Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Coundil Chambers, in the City Hall, in said City, an May 13th, 1940. President Lemmon called the meeting to order'.at 7:30 o'clock P.M., the following members being present: Lemmon, Amundsen, Anderson, Bowers, Moody, Mrachek, Williams. Absent: None. Upon motion by Moody second by Anderson, the minutes of the meeting of May 6th, 1940, were approved. President Lemmon stated this as being the time and place set for a hearing on the construction of a sanitary sewer in Second Street Southwest, from' Sixteenth Avenue Southwest to the west line of Lot 3,Block 2, West Lawn Addition, and asked if any one present wished to be heard concerning the said improvement. No one present wished to be heard. President Lemmon stated this as being the time and place set for receiving bids for the. cleaning and painting of the East Center Street bridge.. The City Clerk reported that no bids had been received, and upon motion by Moody. second by Amundsen the City Clerk was instructed to rea:dvertise for bids.to t be received and opened at 2:00 o'clock P.M., on June 3rd,ig4o. Mr. L.A.Fellows representing a group of property owners from Golden Hill Addition, Knollwood, and Garden Acres, appeared before the Council and requested an adjustment of the $100.00 installation fee fixed by the Public Utility Board for electricity connections in the said additions; said property owners £pinking this $100.00 too high in comparrison with the $45.00 charge in Highland Addition. Alderman Moody explained that these installation fees were to cover the costs only of labor and materials for these connections; and that the difference in the costs was due to the fact that the connections in Highland Addition were made to a 2300 volt line, while those in Golden Hill, Knollwood, and Garden Acres were made to a 6300@rolt line the materials for which were at least 50 per cent higher. Upon motion by Williams second by Anderson the matter was referred t�o the Public Utility Board. Prlrs. John McGovern and Mrs. John Marsh, representing the Ladies Auxiliaries of the American Legion and the Veterans of Foreign Wars, appeared before the Council, asking permission to sell Popies on the streets on April 25th,1940, and upon motion by Amundsen second by Anderson the said organizations were granted permission to sell Popies on the streets on Saturday May 25th,1940. The application of the Texaco Service Station for a permit to place and maintain a sign was read and upon motion by Amundsen second by �Mrachek, permit -.... I� The application of C.E.Lehhardt for a drivers license was read, and upon motion by Mrachek second by Moody license was granted. The application of Bemel Brothers for a junk dealers license, together • e with a surety bond in the sum -of $1,000.00 with the Maryland Casualty Company as surety,(were each read,, and upon motion by Moody second by Anderson, the license was granted, the bond approved, the surety thereon accepted and it was ordered that the same be placed on file.- ii The application of the Yellow Cab Company for transfer of taxicab license !I No.17 to cover a. a 5 passenger LaSalle Sedan bearing State License No.474-061, was read, and upon motion by Williams second by Bowers, transfer fras granted. The official bonds of George F.Strifert with the Great American Indemnity j Company as surety in the sum of$$OOO.00,Jose Bosley $50.0.00 and Mrs. Mabel I Fountain $500.00 each with the Fidelity & Casualty Company as surety, were each ;I read, and upon motion by Mrachek second by moody the said bonds were approved the aureties thereon accepted and it was ordered that the same be g�jaced on file. ' 'I The License bond of J.P.Huyber with the Aetna Casualty & Surety CoDJpany as surety in the sum of $1,000.00, was read, and upon motion by Mrachek second by Moody, the said bond was approved, the surety.accepted and it was ordered is that the same be placed on file. The contract bondsof C.G.Fraser and L.M.Feller in the sum of $54,770.00 ;with the United States Guarantee Company as surety, and of the Standard Oil Company in the sum of $4430.00 with the.Seaboard Surety Company as surety. - were each read, and upon motion by Mrachek second by Moody the said bonds were approved, the sureties thereon accepted and it was ordered that the same be ,placed on file. A petition signed by Harvey W.-Harrison and Carrie L.Harrison, requesting that Lots 2 and 3 in Block 1, tiestlawn Addition be changed from residential and zoned as Commercial, was read and President Lemmon referred the -said petition to I, ;the Zoning Board for recommendation. A communication from the Twin City Testing & Engineering Laboratory, asking that said firm be designated as inspectors of all materials used in the construction of the trunk line surface drainage sewer in Third Avenue Southwest, ' Center Street West, Second Avenue Northwest and Fifth Street Northeast and i '!Northwest, was read, and upon motion by Moody second by Amundsen, the Twin City Testing & Engineering Laboratory was designated to make such inspections. The appointment by the Mayor of Peter Hanson as a special policeman for ;I duty at the A.O.U.!7.Hall, he to serve without pay and to hold office until the !I second Monday in April, 1941, unless sooner removed, was read, and President Lemmon ordered that the same be placed on file. Copies of resolutions passed and adopted by the Public Utility Board, requesting authority to enter into contracts with the American Cast Iron Pipe Company and with the L.A.Kepp Contracting Company, were each'rdad, and President Lemmon ordered that the same be placed'on file. An offer by Elmer W.Lyon for furnishing and installation of 1" Gold Bond Low Density tile 12" x 1211, in the Police Department room, fray the sum of $95.00, was read, and upon motion by Moody second -by Amundsen, -this matter was referred to the Public Grounds Committee with power to act. The Trial Balance of the City Engineer's department for the month of April,1940, was read, and President Lemmon ordered that the same be placed'on file. The report of the Clerk of the Municipal Court for the week ending May 13th,1940, showing"criminal fines and costs coll4cted $159.20, civil fees received $5.D5, and conciliation court fees $1.00, was read and having been -previously approved by the City Attorney, president Lemmon ordered that the same be placed on file. The report of the Finance Committee that they had checked the reports of the Building and Plumbing Inspector, the Electrical Inspector, and the City Weig�hmaster for the month of April, 1940, and found 'the same correct, was read and upon motion by Mrachek second by Anderson said report was accepted. - The Chief of the Fire -Department submitted specifications and estimate of cost for furnishing 750 feet of fire hose. • Alderman Williams introduced a resolution ordering plans, specifications and estimate of cost for the construction of a sanitary sewer and water main in Second Street Southwest from Sixteenth Avenue Southwest -to the west line of Lot 3,Block 2, Westlhwn Addition, #hick was read. Upon motion by Williams second by Amundsen that thle said resolution be adopted as read, and all voting in favor thereof, President �emmon declared the I said resolution duly passed and adopted. T.he.4City Engineer submitted plans, specifications and estimate of cost for the construction of a sanitary sewer and water main in Second Street South- west from Sixteenth Avenue Southwest to the City limits. Alderman Mrachek introduced a resolution adopting the plans and specifica- tions for the construction of the sanitary sewer and water main in Second Street Southwest as above described, ordering a hearing on the said improvement to be held - at 2 :00 o'clock P.M., on 'Mune 3rd, 194o, and' ordering advertisement for bids to be received and opened at 2:00 o'clock P.M., on June 3,1940, which was read. Alderman Mrachek introduced a,resolution authorizing the Public Utility Board to enter into contract with the L..A.Kepp Contractilig Company for the installation of the East Center Street underground system for a total lump sum price of $30,719.00, which was read. Upon motion by Bowers second by Anderson that the said resolution be adopted 'as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Mrachek introduced a resolution authorizing the Public Utility. Board to enter into contract with the American Cast Iron Pipe Company for the furnishing of pipe.and fittings, for a total lump sum price of $1292.16, which i was read. , Upon motion by Moody second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon, declared the said resolution duly passed and adopted. i Alderman Moody introduced a resolution granting public dance permit to the Centual Labor Union, for thii Woodman Hall,.May llth,1940, and fixing the fee at $3.00, which was read.. 'i Upon motion by Mrachek second by Amundsen that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution granting public dance permit to Dale Hess for the A.O.U.W.Hall, May llth,1940, which was read. Upon motion by Mrachek seco7.d by Amundsen that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Bowers introduced a resolut}on appropriating $479.91 from the Park Improvement Fund and ordering payment made to the Rochester Egg & Poultry Company for seed and fertilizer for various parks, which was. read. Upon motion by Moody. second by Bowers that the said resolution be adopted as read, and all voting in favor .thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Bowers in-troduced a resolution appropriating $209.33 from the Permanent Improvement Revo.lving,Fund.and order-ing payment made to Wm.C.Fraser & Son, for first and final. estimate on contract f-or the construction of a sanitary sewer in Tenth Street Southeast from Eighth Avenue Southeast to 170 feet east, which was read. Alderman Amundsen introduced a resolution appropriating $321.96 from the (Permanent Improvement Revolving Fund, and ordering payment made to Wm.C..Fraser 8d Son, for first and final estimate on contract for construction of a sanitary sewer in 101 Street Southeast, from First Avenue Southeast to 260 feet east, whicl Iwas read. Upon motion by Moody second by Bowers that the said resolution be adopted Ias read, and all voting in favor thereof, President Lemmon declared the said iresoiution duly passed and adopted. Alderman Amundsen introduced a resolution appropriating $225.96 from the Street and Alley Fund, $25.45 from the Fire Protection Fund, $3.20 from the Sewer fund, . and ordering payment made to the National Bushing & Parts Company, If or repair parts for equipmeht furnished during March and Apri1,1940, which as read. Upon motion by Amundsen second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Anderson introduced a resolution adopting the specifications for (furnishing 750 feet of fire hose, and ordering advertisement for bids to be received and opened.at 2:00 o'clock P.M.,2on J uue-3,1940, which was read. Upon motion by Mrachek second by Bowers that the said resolution be adopted' las read, and all voting in favor thereof, President Lemmon declared the said reso- jlution duly passed and adoptedl Alderman Anderson introduced a resolution ordering a hearing on the widen- ing of the pavement on Center Street West from Broadway to Seventh Avenue West, land on Second Avenue Northwest from Center Street West to the Chicago Great (Western Railroad Company tracks, rhich hearing shall be held at 7:30 o'clock P.M. on May 20th,1940, which was read. Upon motion by Mrachek second by Anderson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. , ' Geo.Allen, Attorney, representing Dewey Nelson, et.al., appeared before the Council regarding the grading and improving of Eighth Street Southwest, which street is not within the limits of the City, but adjacent to Parkin's Addition, , and E.ilesident Lemmon referred the matter to the Street and Alley Committee, the City Engineer and the City Attorney for report at the meeting to be held on May 20th, 1940. 594 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., . Geo.Allen, Attorney, also spoke in behalf of H.W.Harrison and his petition to have Lots 2 and 3 in Block 1, Westlawn Addition zoned as Commercial,and I; t upon motion by Moody -secon'd by Amuhdsen the matter was referred to the Zoning i� • Board. The Mayor commended Alderman Moody on his efforts through the newspaper to reduce the hazzards of -cisterns in the City, and recommended that steps be taken by the Council to control such conditions. Alderman Moody recommended that an -ordinance governing'such conditions be introduced and passed on this date. Alderman Amundsen introduced an ordinance to prohibit, prevent and remove any and all dangerous conditions in the City of Rochester, Minnesota, whibh was given its first reading. G ' Upon motion by Moody second by Amundsen, and all voting in favor thereof, the rules were suspended and the said ordinance giver, its second reading.' Upon motion by Mrachek second by Amundsen, and all voting in favor thereof the rules were suspended and the said ordinance was given its third and final reading. Upon motion by Amundsen second by Mrachek that the said ordinance be adopted' t as read, and upon roll call all voting in favor 'thereof, President Lemmon declared the said ordinance duly passed and adopted. The Mayor recommended that the purchase and installation of a cooling system be investigated, and upon motion by Williams second by Amundsen the matter Nvas referred to the Public Grounds Committee for investigation. Alvin Benike representing the Continental Oil Company, asked permission to set their new curb in line with the curb in the next block, and upon motion ;iby Moody second by Williams, said Oil Company were requested to abide by the former action of the council regarding this matter.
