Minutes of an adjourned regular meeting of the Common Council of the City
of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in
said City, on April 22, 194o.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
,following members being present: Lemmon, Anderson, Bowers, Moody, Mrachek,
Williams. Absent: Amundsen.
Upon motion by Moody second by Williams the minutes of the meeting of
April 15th,1940, were approved.
Petitions asking that Fourth Street Northeast from Broadway Street North
to First Avenue Northeast; and the alley running north and south in Block 21,
Northern Addition be treated with oil, were each read, and President Lemmon
referred the same to the Sprinkling Committee.
An emergency order given by the Mayor to the City Clerk for the purchase
of a carload of gasoline, was read and upon motion by Williams second by
!Moody the said action by the Mayor was approved.
'j Copies of communications from the Minnesota Railroad and Warehouse
;'Commission to A.H.Clemens regarding the Rochester Bus Line,Inc., were read, and
President Lemmon ordered that the same be placed on file.
A communication from the President of the Common Council, appointing
iD.L.Williams, Leo C.Anderson and Harold Mrachek as a Survey Committee for the
1;Common Council, was read and ordered placed on file.
A report by the License Committee stating that after a careful investigation
,�of R.L.Harrell the said Committee reports unfavorably and did not recommend
!granting him a license as electrician, was read and President Lemmon ordered
that the same be placed on file.
A communication from the Petroleum Division of the Department of
'Taxation, State of Minnesota, regarding the renewal of the distributor's license
[for the City of Rochester, was read, and upon motion by Mrachek second by
Amundsen, the sum of $1.00 was appropriated from the General Fund, for paymant
of the said license fee.
Notice of dissatisfaction from the decision of the Building Inspector in
(granting a permit to John Berghammer for remodeling his house, and a notice, of
t!dissatisfaction in the decision of the Building Inspector in not granting a
permit to Soren Olson to construct a garage; and a notice of dissatisfaction of
,Thomas Parking in the Building Inspector's refusal to issue a permit for
,,remodeling his house, were each read, and upon motion by Williams second by
'[Moody the said notices were referred to the Zoning Board for recommendation.
A petition asking that a storm sewer be constructed in the north and south
alley in Block 21,Northern, Addition was read and President Lemmon referred th6'
l� same to the Server Committee.

A communication from the Board of Park Commissioners requesting approval
of salaries fixed for park department employes during the ensuing official year,
was read and President Lemmon ordered that the same be placed on file.
The City Engineer submitted specifications and estimate of cost for
cleaning and painting the Center Street bridge over the Zumbro River, and
President Lemmon ordered the same placed on file.
The City Engineer submitted specifications, plans, and estimate of cost for
the construction of a sanitary sewer an`d water main in part of Sixth Street
Southwest, and President Lemmon ordered that the same be placed on file.
The City Engineer submitted plans, specifications and estimate of costfor
the construction of a surface drainage sewer commencing at Fourth Street and
Third Avenue Southwest running thence north on Third Avenue to Center Street
West, thence east on Center Street West to Second Avenue Northwest, thence
north on Second Avenue Northwest to Fifth Street Northwest, and thence east on
Fifth Street\Northwest and Northeast to the lumbro River.
After consi`de�ration and discussion of said plans and specifications, a
motion by Moody second by Bowers carried, that the B:hty Engineer be instructed
to include in said specifications and plans provision for an alternate bid on
two 36 inch pipes in place of the 54 inch pipe specified for nine blocks.
Upon motion by Williams second by Anderson, The Sewer Committee and the
City Engineer were authorized and directed to investigate the feasibility of
using two 36 inch pipes in place of the 54 inch pipe,in the above proposed
surface drainage sewer, and if necessary, to employ the services of a
consulting engineer in said matter.
Quotations by the Clements Chevrolet Company, and the Universal Motors,
Inc., for furnishing automobiles to the Police Department, were read and upon
motion by Williams second by Bowers, the said proposals were referred to the
Police Committee, the Mayor, and the Chief of Police, with power to act.
The application of Geo.Jacobs for a plumbers license was read, and upon
motion by moody second by Mrachek, the license was granted.
The application of Donald Murray, as Manager of the Mayo Civic Auditorium
for a soft drink dealers license was read, and upon motion by Mrachek second
by ui , Phe license was granted.
The following applications for permits to place and maintain signs, were
each read and upon motion by Mrachek second by Moody permits were granted:
L.L.Corryell, Variety Club,'Wm. Thompson, Clements Chevrolet Company, Swartz
Grocery, Baker -Motor Company, Sinclair Oil Company, Silver Lake Grocery, Mosing
Studio,(2), Boston Shine Parlor, Lauretta Beauty Shop, Commercial Lunch, State
Farm Insurance Comfy, Robert Orr, Hargesheimer Drug Store, (2), H-gey's Cigar
Store, DeFosse Service Station, Buur Rug Service, L.L.Corryell,Anderson Tire Servilie.

The license bond of George W.Jacobs in the sum of $1,000.00 with the
,Fidelity & Casualty Company of New York as surety, and the official bond of

Soren Olson in the sum of $1,000.00 with the Standard Accident Company of
Detroit, P4ichigan as surety, were each read, and upon motion by Moody second
by Williams, the said bonds were accepted and the sureties thereon approved, and
it was ordered that the same be 'the
on file.
The report of the Clerk of the Municipal Court for the week ending
April 22nd, 1940, showing criminal T -iies_ and costs collected $278.4o, civil
fees received $9.60, and conciliation court fees $5.00, was read and having
!; been previously approved by the City Attorney, President Lemmon ordered that the
same be placed on file.
The owners and tenants public liability policy written by the Fidelity 8-
Casualty Company of\New York, covering the signs licensed by the City of
Rochester, was presented, and upon motion by Moody second by Williams said
.policy was approved.
Alderman Moody reported that the Committee which had investigated the
conditions in Third Street Southwest, west of -Ninth Avenue Southwest, for which
Miss Ida Jahnke had requested improvements, and that it was the opinion of the

said Committee that the costs of said improvements could be too great to
recommend that the same be done, due to the fact that such improvements would
be assessed against the property abutting.
Upon motion by Alderman Moody, seconded by Alderman Williams, Miss Ida
Jahnke was authorized to make such improvements as she felt necessary in Third
Street Southwest, at her own expense; said improvements to be made under the
supervision of the City Engineer.
A communication from the Local 472 of the Operative Plasterers and Bement
Finishers Union, regarding their hourly scale of wages, was read, and upon
motion by Williams second by Moody it was ordered that the same be placed on
file.
A recommendation by the Lighting Committee that street lights bei«stalled
one on Eleventh Avenue Southwest between Second Street fiouthwest and First
! Street Southwest; one on Eleventh Avenue Southwest between First Street South-
l'west and Center Street West; one in the alley west of Broadway between
;!Seventh Street Northwest and Eighth Street Northwest; one at the intersection
Of Twelfth Avenue Northeast and Ninth Street Northeast; one at the intersection
of Twelfth Avenue Northeast and Tenth Street Northeast; one at the intersection
of Fifth Street Southeast and Thirteenth Avenue Southeast; and two lights on
Fourth Street Northeast to Fifteenth Avenue Northeast, the end of the street,
was read, and upon motion by Mrachek second by Williams, the City Clerk was
instructed to request the Public Utility Board to make installations accordingly.

The report of the Police Committee and the Chief of Police regarding the
(placing of three additional men in the Police Department for duty at the desk,
land recommending that this be done at such time as funds are available for that
purpose in the salary budget of the Police Department, was read, and upon motion
Iby Moody second by Mrachek said report was accepted.
Upon motion by Mrachek second by Bowers, the question of funds available
for placing three additional men in the Police Department, was referred to the
Finance Committee.
Alderman Williams introduced a resolution approving and fixing salaries
lof employes in the Park Department, for the ensuing official year, which• was read.
Upon motion by Williams second by Moody that the said resolution be' adopted
las read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted. -
Upon motion by Moody second by Williams, the City Engineer was instructed
to prepare specifications for cleaning and painting the East Center Street
bridge, which specifications shall be attached to his estimate of cost
submitted on this date.
Alderman Moody introduced a resolution adopting plans and ordering bids for
a sanitary sewer and water main in Sixth Street Southwest, from approximately
500 feet` east of Fourteenth Avenue Southwest to approximately 720 feet with the
sewer and to Tenth Avenue Southwest with the water main," Said bids to be opened
at 2:00.o'clock P.N., on May 6th,1940, and ordering a hearing on the said
improvement to be held at 2:00 o'clock P.M., on'May 6th,,194ot which was read.
Upon motion by Mrachek second by Williams that the said resolution be
adopted as read, and all voting in -favor thereof, President Lemmon declared the
said resolution duly passed and adoptedl
The following resolution passed and adopted by the Charter Commission, and
copy of a communication to th`e Itayor, were each read:
"BE IT RESOLVED, By the Board of Freeholders of the City of Rochester,
Minnesota, that an amendment' be proposed to the present Charter of the City
of Rochester, Minnesota, as -follows:
AMENDMENT.
Amend the last paragraph of'Section 164; of said Charter, so that the same
shall read as follows:
Fox the Park Improvement Fund so much as it may deem necessary for the
improvement of the public parks` and 'parkways,'in or near the City, not exceeding
four (4) mills on the dollar of such assessed valuation.
BE IT FURTHER RESOLVED, That the President and Secretary of the Board of
Freeholders of the City of Rochester, Minnesota transmit a copy thereof to the
Mayor of said City, in due form.
Passed and adopted by the Board of Freeholders of the City of Rochester,
Minnesota, this 16th day of April,A.D.1940.

" PROPOSED AMENDMENT TO THE
CHARTER OF THE CITY OF ROCHESTER,MINNESOTA.
To The Honorable Paul A.Grassle,
Mayor of the City of Rochester, Minnesota.
We, the Board of Freeholders of the said City of Rochester,
Minnesota, duly appointed to draft a Charter for said City and to propose
and submit amendments to said Charter, do hereby propose and submit
the following Amendment Vo the present Charter of the City of Rochester,
Minnesota:
AMENDMENT.
Amend the last paragraph of Section 164, of_ said Charter, so
that the same s1ra ll read as follows:
For the Park Improvement Fund so much as it may deem necessary
for the improvement of the public parks and parkways, in or near the
City, not exceeding four (4) mills on the dollar of such assessed valuation.

Alderman Mrachek introduced the following resolution, which was read:
"WHEREAS, The Board of Freeholders of the City of Rochester,Minnesota,
heretofore appointed by the Judge of the District Court of Olmsted County,
Minnesota, of the Third Judicial District, to frame a Charter for the City of
Rochester, in said County, and to propose amendments thereto, has delivered to
the Mayor of said City of Rochester, Minnesota, a proposed amendment to said
Charter, which was requested by the Common Council of said City, which amend-
ment would amend the last paragraph of Section 16,4 of said Ch`a;rt"er, and the
Mayor of said City has transmitted to the Common Council of said City copies
of said proposed amen'dment`;
SO THEREFORE: Be it resolved by the Common Council of the City of
Rochester, Minnesota:
That the City Clerk of said City be and he is hereby ordered and directed
'to file said copies of said proposed amendment in his office, and to cause the
;said proposed amendment to be published for at least thirty days before the
special election which is to be held in said City on Tuesday May 28,1940, between
the hours of 9:00 o'clock A.N. and 7:00 o'clock P.M., in each of the following
,newspapers, to -wit: The Rochester Post -Bulletin, published and printed at
Rochester, Minnesota, and of general circulation in said City; the Stewartville
',Star, printed and published at Stewartville,Minnesota, and of general circulatio'
in said City of Ro-chester, Minnesota; and the Dover Indepandent printed band
published at Dover, Minnesota, and of general 'circulation in the City of Rochester,
Minnesota.
Be it further resolved by.the said Common Council:
That the said proposed amendment shall be submitted for ratification to
the qualified voters of said City at a special election to be held in said City
,of Rochester, Minnesota, on Tuesday, May 29th,1940, between the hours of 9:00
o'clock A.M.and `7:00 o'clock P.M. and the City Clerk of said City is hereby
'directed to give notice of the submission of said proposed amendment and to
provide suitable and proper ballots and ballot boxes and other supplies for the
submission of the said proposed amendment to the voters of the City of Rochester,
.Minnesota, at the said Special Election.
Upon motion by Williams second by Mrachek that the said resolution be
,adopted as read,
and
all voting
in favor thereof, President Lemmon declared the
said resolution
duly
passed *and:
adopted.

Alderman Moody -introduced a resolution appropriating $244.22 from the
Street and Alley Fund and ordering payment made.to W.H.Ziegler Company,Inc.,.
(for repair parts .for equipmen.t,which was -read.
Upon motion by Moody .s-e,cond by Mrachek that the said resolution be adopted
as read, and all voting 1n f avor. thereof; 'President, Lemmon declared the said
resolution duly passed and adopted.
Alderman Mrache-k introduced a resolution granting public .dance permit to
Dale Hess for t'he _Armory, April 20th,1940, and .fixing the fee at $3.00,which
Iwas read.
Upon mbbion by Williams second by Amundsen that the said resolution be
jadopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Bowers introduced a resolution granting public dance permit to the
(Central Labor union for' the Woodman .Hall, April 13th and 20th,1940, and fixing
(the fee at $6.00, which was read.
Upon motion by -Williams second by Amundsen that -the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adoptedo
Alderman Williams introduced a resolution deeming it expedient and necessary
that a surface drainage sewer be constructed commencing at Fourth Street and Thirc
Avenue Southwest running thence north on Third Avenue to Center Street West,
(thence east on Center Street West to Second Avenue Northwest, thence north on
ISAvenue Northwest to Fifth Street Northwest, and thence east on Fifth Streetll
Northwest and Northeast to the Zumbro River, adopting the City Engineer's plans,
specifications and estimate of cost for the said surface drainage sewer, and
ordering bids to be received and opendd for the construction of said surface
drainage sewer, at 2:00 o'clock P.M., on May 6th,1940, which was read.
Upon motion by Moody second by Williams that the said resolution be adopted
las read, and all voting in favor thereof, President LemmoFrn declared the said
resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $5,000.00 from
(the Generbl.:Fund:-and ordering payment made to the Park Improvement Fund, $2200.00
thereof to be for W.P.A.Projects and $2900.00 for maintenance of parks, which
Iwas read.
Upon motion by Mrachek second by Williams that the said resolution be
adopted as read, and all voting -in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
The Mayor stated that he had a request from an individual for permission to
solicit for donations of old clothing, and asked that the Council authorize
him to either grant said request or ref use it, and a motion by Moody seconded
1by Williams carried that such permission be not granted.

Upon motion by Moody second by Williams, the matter of closing off
Fifth ,Avenge Southeast between Seventh and Eighth Streets Southeast, was
',!referred to the Street and Alley Committee and the ,City Engineer.
Alderman Anderson bro.ught up the question of discontinuing the dancing
on Sundays in places having on -sale licenses to sell non -intoxicating malt,
liquors, and a motion by Williams seconded by Moody carried that the City.
`Attorney be instructed to prepare an ordinance to allow dancing in such places

on Sundays only between the hours of 9:00 o'clock P.M..to, 12:00 o'clock mignight.
` A motion by Bowers second by Moody carried'that the caretaker of the,
Fifth Street Northeast dumping grounds be paid a salary of $20.00 per month for
deemed
said services, payable monthly at, such times as said services are/,necessary
by the Street and Alley Committee.
Upon motion by. Williams second by Mrachek the City Engineer was instructed
to prepare plans and specifications for the resurfacing of paved streets in -
the City of Rochester, and that the City Engineer and the Street ,and Alley
Committee submit a list of proposed streets to be resurfaced
j A motion by Williams seconded by Bowers carried that Thirteenth Street
(Northwest between Blocks 17 and 19 Northern Addition, be not vacated at this
!time.

Upon motion by Mrachek second by Williams the Common Council adjourned
until'7:30 o'clock P.M., on April 29th,194o.
