Minutes of an adjourned regular meeting of the Common Council of the City of ochester, Minnesota, held in the Council Chambers, in the City Hall, in said ity, on April Sth,1940. President Lemmon called the meeting to order at 7:30 o'clock P.M., the ollowing members being present: Lemmon, Anderson, Bowers, Moody., Mrachek, illiams. Absent: Amundsen. President Lemmon announced this as being the time and place set for re£eiving and opening bids for being designated dity depositories. Proposals rom the First National Bank for $200,000.0.0, Union National Bank for $100,000.00, d the Olmsted County Bank & Trust -Company for $50, 000. 00, were each read. Alderman Williams introduced.a resolution designating the First National ank of Rochester, Minnesota, as a city depository in the sum of $200,000.00, he Union National Bank of Rochester, Minnesota, as a city depository in the um of $100,000.00, and the Olmsted County Bank and Trust Company.as a_city epository in the sum of $50,000.00, in accordance with the above mentioned (;proposals, which was read. Upon motion.by Williams second by Anderson that the said resolution be dopted as read, and all voting in favor thereof, President Lemmon declared the aid resolution duly passed and adopted. Mr. Benjamin presented, a proposed new wage scale for adoption by the ouncil under Ordinance No.415,. and suggesting that the maximum hours of work er week be changed in most cases from 44 hours to 40 hours,. and including ljthree new classifications of work. Alderman Moody introduced a resolution fixing the minimum wage scale for killed and non -skilled labor as provided for in Ordinance No.415, at the same ates per hour as last year, and adding thereto the classification of form etters at $.90 per hour, "Grader operators $.95 per hour,and sewer pipe layer t $.85 per hour, with the maximum hours -of employment per week at forty-four ours, which was read. Upon motion by Yiilliams second by Moody that the said resolution be .adopted s read, and all voting in favor thereof, President Lemmon declared the said esolution.duly passed and adopted. Walter Caustin appeared before the Common Council in regard to the salary of the City Assessor. He complimented Mr. LaPlant on -the manner in which the assess- nts are made in the City of Rochester, and stated that he thought. the City sse-ssor's salary should be set at $4000.00 which he estimated would net the ssessor $3500.00 after paying the expense of operating'his own car. He ecommended that the Assessor's salary be raised. Mr. C. C. Rasmussen, Chief Deputy Assessor of St -Paul and Ramsey County lso appeared before the Council and stated that Mr. LaPlant had made many mprovements in the files and records in the City Assessor's office. He also Record of Official Proceedings- of. the Common Council of the. City. of Rochester, Minn.: Apri 1 s .194o . stated that Mr. LaPlant was considered one of the outstanding assessors in the State of Minnesota, and had done very good work in assessing the City of, J Rochester. President• Lemmon stated that reconsideration of action taken a week before could not be done. No further action was taken on� aaid matter. A communication from the Liquor Control Commissioner was,read and President Lemmon ordered that the same be placed on file. The City -Engineer submitted specifications, plans, and estimates of cost '!for'the'construction of the following improvements: A sanitary sewer in 104 Street ,i Southea'st from First Avenue Sotzthe-ast to 260 feet east; a sanitary sewer in Tenth Street' Southeast from -Eighth Avenue Southeast to 170 feet east; and curb and' gutter on Second Street Southeast from Eleventh .Avenue 'Southeast to f Thirteenth Avenue Southeast. A communication from the City Engineer recommending that each -of the 21 ;amen authorized to be employed by his department, vork-21.60 hour per year, was r read, and upon motion by Moody second by Anderson, the said recommendation was approved. The appointment by the City Engineer of Soren Olsen as First ,Assistant City Engineer, Gerald Hutchins, assistant 'city engineer, Anna- M.Drews, bookkeeper j' and privat•e.-secretary, Herman P.Free,mechanic , John J.Cook, Chief operator ''at sewage disposal plant, Edgard Ranfranz and H.M.Pers-ons, assistant operators at sewage disposal plant, was read, and upon motion by Williams second by Moody said appointments were approved. The appointment by the City Clerk of Lillian R.Sveom as City Clerk's Stenographer and Clerk -of Registration, and of Russell Sanders as Second City ;,Clerk's Stenographer and Clerk of Registration, was read, and upon motion by Mrachek second by Anderson said appointments were approved, all voting in favor thereof.except Alderman Bowers who voted "No." The City Engineer's Trial balance for the month of March, 1940, was read and President Lemmon ordered that the same be placed on file. The application of Ralph Fenske for the position of Electrical Inspector was read, and President Lemmon ordered that the same be placed on file. The application of Harold R.Dunnett for appointment as Building,&Plumbing j 'Inspector, was read and President Lemmon ordered that the same be placed -on file. A communication from the Board of Public Health & Welfare making appoint- ments in said department, and recommending salaries to be fixed for the ensuing I official year, was read, and upon motion by Mrachek second by Williams, the said appointments were approved. Record of Official Proceedings of the Common Council of the City of Rochester, Minn* I April s , 19 4o - 545 The report of the Finance Committee stating that they had checked the reports of the Building and Plumbing Inspector, the Electrical Inspector, and the City Weighmast.er for the month of March, 1940, and found the same correct, jwas read, and President Lemmon ordered that the same be placed on file. The report of the Clerk of the Municipal Court for the weekending April St,h, 194o, showing criminal fines and costs collected $399.20, civil fees received $4 ,90, and conciliation court fees $8o50, was read, and having been previously approved by the City Attorney, President Lemmon orderedthat the .same be' placed on file. , The City Treasurer's report as of Md�ch 3>,1940, was read and President Lemmon ordered that the same be ,placed on file. A.`recommendation by the Lighting Committee that fluorescent lighting be installed in certain offices iri the ,City Hall, .was read and upon motion by Williams second by Mrachek the said recommendation was accepted and the matter left with said committee ,with power to act. ,The .annual report of the, Board of Park Commissioners was read, and President Lemmon ordered that the same be placed on file. n The recommendation by the Board of Zoning that H.Dornack be granted a building permit for,improvements on his shop, -was read, and upon motion by Moody second by Bowers the,said recommendation by the Zoni4g.Board was accepted, and the Building Inspector- authorized to issue,said building permit. The,applications of Lillian.A.Doole, Henry Bakker,,Geo.Barbes, and the Snack Shop for on &ale licenses to sell, non -intoxicating malt liquors were each read, tnd upon motion by Moody second by Anderson licenses were granted. The applications of H.J.Wernecke, Lillian A.Doole, RIS.Plaak, Henri Bakker Geo. Barbes, S.H.Arthur West, and the Snack Shop, for off -sale licenses to sell jnon-intoxicating malt liquors, were each read, and upon motion by Mrachek second by Williams, licenses were granted. The application of Chamberlain Brothers for a license to operate a popcorn wagon, was read aid upon motion by Mrachek second by Andekscn, license was granted. ,The application of.Ernest C.Schacht for an On -Sale license to sell intoxicating liquors, together with a.surety bond in the sum of $3,000.00 with the American Surety Company as surety thereon, were each read, and upon motion by Moody second by Williams, the license was granted, the bond approved, the surety thereon accepted and it was ordered that the same be placed on file. Upon motion by Mrachek second by Moody that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Mrachek introduced a resolution adopting the plans, specifications` and estimate of cost for the construction of a sanitary sewer in Tenth .Street Southeast from Eighth Avenue Southeast to 170 feet east, ordering�a'hearing on the said improvement for 7:30, O'clock P.M. on April 29th,1940, and ordering advertisement for bids to be received and opened at 7:30 o'clock P.M., on` April 29th, 194o, which was read. Upon motion by Moody second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said` resolution duly passed and adopted. Alderman Mrachek introduced a resolution adopting the plans, specifications and estimate of cost for the construction of curb and gutter on Second Street Southeast from Eleventh.Avenue Southeast to Thirteenth _Avenue Southeast, ordering a hearing on the said improvement for 7:30 o'clock P.M., on April 29th,1940, and ordering advertisement for bids to be received and opened at 7:30 o'clock P.M.,. on April 29th,194o, which was read. *. Alderman Moody introduced a resolution fixing the fees to be charged by the City Scavenger during the ensuing official year, which -was read. Upo n motion by"Williams second by Anderson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and .a.clopted. Upon motion by Williams second by Moody that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution approving appointments and salaries fixed by the Board of Public Health and Welfare for employes in the said departipent during the e$suing official year, which was read. Upon motion by Mrachek second by Bowers that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution accepting the collateral assignment, etc. of the First National Bank, in lieu of their depository bond, which was read. Upon motion by Williams.second by Anderson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Bowers introduced a resolution accepting the collateral,assignment, etc., of the Union National Bank in lieu of a depository bond, which was read. Upon z)otion by Mrachek second by Moody that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Bowers introduced a resolution accepting the collateral, assignment etc., of the Olmsted County Bank & Trust Company, in lieu of a depository bond, . , which was read. Upon motion by Mrachek second by Bowers that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Bowers introduced a resolution granting public dance permit to Dale Hess for the Armory April 6th,1940, and fixing the fee at $3.00, which was read. Upon motion by Bowers second by Anderson that the said resolution be :adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Bowers introduced a'resolution granting public dance permit to the Central Labor Union for the Woodman Hall, April 6th,1940, and fixing the ,a fee at $3.00, which was read. Upon motion by Williams second by Anderson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Anderson introduced a resolution appropriating $375.00 from the Deposit Fund, and ordering payment made to Leonard W.Benike for refund of license fee dei5osited with application for On -Sale liquor license, which was read. Alderman Anderson introduced a resolution appropriating .$64o.9.5 from the Street and Alley Fund and ordering payment made,to the Street and Alley Fund, for use of equipment, which was read. Upon motion by Moody second by Bowers that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon'declared the satld resolution duly passed and adopted. Alderman Anderson introduced a resolution appropriating•$251.:75 from the Sewer Fund and ordering payment made to the Street -and. Alley Fund for use .of equipment , •which was read. Upon motion by Williams second by Bowers that the said resolution be adopted as read, and all voting in favor -thereof, President Lemmon, declared the said resolution duly passed and adopted. Alderman Anderson introduced a resolution fixing the salary of the Building and Plumbing inspector at the sum of $1920•for the ensuing official year, which was read. Upon motion, by Williams second by B•ow-ers that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon de•clared the said resolution .duly passed and -adopted. Alderman Anderson introduced a .resolution fixing the,.salary of the Electrical Inspector at $420.00 per year for the ensuing official year, which shall be in addition to compensation paid him by the Public Utility Board, which was read. Upon mot.ion by Williams second by Moody that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. - Mr. Sickels, representing the Ohio Oil Company appeared before the Council regarding bidsfor road oil and cutback asphalt bidding on March 25th,1940, stating that acceptance of.certain bids to higher bidders was irregular, and claiming -that his company is a.reliable and responsible bidder. No action was taken in the matter, President Lemmon informing Mr.Sickels that the Council acted in good faith on the recommendation of the Street and Alley Committee and the City Engineer. A motion by Alderman Bowers to repeal the ordinance setting up the office of Assistant -Chief, was declared out of order for --lack of a second. deconded A motion by Andetson/by Moody carried that the Firemen be given one day off a month in addition to the one day per month which they now receive. Upon motion by Mrachek second by Iilliams Edw. Upon motion. by Williams second by Mrachek Flora Anderson was appointed stenographer for the City Attorney, Chief of Police and Juvenile Officer for the ensuing official years Upon motion by Moody second by Mrachek Mrs. Norma Schroeder was appointed Secretary in the Mayor's Office for the ehsuing official year, effective , April 15th, 1940. Alderman Williams introduced a resolution fixing the salary of the Stenographer in the Mayor's Office at the sum of $85.00 per month during the ensuing official year, which was read. A communication from the Rochester and Olmsted County Public Safety Council regarding the present electrical ordinance was read and President Lemmon ordered that the same be placed on file. Mr. Leo Michartz'presented a petition asking for the vacation of part of Thirteenth Street Northwest, and Rpesident Lemmon referred the same to the Street' and Alley Committee and the City Engineer. A communication from. Anton Christensen regarding a part of Cascade: Creek ` from Eleventh Street •to Fourteenth Street Northwest, requesting that treesy, sand and willow brush be cleared out to stop flooding during high water, was"'read and President Lemmon referred the same to the. City Engineer. Mat E. Walz addressed the Council and expressed criticism regarding his, not being reappointed as Electrical Inspector for the ensuing.. year.
