Minutes of an adjourned regular meeting of the Common Council of the City
Rochester, Minnesota, held in the Council Chambers in the City Hall in said
City, on April 15th,194o.
President Lemmon called the meeting to order at 7 :30 o 1 clock � .M. , the
following members being present: Lemmon, Anderson, Bowers, Moody, Mrachek,
Williams. Absent: Amundsen.
Upon motion by Mrachek second by Moody the minutes of the meetings held.
April 1st, 1940, April gth,1940, and April 10th,194o, "ere each approved.
President Lemmon stated this as being the time and place set for receiving
bids for the furnishing of. one or two carloads of gasoline. The
City Clerk announced that no bids had been received.
Upon motion by Mrachek second by Moody the Mayor was authorized to
purchase said gasoline under an emergency`authorization.
Dr. Fraser appeared in behalf of the Gyp-sy-.. Frolic sponsored by the
Junior 0hamber of Commerce and requested that the Council appropriate funds to
assist in putting on the two day Frolic, and upon motion by Moody second by
Mrachek the sum' of $140.00 was appropriated from the Band Fund acid ordered
paid to the Junior Chamter of Commerce for music on the streets'and in public
buildings. s
The application of David Nichols for a license to connect with sewers and
drains; was read and upon motion by goody second by Bowers license was granted.
The application of A.Madenberg for a solicitors license was read, and
upon motion by Moody second by Williams said application was referred to the
City Attorney.
The application of Ross Phill for an on -sale and an off sale license to
sell non -intoxicating malt liquors, was read and upon motion by Moody second
by Mrachek licenses were granted.
The applications of Ross Phill and Mrs. Sophia Anderson for soft drink
dealers licenses were each read, and upon motion by Williams second by Moody
licenses were granted.
Applications signed by Shell Oil Company, Max Hargesheimer, D.L.Chamberlain,
Jake's Motor Service, and Hagen' s Market, for permits- to place and 'maintain
signs, were each read, and upon motion by Mrachek second by Bowers, licenses
were granted.
The official bond of Geo.E.Rink as Electrical Inspector, in the sum of
$1,000.00 with the Fidelity & Casualty Company of New York as surety was read
and upon motion by Williams second by Anderson, the said bond was approved the
surety thereon accepted and it was ordered that the same be placed on file.

!' The license bonds of David Nichols, nrn the sum of $1,000.00 with the
United States Fidelity & Guarantee Company as surety, and of C.R.Bowen in the
sum of $7,500.00 with the Western Suety Company as surety, were each read
and upon motion by Williams second by Anderson the said bonds were approved,
the sureties thereon accepted and it was ordered that the same_be placed on
file.

The application of C.R.Bowen for a permit to move a house from Fourth
Street Southwest and Second Avenue Southwest, to a location on hest Center
! Street, was read and upon motion by Mrachek second by Anderson, permit was
granted.
The application of R.L.Harrell for an electrical contractor's license,
and for a master electrician's licensee were each read, and upon motion by
Williams second by Moody licenses were granted subject however to the approval
of the License Committee, and the submitting of the -required surety bond.
The report of the Clerk of the Municipal Court for the week ending
April 15th,194o, showing criminal fines and costs collected $312.95, civil
fees received $5.70, conciliation court<_fees received $3.50, was read, and
having been previously approved by the City Attorney, President Lemmon ordered
that the same be placed on file.
A communication from C.C.Pagenhart cintaining an estimate of the cost
of installing acoustical -tile in the community room in the City Hall, was
read, and upon motion by Mrachek second by Anderson, the said matter was
left in the hands of the Public Grounds Committee with power to act; said
installation to cost not more than $499.00. -
The veto by the Mayor on a resolution passed-by.the Common Council on
April Sth,1940, fixing the salary of the BT1ilding and Plumbing Inspector at
the sum of $1920.00 for the ensuing official year, was read, and upon motion
by Williams second by Bowers that the said resolution be adopted as read, and
upon roll call all voting in favor thereof, except Alderman Anderson,who-voted
'9Vo," President Lemmon declared the said resolution duly passed over the veto
of the Mayor.
The veto by the Mayor of a resolution passed by.the Common Council on
April lOth,194o, fixing the salary of the Electrical inspector for the
ensuing official year at the -sum of $2100.00,
was read, and upon motion by Williams second by Bowers, and upon roll call

all voting in favor thereof/ President Lemmon declared the said resolution
duly passed and adopted over the veto of the Mayor.
Mr. J.J.gerr presented a plat of Oak Rest ResoPlat, part of Block 19
Northern"Addition, and upon motion by Moody second by Williams said plat was
accepted with the provision that the street be graded at the expense of the
property owners.

Alderman Bowers introduced a resolution repealing a resolution fixing
fees to be charg;ed-by the City Scavenger, which was read.
Upon motion by Mrachek second by Moody that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Bowers introduced to resolution fixing the salary for the painter
to be employed by the City of Rochester during the ensuing official year at
$140.00 per month, which was read.
Upon motion by Moody second by Williams that the said resolution be adopted
a°s read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed -and adopted.
Alderman Anderson introduced a resolution granting public dance permit
to Dale Hess for the Armory April 13th, 1940, and fixi,np, the fee at $3.00,
which was read.

Upon motion by Mrachek second by Anderson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Anderson introduced a resolution granting public Dance Permit to
the Junior Chamber of Commerce for the Mayo Civic Auditorium on April 26th
and 27th, 1940-, and fixing the fee at $6.00, which was read.
Upon motion by Mrachek second .by Anderson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and .adopted.
Alderman Moody introduced jai 3resolut ion appropriating $209.92 from the Park
Improvement Fund and ordering payment made to the Coca Cola Bottling Company
for soft drinks furnished during February .and March,1940 at the Auditorium,
which was read.
Upon motion by, Moodysecond by Bowers that the said resolution be adopted
as read,- and all voting ,in •favor thereof,. Presi.der_t Lemmon declared the .said
resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $390.00 from the
Park Improvement Fund and ordering payment made to the Universal Motors,Inc..,
for a 1940 Standard Ford Coupe $165.,00,less.allowance for 1936 Ford Coupe,
which was read.
Upon motion by Mrachek second by Anderson that the said resolution be
adopted as read, and all voting'in favor thereof,, President Lemmon declared the
said resolution duly passed and adopted.

Alderman Mrachek introduced a resolution appropriating $1,967.79 from
the Park Improvement Fund and ordering payment made to the Mayo Trust Fund,
for payroll for labor during the half month ending April 15th,1.940, whihh
was read.
Upon motion by Williams second by Moody that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and adopted.
The following claims were read and upon motion by Moody second by
Williams the same were allowed and the Mayor and City Clerk were instructed ,
to draw warrants upon the City Treasurer and make payments accordingly:

Upon motiort by Moody second by Anderson Mark Blanchard was appointed
painter for the City of Rochester for the ensuing official year.

li A•communication from Miss Ida L.Jahnke,regarding improvements desired on
Third Street Southwest west of Ninth Avenue, was read, and upon motion by
Williams second by Anderson the matter was referred to the Street and Alley
Committee and the City Engineer.,
Mr. E..D.Posz, president of the musicians union, appeared before the
Council in regard to hours of dancing in night clubs, and sunday dancing in

the City and protested the discontinuing of Sunday dancing.

Phil Sternberg also spoke in favor of Sunday evening dancing but did not
object to removing Sunday afternoon dancing.

Mrs. Schamberg opposed -.the Sunday.dancing in the City.
Upon, motion by Williams second by Moody the appointment by the'Mayor of
Stanley Gerlicher and Dr. N.D.Smith as members of the' Band Committee were
approved.
Alderman Williams• repo'rted prices on installing a, counter in the office
of the Clerk of the Municipal Court, and upon motion'by Moody second by -
Williams the matter was left in the hands of the purchasing committee with
power to act.
Alderman Williams submitted plans and specifications for improvements to
the °areaways around the basement windows of the City Hall, and upon motibon by
Moody second by Mrachek the matter was left —in the hands of the Public Grounds
Committee with power to act; the cost of said fmprovements to cost not over
$499.00.
Upon motion by Williams second by Mrachek a deed 'given by Christopher
Graham to the City of Rochester covering Lot 14,Block 2, Sunnyside Addition,
was accepted and the City Clerk instructed to have the same recorded.
Alderman Williams introduced a resolution appropriating $400'.00 frmm the.
General Fund and ordering payment made to Christopher Graham for the purchase
price of Lot 14,Block 2,Sunnysid� Addition, which was read.
Upon motion by Moody second by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and adopted.
Upon motion by Williams second by Anderson, the warranty deed given ' '
by Clarence M.Boutelle and wife, covering lands for an e'xtensi.on of Third
Street Northeast, was accepted and the City Clerk'instructed to have the
same recorded.
Upon motion by Mrachek second by Williams the Purchasing Committee was
authorized to purchase necessary equipment for the Mayo°r's.office.
Upon motion by Williams second by Anderson; Lee Nelson,Frank Adair and
John Huyber were appointed as an advisory committee to the Electrical
Inspector.
Upon motion by'Williams second by Anderson, the President of the Council
was requested to appoint a Council Committee to make a survey of the
offices in the City Hall and form rules and regulations for the employes
'regarding vacations,' etc.,
Upon motion by Williams second by Moody the Common Council adjourned
until'7: 30 o'clock P.M., on April'22nd,1940.
