i� Minutes of an -:adjourned regular meeting of the Common Council of the City
i of Rochester, .Iinnesota, held.in the Council Chambers, in the City Hall, in
said City,. on March 13th, lo4o.
I President Lemmon called the meeting to order at 7:30 o'clock P.M.., the
following members being present: Lemmon_, Amundsen, Fryer, Green, Moody,
jMrachek, Williams. Absent: None. ,
Upon motion by Moody second by Amundsen, the minutes of the meeting held
,:,March 4th, 1940, were approved.
A. H. Clemens appeared in the interests of the Rochester -Bus Line, Inc.,
� and presented and explained -a proposed ordinance authorizing said Rochester
:Bus Line, Inc. to establish, conduct and maintain and operate bus lines in the
City of Rochester.
:i Alderman Williams introduced an ordinance authorizing the Rochester Bus
'Line, Inc., its successors and assigns, to establish, conduct, maintain and
operate bus line or bus lines, through, over, upon and along the streets and
avenues in the City of Rochester, Olmsted County, Minnesota, which was given
its first reading.
Upon_ motion by Fryer second by Amundsen, and all voting in favor thereof,
jthe rules were suspended and the said ordinance was given its second reading.
I Upon motion by Moody second by Williams, and all voting in favor thereof,

the rules were suspended and the said ordinance was given its third and final
!' reading.
Upon motion by Moody second by Fryer, that the said ordinance be adopted
'E as read, and all voting in favor thereof, President Lemmon declared the said
ordinance duly passed and adopted.
Upon motion by Amundsen second by Moody, the rules were suspended and
,an ordinance amending an ordinance for the purpose of promoting health, safety,
order, convenience and general welfare by regulating the use of land, height of
!tlbuil dings, and the arrangement of building on lots and the density of popula—
I tion, within the City of Rochester, Minnesota, all in accordance with a
comprehensive plan, the same being ordinance No.558, as amended by ordinance
130.560, it was given its second reading, all voting in favor thereof; sand
ordinance having been introduced and given its first reading on March 4th,194o.
Upon motion by ',�rloody second by Mrachek, and all voting in favor thereof,

the rules were suspended and the said ordinance was given its third and final

reading.

Upon motion by ?Moody second by Amundsen, that the said ordinance be adopted
as read, and upon roll call all voting in favor thereof except Alderman Fryer
who voted "No", President Lemmon declared the said ordinance duly passed and
adopted.

Communications from the Secretary of the Firemen's Relief Association,
requesting the approval of the Council to an investment of �3020.54 in State of
Minnesota, Rural Credit Bonds bearing interest at 13%,°and requesting approval
of action b"y the said Firemen's Relief Association in' giving Mrs. Conger a
first mortgage on her property in place of a contract for..deed, said first
mortgage to bear interest at 6 o computed 'semi-annually, were each" read, arid
President Lemmon referred the'same to the Finance Committee.
An incitation from the League of Minnesota Municipalities for employes
to attend the University Center for Continuation study, for short courses
for waterworks operators, plumbing inspectors, and sewage plant operators the
week of March 25th,1940, was read, and upon motion by Moody second by Amundsen,
the` Chief Operator at the' Sewate Disposal Plant was' authorized to attend this
(course at the expense of the City of Rochester.
An emergency authoriza#ion given by the Mayor to the City Clerk for the
purchase of a car load of gasoline for the Bulk' station, was read, -and Rpon
motion by 1drachek second by Moody, said action was approved and it was ordered
that said emergency authorization be placed on file.
A communication signed by the president and secretary of the Edison
Parent Teacher Association, opposing; slot machines, pin ball machines, and
similar devices in the City of Rochester, was read, and upon motion by Green
second by Amundsen it was ordered that the said communication be placed on file:
Upon motion by Moody second by Williams, IIIarch 25th,1940, at 7:30 o'clock
P.M. was fixed as the time for a hearing on the subject of said pin ball machines,
at w.nich time any one interested m`a`- attend and express themselves on the
subject, and the City Clerk w`as instructed to invite the two new aldermen to
attend said meeting.
The application of Foster Electric Company, fo'r an electrical contractor's
license, was read, and upon motion by Fryer.second by Amundsen, license was

granted.
The application of Ray Niles for a license to sell 'soft drinks, was read
and upon motion by Greer_ second by r,Trachek, license was granted.
The application of the Marcell Shop for a permit to place and maintain
a sign, was read, and upon motion by Amundsen second by I+frachek, permit was
granted.
The application of J.A.Peterson for a master electrician's license, was
read, and upon motion byIMrachek second by Williams, license was granted.
The application of A. Madenberg for a solicitor's license, was read,, and
upon motion by Green second by Amundsen, license was granted, all voting in
favor thereof, except Alderman Williams, who voted "'_`do."

The license bond of Sam Lumelsky, in the sum of $1,000.00 with the United
States Fidelity & Guaranty Company as surety, and the license bond of John
Morrison, in the sum of $1,000.00 with the Employers Liability Assurance
Corporation as surety, were each read, and upon mot}on by Moody second by
Green, the said bonds were approved, the sureties thereon accepted and it was
!,ordered that the same be placed on file.
The report of the Clerk of the ^Municipal Court for the week ending
:March llth,1940, shoring criminal fines and costs collected $260.00, civil
'fees received $2.60, and conciliation court fees received $11.25, was read,
;and having been previously approved by the City Attorney, President Lemmon
ordered that the same be placed on file.
Petitions, signed by Geo.M.Alseth, 0.1. .Rucker, 1M.E.Olson, and Edw.H.Coon,
asking that the sanitary sewer and water main in Sixth Street Southwest, be
I`extended from 500 feet east of Fourteenth Avenue Southwest to 720 feet east,
i,were each read; also a petition signed by Kenneth Renaux, evelyn�E.Funk, and
Walter. King, that a sanitary sewer be constructed in Tenth Street Southeast from
;Eighth Avenue to 170 feet east; and a petion signed by Elmer Lee and Christopher

Graham, asking that a sanitary sewer be constructed in 10a Street Southeast,
from First Avenue Southeast to 290 feet east, were each read.
Upon motion by Moody second by Williams, the above petitions were
referred to the Sewer Committee and the City Engineer, for a report and
recommendation, at the meeting to be held March 25th,1940.
The report of the Finance Committee stating that they had checked the
-reports of the Building and Plumbing Inspector, the Electrical Inspector,'
and the City Weighmaster, for the month of February , 1940, and found the same
to be correct, was read, and upon motion by Green second by Moody the said
Committee report was accepted.
The redommendation of the Finance Committee that the Council approve the
action of the Firemen's Relief Association in giving Mrs. Congor a first

Fryer, said report was' accepted, and the action of the Firemen's Relief
Association approved.
The recommendation of the Finance Committee that the Council approve
an investment by the Firemen's Relief Association in Minnesota, Rural Credit
Bonds, was read, and upon motion by Mrachek second by Amundsen, the said

Alderman Amundsen introduced the following resolution, which was read:
"WHEREAS, By resolution dated October 24th,1932, the Public Utility Board of
the -City of Rochester, Minnesota, was authorized to pay 100 of the gross income
from the operation of the Light and Grater Departments of said City into the City
Treasury for general taxation purposes, and
, HE_REAS� In determining the amount of the 1939 tax levy, the distribution
of said income tax,to the various funds of said City was taken into considera-
tion;
t NOW THEREFORE, Be it and it is hereby resolved by the Common Council of the
City of Rochester, Minnesota:
That- beginning with the January 31,1940 payment of said income tax and
continuing for a period of twelve months, the distribution of said tax shall be
9% -to the Public Health and Welfare Fund, and 91% to the General Fund; the said
91% to be distributed to the following codes in the following percentages;
24 to Code 1, 17% to Code 6, 5 to Code S, and 45% to Code 18. "
Upon motion by Green second by Amundsen that the said resolution be adopted

resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $205.s5 from the
General Fund and ordering payment made to the Rochester Post -Bulletin, for
official publications and printing during February,1940, which was read.
Upon motion by Mrachek second by Moody that the said resolution be adopted
las read, and all voting in favor thereof, President. Lemmon declared the sai d
resolution duly passed and adopted.
Alderman Williamd introduced a resolution appropriating $346.05 from the
Park Improvement Fund and ordering payment made to the City of Rochester, Steam
(Department, for steam furnished at Mayo Civic, Auditorium, in accordance witk

Upon motion by Amundsen second by Moody that the said resolution be adppt'ed

Alderman Mrachek introduced a resolution granting public dance permit to
;Dale Hess for the Armory, March 9th,1940, and fixing the fee at $3.00, which
was read.
Upon motion by Moody second by Mrachek that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Green introduced a resolution granting public dance permit to
the Central Labor Union for the Roodman Hall, March 9th,1940, and fixing the fee
at $3.00, which was read.
Upon motion by Moody second by Mrachek that the said resolution be .adopt ed
as read, and all. voting in favor thereof, President Lemmon declared the said ,
resolution duly .passed and adopted.
Alderman Green introduced a resolution appropriating $9590.00 from the
Fire Protection Fund and ordering payment made to the Cit§ of Rochester, Water
''Department, for fige hydrant rental, on 479 hydrants,during the official year
ending March 31,1940, which was read. ;
Upon motion_ by Green second by Moody that the said resolution be adopted

j Alderman Green introduced a resolution appropriating $105.00 from the
E Interest Fund and ordering payment made to the First National Bank of Rochester,
for the march lst,1940 matdrity of interest on City 6f Rochester 3% Repaving
! -Bonds Nos.29 to 35,inclusive, which was read.
Upon motion by Williams second by Moody that the said resolution be -adopted
as read, and all voting in favor thereof, President Lemmon declared the said
i, resolution duly passed and adopted.
Alderman Fryer introduced the following resolution, which was read:
"Be it resolved by the Common Council of the City of Rochester, Minnesota:
' That the following sums s,re hereby appropriated from the Funds stated and
';ordered paid to the funds stated for the'purposes mentioned:
$966.64 from Code 19 of the General Fund, to Code 26 of the General Fund,
ito take up overdraft in said Code 26,for the purchase of land for public purposes;
$3,000.00 from Code 1 of the Street and Alley Fund, to Code 2 of the Street
& Alley Fund, to take up overdraft in said Code 2, and make funds available for
repairs to paving and curbing;. <
$142.53 from Code 4 of the Sewer Fund, to' Code 11 of the Sewer Fund, to
take up overdraft in the said Code 11 of the Sewer Fund;
$109.55 from Code 1 of the Bridge Fund, to Code 3 of the Bridge Fund, to

Upon motion by Williams second by T4rachek that the said resolution be
(adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution -duly passed and adopted.
Alderman Amundsen introduced'a resolution appropriating $333.94 from the
Park Improvement Fund and ordering payment made to A.D.Reynolds, Collector of
Internal Revenue, for amusement taxes collected at Mgyo Civic Auditorium
February 20th and 21st, for the Ice Vanities of 1940, which was read.

Upon motion by Fryer second by Amundsen, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Amundsen introduced a resolution designat_ingnstreets and avenues
to be sprinkled and/or flushed, and sprinkled and/or oiled during the season of
1940,,determining to assess a part of the cost and expense of said sprinkling
and/or flushing, and/or oiling, and determining the rate per front foot for
said assessments; and fixing 7:30 o'clock P.M., on March 25th,1940, as the time
f.o.r. a' -hearing on the said sprinkling and/or flushing, and/or oilingt which was
read.
Upon motion by Mrachek second by Williams that the said resolution be adoptei
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted. Y
Alder4an Williams introduced a resolution ordering advertisement for pro-
posalt for being designated as city depositories during the official year
commencing April 1,1940, said bids to be received and opened at 2:00 o'clock
P.M.,.on April lst,1940, which was read.
Upon motion by Williams' second by Moody that the said resolution b e
adopted as. read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted-.
A1d'erman Williams introduced a. resolution ordering advertisement' for bids -
for doing the -official printing and publications during the official year
commencing April 1, 1940, said bids to be received and 'opehed at 2•:00. o'clock
P.M., on April 1,1940, which was read.
Upon motion by Williams second by Moody that the said resolution_ be - adopted
as' read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman` Williams introduced. an ordinance to"Amer_d- an ordinance regulating
traffic, the operation and parking of vehicles, the use of stpeets for driveway
entrances, and designating arterial highways in the City of Rochester, Minnesota,
the same being ordinance do.499", whichc was 'given its first readingi.

Alderman Williams introduced the following resolution, which was read:
"Resolution amending a resolution entitled,
i Resolution for construction of lateral connections in`
part of Sixth Street Southwest and First Avenue South-
west, and passed by the Common Council of the bity of
Rochester, Minnesota, on February 5,1940, and approved
by the Mayor of said City February 6,194o.
Be it and' it ` is hereby resolved by the Common Council 'of the City of
Rochester, Minnesota, that a resolution entitled 'Resolution levying special
assessments for construction of lateral connections in part of Sixth Street
Southwest and First Avenue Southwest, dated February 5, 1940, and approved on
February 6,1940, be and the same is hereby amended so as tb read as follows:

That the said Common Council does hereby assess and levy upon and against the
several lots and parcels of land described below and situt.ted in the said City
,;the respective sum of money set opposite to the description herein of each said
lot and parcel:
This assessment is made to d6fray h part of the cost and expense of the
construction, under P.W.A.Docket No.1515-F, of lateral connections to the curb
line on Sixth Street Southwest from Broadway Street South to Second Avenue
Southwest, and on First Avenue Southwest from Fifth Street Southwest to Sixth
,Street Southwest, according to contract for said lateral connections entered
Tinto by said City of Rochester, with Martin Paulson, which contract is on file
din the office of the City Clerk of said City.
Said lots and parcels of land are assessed ratably according to the special
benefits derived from said lateral connections without re,ard to cash valuation;
and said Common Council does hereby adjudge and determine that the amount levied
upon and against each lot and parcel of'land described below, is the amount of
,'special benefits derived by each said lot and parcel of land from said improve-
' went .
Be it further resolved by said Common Council: That each of said assessments
!against each lot or parcel of land shall be payable in ten (10) equal annual
installments, and one of said installments shall be due and payable on or`before
the first day of June each year hereafter, with interest on all deferred in-
stallments payable semi-annually at the rate of five (5) per cent per annum
until the same are fully paid, as. provided by the Charter of said City; provided
that any of said assessments may be paid at any time.

Be it further resolved by said Common Council, That Edith Rommel, Frank J.
Rommel and Tillie Rommel, his wife, Chas`. E.Gates and TIaggie C.Gates,his Wife,
and Mark D.Mattson, or their assigns, are hereby granted permission to use the
laterals above described and connect any of Lots one (1) to five (5), inclusive,
in Block One (1), Original Plat of the City of Rochester, Minnesota, in First
Avenue Southv est, from Fifth Street* Southwest to Sixth Street Southwest.
That there is to be no assessment levied against,said lots or any piece or
parcel thereof abutting on the said lat,erals unless and until some of the said
lots or any piece or parcel thereof shall be connected with the said laterals,
but at the tine that the said Edith Rommel, os any of the owners or their assigns
mentioned above shall connect any part, piece, lot or parcel of the above men-
tioned lots or parts thereof wiih said laterals, they shall pay to the said City
of Rochester, Minnesota, at the time of making of such connection or connections,'
a sum computed as follows: A sum equivalent to the number of lineal feet
abutting on the said laterals and owned by the parties desiring to connect with

Upon motion -by Williams second by Fryer that the said resolution be adopted
as read, and all voting in favor thereof, President Lgmmon declared the said
-resolution duly passed and adopted. ,
-Upon motion,by•Green second bN Fryer the City Attorney .was given authority
to appeal -the Armstrong case.,
The matter of printing a new,ordinance book wassrefgrred to the
Purchasing Committee. , •
Alderman Williams,submitted recommendations regarding license applicatfors,
fees, -etc.:, and upon motion by Williams second by Amundsen the said,recommed&a-
tions were ad6ptad.
- The City Attorney having -been instructed by the Council on Fetruary tth,
1940, to draft an ordinance with the view of curtailing -the promiscuous sale o£
prophylactic rubber goods, reported that in his wonsideration'of such an
ordinance he found that the matter is govorned by State Laws:and the State
Board of Health, and therefore he did not recommend •that •the Council pass, such
an ordinance. Upon motion by Green second by:Williams the City Attorney s
recommendation was -accepted and no further action t,ken.
The following claims were read, and uponmotion by Fryer second by Amundsen
the same were allowed and the Mayor and City Clerk were instructed to draw
warrants upon the City Treasurer'and,make payments accordingly:,
