by Amundsen
the said Committee report was* accepted and the loan approved.
An appeal from the action of the Common Council in approving the award of
t1ge Commissioners for Lot 15, Block 3 Sunnyside Addition, was read and Presi-
dent. Lemmon referred the same to the City Attorney.
An emergency authorization given by the Mayor to the City Clerk for the
purchase of a carload of gasoline was read, and President Lemmon ordered that
the same be placedon file.
'The appointments by the Mayor of Martin Kulsrud as a special policeman
for duty at the Hol#es School, and of Philip A.We•ivoda for duty at the Hawthorne
School, each to serve without pay and -to hold office until the second Monday in
April, 1940, unless sooner removed",-w,ere each read and President Lemmon ordered
that the same be placed on file.
Copies of resolutions passed and adopted by the Commissioners, of the
Sinking Fund, appropriating $19,000.00 from the Sinking Fund anal ordering pay-
ment made to the First National Bank for the January 1st 19.E+0 maturity of
Rochester Electric Light Bonds 423 to 435 inclusive $1.3,O00.00 and for the
Jan.. ls.t, 1940 maturity of City of Rochester Pater Bonds 136 to 140, inclusive
$5,000.00, and, appropriating $4641.97 from the Sinking, Fund to the Interest
Fund, to apply on the January 1st, 1940 maturity of interest on Rochester Light
and Pater Bonds, were each read and upon. motion by Williams second by Green
.the actions set forth therein were .approved, and it was ordered that the same
be placed on file.
A copy of a resolution passed and, adopted by the Public Utility Board
requesting authoritjr to enter into contract with the Foster Weeler Corporation
for the furnishing of 56 superheater elements, was read and President Lemmon
ordered that the same be placed on file.

A communication from Theo Theel withdrawing his name from the petition
requesting that Second.5treet Southwest between Thirteenth Avenue and
Sixteenth Avenue Southwest remain a residential district, and a communication
signed by Theo.Theel.requesting that the said part of Second Street Southwest

be zoned as a Commercial District, were each read and President Lemmon ordered
that the same be placed. on file.
A petition. signed•by thirteen persons opposing the changing of the
north side of Fourth .Street Southeast between Ninth and Tenth Avenues from
a residential zone to a•commercial zone, was read and President Lemmon ordered
that the same be placed on file.
A petition with 99 signers requesting additional busses running on
Sixth fiiLdeeV'.Sp-,uthwest and Seventh Avenue Southwest, was read and upon motion
by Fryer second'by .Amundsen the said matter was referred to the Public
Grounds Committee.

The application of the Rochester Bud Line for ,transfer of bus licenses
was read and upon motion by Amundsen second by Moody transfers were granted.
The application of Rowland Fosburg for a license to sell soft drinks at
119 No.rt.h Broadway was read and upon motion by Fryer second by Mrachek license

was granted subject to the approval of the License Committee, and 8hief of Police.

The applications of Rowland Fosburg for off sale and on sale non-intoxicat-,
ing malt liquor licenses at No.11.9 Broadway Street North were each read add
upon motion by Fryer second by-Mrachek licenses were granted subject to the
approval of the License Committee and the Chief of Police.
The reports of the Clerk of the Municipal Court for the week ending

fees received $7.15, sonciliation•court fees.received $7.75; for the week
ending December 26th,1939, showing criminal fines and costs collected $90.80,
civil fees received .$7.90, conciliation court fees $6.00; and for the week

ending January 2nd,1940, showing criminal fines and costs collected $11.g.45,.
civil fees received $4.00, conciliation court.fees received $1.00, were each

read and having been previously approved by the City Attorney,P.resident Lemmon
ordered that the same be placed on file.

Applications signed by Sidney N.Arneson, Robert C.Kieth, Andrew Benschoter,
Richard L.Coon, 'Walter C.Scharweber, Raymond F.Lewis, Otto C.Siercks, Arthur
Beccue, Lester Lawrence and Harry O.Brown, for drivers licenses were each read,
and upon motion by Moody second by Amundsen licenses were granted.
Applications signed by Tauers Store, Rochester Production Credit Company,
and the South Broadway Texaco Service Station, far. -permits to place and maintain
signs, were each read and upon motion by Fryer second by Green permits were

The report of the.'City Weighmaster for the month of December,1939, showing
313 private loads weighed and total receipts $31.30, was read and President
Lemmon referred the same to the Finance Committee.
The reports of th-e Building and Plumbing Inspector and the Electrical
Inspector for the month of December,1939, showing building permits issued
$61.00, Plumbing Permits $32.25, and Electrical Permits $29.00, were each read,
and President Lemmon referred the same to the Finance Committee.
An ordinance for the purpose of promoting health; safety, order, convenience
and general Welfare by regulating the use of land, the location, size, use and
height of buildings and the arrangement of building on lots and the density of
population with the City o-f Rochester, Minnesota, all in accordance with a com-
prehensive plan, introduced and given its first reading November 20th,1939,
its second reading December 4th,1939, was given its third and final reading.
A.H.Clemens representing residents living on Second Street�Southwe'st and
Fifteenth Avenue Southwest spoke in opposition to the above ordinance in so far
as it places Second Street Southwest from Thirteenth Avenue to Sixteenth Avenue
Southwest in the Commercial Zone. Miss Hickey and A.C.Gooding also opposed
the placing of said property in the Commercial Zone. Matt Fitzpatrick spoke
in support of the proposed change to a Commercial Zone for said property.
After consideration was given by th.e Council to the above protests, it was
deemed advisable to pass the above ordinance as drafted,and introduced, and the
City Attorney was informally ins tructed to prepare an ordinance amending the
same to comply with the above protests and place said property in•the residential
zone, and also to include.Block 42, Morse & Sargent's Addition in the Residential
zond.
Upon motion by Moody second by Williams that the said ordinance be adopted
as read, and upon roll call all members voting in favor thereof, President
Lemmon declared -the said resolution duly passed and adopted.
An ordinance regulating -the installation, operation and maintenance of
electric wires, apparatus and machinery, within the City of Rochester, Minne-
sota, introduced and given its first reading December llth,1939, was given
its second reading.
Upon motion by Fryer second by Amundsen and upon roll call all voting in
favor thereof, the rules were suspended and the said ordinance. given its third
and final reading.
Upon motion by Mrachek second by Fryer that the said ordinance be adppted
as read, and upon roll call all voting in favor thereof, President Lemmon
declared the said ordinance. duly passed and adopted.
Erwin Briese as spokesman for a group from the Chamber of Commerce asked
that steps be taken to provide adequate -"'storm sewers in the business district.
Alderman Moody,Chairman of the Sewer Committee, explained that plans for said

'I storm sewer were being prepared at this time,and the'financing. of. said project was
jassured by the Finance Committee.
Alderman Amundsen introduced a reso.lution vacating that part of Second
!Avenue Northeast lying south of the south line of Fourteenth St.reet Northeast
viand north of the north shore of Silver Lake and discontinuing the same as a
,public street, which was read.
Upon motion by Amundsen second by Fryer that the said resolution be adopted
�'as read, and all voting in favor thereof,. President Lemmon declared the said
,resolution duly passed and adopted..
Alderman Amundsen introduced a resolution ordering a hearing on the levyin g
j; of special assessments for the following public 'improvements:
'!The construction of a water main in Sixth Avenue Northwest from Eighth St-reet
Northwest. to a point 250 feet north;
The const ruct!i on of a water main in Fourteenth Avenue Southwest from .Sev.enth
Stree-t Southwest to Eighth Street Southwest, and in Eighth Street Southwest
from Fourteenth Avenue Southwest east to the alley;
'The grading of Fourth Avenue Southeast from Twelfth Street Southeast to Thirteenth
Street•. Southeast;

Alderman Mr-a.chek, introduced a. resolution appropriating $463.66 from the
Street and Alley- Fund ,an-d..$10.50 from -the Bridge Fund, and ordering payment
made to the General Fund, for gasoline furnished from the city filling station,
which was read.
Upon motion by Mrachek second by Green that the said resolution be adopted
as read, and allvoting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman.Mr.achek introduced a resolution appropriating $316.92 from.the
General Fund, $3.75 from the Street and Alley - Fund, $574.94 from the Sewer
Fund, and $3,763-.23 from the Lighting Fund and ordering payament made to the
City of Rochester, Light, Pater and Steam departments, for electricity, water
and ,steam furnished at public buildings, and lighting of public streets and
grounds, which was read.
Upon motion by Fryer second by Williams that the said resolution be
adopted as read, and all voting, in favor thereof, President Lemmon declared
the said resolution duly passed and adopted.
Alderman -Moody introduced a resolution appropriating $1615.36 from the
Park Improvement Fund and ordering payment made to the Mayo Trust Fund, for
payrolls for -labor during the .half month ending December 15th,1939, which was
re ad.
Upon motion by Green second by Amuhdsen that the said resolution be, adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Moody introduced a resolution appropriating $1672.69 from the
Park Improvement Fund and ordering payment made to the Mayo Trust Fund, for -
payrolls for labor during the half month ending December 31st,1939, which was
read.
Upon motion by Mrachek second by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
-Alderman-Moody introduced a resolution granting public dance permit to
Dale Hess for the Armory, December 23rd, 25th and 30th,1939, and January 6th,
1940, and fixing the fee at $12.00, . which was read.

Alderman Williams -introduced a resolution appropriating $173.45 from the
Permanent Improvement Revolving Fund and ordering payment made to -the General
Fund, for adjustments o£-Go-sts on jobs to amount of assessments to be levied,
which was -read.

Permanent .Improvement Revolving Fund and ordering -payme-nt -made to the •General

of laterals in First Avenue -Southwest and Sixth Street Southwest under P:'W.A.

Alderman Williams introduced a resolution appropriating $9959.94 from the
Permanent Improvement Revolving Fund and ordering payment made to the General
Fund, for transfer'of funds covering assessments levied for paving and cur7ging
on 'First Aven-de and Sixth Street Southwest under.P.W.A.Docket .No.1515-F, which
was read. '

Alderman Williams introduced a resolution appropriating •$1353.56 from the
Permanent Improvement Revolving Fund and -ordering payment made to the Sewer
Fund, for return'of temporary transfer, which was read.
Upon motion by Williams second -by Mrachek •that tthe said resolution be
adopted as read; and all voting in -favor thereof, President-Lemmon declared

General Fund, for transfer of funds covering assessments levied for construction,

which was read.
Upon motion by Moody second by Green that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.

Alderman Williams introduced an ordinance amending an ordinance for the
purpose -of promoting health, safety, order, convenience and general welfare by
regulating the use of.land, the location, size, use and height of buildings,
and the arrangement of buildings on lots and the density of population within
the City of Rochester, Minnesota, all in accordance with a comprehensive plan,
adopted January 2nd,1940, which was given its first reading.

voting in favor thereof, the rules were suspended and the said ordinance was
given its second reading.
Upon motion by Fryer second by Williams and upon roll call all members
voting in favor thereof,`the rules were suspended and the said ordinance was
