of the City of Rochester, Minn., October 14, 1957
Minutes of a special meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City,
on October 14, 1957.
President Bach called the meeting to order at 5:00 o'clock P. M., the
following members being present: President Bach, Aldermen Briese, DeWitz, Haas,
Schroeder, Tingley. Absent: Alderman Morris.
The call of the special meeting was read and President Bach ordered the
same placed on file, the said meeting having been called for the purpose of
annexing land for and approving plat of Elton Hills Third Sub --Division, and con-
sider taking action to acquire the land necessary to straighten 13th Street
Northwest and any other business the said Common Council may deem proper.
A petition signed by Stanley Guth, President of Builders Land Company,
to have the following described property annexed to the City was read:
"That part of the SE4 of Section 22 Township 107 North of Range 14
West described by metes and bounds as follows: Beginning at a
point on the South line of said SE4 of Section 22, 1621.4 feet
East of the Southwes't corner of said SE-, thence Northwesterly at
a deflection angle of 950571 left for a distance of 76.6 feet,
thence Northeasterly at a deflection angle of 100431 right for a
distance of 267.9 feet, thence Northwesterly at a deflection angle
Of 10059' left for a distance of 164.8 feet, thence Northwesterly
at a deflection angle of 11006, left for a distance of 341.7 feet,
thence Northwesterly at a deflection angle of 5039' left for a
distance of 159.6 feet, thence Northeasterly at a deflection angle
of 89059' right for a distance of 130.4 feet, thence due East a.
deflection angle of 230031 right for a distance of 61.0 feet (thence
Northeasterly at a deflection angle of 370591 left for a distance
of 144.61 thence Northeasterly' at a deflection_ angle of 22016, left
for a, distance of 129.0 feet, thence Northeasterly at a deflection'
angle of 51040' right for a distance of 214.41 feet, thence
Northeasterly at a deflection angle of 3P°551 left for a distance
of 512.9 feet to the East line of said SEW„ thence South along
said line for a distance of 1832.7 feet to the Southeast corner
of said SE4, thence West along the South line of said SEI to the
point of beginning, in Olmsted County, Minnesota. 1t
The recommendation of the Planning and Zoning Commission that they had reviewed the
1proposed annexation of lands and recoT#mended that the said lands be annex§;d to the
City of Rochester was read and placed on file.
An Ordinance annexing to the City of Rochester, Minnesota a part of the
.Southeast onq-quarter of Section Twenty-two, Township One Hundred Seven, North
of Range fourteen West, Olmsted County, Minnesota, was given its first reading.
Upon motion by Schroeder, second by Briese, and upon roll call and all
voting in favor thereof, the rules were suspended and the ordinance was Liven its
second reading.
Upon motion by Tingley, second by Schroeder, and upon roll call and all
voting in favor thereof, the rules were suspended aAd the ordinance was given its
third. and final reading.
Upon motion by Tingley, second by DeWitz, that the said ordinance be
adopted as read, and all voting in favor thereof, President Bach declared .the said

The recommendation of the Planning and Zoning Commission that the plat of Elton
Hills be granted final approval as to general street pattern and lot layout was
read together with the recommendation of the Survey Committee that the final plat
of Elton Hills '3rd Subdivision be granted final approval subject to receipt of the
City Engineer's report. The recommendation of the City Engineer that he had
examined the plat of Elton Hills Third Subdivision and that it meets the require-
ments of Ordinance 704 and is acceptable was also read. Upon motion.by Schroeder,
second by DeWitz, the recommendations were approved and the City Attorney was
instructed to prepare a resolution approving the plat of Elton_ Hills Third Sub-
Divis ion.
Alderman Schroeder introduced a resolution accepting the plat to be knowy
and designated as Elton Hills Third Subdivision. Upon motion by Tingley, second
by Schroeder, resolution approved.
Mr. Lloyd Bennett and Mr. and Mrs. Wendell Bass were again present and
inquired if the', Council had taken any definite action in regard to purchasing land
necessary to straighten 13th Street Northwest. They were told that the Council
was awaiting a more detailed report which they they expected to get in about ten
days. Mr.. Bennett stated that he would like some definite answer as to the price
they intended to pay and also if he was going to be able to move the house from
the lot. He was told to submit a written proposal to the Council as to what he
.felt the lot and house were worth, and perhpps the matter could be expedited
faster than by condemnation. Mr. Bass was told that as soon as the Council
received a moreldetailed report they would be able to tell if they needed the
*whole property or just a strip of land on the side taut until then they could not
give him a definite answer until then.
Upon motion by Schroeder, second by Haas, and upon roll call and all
voting in favor ,thereof, the Council considered business other than the call.
A letter signed by Stanley Guth of Builders hand Company requesting
permission to construct sanitary sewer, storm sewer, water mains, sewer and water
house connection's and such street construction as is required and necessary, in
Elton_ Hills Thirid Subdivision and also requesting that the Council appoint Kenneth
M&Ghie, civil engineer, as engineer for the a.foremnetioned improvements, was read
and upon motion by Haas, second by Schroeder, the same was referred to the
Street & Alley Committee, Sewer Committee, Water Committee and City Engineer.
A letter from the American National Red Cross notifying the Council of
the Red Cross Disaster Preparedness meeting on Thursday evening October 17th at
7:00 P. m. in the public library was read and Presiddnt Bach ordered the same
placed on file.
The request of Olmsted County Bank & Trust Company for permission to
erect a temporary canvas canopy,

on October 24, 25 and 26, was read. Upon motion by Schroeder, second by Haas,
their request was granted. All voted in favor thereof.
The request of the Kahler Corporation for permission to close, for
construction purposes, the alley behind the Kahler Hotel between Center Street
and First Street Southwest, effective immediately through April 1, 1959, was read
land upon motion by Schroeder, second by Briese, their request was granted and
the City Clerk was instructed to notify the Fire and Department. All voted in
faovr thereof.
The request of American Wart Dads, Inc. for permission to sell marigold
tags, for their annual tag day on the streets of Rochester on Saturday, October 26,
from 9:00 A. M. to 6:00 P. M. was read and upon motion by Schroeder, second by
DeWitz, their request was granted. All voted in favor thereof.
Alderman Schroeder introduced a resolution approving the plat to be
known and ddsignated as Valleyhigh Addition, which was read. Upon motion by
Schroeder, second by Tingley, resolution adopted.
Upon motion by Schroeder, second by Tingley, the meeting was adjourned.
