Council of the City of Rochester, Minnesota,. held in the Council Chambers, :in the City Hall, in said City on April 29t.h,1940. President Lemmon called the meeting to order at 7:30 o'clock P.M., the following -me•mb.ers being present: Lemmon, Anderson, Bowers, Moody,, Mrachek, Williams. Absent: Amundsen. Upon motion bey ,Moo.dy. second,-bybMTache.k the minutes of the meeting of April 22nd,1940 were appxoved. President Lemmon stated this as being the time and place fixed for a hearing on the construction of curb and gutter on Second Street Southeast from Eleventh Avenue Southeast to Thirteenth Avenue Southeast; and asked if any one present wished to be heard concerning the said improvement. No one present wished to be heard. President Lemmon stated this as being the time and place set for a hearing on the construction of a sanitary sewer in 10" Street Southeast from First Avenue Southeast to a point 260 feet east, and asked if there was any one present who wished to be heard concerning the said improvement.. No one present wished to be heard conserning the construction of the said sanitary sewer'. President Lemmon stated this as being the time and place set for a hearing on the construction of .a sanitary sevier in loth Street Southeast from Eighth Avenue Southeast to a point 170 feet,east, and asked if any one present wished to be heard concerning the said improvement. President Lemmon stated this as being the time fixed for receiving and opening bids for the construction of curb and gutter on Second,Street Southeast from Eleventh Avenue Southeast to Thirteenth Avenue Southeast-; The following bid was opened at this Mime: H. T. Earle $750.00 — and City Engineer President Lemmon f4ferred the said bid to the Street & Alley Committee for recommendation. Presidtne Lemmon stated this as being the time and place set for receiving and opening bids for the construction of a sanitary sewer in 10_-1 Street Southeast, The following bids were received and opened: Wm. C. Fraser & Son $354.4o, Martin Paulson $373.30. President Lemmon referred the said bids to the Sewer Committee and the City Engineer for recommendation. President Lemmon 'stated this as being the time and place set for receiving and opening bids.for the construction of a sanitary sewer in Tenth Street Southeast from Eighth Avenue Southeast to:170 feet east. The following bids were opened at this time: Martin Paulson $224.00, Wm. C. Fraser & Son $211.60. President Lemmon referred the said,bids to the Sewer Committee for recommendation 568 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., Anri - 29i-94o _ Gus Obst, Chairman of the Bicycle Safety Council asked - for permission to tise , the Council Chambers every Saturday afternoon at 2:00 o'clock-P.'M., for, . 'holding the Bicycle Court, and upon motion by Bowers second,by Mrachek the* request was .granted. Ray Niles, Manager of the Rochester Amusement Company, requested a reduction in the license -fee for motion picture theatres, and upon motion by Moody second by Williams the matter was referred to the License Committee for recommendation at the meeting to be held on May 6theI940. August Dornack requested that a sidewalk be constructed on Fourth Avenue Southeast between Fourth Street and Sixth Street Southeast, -and upon motion by Moody second by Williams, it was ordered that -a sidewalk be constructed on the west .side of Fourth Avenue -Southeast -between Fourth -Street Southeast and Sixth Street Southeast and the City Engineer- was instructed to give the required 'notices to -the property owners to construct said sidewalk. The application of the Murphy Finance Company to operate as a•Loan Company was read, and upon motion by Williams second by Moody the license was granted provided they already have a state license. The application of Allen Fuerstnau for a journeyman electrician's license. was read, and upon motion by Moody second by Anderson said application was "referred to the License -Committee for investigation and report. The applications of Brumm & White, Edge Water Tavern and Nanny's Men's Shop for permits to place and maintain signs, -were each ' read, and upon motion by ' Moody second by Bowers permits were granted. The application of A.Madenberg for a solicitor's license, was read, and upon motion by Williams second by Andersson the said license was not granted, ''all voting in f avor*thereof, except Alderman Bowers who voted "No-11 i The official bond of Edw.E.Zuehlke, in the -sum of $1,000.00 with the American .Bonding Company of Baltimore as surety; -of Edna Oesterreich in the sum of $500.00 i 'and Geo.C.Wood in the sum of $500.00 with the Fidelity & Casualty Company as surety J were each read, and upon motion by Mrachek second by Anderson the said bonds were ,approved, the sureties thereon approved and it was ordered that the same be Iplaced on file. - The applications of Lev Martinson for on -sale and off -sale licenses to sell non -intoxicating malt liquors at 1.19-Forth Broadway, were. each read, and upon motion by Moody second by Mrachek the said applications were referred to ,the License Committee and the Chief of Police for recommendation. The report of the Clerk of the Municipal Court for the week ending ° �; April 29th, 1940, showing criminal Fines and costs collected $298.65, civil fees 'received $13.70, conciliation court fees $4.00, was read, and having been ,,previously approved by the City Attorney,President Lemmon ordered that the same be placed on file. A recommendation by the Sprinkling Committee and the City Engineer, that Fourth Street Northeast from Broadway to First Avenue Northeast and the alley in Block 21, Northern Addition be soled, was read, and upon motion by Moody second by Mrachek the said report was accepted and ordered placed on file. A report from the Street and Alley Committee and the City Engineer on the matter of the School Board using part of Fifth Avenue Southeast as a play- _ ground, and the school --bus leaving children on Twelfth -Street Southeast, was read, and upon President Lemmon ordered that the same be placed on file. The City Engineer submitted an estimate of cost for the resurfacing of the north and south alley in B,,locks S, 9, 10, 11, 19, 19, 22, 23, 32, 33, 37, and 4G Original. Plat, and Block 20, Pdoe and Old's Addition, and Mill Reservation; . . , . . e , . the east and west alley in Block 19, Original Plat, and Third Street Southwest from Broadway Street .South to Third ,Avenue Southwest; and upon motion by. , Moody second by Bowers, the Common Council determined to proceed with the said , resurfacing, and the City Engineer was instructed to prepare plans and specifications for said resurfacing for further action on May 6th, 1940. A communication from the City Treasurer requesting authority to release the U.S.Treasury bond of Andrew Chafoulias, was read and upon motion by Williams second by Anderson, the City Treasurer was authorized to return to Andrew C. Chafoulias the U.S.T_reasury bond which he submitted in lieu of .a surety bond covering his Off -Sale liquor license. A communication from Adolph F.Meyer, Consulting Iydraulic Engineer, respecting the hydraulic properties of certain sewer pipes, was read, and President Lemmon ordered that the same be placed on file. A communication from the Twin City Testing & Engineering Laboratory, quoting prices for tests and other services,'wds Srb&d and upon motion by Mrachek second by Williams the matter was referred to the Street ' and Alley Committee and the City Engineer with power to act. A copy of the addenda added by the City Engineer to the specifications for construction of -a storm sewer, was read, and upon motion by Anderson second by Moody the same was approved.. L.W.Repsold inquired as to what steps had been taken toward taking over the gas plant, and he was informed that inquiries were now in the mail and that upon receipt of information requested therein the Council would further -stud and consider said matter. The recommendation by the Street and Alley Committee and the City Engineer i that the contract for the construction of curb and gutter on Second Street Southeast,be awarded to H.T.Earle; and the recommendations by the Sewer doimittee and the City Engineer that the contracts for the construction of sanitary sewers in parts of Fenth Street Southeast, and in 10i 'Street Southeast be awarded to Wm.C.Fraser & Son, were each read, and ordered placed on file. Alderman Bowers introduced a resolution accepting the bid of H. T. Earle I . i for the construction of curb and gutter on Second Street Southeast from Eleventh ,iAvenue Southeast to Thirteenth Avenue Southeast for the sum of $790.00, which ,was read. Upon motion by Mrachek second by Williams that the said resolution be ,adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Boners introduced a resolution accepting the bid of Wm. C.Fraser & Son for the construction of a sanitary sewer in 10� Street Southeast from First Avenue Southeast to a point 260 feet east for the sum of $354.40, which was read. I' I; Upon motion by Williams second by Anderson that the said resolution be ;adopted as read, and all voting in favor thereof, President Lemmon declared the I;said resolution duly passed and adopted. Alderman Bowers introduced a resolution accepting the bid of Wm. Alderman Anderson introduced a resolution adopting.the specifications and plans for pleaning and painting the Center Street bridge, and ordering adver- tisement for bids to be received and opened at 7:30 o'clock P.M., on May 13th, Upon motion by Williams second by Moody that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Avenue Southeast, and Third Avenue Southeast between Fourth Street Southeast and Fifth Street Southeast be widened and a new curb and gutter constructed thereon, and ordering a hearing on the said improvement to be held at ?:90 o,'cloc] P.M., on May 6th,1940, which was read. Upon motion by Bowers second by Mrachek that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Anderson introduced a resolution appropriating $253.57 from the Firemen's Relief Fund, and ordering payment made to Frank Springe-r,Treasurer, of the Firemen's Relief Association, for transfer of funds received in the March, 1940 tax settlement, which was read. Upon motion by Anderson second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Anderson introduced a resolution appropriating $369..47 from the Street and Alley Fund and ordering payment made to the Firestone Auto Supply and Service Store, for 8 tires and 6 tubes and tire repair for equipment,which was read. Upon motion by Mrachek second by Anderson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $590.20 from the Street and Alley Fund and ordering payment made to Morse Brothers for sand, gravel and crushed rock used during April,1940, which was read. Upon motion by Moody second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $937.49 from the Permanent Improvement Revolving Fund and ordering payment made to Wm.C.Fraser 81 Son, for first and final estimate on contract for construction of a sanitary sewer and water main in Fifth Street Southeast from Twelfth Avenue Southeast to 572 Record of Official Proceedings of the Common Council of the City of. Upon motion by Williams second by Anderson that the said resolution be ,.adopted -as read, and all voting in favor thereof, President Lemmon declared the �i ;! said resolution duly passed and adopted. Alderman Brachek introduced a resolution appropriating $499.39 from the General•Fund and'oraering payment made to George C.Peterson Company for 9070 h (gallons gasoline furnished in Car SW LX 939, which was read. ` Upon motion by Mrachek second by Moody that the said resolution be gdopted 'I as read, and all voting in favor thereof, President Lemmon declared the said 'resolution duly passed and adopted. Alderman Mrachek introduced a resolution appropriating $319.29 from the !iGeneral Fund and ordering payment made to State of Minnesota,0il Inspection ;Division for State tax, and inspection fee on gasoline purchased`in Car SWLX'938, ,,which was read. Upon motion by Bowers second by Anderson that the said resolution be'adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly'passed and adopted. Alderman Williams introduced a resolution approving general plans and center line grades for construction and improvement of Trunk Highway �63 through the City of Rochester, which was read. ' -Upon motion by Williams second by Mrachek that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. ` Alderman Williams introduced a resolution appropriating $9,616.47 from the :deposits for licenses and permits fund and ordering payment made to the General !Fund, fot deposits made during the month of March,1940, which was read. Upon motion by Williams second by Mrachek that the said resolution '6e i adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed acid Adopted. i Alderman Williams introduced a resolution appropriating $2329.52 from the !,Street and Alley Fund, Code 1, and ordering payment made to Code 10 of the r Street'and Alley Fund for transfer of funds to take up overdraft in Code 10, which was read. ' Upon motion -by Mrachek second by Williams that the said resolution lie !,adopted as read, and all voting in -favor `thereof, President Lemmon declared the said resolution duly passed and adopted. i, Alderman Moody brought up the matter of acquiring the necessary additional grounds for street purposes at North Broadway bridge and the matter was ;left in the hands of the'Public Grounds Committee the Mayor and the City ;Attorney and City Engineer. u Record of Official Proceedings of the Common Council of the City, of Rochester, Minn., April 29,19 4o . 573 Alderman Williams introduced an ordinance prohibiting public dances and public dancing on Sundays except between the hours of nin o'clock F.M. and Twelve o'clock midnight, which was given its first -reading. Upon motion by Moody second by Williams, and upon roll call all voting in favor thereof, the rules were suspended and the said ordinance given its second reading. Upon motion by Mra.chek second by Williams the City Engineer was instructed to request the School Board to discontinue the use of Fifth Avenue Southeast between Seventh Street and -Eighth Street Southeast for playground purposes. Alderman Mbadyd.stated that he would like to see the House moving ordinance repealed due to damage done while houses are being moved on City Streets, but no action was taken on this suggestion, at this time. Upon motion by Moody second by Bowers the E.A.Enowlton Company were granted permission to make sidewalk improvements around their building under the supervision of the City Engineer. Upon motion by Williams second by Anderson the Chief of Police was authorized to purchase the necessary posts for stop signs, said posts to be more su stantia.l and set in cement under the supervision of the City Engineer. Upon motion by Mrachek second by Williams it was ordered that the certified checks of the unsuccessful bidders on the construction of sanitary sewers, opened on this date, be returned to them. Upon motion by Williams second by Bowers the Common Council adjourned. City Clerk.
