April 1,� 1940 . 52 Minutes of a regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City, on April lst,1940. President Lemmon called the meeting to orderat 2:00 O'clock P.M., the following members being present: Lemmon, Anderson, Bowers, Moody, Mrachek, Williams. Absent: Amundsen. Upon motion by Williams second by Moody the minutes of the meeting of March 25th,1940, were approved. The Mayor addressed the Council and complimented them on the work done during the past year and welcomed Mr. Anderson and Mr. Bowers, the new members of the Council, and also announced his appointments to various Boards. Upon motion by Mrachek second by Williams the resignation of T.M.McDonnell as a member -of -the Board of Park --Commissioners due to the fadt that he had moved to another section of the City, was accepted. Upon motion by Moody second by Williams the appointment by the Mayor of Dr.Louis A.Brunsting as a member of the Board of Park Commissioners for the First Ward for a term of t4i- a years, of Lester Fawcett f,or the Second Ward for the unexpired term of T.M.14cDonnell resigned, and of James O'Connor for the F5 Record of Official Proceedings of the -Common Council of the City of Rochester, Minn., Ap r i l 1, 19 40. Third Ward for a term of years, were each approved. Upon motion by Moody second by Mrachek the appointment by the Mayor of G.O.Lohse as a member of the Public Utility Board, was approved. Upon motion by Moody second by Williams, the appointment by the Mayor of F.F.Palen as a member of the Board of Public Health and Welfare was approved. Upon motion by Mrachek second by Williams the Mayor's appointment of Harold Steward as a member of the Police Civil Service Commission was approve:. Upon motion by Bowers second by Mrachek the appointment by the Mayor of Oscar Hargesheimer to the Board of Zoning for the unexpired term of Dr. Higgins who resigned, and the appointment of H.E.Whiting as a member of said Zoning Board, were each approved. Upon motion by Mrachek second by Williams, the appointment by the Mayor of Peter Donovan as City Weed Inspector,was approved. Upon motion by Williams second by Moody Leo C.DeVilliers was reappointed as a member of the Firemen's Civil Service Commission. Alderman Mrachek introduced the following resolution,which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the said Common Council of the City of Rochester,Minnesota, hereby adopts the following rules and regulations for the order of business of said Common Council: 1. Roll Call. The roll call of th4 Common Council shall be had and taken in its alphabetical order according to the, names of t-he members, except that the name of the President of the Common Council shall be called only at the first roll call of each meeting and then after that,• at that meeting, only in case of a tie vote when his name shall be called and vote taken after the expression of each of the other members of said Common Council. 2.' Reading and approval o•f the minutes of the preceeding meeting. 3. At first meeting, the appointment of officers and committees. Public -Hearings.. 5. Reading of petitions and communications) 6. Report of committees.- All reports of committees shall hereafter be made in writing, unless ordered otherwise by said Common Council. 7.. Unfinished •business. g. Resolutions and ordinances. 9. " Upon motion by Bloody second by Anderson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resoltit ion duly passed and adopted. ,Alderman'Williams introduced the following resolution,which was read: - a - "WHEREAS, It i,s. ,deemed expedient and necessary that the Common Council of the ' . Record of Official Proceedings- of the Common Council of the City of Rochester, Minn., April 1.,19 4o . 529 Upon motion by Williams second by Moody that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said -resolution duly passed and adopted. The applications.of Walter C. Hogenson and Arleigh C.Smith for appointment as City Engineer were each.read. A motion by Bowere seconded by Anderson, to appoint Walter C.Hogenson as City Engineer for the ensuing official year lost by the following vote: Ayes: Anderson, Bowers., No:.Moody, Mrachek Williams. Upon motion by Williams seconded by Moody Arleigh C.Smith was appointed City Engineer for the ensuing official year, all,voting in favor thereof, except Alderman Bowers, who voted "No." The application of.Irving L.Eckholdt for reappointment as City Attorney was read, and upon motion by Mrachek second by Moody Irving L.Eckholdt was appointed City Attorney for th-e ensuing official year, -all voting in favor thereof. The application of F.R.Finch for reappointment as City Clerk was read, and upon motion by Moody second by Williams, F.R.Rinch was appointed City Clerk for the ensuing official year. The applications of Edw..E.Zuehlke and Henry A. Mourning for appointment as Building and Plumbing Inspector for the ensuing official year, were each read. Upon motion by Mrachek second by Williams action on the above applications for appointment as Building and Plumbing Inspector was deferred until April gth, 194o. The applications of Lyle E.Pike 'and Mat E. Walz for appointment as Electrical Inspector were each read, and upon motion by Bowers second by Williams action on these applications was deferred until the meeting to -be held on April gt h, 1940. Applications signed by C.A.Cottingham, W.W.Thompson, and O.J.Anderson, for appointment as City Weighmaster, dare each read, and upon motion by Mrachek second by Bowers C.A.Cottingham was appointed City Weighmaster for the ensuing official year. The application of Janice Ellringer for appointment as stenographer in the office of -the Social Welfare Worker and the Judge of the Municipal Court was read, and upon motion by Williams second by Moody Janice Ellringer was duly appointed Stenographer in the said offices for the ensuing official year. The application of Grayce L.Lee for for appointment as Stenographer in the off -ice of the Building and Plumbing Inspector.and the Electrical Inspector was read, and upon motion -by Anderson second by Bowers Grayce L.Lee was reappointed Stenographer in the said offices fox the ensuing officia 1 year. 530 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., Ap r i 1 1,19 40 . The application of Flora C.Anderson for appointment as stenographer for the Mayor, Chief of Police and,City Attorney, was read, at which the Mayor requested that he be permitted to appoint his own stenographer. Upon motion by Bowers second by Moody the Mayor's request -was granted, all voting in favor thereof except Alderman Anderson who voted "No." The applications of Henry C.Lindberg and Joseph J.Schuster for appointment as assistant custodians of the City Hall were each read, and upon motion by ✓ Moody second by Anderson, Joseph J.Schuster and Henry C.L-indberg were appointed assistant custodians of the City Hall during the ensuing official year. The application of Otto R.Tornow for appointment as one of the assistan$ superintendents at the Dumping Grounds, and the application of Peter D.Claude for appointment as Assistant superintendent of -the Dumping grounds and the application of Paul Dornack for appointment as second assistant superintendent of the dumping grounds, were each readl A motion by Alderman Bowers that Otto R.Tornow be appointed as Assistant accordingly Superintendent of the Dumping Grounds received no second and/President Lemmon declared the said motion out of order. Upon motion by Williams second by Moody,Peter D.Claude was appointed assistant superintendent of -the dumping grounds -for the ensuing official year, all voting in favor thereof, except A18erman*Bowers who voted "No.1' Upon motion by Williams second by Mrachek,Paul Dornack was appointed second assistant superintendent of the Dumping Grounds for the ensuing official year. Upon motion by Moody second by Williams, C.E.Ginther was appointed Fire Warden of the City of Rochester, for the ensuing official year. President Lemmon stated this as being the time and place.set for a hearing on the construction of curb and gutter on Second Street Southeast from Eleventh Avenue Southeast to Thirteenth Avenue Southeast, and asked if,any one present wished to be heard concerning the -said improvement. No one present wished to be heard. President Lemmon stated this as being the time and place set for a hearing on the construction of a sanitary sewer and water main in.Sixth Street Southwest from 500 feet east of Fourteenth Avenue Southwest to 720 feet east, and asked if any one present wished to be heard concerning the said improvement. No one present wished to be heard. President Lemmon stated this as being the time and place set for a hearing on the construction of a sanitary sewer in 101 Street Southeast, from First Avenue Southeast to 260 feet east, and asked if any one present wished to be heard concerning the said improvement. There was no one present who wished to said sanitary sewer. be heard concerning the Record of Official Proceedings of the_ Common Council of the City of Rochester, Minn*., April 1, 194o. 532 O- Y President,Lemmon stated this as being the time and place set for a hearing on the construction of a sanitary s ewer in Tenth Street Southeast from Eighth Avenue Southeast to 170 feet east, and asked if any one present 'wished -to -be heard concerning this - improvement*. No one present wished to be heard. E.M.ftaetz, W.H.Ford, Joe Bear, Mr.Turner, each appeared before the Council urging careful•consideration in selection of an electrical inspec'tor,and recommending reappointment of Mat E.Walz to said office; Mr.Raetz recommending only that the present type of inspection be continued. `hiss Agnes Hoffman appeared before the Council *in regard to the regiring of her house while remodeling same, Mat E.Walz, Electrical Inspector, spoke in defense of his requirements on said job. A motion by Bowers second by Moody darried that the above':mentioned Hoffman job be inspected"by the Mayor, Council, City Attorney, Electrical' Inspector, and the State'Electrical Inspector and contractor.' Upon motion by Bowers second by Anderson further action on the appointment of an Electrical Inspector was deferred for. one week. A communication presented at the meeting held March 25th,1940, from the Non -intoxicating Malt Liquor Beverage Dispensers Association of Minnesota, was considered at this time. A-'-petition.'-signed by 25 retail grocers operating,retail stores, asking that no change be made in the present ordinance governing the'sale of non-intoxicati malt" liquors was read."" After considerable discussion on the subject of selling non -intoxicating malt liquors off -sale, Alderman -'Williams brought up the fact that all off -sale should be sold in the original package, and a number of the beer dealers present asked for an explanation of the law, which was read to them by the City Attorney; the City Attorney reading the law on both hard liquor and 3.2 beer off -sale. Upon motion by Williams second by Mrachek it was ordered -that both of the above petitions regarding off -sale 5.2 beer be placed on file. The City Clerk reported that no proposals had been received for doing the official printing during the ensuing official year, and President Lemmon referred the matter to the Finance Committee. ,The City Clerk reported that no proposals had been received for being designated City depositories, and upon motion by Moody second by Williams, the City Clerk was instructed to readvertise for proposals for depositories, said bids -to be opened at 7:30 o'clock P.M., on April gth,1940. The appointment by the City Assessor of Tim"K.Puryear as Deputy Assessor for a period of"one year-, Adolph uruszynski for a period of approximately five months, and John Sr.Morrison for a period of approximately five months, was read, and upom motion by Moody second by Williams said appointments were approve( Record of Official Proceedings of the Common Council of the City -of Rochester, Minn., The report of the City Engineer for the month of March,1940, showing expenditures for labor from the General Fund $19.23, Street and Allay Fund $2990.99, Sewer Fund $1197.06, was read and Rpon motion by Mrachek second by Moody said report was accepted and ordered placed on file. The report of the Clerk of the Municipal Court -for the.wsek ending . i April 1,1940, showing criminal fines and costs collected $192.30, civil fees received $5.30, conciliation court fees $.50, was read and having been previously approved by the City Attorney, President Lemmon ordered that the same be placed on file. The report of the Electrical Inspector for the month of March,1940, showing electrical permit fees received $34.25, and the report of the Building and Plumbing Inspector for the month.of March,1940, showing building permits - issued $91.00, and plumbing permits $63.75, were each read and President Lemmon referred the same to the Finance Committee. A communication from Arleigh C.Smith,City Engineer, requesting an appropriation of $3,000.00 from the Street and Alley Fund, and $1,000.00 fm m the Sewer Fund, for use of the Street and Alley Committee, was read and i President Lemmon ordered that the same be placed on file. The application of O.S.Cummens for an electrical contractors license, was read, and.upon motion.by Moody second by Williams, the license was granted. The application of C.R..Bowen for a house movers licepse, was read, and upon motion by Williams, second by Moody license was granted. The application of Herman Dornack for a license to connect with sewers and drains, together with a surety bond in the sum of $1,000.00 with the Employers Liability Assurance Corporation as surety thereon, were each read, and upon motion by Moody second by Mrachek, the license was,granted, the bond approved the sureties thereon accepted, and it was ordered that the same be _placed on file. on -sale The applications of the following persons for/licenses to sell non - intoxicating malt liquors were each.read and upon motion by Moody second by Mrachek licenses were granted: Earl Huey,Rochester Chamber of Commerce, Belmont, Florence Tadens & Marie Tadens, George Graen, Harry C.Belmont, Harry C. Be it further resolved by ,the said Common Council: That in the event the above•number.of employees shall not be sufficient to adequately carry on the•work of said department the said•City Engineer,.with the approval oaf the Street and Alley Committee and the Common Council may employ not to exceed an additional 21 men on the hourly basis. Be it further resolved by the common Council of said City: That in case of extreme emergency the City Engineer of said City is hereby authorized to employ such additional help as may be necessary during said emergency.". Wray Eastlick submitted a proposed wage scale to be fixed by the Council as provided for in Ordinance 415, and upon motion •by Anderson second by Williams action thereon was deferred until April 9th,194o. H.C.Bluhm, member of the Firemen's Civil Service Commission, appeared before the Council regarding -desired increases in the salaries of members of the Fire Department, and urged that some increases be made in the said salaries for the ensuing official year. Upon motion by Anderson second by Williams action to fix the salaries for the Fire Department for the ensuing year was deferred until the meeting of the Council which is to be held on April 8th,1940. Upon motion by Moody second by Mrachek the setting of salaries for the Police Department for the ensuing official year was deferred until the meeting of the Council which is to be held on April 9th,194o.
