Minutes of a regular meeting of the Common Counc9l of the City of Rochester,
Minnesota, held in the Council Chambers in the City Hall in said City, on
May 6th, 1940. .

President Lemmon called the meeting to order at 2:00 o'clock P.M., the
i
following members being present: Lemmon; Amundsen; Anderson, Bowers, Moody,
M. achek, Williams.
Upon motion by Williams second by thrachek the minutes of the meeting of
April 29#h,1940, were approved.
President Lemmon stated this as being the time and place set for a hearing
on the construction of a sanitary sewer and water main in Sixth Street Southwest,
commencing at a point approximately 500 feet east of Fourteenth Avenue Southwest
to approximately 720 feet east with the sewer, and to Tenth Avenue Southwest with
the water main, and asked if any one present wished to be heard concerning the
said improvements. No one present wished to be heard.

President Lemmon stated this as being the time and place set for receiving
bids for the construction of.a sanitary sewer and water main in Sixth Street

i; Southwest, dommencing at a point approximately 500 feet east of Fourteenth
Avenue Southwest to approx_imat#--ly 720 feet east with the sewer and to Tenth

Avenue Southwest with the water main:.The following bids were received and
;opened at this time: Martin Paulson $3,504.30, Wm. C. Fraser & Son $3,679.25,
H. H. Frankamp $3,779.45• President Lemmon referred the said bids to the
Sewer Committee and the City Engineer for tabulation and recommendation.
President Lemmon stated this as being the time and place set for receiving
'i and opening bids for the construction of a storm sewer- in Thirii Avenue Southwest
commencing at Fourth Street Southwest and Third Avenue Southwest, running thence
north on Third Avenue Southwest to Center Street West, thence east on Center
Street West to Second Avenue _Northwest, thence north on Second Avenue North-
ii west to Fifth Street Northwest, thence east on Fifth Street Northwest and
('Northeast to the Zumbro River. The following bids were received and opened at

$54,890.25, total second combination $57429.00; The Barnett & Record Company:
Total base bid $56,573.00; total first combination $56,505.75, total second
combination $59,025.50; Otto M. Andersen: Total base bid $56,976.70, total

Jensen Company: Total base bid $5g,441.90, total first combination $59,441.90,

to the Sewer Committee and the City Engineer for tabulation and recommendation.

President Lemmon stated this as being the time and place set for a hearing
on the widening of Fourth Street Southeast from Third Avenue Southeast to
Sixth.Avenue Southeast and Third Avenue Southeast from Fourth Street Southaast
to Fifth Street Southeast, and'the construction of curb and gutter thereon.,
and asked if any one present wished to be heard concerning the said improvement.
.No one present wished to be heard. ,
A communication from the Executive Secretary of the League of Minnesota
Municipalities regarding the annual convention at Two Harbors, Minnesota,
June 17th, lSth,and 19th, 194o; was read and President Lemmon ordered that the
same be placed on file.
A communication from the Executive Secretary of the League of Minnesota
Municipalities regarding the Thirteenth.Northwest Fire School, May 15th,16th,
and 17th,lo4o, to e held at the University Armory, was read and President
Lemmon ordered that the same be placed on file.
Upon motion by Amundsen second by Anderson the matter pertaining to the
Fire School was left with the Chief of the Fire Department, he to select the
members of the Fire Department'who will attend the school.
The appointments by the Mayor of Max Graham as a special policeman for
duty at the Armory, and Gerald'J.Wieser as a special policeman for duty at
St.Mary's Hospital, each to serve without pay and to hold office until the
second Monday in April,194(1,unl'ess sooner removed, were read and President
Lemmon ordered that the same.be placed on -file.
A communication from the 15oard of Park Commissioners requesting authority
to enter into contract' with the American Radiator and Standard Sanitary
Corporation for tl e furnishing of pipe and fittings which may be required for
the installation of a fairway watering system at Soldier Field 'Golf Course
for the sum of $919.72, was read and President Lemmon ordered that the same
be placed on file.
'A statement of receifts and expenditures in the Park Improvement Fund for
April, 194o, was read and President Lemmon ordered that the same be placed 'on
file; said statement being as follows:

T,he report of the City Engineer for the monttr of April,1940, showing
expenditures from the General Fund for Labor $360.29, Street and Alley Fund
I$2,151.02, Sewer Fund $392.00, was read. -.and President Lemmon ordered that the
same be placed on file.
The City Engineer submitted plans, specifications and estimate of cost for
the widening of Fourth Street Southeast from Third.Avenue Southeast to Sixth
Avenue Southeast and Third Avenue Southeast from Fourth Street Southeast to
(Fifth Street Southeast, and the construction of curb and gutter thereon, and
upon motion by Williams second by Anderson it was ordered that the same be
placed on file. „
The report of the Building .and Plumbing Inspector for the month of Apti;
1940, showing bmilding permits issued $205.00, Plumbing Permits $43.25. was
read, and President Lemmon referred the same to the 3'ir_ance Committee.
The report of the Electrical Inspector for the month of April,1940, showing
electrical permits issued $42.75, was read and President Lemmon aeferr.ed the
same to the Finance Committee.
The report of.the Building Inspector and :thw Sanitary Inspector on the
(Silver Lake Cabins Trailer Camp, was read, and upon motion by Williams, second
by Amundsen, the said report was accepted and th4 license granted to Kenneth
and Esther Silker to operate said trailer camp.
Alderman Bowers,Ch,airman-of the License Committee, rgported on the request
of the Rochester Amusement Company for a reduction in the fees charged for
(motion picture licenses, the said License Committee recommending that the
following fees be charged for said licenses: Chateau Theatre $75.00, Time
Theatre $75.00, Lawler Theatre $50..00, and Empress Theatre $50.00.
The report of the License Committee recommending that the application of
Alden Fuerstnau for a Journeyman's Electrician License be granted, was read
and upon -motion by Mrachek second by Moody, said report was accepted and the

license granted.

The report of the License Committee recommending that the application of
Lew Martinson for an off -sale and on -sale license to sell non -intoxicating malt
liquors at 119 Broadway Street North be not granted, was read, and upon motion
by 'Williams second, by Moody the -said report was accepted and it was ordered
that the license fee be returned to Lev, Martinson.
The report of the Clerk of -the Municipal Court for the week ending
May 6th,1940, showing criminal fines and costs collected $245.90, civil fees
received $11.90, and conciliation court fees $6.00, was read, and having been
previously approved by the City 'Attorney, President Lemmon ordered that the same
be placed on file.,
The applications of M.L.Bloom and Howard E.Hill for soft drink dealers
licenses were each read, and upon motion by Mrachek second by Amundsen licenses
were granted.
The applications of Mrs. Ed.-Deitschman and Clarats Beauty Shop, for
;permits to place and maintain signs, were each read, and upon motion by
"Amundsen second by Bowers permits were granted.
The contract bondsof Wm.C.Fraser & Son in the sum of $354.40, and $211.60
with the United States Guarantee Company as surety, the official bond of the
Rochester Post Bulletin,in the sum of $1,000.00 with the Fidelity & Casualty
Company as surety, and the official bond of Manfred Waldron in the sum of
$500.00 with the Fidelity & Deposit Company of Maryland as surety,.were each
read, and upon motion by Moody second by Williams, the said bonds were approved

the sureties thereon accepted and it was ordered that the same be placed on
file.
A petition asking that the Common Coii.ncilJcause bus service to be
established on Eleventh Avenue Northeast and Fourteenth Street Northeast, was
'read. Dr. Boyd S.Gardner and Alderman Bowers spoke in favor of the establishment
of said bus service. President Lemmon referred the matter to the License
Committee the Mayor and the City Attorney.
The appointment by the Mayor of Arthur E.Reiter, L.A.Brunsting, Ralph
B.Compton, J.H.Starkey, James M.010onnor, and Lester N.Fawcett as Special
'Policemen for the parks, each to serve without pay and to hold office until the
'second Monday in April,1941, was read, and President Lemmon ordered that the
same be placed on file.
A communication from Alvin Mattison regarding }permission to move a house,
was read, and up6n•motion by Moody second by Mrachek the City Clerk was
;instructed to notify Mr -Mattison by registered mail to confer with the
City Attorney in regard to the ordinance concerning the moving of buildings

The Chief of Police and Police CommEttee submitted specifications for the
furnishing of an automobile for the Police Department, the estimated cost of
same being $499.00, which were read, and President Lemmon ordered that the same
be placed on file.
A communication from the Church of Saint Francis of Assisi asking that
j2 Street Southeast from Eleventh Avenue Southeast to a point approximately
95 feet west of Thirteenth Avenue Southeast be permanently closed, was read
and upon motion by Williams second by Amundsen the said matter was referred to
the Street and Alley Committee and City Engineer for report on'May 13th,1940..
The report of the License Committee recommending that theatre licenses
fees be changed was read, and upon motion by Moody second by Bowers said report
was accepted and turned over to the City Attorney to change, the ordinance.
in accordance with changes recommended.
The report of the Purchasing Committee on the purchase of an adding
machine for the City Ehgineer's office, was read, and upon motion by Mr2chek
second by Moody the Purchasing Committee was authorized to purchase said machine.
Alderman Bowers introduced a resolution accepting the bid and proposal of
Martin Paulson, in the sum of $3504.30, for the furnishing of all labor,
jmaterials, equipment,etc.necessary for the construction of a sanitary sewer and
(water main iA Bixth Street Southwest, which was read.
Upon motion by Moody second by Williams that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.

Alderman Moody introduced a resolution ordering plans, specifications and
estimate of cost for the widening and.construction of .curb and gutter on Fourth
Street Southeast from Third A -venue Southwest to Sixth Avenue Southwest, which
was read.
Upon motion by Moody second by Anderson that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
The City Engineer submitted plans, specifications, estimate' of cost, for the
widening and construction of curb and gutter on Fourth Street Southeast and
Third Avenue Southeast, as above described.

and estimate of cost for the widening and construction of curb and gutter on

Alderman Anderson introduced a resolution deeming it expedient that the
north and south alleys in Blocks, 8, 9, 10, 11, 18, 19,' 22, 23932, 33, 37, and
i46 of Original Plat and Block 20 Moe and Olds Addition, and Mill reservatipn,
I,the east and west alley in Block 18, Original. Plat, and Third Street Southwest
lfrom Broadway Street South to Third Avenue Southwest, be resurfaced; adopting
.,the City Engineers specifications and estimate of cost for said resurfacing; and

Alderman Anderson introduced a resolution deeming it expedient and necessary

Upon motion by Williams second by Anderson that the said resolution be

Alderman Anderson introduced• a resolution_ granting public dance permit to
the Central Labor Union, for the Woodman Hall May 4th, 1940, and fixing the
fee at $3.00, which was read.
Upon motion by Moody second by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.

Alderman Bowers introduced a resolution appropriating $379.97 from the
Street and Alley Fund, and $5.60, from the Server Fund and ordering, payment made
to -the Fullerton Lumber Company for lumber and cement furnished during April,
1940, which was. read.
Upon motion by Moody second by Bowers that the said resolution be adopted
as read, acid all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.

General Fund and $55.60 from the Permanent Improvement Revolving Fund, and
ordering payment made to the Rochester Post -Bulletin, for official publications
and prin.1ing during April, 1940, which was read.
Upon motion by.Mrachek second by Williams that the -said resolution be
adopted as read, and all voting -in favor thereof, President Lemimon declared
the said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $562.17from the
Permanent Improvement Revolving Fund and ordering payment made to Wm.C.Fraser
& Son, for first and final estimate on contract for construction of a water
main in Sixth Avenue Northwest from Tenth Street Northwest to Eleventh Street
Northwest, which was read.
Upon motion by Bowers second by Moody that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.

Alderman Mrachek introduced a resolution appropriating $902.95 from the
General Fund and ordering payment made to the Street and Alley Fund, for use of

equipment for flushing streets during April',*1940, which was read.
Upon motion by Amundsen second by Williams that 'the. said resolution be

said resolution duly passed and. adopted.
Alderman Amundsen introduced a resolution appropriating $$45.-30 from the
Street and Alley Fund and ordering payment made to the Street and Allgg Fund,
for use of equipment during April,154o, which was read.
Upon motion by Williams second by Mogdy that the said resolution be adopted
as read, and all voting in. favor thereof, President Lemmon declared the said
lresolution duly passed and adopted.

Alderman Amundsen introduced a resolution appropriating $307.19 from
the Street and Alley Fund, and ordering payment made to the Street and Alley
Fund, for stock used during April,194o,' which was read.
Upon motion by Mrachek second by Amundsen that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating•$309.15 from the
General Fund and $10.90 from the Permanent Improvement Revolving Fund, and
ordering payment made to the Rochester Post -Bulletin, for official printing
and publications during Larch,1940, which was read.
Upon motion�by Amundsen second by Boyers that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared
:the said resolution duly passed and adopted.
Alderman Williams introduced•a resolution appropriating $301.95 from the
General Fund, $4- 50 from the Street and Alley Fund, and $3336.99 from the
Lighting Fund, and ordering payment made to the City of Rochester, Light, dater
.and Steam Departments, for electricity, water and steam furnished at public
grounds and buildings, in accordance with billings of April 25th,194o, whilmh
was read.
Upon motion by Bowers second by Moody that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $2,275.19 from
the Park Improvement Fund and ordering payment made to the Mayo Trust Fund, for
payrolls for labor during the half month ending April 30th,1940,which was read.
Upon motion -by Mrachek second by Amundsen that the said resolution be
,adopted as read,

Alderman Williams introduced a res.olution authorizing the Park Board to
'enter into contract with the American Radiator and Standard Sanitary Corporation

Upon motion by Williams second by Amundsen -that the said resolution be
adopted -as read, and all voting in favor thereof, President Lemmon declared the

Alderman Williams introduced a resolution appropriating $400.00 from
Code 19 of the General Fund and ordering payment made to Code 26-of the General
Fund, to take up overdraft= in said Code 26, which was read.
Upon motion by Mrachek second by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $3,200.06 from
the General Fund and ordering payment made to the Public Health and Welfare
Fund, for transfer' of funds received in tax settlements for salarie.s of
Health and Welfare Department, and Garbage Assessments collected; which was
read.
Upon motion by Amundsen second by Anderson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Williams introduced an ordinance amending an ordinance to license
and regulate moving picture shows in the City of Rochester, Minnesota, the same
being Ordinance No.192, which was given its first reading.
Upon motion by Moody second by Amundsen, and all voting in favor thereof,
the rules were suspended and the said ordinance given its second reading.
Upon motion by Williams second by Mrachek and all voting in favor thereof,
the rules were suspended and the' said ordinance given its third and final
readi ng.

declared the said ordinance duly passed and adopted.
The recommendation of the Zoning'Board that'the request of John Berghammer
for a permit to remodel his property into a two family dwelling, was read, and
upon motion by Williams second by Anderson, said recommendation was accepted,
and the -Builclirig Inspector authorized to issue a permit for the construction of
said addition.

"a permit to construct a double garage on his property,be granted, was read, and
upon motion by Mrachek second by Moody the said Zoning Board recommendation was
accepted and the Building Inspector authorized to issue a building permit for
the construction of said double garage.
Mr. L.W'.Repsold urged very strongly that the Gas Company be notified of the
Common Council's intentions to purchase the gas plant.. Mayor Grassle stated
that the Council had several new members and a great deal of business to handle
'since April 1st, and asked that Mr. Repsold bear with the Council.
The application of C.R.Bowen for a permit to move a private garage from

409 Second Avenue Southwest to 1149 Center Street West, was read, and upon
motion by Amundsen second by Anderson, permit was granted, all voting in favor
'thereof except Alderman Moody who voted "No".
A motion by Mrachek second by Anderson carried; that no defin&te action
be taken by the Council before the regular meeting of June 3rd,1940, regarding

C.R.Bowen inquired as to what he could tell his prospects in the future
;in regard to moving houses. In the discussion on said subject it was cited that
in one instance a basement had been excavated and a foundation built for a
house before application was made for a permit to move said house.
A motion by Mrachek second by Bowers carried that all applications for .
;permits to move houses be settled on their merrits, and that said matters be
I; taken up with the aldermen of the wards affected before action is taken on the
I permits, and that action on applications for permits to move houses be taken
I�before the house mover or the owners go t.o any expense.
An ordinance prohibiting public dances and public dancing on Sundays
except between the hours of nine o'clock P.M., and twelve o'clock midnight,
introduced and given its first and second readings on May 29th,1940, was given
i its third and final reading.

Minutes of an adjourned regular meeting of the Common Council of the City
of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in
said City, on May 6th, 194o.

President Lemmon called the meeting to order at 7:30 o'clock P.M., the follov
ing members being present: Lemmon, Amundsen,.Anderson, Bowers, Moody, Mrachek,
Williams.
The recommendation of the Sewer Committee.and the City Engineer that
the contract for the construction.of a trunk line storm sewer commencing at
Bourth Street and Third Avenue Southwest, thence north on Third Avenue to
West Center Street,_thence east on west Center Street to Second Avenue Northwest
thence north on Second Avenue Northwest to Fifth Street Northwest thence east
on Fifth Street Northwest and Northeast to the Zumbro River,.b4.ay.-Jarded.to
Wm. C.Fraser & Son and L.M.F.eller & Company for the sum of $54, 769.25, . was
read and President Lemmon. ordered that the same be placed on file.
Alderman Bowers introduced a resolution accepting the bid -and proposal of
Wm. C. Fraser & Son. and L.M.Feller &. Co., for the furnishing of all labor,
materials and equipment, necessary for the.construction.of the trunk line storm
sewer in Third Avenue Southwest, Center Street West, Second Avenue Northwest
and Fifth Street Northwest and Northeast, as.above described for the sum_of.
$54,769.25, which was read.
Upon motion by Moody second by Bowers that the said resolution be adopted
as read, and all .voting in favor thereof,.President Lemmon declared the said
resolution duly passed and adopted.
Upon motion_by Williams second by Amundsen the.City Clerk was instructed
to return the.certified checks of the unsuccessful bidders.
Alderman Williams reported that the committee had interviewed -Mr. Gregg
in regard to the purchase of a fifty foot strip of land bordering on Broadway
Street North, for which Mr. Gregg asked $2500.00 togetheker with a 25 year
lease for an oil station building to be moved back to new street line, and
upon motion.by Bowers second by Moody.the said committee were instructed to ,
offer Mr. Gregg $1500.00 for the 50 foot strip of land, his building to be moved
back to the new street line and he to be given a lease for life and the
building to revert to his heirs; the building to be moved at the expense of the
city provided this plan meets with the approval of the Minnesota Department
of .Highways.
. Upon.motio.n by Moody second by Williams the City Engineer was instructed
to prepare plans and specifications for the widening of Center Street Vest from
Broadway to Seventh Avenue and Second Avenue Northwest from Center Street West
to th4 Chicago Great Western Railroad Company tracks, and also the oiling of
the alley running north and south between Fourth and Fifth Airanabe and between
