President Lemmon called the meeting to order at 2:00 o'clock P.14„ the i following members being present: Lemmon, Amundsen, Fryer, Green, Moody, Mrachek, Williams. Absent: None. 0 Upon motion by Green second by Amundsen the minutes of the meetings of February 5th and 29th,1940, were each approved. John Kerr presented plats of certain_ street lines in the City, and President Lemmon referred the matter to the Street & Alley Committee, the City Engineer and the City Attorney. A communication from the Secretary of the Firemen's Relief Association, requesting the app.roval of the Council of a change in the contrz.ct for deed mortgage by' M. bel Couger on her residence at 425 Fourth Avenue Southwest, to a first mortgage on said property, the same to bear interest 'at '6% computed semi-annually until paid in full, was read and President Lemmon referred the same too the Finance Committee. A communication from F.D.Hayes Electric Company, was read and President Lemmon referred the same to the Committee in charge. A communication from the County Auditor regarding taxes anA assessments on Lot 15, Block 2, and Lot 15, Block 3, both in Sunnyside Addition, was read, and President'Lemmon referred the same to the City Attorney. ` The appointment by the Mayor of Max Graham as a special'Policeman for duty at the Armory, he to serve without pay and to hold office until tend Second Monday in April,1940, unless sooner removed, was read and Prdsident Lemmon ordered that t`he same be placed on file. ` A communication from'J.T.Langlais,-Public Examiner, acknowledging receipt of a resolution by the Council requesting an audit of the books and records of the City of Rochester for the fiscal year ending'March 31,1940, was read and President Lemmon ordered that the same be placed on bile. The appointment by the Judge of the Municipal Court of May Nelson as Clerk of the Municipal Court was read and Presiden_. �� emm'04 ordered"that the same be placed on file. v A communication from the City Engineer 'requesting an appropriation of $3,000.00 from the Street and Alley Fund and $1,000:00 from the Sewer Fund., was President Lemmon ordered that the same be placed on file. Copies of resolutions passed and adopted by the Public Utility Board, requesting authorit* to change the Commercial Light Rate, and to enter into contract with the ,American Cast Iron Pipe Company, were each read and President Lemmon ordered that the same be placed on file. Trial Balances for the City Engineer's Department for the months of I'. December 1939, and January, 1940, were each read and President _Lemmon ordered ;. that the same be placed on file. ! The reports of the City Engineer's Department for the month of December 1939, showing expenditures from the General Fund for labor in the sum of $61.84, from the Street and Alley Fund $2159.81, Sewer Fund $589.70, from the i Bridge Fund $.65; for the month of January 1940, showing expenditures -for labor I from the General Fund $12.11, Street and Alley Fund ,$1456.52, and from the Sewer Fund $1311.37; and for the month of February,1940, showing expenditures for labor from the General Fund $5.78, Street and Alley Fund $1297.70, from the t Sewer Fund_$2142.46, were each read, and President Lemmon ordered that the same be placed on file. The annual report of the City Engineer for the year ending January 31,1940, was read, and President Lemmon ordered -that the same be placed on file. The reports of the Clerk of the Municipal Court for the week ending February 12,1940, ahowing criminal fines and costs collected $369.90, civil !i fees received $6.25, conciliation court fees $4.75; for the week ending February 19th,1940, shoeing criminal fines and colts collected $280•:40, civil fees received $4.00, conciliation court fees-$3.75; for the week ending February 26th,1940, showing criminal fines and costs collected $245.70, civil !; fees received $4.4.0, conciliation -court fees $7.00; and for the week ending March 4th,1940, showing criminal fines and costs collected $159.80; civil fees received $8.35, and conciliation court fees $3.75, wdre each -read, and having been previously approved by the City Attorney, President Lemmon ordered that the same be placed on file. Dr. T.B.Magath, Health Officer submitted a copy of the annual report to the State Division of Social V,el.L on the City lockup, and President Lemmon ordered that the same be placed on file. The reports of the Building and Plumbing Inspector and the Electrical ,I Inspector for the mont4 of_February,1940, showing building permits issued $61.00, plumbing permits $42.75, and electrical permits $21.50, were each read and President Lemmon referred the same to the Finance Committee. A communication signed by F:R.Finch,City Clerk, and Arleigh C.Smith,Cit§ Engineer stating that they have talked to various Oil Companies about bi•ds for V gasoline for three seasons of the year, and that all companies will not guarantee the bid price for gasoline more than 30 days, was read, and it was agreed -to purchase one car for present needs through an emergency order given by the Mayor and that the City Engineer prepare specifications for gasoline to be purchased for future use under advertisement for bids. The report of the Finance Committee on the reports of the Building and Plumbing Inspector, Electrical Inspector and the Weighmaster for the month of January,1940, was read and upon moti-onby Green second by Amundsen said.Teport was accepted•and ordered placed on file. A.petition sinned by Clarence W.Klee, Otto H.Heyn, Nellie J.Toogood, and James W. Shiets, stating that they are not opposed to ilorey Kitzman moving a house onto Lot 3, Block 9, Sunnys.ide Addition, was read and President Lemmon < < ordered that said petition be placed on file. The report of receipts and expenditures from the Park Improvement Fund, during the month of February,1940, submitted by James H.Starkey, Secretary, was read and,President Lemmon ordered that the same be placed on file. i A recommendation signed by the Street and Alley Committee and the City* Engineer that a walk or step be Aconstructed on Third Street Southwest from Ninth Avenue Southwest to St.1,1ary's Park, was read and upon motion by Mrachek second by Amundsen. said recommendation was placed on file. A communication signed by the Street and Alley Committee and the City Engineer recommending that Third Street Northeast east of Sixteenth Avenue Northeast be extended approximately 200 feet east and that a plat be prepared and submitted to the Council for approval, was read and upon motion by. Amundsen second by Mrachek the said recommendation was approved and ordered filed, the owner of property to be notified. The license bond of Lyle W.Edgerton, in the sum of $1,000.00 with the Fideli & Casualty Company as surety; of the Rochester Electric Company in the sum of $1,000.00 with the United States Fidelity & Guaranty Company as surety; of Vincent Huyber in the sum of $1,000.00 with the Aetna Casualty and Surety Company as surety; and ofObedd ah S.Cummens in the sum of $1,000.00 with the Unite States Fidelity and Guaranty Company as surety, were each read,. and upon motion by Amundsen second bey Green, said bonds were approved, the sureties thereon accepted and it was ordered that the same be placed on file. ty 494 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., March 4.19 4 o The rider extending the anliversary date of schedule bond 4369319 of the Fidelity and Deposit Company, in favor of the City of Rochester, Board of Park Commissioners to April 9th,194o, was read and upon motion by Amundsen second by Green the said rider was accepted and ordered filed. j The contract bonds of Wm.C.Fraser & Son, with the United States guarantee Company as suretyt?y thereon in the sum of $595.00, and $976.58, respectively, were each read, and upon motion by Amundsen second by Green, the said bonds were approved, the surety -thereon accepted and it was ordered that the same be placed on file. The application of Pittsburgh -Paint Store for a permit to place and maintain a sign, was read 'and upon motion by Amundsen second by Moody, permit was grant ed. The application of Harold A.Witzke for a license to sell soft drinks was read and upon motion by Green second by Lhrache'k license was granted. !I Applications signed by Mrs.Verla DeWitt, and John Holland for solicitorts licenses, were each read, and upon motion byGreen second by Amundsen, licenses ;! were granted subjiect to a rdinanc�i. The application of John Benes for mOff sale license to sell non -intoxicating malt liquors was read and upon motion by Green second by Amundsen, license I� was granted. The application of the Mankato Brewing Company for an off sale license to sell non -intoxicating malt liquors, was read and upon motion by Green i; second by Amundsen license was granted. The application signed by Harold Witzke and H.L.Thurber for transfer to flit zke of on- sale' License No.313 and off sale license No.506 for selling non -intoxicating malt liquors, was^ read, and upon motion- by Moody second by Amundsen,' licenses were trar_sfered. The application of Andrew C. Chafouliae for an Off Sale liquor license, at No.6 North Broadwhy, together with a communication offering to submit the United States Treasury Bond in the sum of $1,000.00 in lieu of a surety bond, were each read, and upon motion by Green second by Amundsen, the license was granted &nd the U.S.fireasury bond accepted in -lieu of the surety bond. jt } i Record of Official Proceedings of the Common Council of the City of Rochester, Minn., March 4 ,19 40 . 495 for Off Sale Liquor licenses, Applications/signed by Robert P.Kennedy, Christ Margellos, Joe Wallace, Emanuel Kostakes, R.M.Graen, and Leo A. Huey, each having a surety bond in the sum of $1,.000..00 each with the Western Surety Company as surety thereon, and the application of Hazel V.Kitzman together with a surety bond in -the sum of $1,000.00 with the Fidelity and Deposit Company of 1.1aryland as surety, were t < / , each read, and upon motion by Green second by Amundsen, licenses were granted, t t S the bonds approved, the sureties thereon accepted, and it was ordered that the same be placed on file. An invitation from Donald D•Miiurray Manager of the Mayo Civic Auditorium to the Common Council to attend the first anniversary.program at the Auditorium March llth, 1940, was read, and upon motion by Williams second by Mrachek the invitation was accepted and ordered placed on file. A report from the Police Committee and the Mayor regarding the parking on First Avenue Southwest from Fourth Street to Sixth Street Southwest was read and President Lemmon ordered that the same be.placed on,fil.e. Alderman Green introduced an ordinance amending an ordinance for the purpose of promoting health, safety, order, convenience and general welfare by regulating the use of land, height of buildings, and the, arrangement of building lots and the density of population within the City of Rochester, Minnesota, all t in accordance with a comprehensive plan, the same being.ordir_ance No.558, as t amended by Ordinance No.560, which was given its.first reading.. Alderman Williams introduced a resolution-autho.rizing.the Public Utility Board to enter into contract with the American Cast Iron Pipe Company for the furnishing of 3200 ft. 6" pipe, and 960 ft. 41' pipe, 1537 pounds 6" fittings, `and $394 pounds 411 fittings, for a total contract price of $3301.1-7, which was read. Upon motion by Green second by Williams, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon decla red the said resolution duly passed and adopted. Alderman Williams introduced a resolution appropriating $j,000.00 from the Street and Alley Fund, and $1,000.00 from the Sewer'Fund,' foruse of the' Street & Alley Committee, which was read. Upon motion by Williams second by Amundsen that the said resolutiontbe adopted as read, and all voting in favor thereof, President Lemmon declared the said re.solution duly passed and adopted. Upon motion by Mrachek second by Williams that the said resolution be ,I adopted as read, and all voting in favor thereof, President Lemmon dellared the said resolution duly passed and adopted. Alderman Williams introduced a resolution granting public dance permit to i the Central Labor Union for the Woodman Hall, February l0t-h, 17th, 24th, and March 2nd, 1940, and fixing the fee at $12.00, which was read. it Upon motion by Green second by Amundsen that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the. sai d r, resolution duly passed and adopted. i c The following communication was read, and President Lemmon ordered that the same be placed on file: "Hon.,Mayor & Common Council Gentlemen: I herewith submit approximate estimate of cost for road oil and asphalt that will be required for the year 1940. 150,000 Gal. Road Oil @ 4-A cents per gal. $ 71.25.00 100,000 Gal. Asphalt @ 5� cents per gal. $ 5500.00 Respectfully Arleigh C.Smith, City'Engineer." Alderman Mrachek introduced the following resolution, which was read: "WHEREAS, The .Common Council of the City of Rochester, Minnesota, deem it expedient and necessary that road oil or other bituminous material be applied on various streetd and avenues of the City of Rochester as a dust preventive during the 1940 season, said oil and bituminous materials to meet the Minnesota State Highway Department required specifications, and i` ,WHEREAS, The City Engineer of said City has submitted an estimate of 15,000 gallons road oil at 4A cents per gallon and 1OQ000 gallons asIbhalt at 52 cents per gallon, as being the approximate requirements,- and has submitted an estimate of the cost for said road oil and asphalt, NOW THEREFORE, Be it and it is hereby resolved by the Common Council of the City of Rochester, Minnesota: That the City Clerk of said City be and he is hereby authorized and directed to advertise for sealed bids for the furnishing of the seasons supply of road oil and other bituminous materials, to be delivered, as, if and when needed by the City Engineer's Department, said bids to be received and opened at a rAeeting of said Common Council, which is to be held at 7:30 o'clock P.M., on March 25th,1940. Upon motion by Fryer second by Green that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. ` Alderman Mrachek introduced a resolution appropriating $301.95 from the General Fund and ordering payment rude to the City of Rochester Steam Department i� !; for steam furnished at the City Hall in accordance with billing of February f f f < 28th,1940, which was read. , Upon motion by Green second by Amundsen -that the said resolution be adopted li as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Upon motion by Amundsen second by `ilachek that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Mrachek introduced a resolution appropriating $24-75 from the Gener Fund, $2.00 from the Street and Alley . Fund, and $3955- 93 from the Lighting Fund, for electricity'•furnished for lighting public streets and grounds, in actor ante with billings of February 25th,1940, which was read. Upon motion.by Green second by Moody that the said resolution be adopted as.read, and all voting in favor thereof, President Lemmon declared the said. " resolution duly paased-and adopted. Alderman Moody introduced a resolution appropriating $372.35 from the Street and Alley Fund and ordering payment made to the Street and Alley Fund, for uas of equipment during February, 1940, which was read. 0 Upon motion by Mrachek second by.17illiams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $264.70 from the Street and Alley Fund and ordering payment made to the Street and Alley Fund for(use.of equipment)during December, 1939, which was read. Upon motion by Green second by Fryer that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the seid resolution duly, passed and adopted. Alderman Moody introduced a resolution appropriating $299.60 from the Street and Alley Fund and ordering payment made to the Street and Alley Fund, for use of equipment during January, 194o, which was read. Upon motion by Williams second by Amundsen that the said resolution be adopted as read, and all voting in favor. thereof, President Lemmon declared the f t said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $591.50 from the Street and Alley Fund and ordering�ayment made to the Street and Alley Fund, for use of equipment during December, 1939, which was read. Alderman Green introduced a resolution appropriating $340.75 from the Sewer Fund and ordering payment made to the Street and Alley Fund, for use of equipment during°February,1940, which was read. Upon motion by Amundsen second by Green that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. q < Alderman Green introduced a resolution appropriating $1676.23 from the Park Improvement Fund and ordering payment made to the Mayo Trust Fund, for I, j payrolls for labor during the half month endirig February 29th, 1940, which vas I read. Upon motion by Green second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said Resolution duly passed and adopted. I Alderman Amundsen introduced a resolution appropriating $1533.24 from the Park Improvement Fund and ordering payment made to the Mayo Trust Fund, for I� payrolls for labor during the half month ending February 15th,1940, which was read. Upon motion by Mrachek second by,Amundsen that the said resolution be - adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution appropriating $308.25 from the Park Improvement Fund and ordering payment made to the City of Rochester Steam Heating Department, for steam heat furnished at the Mayo Civic Auditorium per bill of January 28th, 1940, which was read. t - - Upon motion by Green second by Moody that the said- resolution be adopted as -read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced a -resolution-appropriating $396.19 f rom the Park,Improvement Fund and ordering payment made to City of Rochester; Light and Water Departments for electricity and water used at Mayo Civic Auditorium in accordance :pith billings of February 25th, 1940, which was read. Upon motion by Williams second by Amundsen that the said resolut ior_,b e adopted as -read, and all voting in favor thereof, President Lemmon declaredhthe said resolution duly passed and adopted. Alderman Amundsen introduced a resolution vacating the alleys in Block 11 Northern Addition, which was read. Upon motion by Mrachek second by Ivioody that the said resolution be adopted .as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution approving the commercial light rate change requested by a resolution passed and adopted by the Public Utility Board, which was read. Upon motion by Moody second by Fryer that the sai-d resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Quit claim deeds given by Helmuth Reinmund, et al., and Helmuth MT. Brehmer, et.al., to the City of Rochester covering lands for a public alley in Block 11, Northern Addition, were each read, and upon motion by Green second by Williams, said quit claim deeds were accepted and the City Clerk instructed to have the same recorded. A resolution passed by the Rochester Junior Chamber of Commerce on February 26th,194o, was read and President Lemmon ordered that the same be placed on file. The said resolution reads as follows: "WHEREAS: The Rochester Junior Chamber of Commerce is an organization of young business and professional men between the ages of twenty one and thirty five years inclusive; and WHEREAS: The great objective of the Rochester Junior Chamber of Commerce is to 'inculcate civic conciousness in its•members and provide an avenue for'the type of activity that conciousness will induce'; and, WHEREAS: It is the further purpose of the Junior Chamber to improve and develop this community and to improve and develop its individual members so that they may be better qualified for the type of civic leadership that will build this community and increase its civic assets; and, WHEREAS:� The Junior Chamber eadeavors to provide a spark plug for the general civic welfare; and WHEREAS: The Honorable Mayor and the members of the Common Council of the City of Rochester hav6 during the past year giver_ unselfishly of their time and energy in order that they might provide us viith an energetic,lionest and con— scientious government of which we may 'all be justly proud; and, WHEREAS: They have recognized WHEREAS: Rochester Junior`Chamber of Commerce as an organization interested, like themselves, in the promotion of the general ' civic welfare; and, 500 Record of Official Proceedings of the Common Council of the City_ . of Rochester, Minn., Mach �-, 1940. WHEREAS, They have seen fit to appoint to positions of public trust several of -our members; and - - • WHEREAS: They -have -at -all times willingly and -wholeheartedly cooperated with us and -assisted us in the various projects which we have undertaken in and_ effort to develop better citizens in a greater Rochester; 'and; WHEREAS, much that we have undertaken-whuld have been impossible but for the co'operat ion and assi stance,whi ch they have given us; N0W.THEREFORE; We, the members of the Rochester Junior Chamber of Commerce do -hereby publicly acknowledge and thank the Honorable Mayor and the members of the Common Council for splendid leadership and government which they t t have given Rochester during the past year; for the recognition they have given our organization as one dedicated to the -improvement and development of Rochester - one anxious to provide it crith competent, capable, unselfish, honest and inspired leadership in -the future; and for the cooperation and assistance which they have given us in the projects which we have undertaken to promote the general civic welfare of the City of Rochester. Upon motion by Williams second -by Amundsen, 111arch 20th, 1940, at 7 : j0 i o'clock PwM., was fixed as the time for a meeting with the Highway Department if convenient.
