HomeMy WebLinkAbout09-16-1957Record of Official Proceedings 6f 'tlie Common Council of the City- of -Rochester, Minn., September 16, 1957 E 1 • 1 Minutes of a special meeting of the Common Council of the City of Rochester, Minnesota held in the Council Chambers in the City Hall in said City on September 9th, 1956. President Bach called the meeting to order at 7:30 P. M. the following members being present: President Bach, Aldermen Briese, Haas and Schroeder. Absent: Aldermen Morris, Tingley and Whiting.. The call of the special meeting was read and President Bach ordered the same placed on file, the said meeting having been called for the purpose of reconsidering ',the location of the water tower on the Carl Elford farm and any other business the said Common Council may deem proper. The following recommendation of the Water Committee was read and upon motion by Alderman Haas, second by Alderman Schroeder, the recommendation was approved and all present voted in favor thereof: "To the Honorable Mayor and Members of the Common Council City of Rochester, Minnesota Gentlemen:' We, the undersigned members of the Water Committee, recommend that if the alternate water tower site described below can be purchased - for the sum of, $1, 500.00, then such site should be purchased by the City in lieu of, the site now being condemned and upon completion of this purchase, ,the condemnation proceedings heretofore instituted should be abandoned. A part of the Southeast quarter of Section Twenty-two (22) ,Township One Hundred Seven (107) North, Range Fourteen (14) West, Olmsted County Minnem�ta, described by metes and bounds as follows: Beginning at a point on the West line of said quarter Section which is two thousand one hundred and twenty (2120) feet North of the Southwest corner of said quarter Section; thence East at right angles a distance of one hundred sixty-two and five tenths (162.5) feet, thence North parallel with the quarter line a distance of one hundred and forty (140) feet, thence West at right angles a distance of one hundred sixty-two and five tenths (162.'5) feet to the quarter line, then South on the Quarter line a distance of one hundred and forty (140) feet to the point of beginning. This re' commendation is made on the basis of the determination of the Public Utility Board at a special meeting held at 4:30 P. M. on September 6, 1957 that the re -location of the water tower can be accomplished without additional cost and without adverse affect on the service for which the water tower was designed. A motion was then made by Alderman Schroeder that the Mayor and the City Attorney negotiate for-tthe purchase of this alternate site in accordance with the pro- visions of the'' above recommendation of the Water Committee. Alderman Haas second- ed the motion and all presentvoted in favor thereof. Mr;. ,.Don Buske was: present in behalf of Mr. Ed Siem who lives in Allendale Sub -Division. and inquired where the new site for the water tower would be located. M., the following members being present: President Bach, Aldermen Briese, Haas, Morris, Schroeder, Tingley. Absent: Alderman Whiting. Upon motion by Morris, second by Schroeder, the minutes of the meetings of September 3rd and 9th, 1957 were approved. • President Bach stated this as being the time and place set for hearing a a ng on the construction of a sanitary sewer in 17th Street Northeast from 3rd Avenue Northeast to a point 190 feet East of the center of 3rd Avenue Northeast. There was no one present wishing -to be heard. President Bach stated this as being the time and place set for a hearing on the proposed annexation of Lots 1, 2 and 3, in Block 1 and Lots 1, 2 and 3, in Block 2, Belt Line Subdivision now completely surrounded by the'City. There was no one present wishing to be heard. A motion was then made by Alderman Haas that the City Attorney be instructed to prepare an ordinance annexing the said lots. Alderman Morris''seconded the motion and all voted in favor thereof. I President Bach stated this as being the time and place set for receiving and opening bids for construction of a sanitary sewer in 13th Street Northwest from 2nd AvenuelNorthwest to a point approximately 300 feet west. The bidsof Littrup Nielson)in the amount of $4,433.75 and Carlisle G. Fraser, Inc. in the amount of $4,631.60 were each received and opened and upon, motion by Morris, second by Briese, the same were referred to the Sewer Committee and City Engineer for tabulation and report. All votted in favor thereof. President Bach stated this as being the time and place set for receiving andopening bids for construction of Part 2 of Trunk Line Sanitary Sewer from the • City System to Country Club Manor 1st Addition (9th Avenue N. W. to Trunk Highway and No. 52) and ''construction of Part 3 of Trunk Line S . anitary Sewer from the City i System to Country Club Manor lst Addition (Trunk Highway No. 52 to Country Club I Manor 1st Addition). SIB Mr. Emil J. Aufenthie, City Dog Catcher, was present and stated that he was having trouble with the chimney on the dog catcher's house and -would like to have it fixed now before winter. President Bach appointed Alderman Briese as a committee of one to investigate the matter and report back to the Council. The following letter from Builders Land Company was -read: "The Honorable Mayor and City Council Rochester, Minnesota The attached Re -Plat of Blocks S, 9, 10,and part of 11 in Elton Hills 2nd Subdivision is submitted for your approval. This replat has not changed the street alignment or the shape or size of the blocks as they were originally platted. The lots as re -platted conform to the city ordinances as to frontage and square footage. This re -plat was requested by the home builders to permit the constr- uction of moderate and low priced homes. The lots could have been described by metes and bounds descriptions from the original plat. However it is recognized that a recorded plat of the new lots would assist the city engineer, building inspector, assessor and other departments to more easily and accurately work in this subidivison. We respectively request the necessary council approval of this re -plat at the earliest date possible. A motion was made by Alderman Haas that the plat be referred to the Planning Commission. Alderman Morris seconded the motion and all voted in favor thereof. A motion was then made by Alderman Schroeder, Chairman of the Sewer Committee, that the two low bids on each of the sewer projects received tonight be retained for- further study and the balance -of the certified checks be returned to the unsuccessful bidders. Alderman Haas seconded the motion and all voted in favor thereof. A letter signed by Joe -Robbins, Chairman of giwanis'Peanut Sales Day, requesting permission to hold their annual Peanut Sales Day on September 23, 1957 was read and upon motion by Haas, second by Morris, their request was granted. A letter from the Board of Public Health & Welfare requesting approval of the appointment of Miss Anita Lussier, R. N. as public health nurse, effective September 23, 1957 at the beginning salary of $340.00 per month was read and upon motion by Morris, second by Tingley, the appointment was approved. A notice from the League of Minnesota Municipalities giving the dates for the 1957 series of Regional Meetings Sponsored by the League(the meeting for this region to be held in Faribault on October 9) was'read and President Bach ordered the same placed on file. • A notice of claim of injury to Harry Meinen in the amount of $17,000.00 caused by stumbling on a dangerous condition of the crosswalk and the curb and gutter on the Southwest corner of the intersection of 2nd Avenue and 2nd Street u 1 •.. The following letter from the Airport Commission was read and upon motion by Morris, second by Haas, the same was approved: "Honorable Members of the Common Council City of Rochester Rochester, Minnesota Gentlemen: The;Airport Committee recommends the following two men be appointed to the Airport Zoning Board: Mr. Robert B. Morris - 909 18th Avenue Northeast Mr. Howard West - 1065 Plummer Lane The' Olmsted County Commissioners have appointed Mr. Ole Blegen of High Forest Township and Mr. Carl Roeder of Ste;*artville to said Board. We are expecting to be notified very soom of the appointment of 'two men by'the Fillmore County Commissioners.' Mr.' Stewart Radsom, Attorney for the Minnesota Department of Aeronautics will lie called in to meet with the said Board to work out details Pegarding regulations for zoning.. Schreiber for per- mission to construct a dwelling unit as an addition to a two car garage now existing on that tract of land described as Lot 11, Block 11, Head & McMahon' s Addition (515 6th Street S.W.), being 501 x 170' in area or 8500 square feet, was read together with a statement of acquiescence signed by nine property owners in that area. Upon motion by Tingley, second by Haas, the petition was referred to the Board of Zoning. The following letter from th.e Department of Public Utilities was read: The IHon. Common Council City' of Rochester, Minnesota Gentlemen: The Public Utility Board respectfully requests that the Common Council authorize the -said Board to abandon water services as hereinafter identified and according to -time schedules .herein stipulated, because of the ri deterioration and that the customers affected be required to connect with existing regulat ion 'mains. In the Alley: between 2nd St. S.W. & Lst St. S.W. from 12th Ave. S.W. to 16th Ave. S.W. `to be abandoned by November 1, 1958. In the Alley: between 1st St. S.W. & W. Center Street 'from 12th Ave. S.W. to 16th Ave. S.W. to be abandoned by November 1, 1•958. In the Alley: between W. Center St. & 1st St. N. Lentfer, Secretary" A motion was made by Alderman Haas that the City Attorney be instrueted to prepare a resolution abandoning the above water services in accordance with Ordinance No. 222. Alderman'', Morris seconded the motion and 8.11 voted iu favor thereof. -• c° Record of Official Proceedings of the Common Council of the City of Rochester, Minn., - September 16, 1957 OSWALO PUBLISHING CO., NEW ULM, MINN. 5195 The following letter was read: "Honorable Mayor and Members of the Common Council City of Rochester, Minnesota Gentlemen: On August 6th, 1956 Henry J. Giese, John Bielenberg and William Bielenberg petitioned to the Common Council that Lots 2 & 25, Block 2 and Lots 2 & 25, Block 3 and the balance of Block 4 that is not already zoned commercial (approximately the North 14601) in Bielenberg & Giese Third Addition be changed from a residential to a multiple dwelling zone. On August 6th, 1956 the Common Council eeferred the said petition to the Board of Zoning. On September 4th, 1956 the Board of Zoning recommended to the Council that the said petition be granted. At this time a hearing was set for September 17th. The hearing was held • on September 17th and 'co ntinued until October 1st, 1956. At this time certain residents in that area objected to the rezoning of Lots 2 & 25, Block 2 and Lots 2 & 25, Block 3. No further action was taken by the Council after the continued hearing held on October 1st, 1956. On the basis of the recommendation of the Board of Zoning to the Common Council dated September 4th, 1956 that the said petition be granted and on the basis of absence of any objections of the change of zoning of the balance of Block 4, Bielenberg & Giese Third Addition (approximately the North 14601), the property owners at this time would like to have the Council proceed to change the balance of Block 4, Bielenberg & Giese Third Addition from a residential to a multiple dwelling z ofte. Alderman Tingley seconded the motion and all voted in favor thereof. The following resolution adopted by the 'Sinking Fund was read and upon motion by Schroeder, second by Morris, the action of the Sinking Fund Commission wes approved: "Be it resolved by the Commissioners of the Sinking Fund of the City of Rochester, Minnesota.: That the sum of $100, 397. S1 be and the said sum is hereby appropriated from the Sinking Fund and ordered paid to the First National Bank of Rochester, Minnesota for the purchase of 3 5/9% U. S. Treasury Notes maturing December 1st, 1957, the same being purchased for the Parking Meter Fund Account. Bonds $100, 000. 0.0 • Premium " 31.25 Accrued Interest 356.56 $100 , 39 7. 910 The request of the Board of Park Commissioners for permission to enter into contract -with Allen Truck and •Implement Company for the purchase of a 1-ton pickup truck for use in the Park Department was read and upon motion by Schroeder, second by Tingley, their- request was granted. A letter from James V. A motion was made by Alderman Schroeder that the Sewer Committee and the City Engineer meet with the School Board to discuss t.hese problems at the earliest possible time. Alderman Morris seconded the motion and all voted in favor thereof. 1� C� A letter from the Rochester Fire Department Relief Association requestinCZY �i permission to make a loan of $10,000.00 to Richard Monson, a fireman, for the building of a new home on 162 Street N. W. in Sunset Terrace and stating that Mr. Schroeder, chairman of the Finance Committee, had seen the blue prints and building • specifications,'was read. The recommendation of the Finance Committee that the Fire Department' Relief Association grant a loan to Mr. Richard Monson, a fireman, for the building of a new home at 162 Street N. W. in Sunset Terrace Addition, the amount of the loan to be $10, 000.00, was also read. Upon motion by Tingley, second by Morris, the recommendation of the Finance Committee was approved. All voted in favor thereof. The recommendation of the Sewer Committee that bids be advertised for October 7, 1957'for construction of Part 1 of the Northwest Storm Sewer Bond Issue Project #9 (from the railroad to a point 400 feet north of 7th Street Northwest) was read and upon motion by Schroeder, second by Briese, the recommendation was approved. The recommendation of the Sewer Committee that bids be advertised for October 7, 1957; (assessment project) for the finish grading, base and bituminous surfacing in Graham's 2nd Addition was read and upon motion by Tingley, second by Haas, the recommendation was approved. The report of the City Engineer that he had examined the petition referred to him requesting surfacing, grading, sanitary sewer, storm sewer, water main and service connections in 16th Ave. N. W. in Thomas First Addition and found it to be in proper form and that the improvement is feasible but only after sanitary sewer ,is first constructed in 16th Avenue N. W. through Bielenberg & • Gie se' s 4th Add ',iti on and giving the estimated cost as $4o, 000. 00 was read. The report of the SItreet & Alley Committee that they had considered the above project and recommend its construction as soon as possible after sanitary sewer connection is made available by extension of the existing main through Bielenberg & Giese's 4th Addition and that the entire cost of this project be assessed against the lots in Thomas First'i'Addition was also read. Upon motion by Schroeder, second by Briese, the recommendation was approved. The report of the City Planning Director that he had reviewed the final plat of Cascade: Plaza and that it met the requirements of City Ordinance No. 704 and. recommended that (1) the final plat of Cascade Plaza be granted final approval. The recommendation of the Planning and Zoning Commission that the above recommendation'of the City Planning Director be approved as conditions for the final plat'- of Cascade Plaza was also read. The recommendation of the Survey Committee that the recommendations of the City Planning Director be approved as conditions for the final plat of Cascade Plaza and that the pla. t be granted final -approval subject to receipt of the City Engineer's report was also read and upon motion by'Schroeder, second by Tingley, the recommendation was approved and the City Clerk was instructed to • prepare a resolution approving the plat of Cascade Plaza. All voted in favor there- of. Alderman Tingley introduced a resolution rescinding a resolution adopted by the Common Council on September-3rd, 1957 approving the plat of "Rolling Greens :'.c" Ropl'at ", which was read. A motion was made by Schroeder, second by' Morris, that the said resolution be adopted as read, a-nd upon roll call and all voting in favor thereof, President Bach declared the said resolution duly passed and adopted. Alderman Schroeder then introduced a resolution approving the plat of "Rolling Greens Replat", which was read. A motion -was made by Schroeder, second by Morris, that the said resolution be adopted as'read and all voting in favor thereof, President Badh declared the said resolution duly passed and adopted. A petition -of The Kruse Company requesting that the Council vacate all that part of 20th Avenue N. W. in Rolling Greens Addition which lies south of the south line of Lot 14, Block 5; all that part 'of, 21st Avenue N. W. in Rolling Greens Addition which lies south of the north line of Lot 24, Block 5, and all of 22nd Avenue Northwest inRolling Greens Addition was read.A motion was made by Schroeder that the City Attorney be instructed to prepare a resolution ordering a hearing on the v-acation and abandonment of the above named streets. Tingley seconded the motion and all" voted in favorthereof. - • The application of The KahlerHote-1 for- a dance license to be effective October 1st, 1957 and to run through the balance of the fiscal period ending March 31st, 1959 was read and upo-n motion by Tingley, second by Schroeder, the license was granted. The application of William M.-Rice for a license to sell soft drinks was read and upon motion by Schroeder, second by Morris, the license was granted. The.applications of Henry Raatz and Roger D. Harwick for Journeyman Electrician's license were each read and upon motion by Morris, second by Schroeder, the licenses were granted. The five contract bonds of Carlisle G. Fraser in the amounts of $6,301.79; $29 , 950.25; $7,106. &0; $35, 962. 50 and $29 ,925.60 with Federal Insurance Company as surety were each read and President Bach referred the same to the Mayor. The two license bonds of Kirckhf Plumbing & Heating Company each in the amount of $1,000.00 with the Western Surety Company as surety and the indemnity bond for lost warrant of J. A. Daly in the amount of $93.42 were each read and upon motion by Tinglley, second by Haas, the bonds were approved, the surety thereon • accepted and the same were ordered placed on file. The report of the City Weighmaster for the month of August, 1957 showing fees received for loads weighed in the amount of $90.90 was read and President Bach ordered the same placed on file. The reports for the month of August, 1957 of the Building Inspector showing fees collected for building permits issued $1,348.00; of the Electrical Inspector showing fees collected for electrical permits issued $314.5' of the Plumbing Inspector showing fees collected for plumbing, permits issued $109.00; of the Heating Inslpector showing fees collected for heating permits issued $560.50 and fees 'collected for sign permits issued $54.63 were each read and President Bach ordered the same placed on file. The reports of the Clerk of Municipal Court for the week ended Sept. 6, 1957 "showing to;ta'l criminal fines and costs collected and civil fees received $1,252.30 and total remitted to City Treasurer $705.50 and for the week ended September 13, 1957 showing total criminal fines and costs collected and civil fees received $944.40 and total remitted to City Treasurer $640.60 were each read and having been approved by the City Attorney, President Bach P ordered the same laced on file.
