IMinutes of a regular meeting.of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said - City, on February 5th,1940. President Lemmon called the meeting to order at 2:00 o'clock P.M,, the following members being present: Lemmon, Amundsen, Fryer, Green, Moody, i Mrachek, Williams. Absent: None. Upon motion by Fryer second by Williams, the minutes of the meetings of January 2nd,1940, and January llth,1940, were approved. President Lemmon stated this as being the time and place set for a hearing on the levying of special assessments for the construction of a water main in Sixth Avenue Northwest from Eighth Street Northwest to a point 135 feet north, and asked if any one present wished to be heard.c No one resent wished to be heard concerning v p g the levying y� g of assessments for said water main. President Lemmon stated this as being the time and place set for a hearing on the levying of special assessments for the construction of concrete paving and curbing on First Avenue Southwest from Fifth Street Southwest to Sixth Street Southwest and on Sixth Street Southwest from Broadway Street South to (P.W.A.Docket 1515-F) Second Avenue Southwest/, and asked if any one present wished to be heard concerning the levying of_said special assessments. No-one present wished to be heard. President- Lemmon stated -this as being the time and place set for receiving land opening bids ,for the construction of a sanitary sewer and water main in ifth Street Southeast from Twelfth AvenueSoutheast to Thirteenth Avenue .So-uth- ast, The following bids were received and opened at this time: Martin Paulson $929.20, Wm.-C. Fraser &--Son $876.59. Presi=dent'-Lemmon referred the said bids' o the Sewer Committee and the City Engineer for tabulation and recommendation. President Lemmon stated this as being the time and place set for receiving and opening bids for the construction of a water main in Sixth Avenue Northwest from Tenth Street Northwest to Eleventh Street Northwest, The following bids were received and opened at this time: Wm. C. Fraser.& Son, $555.00, Martin Paulson $606.95. President Lemmon referred the said bids to the Sewer Committee•and the" City Engineer for tabulation and recommendation. President Lemmon stated this as being the time and place set for receiving and opening bids for the purchase of $49,000.00 City of Rochester, Minnesota, 2% Permanent Improvement Revolving Fund Bonds. The following bids were received and opened at this time: Union National Bank of Rochester, Minnesota; $48;240.00 plus accrued nterest to date of delivery: Paine, Webber & Company, Chicago, Illinois: $49,919.90 plus accrued interest o date of delivery, conditioned than certified copies of all proceedings be sent to .the bidders attorneys, and that said -papers are sati9factory to said attorneys'. . Alderman Amundsen introduced the following resolution.. which was read: "Be -it resolved by the Common Council of the City of Rochester, Minnesota: That the -bid -and proposal of Bigelow, -Webb Co., Moody, Juran & Rice, and the Union National Bank of Rochester, Minnesota, for the purchase of $48,000.00 City of Rochester, Minnesota 2 o Permanent Improvement ie'volving Fund Bonds, at par and a premium of $240.00 and accrued interest $96.00 from date of bonds to date of delivery, February 6,1940, be and the said bid and proposal is hereby accepted." Upon motion by Moody second by Fryer that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolu- tion duly passed and adopted. Upon motion by Fryer second by Williams the City Clerk was instructed to (return the certified check of Pain, Webber & Company. C. 14. Boutelle appeared before the Council and requested that Third Street Northeast be extended. Upon motion by Moody second by Amundsen the matter was ' t referred to the Street and Alley Committee and the City Engineer. The applications of Ray Hanneman and Dorothy Hodgson for license to sell 'soft drinks was read and upon motion by Fryer second by Amundsen, license was 'I granted. The application of Francis Christopherson for a license to connect to , i.sevrers and drains, together with a surety bond.in the sum of $1,000.00 with . i t;the Fidelity & Casualty Company as surety, and the application of Maass & !McAndrew Company for a license to connect with sewers and drains, together with a surety bond in the sum of $1,000.00 with the National Surety Corporation as ;surety, were each read, and upon motion by Moody second by Fryer, the licenses ,were granted, the bonds approved, the sureties thereon accepted and it was ordered that the bonds be placed on file. The application of Jung's Quality Shoes fora permit to place and maintain i s sign, was read and upon motion by Amundsen second by Inlrachek permit was I granted. I The application of Elmer Johnson for a plumbers license, together with a surety bond in the sum of $1,000.00 with the Aetna Casualty and Surety :Company as,surety, was read,, and,upon motion by Moody second by Amundsen, the ;license was granted, the.bond approved, the surety thereon accepted and it was 'i 1� ordered that the bond be .placed on file. i Applications signed by Wm.Harold Sparks, Alvin Roy, Richard Church, I� Leonard Marsh, Vernon Baker, Frank E.Salley, Frank A.11cLaughlin, Gerald A.Cooke, I �,Ed.Campion, M.W.Mathieson, Clifford J.Carson, Richard Lehman, Homer M.Strangeway, ;Walter•Wilke, Alfred H.,Hollo, Julius J.Feind, for drivers licenses, were each head, and upon motion by Green.second by Amundsen, licenses were granted. An application signed by Erling V.Klagstad and Haven Giere, for transfer of on sale license #295 and off sale license #499 for selling non -intoxicating I malt liquors, to Haven Giere at .16 Third Street .Sout4west, was read, and upon motion by Amundsen second by Mrachek transfer was granted. The applications of Rochester Electric Company, Arthur A.Brown, and j Peterson Electric Company for Electrical contractors licenses, were each read, ,!and upon motion by Amundsen second by Fryer licenses were granted. I Applications for Master Electrician's Licenses, signed by Frederick A. Squires, Harold F.Richards, Walter I.Alker, Edward D.Holst, Spencer Holloway, John E.Hines, Fred Raetz, and Herbert H. Fordham, for journeyman's electrician's licenses, were each read, and upon motion by Mrachek second by Green, licenses were granted. The surety bond of J.A.Peterson with the New Amsterdam Casualty Company as surety in the sum of $1,000.00; the surety bond of Foster Mrachek Electric Company, in the sum of $1,000.00 with the Fidelity & Deposit Company as surety; A continuation certificate on the surety bond of.Arthur A.Brown with the Western Surety Company as surety; and the surety bond of Frederick A.Roepke in the sum . of $1,000.00 with the National Surety Corporation as surety, were each read, and upon motion by Green second by Amundsen, the said bonds were approved, • C the sureties thereon accepted and it was ordered that the same be placed -on file. A petition signed by six business men on First Avenue Southwest from (Fourth Street to Sixth Street, asking that the said part of First Avenue Southwest have the parking limit of one hour, was read and President Lemmon referred the said petition to the Mayor, Chief of Police and the Police (Committee. A report from the Zoning Board recommending that the request of Agnes Hoffman to have her property located on the corner of Eleventh Avenue Northeast and Center Street East designated as multiple dwelling be grar_ied, was read, land President Lemmon ordered that the same be placed on file. The report of the City Weighmaster for the month of January, 194o, showing 314 private loads weighed ancL total receipts of $31.4o, was read, and President Lemmon referred the same to the Finance Committee. The report of the Building and Plumbing Inspector for the month_ of January 1940, showing building permits issued $47.00, plumbing permits $24.50, and the report of the Electrical Inspector for the month of January,1940,.showing Iblectrical permits issued .$24.25, were each read and President Lemmon referred the same to the Finance Committee. The repo-st of the Clerk of the Kunicipal Court for the week ending IJ anuary 15th,194o , showing criminal fines and costs collected $202.60, civil Ifees received $3.70, conciliation court fees received $5.00; for the week ending January 22nd,1940, showing criminal fines and costs collected $309.05, civil fees received $4.40, conciliation court fees received $9.25; for the week ending January 27th,1.940, showing criminal fines and costs collected $159.60, I civil fees received $6.70, and conciliation court fees received-$4-35; and for 480 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., F e b r ua r y 5 ,19 40 . 1fthe week dnding February 5th,1940, showing criminal fines and costs collected $199.20, civil fees received $5.05, and conciliation court fees received $4-50, were each read, and having been previously approved by the City Attorney, ;;President Lemmon ordered that the same be placed on file. h t The report of the Park Board for the month of January,1940, was read and ;President Lemmon ordered tha t the same be placed on file. The Board of Park Commissioners presented to theCouncil a W.P.A.Project ';proposal for the construction of bridges; formal entrance gates, drives, rwatering system, walks, installation of playground equipment and other is improvements in the parks, and requested that the Mayor and City Clerk be authorized and directed to execute the said project proposal for the City of ,,Rochester; the total expenditure for materials and labor amounting to $36,5�4.00, the City of Rochester's contribution to be $9,346.00. Upon motion'by Fryer isecond by Amundsen, the Mayor and City Clerk were authorized to sign the said W.P.A.Pro ject proposal for the City of Rochester. I� A report from the Lighting Committee regarding charges being made by the ;Public Utility Department for electric service connections on rural lines !outside the city limits, was read, and upon motion by Moody second by Williams, the City Clerk was instructed to make a number of copies of said report and mail to Mr. Fellows and Hilmer. President Lemmon ordered tha t the said ��report be placed on file. The City Engineer submitted an estimate of cost for the construction of :a trunk line storm sewer on Third Avenue Southwest from Fourth Street Southwest to Center Street, and on Center Street West from Third Avenue to Second Avenue, ;and on Second Avenue Northwest from Center Street to Fifth Street Northwest, and on Fifth Street Northwest from Second Avenue to the Zumbro River, said estimate of cost being $62,000.60. I; Upon motion by Williams second by Fryer the City Engineer was instructed ,Ito prepare plans and specifications for the construction of the above described jtrunk line storm sewer. A communication from Dr. T.B.Magath, Health`Officer, recommending the passage by the Council of an ordinance with the'view of curtailing the promiscuous sale of prophylactic rubber goods; the passage of such an ordinance being requested in an accompanying petition signed by all the proprietors and owners of drugstores in the City of Rochester, were each read, and upon motion by Williams second by Fryer the City Attorney was instructed to draft such an ordinance. ` Record. of Official Proceedings of the Common Council of _the City of - Rochester, Minn., February 5 ,.1 g.40 . 48.1 A communication from the Plumbers and Steamfitter's-Local #556 recommending the adoption of the State plumbing Code`and its additions, revisions, etc., to safe -guard the public health and welfare of the Community of the City of Rochester, was read, and upon motion by Fryer second by Williams the matter was referred to the City Attorney-, Building Inspector, And Board of Public Health an Welfare. A recommendation by the Sewer Committee and the City Engineer that the contract for the construction of a water` main in Sixth Avenue Northwest from Tenth Street to Eleventh Street Northwest be awarded to Wim.C.F-raser & Son for the sum of $5's5.00, was read and President Lemmon ordered that the same be placed on file. Alderman Amundsen introduced a resolution accepting the bid and proposal of Wm, C. Fraser & Son for the construction of a water main in Sixth Avenue Northwest from- Tenth Street Northwest to Eleventh Street Northwest, for the which sum of $585.00 „`was read. Upon motion by Fryer second by.Amundsen that the said resolution be`adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. A recommendation by the Sewer Committee and the City Engineer that the contract for the construction of a sanitary sewer and water main in Fifth Street Southeast from Twelfth Avenue Southeast to Thirteenth Avenue Southeast be awarded to W m.C.Fraser & Son for the sum of $976.59, was read and President Lemmon ordered'that the same be placed on file. Upon motion by Moody second by Amundsen that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $956.99 from the Park Steam Improvement Fund and ordering payment made to the City of Rochester, Light/and Pater Depart:meants for electricity, water and steam furnished at the Mayo Civic Auditorium in accordance with billing of December 25th,1939, which was read. Upon motion by Amundsen second by Green that the said resolution be adopted as read, and all voting in favor thereof, President--Lemmon declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $1479::27, from the Park Improvement Fund and ordering payment made to the Mayo. Trust Fund, for payrolls for labor for the- half month ending January loth, 1940, which was read. Upon motion by Mrachek second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $212.00 from the Park Improvement Fund and ordering payment made to the E.A.Knowlton Company for flowers for decorations for the Mayo Civic Auditorium, which was read. Upoh motion by Amundsen second by nlirachek that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Moody introduced a.resolution appropriating $271.55 from the General Fund, -and $27.50 from the Permanent Improvement' Revolving Fund 'and ordering payment made to the Rochester Post —Bulletin for official publications and printing during December,1939, which was read. Upon motion by Green second by Fryer that the said resolution be adopted as read, and all voting in' favor thereof, President-Lemmon declared the said resolution duly passed and adopted. Alderman Mrachek introduced a resolution appropriating $203.25 from the I Park Improvement Fund and ordering payment made to Ellerbe & Company, for !architectural services on Mayo Civic Auditorium Signs and Ice Thawing pit, i Iwhieh was read. " Upon motion by Green second by Amundsen that the said resolution be adopted ,:as read, and all voting in favor thereof; President Lemmon declared the said (resolution duly passed and adopted: Alderman Mrachek introduced a resolution appropriating $66.8-from the Street & Alley Fund, $50.29 from the Fire Protection Fund, $193.38 from the Sewer Fund, and ordering payment made to the Dodge Lumber & Fuel Company, for fuel for- liwarehouse, disposal plant, fire hall, and lumber for Eire Department, which was , read. Upon motion by Mrachek second -by Moody that the said resolution be adopted , as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Mrachek introduced a resolution granting public dance permit to the Central Labor Union, for the Woodman Hall, January 13th, 20th, 27th, I; and February 3rd, 1940; and fixing the fee at $12.00, which was read. 1'. Alderman Williams introduced a resolution appropriating $3,000.00 from the Sewer Fund, for use of the Street and Alley Committee, which was read. Upon motion by Green second by Fryer that the said resolution be adopted as read, and all voting in favor` thereof, President Lemmon declared the said resolution duly passed and adopted.
