r64 Record of Official Proceedings of the Common Council of the City . of Rochester, Minn., November 4, 1957 Minutes of a regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City, on November 4, 1957. President ,Bach called the meeting to order at 2:00 o'clock P. M., the following members being present: President Bach, Aldermen Briese, DeWitt, Haas, Morris, Schroeder, Tingley. Upon motion by Haas, second by DeWitt, the minutes of the meetings of October 21st and 31st, 1957 were approved. The following letter from the Downtown Rochester Retail 14ercha,nts • Association was read: "The Honorable Mayor C. H. McQuillan Alderman -At -Large A. M. Bach Members of the Common Council City of Rochester, Minnesota Gentlemen: Representatives of the Downtown Parking Council made up o-f members of the Rochester Central Area Improvement Association, the Downtown Retail Merchants Association and other interested groups respectfully petition that the City of Rochester acquire the property known as the Baihly property at 124 - 1st St. S. E. We urge that an appraisal committee be appointed to ascertain the value of the property and tha-t the city initiate condemnation proceedings for the acquisition of the property. It is our belief that the property in .question is needed, for public purposes as an addition to the present parking areas being used in that block. Such parking areas are necessary for the well- being of the City as a growing community. It would also be a helpful addition to parking available for evening auditorium functions. Your thoughtful consideration of this matter will be greatly appreciated. Yours very truly, Is VIRGIL M. ELLIOTT ` Virgil Elliott, Representative of D.T. Retail Merchants Assoc. & C.A.I. Association° Mr. C. R. McDonald, representing a of about 20 business men, was present and group stated that the downtown business men were very disturbed about the parking situation and they felt the purchase of this property would be a wise investment for the City. He cited figures of revenue received from the present parking lots • and showed the increase from 1952 to the present time. Alderman Morris, chairman of the Public Grounds Committee, stated that the said committee had reviewed the property and verbally recommended that the said committee concurred with the idea to purchase this property. Mr. Leonard Ekstrand stated that this lot was directly across from the auditorium and felt the City should try to purchase same before some other concern did. He pointed out that by purchasing this land there would be an exit as well as. an entrance to the present Trot which would it much more usable and efficient. A motion was made by Alderman Morris that the matter be referred to the Finance Committee and that the Baihly property be purchased if the funds are available. Alderman Tingley seconded the motion and all voted in favor thereof. Sehartau, Charles C. Passe and Robert G. Gill to have Lots 5 and 6, Block 2 and Lot 5, Bloack 3' of Gonderman & Thiel ' s Sub -Division changed from a residential to LID a commercial zone be granted was read. Airs. Arthur Betts and Mrs. Einar Lange were Cb present to inquire when the hearing would be held on the above change of zoning. A motion was made by Alderman Tingley that the action of the Board of Zoning be accepted and a hearing be set for November 26th, 1957 at 7:30 P. M. Alderman Haas seconded the motion and all voted in favor thereof. • President Bach stated this as being the time and 'place set for the following hearings: Hearing on the petition for vacating and abandoning all that part of 20th Avenue Northwest in Rolling Greens Addition which lies South of the South line of Lot 11+0 Blocs 5; all that part of 21st Avenue Northwest in Rolling Greens Addition which lies south of the north line of Lot 24, Block 5 and all of 22nd Avenue Northwest in Rolling Greens Addition., There was no one present wishing to be heard. Hearing on the construction of a sanitary sewer, storm sewer, water main, sewer connections and street grading and bituminous surfacing in Cascade Plazas There was no one preset wishing to be heard. Hearing on the construction of a water main extension in 19th Avenue Northwest from 7th Street to loth Street Northwest and in 7th Street Northwest west of 19th Avenue Northwest in Valleyhigh Addition Replat. There was no one present wishing to be heard. Hearing on the constructi'on of a sanitary sewer in 7th Street Northwest from 19th Avenue Northwest to the west line of Valleyhigh Addition Replat. There was no one present wishing to be heard. Hear'ing 'on the construction of a relief sanitary sewer in 7th Street • Northwest to a point 230 feet east of llth Avenue Northwest. There was no one present wishing;. to be heard. A letter from C. H. Diekmeier, Manager of General Trading Company for a loading zone in! front of their place of business, 507 First Avenue Southwest, was read and upon- motion by Haas, second by Schroeder, the same was referred to the Police Committee and the Chief of Police. The following resolution adopted by the Public Utility Board was read and President Bach ordered the same placed on file: "Be'' it and it is here.by resolved by the Public Utility Board of the City of Rochester, Minnesota that the Common Council of the said City be and is hereby requested to authorize the said Board to enter into a contract with C. C., PAGENHART for the furnishing, in accordance with specifications on file; ALL LABOR, TOOLS, MATERIALS AND EgUIPMENT NECESSARY �- FOR THE CONSTRUCTION OF PUMP- HOUSE NO. 151, the total amount of the said contract to be NINE THOUSAND EIGHT HUNDRED DOLLARS (49, 500.00) and the said C. C. Pagenhart being the lowest Responsible bidder.", %a Record of Official Proceedings of the Common Council of the City of Rochester, Minn., November 4, 1957 A letter from the State of Minnesota, Water Pollution Control Commission, transmitting a report of plans for alterations and addition to the Sewage Treatment Plant and granting a permit for construction of same was read and President Bach ordered the same placed on file. A notice from the Railroad and Warehouse Commission of a hearing in the matter of application of the Greyhound Corporation (Central Greyhound Lines Division) for authority to increase its Intrastate passenger fares within the State of Minnesota, said hearing to be held in the State Office Building, St. Paul, Minn. , on Tuesday, December 3, 1957 at 9:30 A. M. was read and President Bach ordered the. same placed on file. A letter from the Minnesota Railroad and Warehouse Commission, Department of Weights and Measures, stating that if so desired an inspection of the 100,000 pound Howe motor truck scale would be made in the near future for the sum of $24.00 was read. A motion was made by Alderman Schroeder that the City Clerk be authorized to instruct them to make the said inspection. Alderman Tingley seconded the motion and all voted in favor thereof. The City Engineer's preliminary estimate for the construction of a relief sanitary sewer in 7th Street Northwest from 7th Avenue Northwest to a point 230 feet east of llth Avenue Northwest in the amount of $13,334.20 was read and President Bach ordered the same placed on file. A letter signed by L. J. Fiegel, President of Olmsted County Bank & Trust Company, thanking the Council for the plant sent to them during their open house was read and President Bach ordered the same placed on file. A letter from the State of Minnesota, Department of Highways, transmitting four copies of an agreement and resolution to be entered into with the City of Rochester covering maintenance for the year of 1959 and noting that the amount to be paid per mile per year had been increased from $900.00 to $1,000.00 was read and as there was a resolution following, President Bach ordered the same placed on file. The recommendation of the Board of Zoning that the petition of George P. Leiferman to have Lots 1 to 16, Block 1, Cascade Plaza changed from a residential to a commercial zone be granted was read. Upon motion by Tingley the recommendation was accepted and a. hearing was set for November 26th, 1957 at 7:30 P. M. Alderman Schroeder seconded the motion and all voted in favor thereof. The recommendation of the Police Committee and the Chief of Police that the request of Schmidt Awning and Siding Company at 414 South Broadway for a loading zone be granted and that the Cit-tT Attorney be instructed to draw the necess- ary resolution to make this change effective was read. Upon motion by Schroeder, second by Morris, the recommendation uias approved and the City Attorney was instrv.- cted to draw the necessary resolution. All voted in favor thereof. 1 • 1 1 • 1 67. November 4, 1957 1 • 1 • 1 �7_ The recommendation of the Police Committee and the Chief of .Police that the request of Waters Conley Company, Incorporated, 501 - lst,Avenue N. W. for a truck loading zone on the west side of 1st Avenue N. W., one hundred and twenty- five feet North' of 5th Street for a distance of thirty feet., more or less, be granted and that the City Attorney be instructed to draw up the necessary resolu- tion to make this change effective was read. Upon motion by Haas, second by DeWitz, the recommendation was approved and the City Attorney was instructed to prepare the necessary resolution. All voted in favor thereof. The following recommendation of the Planning and Zoning Commission was read: "Honorable Mayor and Common Council City of Rochester, Minnesota Re: Petition for Annexation of Lands in'Highland Addition located on 21st.Avenue S.W. from 3rd Street to 5th Street S.W. Gentlemen: The Planning and Zoning Commission at its regular meeting held October 23, 1957 reviewed the proposed annexation of the above described lands in Highland Addition and recommend that: 1.' The property owners be made aware of the following problems: a. Houses are located very poorly with relation to the street grade. This presents a serious prob- lem to grading a normal city street cross section and adequately serving properties on each side of the street. b. Rock excavation will increase costs of utility construction in the area. C. That land lying above elevation 1,100 will need to be served by a high pressure water system. which at present is non-existent in the area. 2.; That the area be annexed to the city to help eliminate future health and sanitation problems that may occur in the area. (Pending a valid petition.). Respectfully submitted, CITY PLANNING AND ZONING COMISIISSICN /s Donald L. Grue, Chairman" The recommendation of the Survey Committee that the petition for annexation of the above described !,'lands in Highland Addition be annexed to the City of Rochester and the property owners be made aware of the construction problems that exist in the area (pending alvalid petition) was also read. Upon motion by Haas, second by Schroeder, the recommendation was. accepted. All voted in favor thereof. The following -recommendation of the Planning and Zoning Commission was read: "Honorable Mayor and Common Council, City of Rochester, Minnesota Re: Northgate 2nd Addition (Preliminary Plat) and Petition for Annexatioi Gentlemen: The Planning and Zoning Commission at its regular meeting held October 23, 1957 reviewed the preliminary plat of Northgate 2nd Addition dated October 15, 1957 and recommend that it be granted preliminary approval as to general street pattern and lot layout. Grue, Chairman" The recommendation of the Survey Committee that the plat of Northgate 2nd Addition be granted preliminary approval subject to receipt of the City Engineer's report and that they concur in the additional recommendations as set forth in the Planning and Zoning Commissions - recommendation was also read." A motion was made by' Alderman Schroeder that the recommendation be accepted, that • preliminary approval be given to the plat and instructing the City Attorney to prepare an ordinance annexing -'the said land. Alderman Morris seconded the motion and all voted in favor thereof. The following recommendation of the Planning and Zoning Commission was read: "Honorable Mayor and Common Council City of Rochester, Minnesota Re: Northwood Second Addition (Preliminary) Gentlemen: The Planning and Zoning Commission at its regular meeting held October 25, 1957 reviewed the preliminary plat of Northwood Second Addition and recommend that it be granted preliminary approval as to general street pattern and lot layout. We further recommend that: 1. the right of way for Northwood Drive be extended to the north line of lot 1, Northwood Second Ad•di t i o n. 2. at least 9 feet of additional reight of way be provided on the west side of Northwood Drive and in front of lot one for a cul-de-sac to be used until such time as Northwood Drive is extended to the north. Grue, Chairman" The recommendation of the Survey Committee that the preliminary plat of Northwood Se•c'b"nd Addition be granted preliminary approval subject to receipt of the City • Engineer's report and that they concur in the additional recommendations as set forth by the Planning and Zoning Commission was also read. A motion was made by Alderman Tingley that the recommendation be accepted and the City Attorney was instructed to prepare an ordinance annexing the said land. Alderman Schroeder seconded the .motion and all voted in favor thereof. The following recommendation of the City Planning and Zoning Commission was read and upon motion by Tingley, second by Schroeder, the same was referred to the Survey Committees. Since! -the beginning of 1956 the City of Rochester has annexed 1,11156 acres of land. These lands breakdown as follows; l9 66 1957 Total Lands' Platted (Acres) 145.2b 255.90 �+01—.0� Lands Unplatted (Acres) 396.64 323.g6 710. 0 Total) 531•90 579-66 1,111.5 The city has acquired only 6.96 acres of o.63% of these lands for actual park useage. These lands were dedicated to the city by the owner's. There were an additional 7.03 acres of land dedicated to the city along the streams for flood control purposes. The Mayo Association has also deeded to the city approximately 20 acres of land South of Slatterly Park for an extension of this area. By combining all of these -lands together, the amount of land acquired • for park purposes is only 3 3.99 acres of 3.06% of all lands annexed and 20 acres of this total the 1945 was within city limits. These figures fall far short of the desirable 10% of lands needed in a city . to provide recreational areas for the community. Small neighborhood parks, well maintained and strategically located in residential areas are a definite asset not only to the, people of th6 area, but to the community as a, whole. We feel that these small parkslwill have a healthy affect on the lives and character development of our children. We also feel that the cost of present and future juvenile delinquency may far exceed that of providing ample recreat- ional and playground areas. In veiw of the above facts, the Planning and Zoning Commission respect-- fuiiyrequests the help of the Common Council in alleviating this problem. Grue, Chairman" The application of Allen DeFosse for a license to sell cigarettes was read and upon motion by Morris, second by Schroeder, the license was granted. The application of Orville Lubahn for a Journeyman Plumber's license was read and upon motion by Tingley, second by Morris, the license was granted. The application of Lysne Construction Company for a, permit to move a 24, x 281 two story house from 1116 - 3rd Street Southeast to 501 - 1_lth Avenue Southeast over certain city streets was read and upon motion by Morris, second by Briese, the permit was granted subject to the approval of the Building Inspector and the Chief of Police. • The contract bonds of Littrup Nielson in the amount of $697.65 ,.=ith- the Travelers Indemnity Company as su-cety and Universal Motors, Inc. in the amount of $12,798.00 with the Standard Accident Insurance Company as surety were each read and the same were referred to the Mayor for his approval. The reports of the Clerk of Municipal Court for the week ending Oct. 25, 1957 showing total fines and costs collected and civil fees received $1, 512.40 and total remitted to the City Treasurer $710.90 and for the week ending November 1, 1957 showing total fines and costs collected and civil fees received $2,407.76 and total remitted to the City Treasurer-$1,432.36 were each read and Having been approved by the' ,City Attorney, President Bach ordered the same placed on file. The following resolutions were each introduced and read and President Bach declared the,same duly passed and adopted: Resolution accepting plans and specifications and ordering bids for the construction of a water main .extension in 1,9th Avenue Northwest from 7th Street to 14th'Street Northwest and in 7th Street Northwest, west of 19th Avenue Northwest in Valleyhigh Addition Replat. Upon motion by Briese, second by DeWitz, resolution adopted. Resolution accepting plans and specifications and ordering bids for the construction of a sanitary sewer in 7th Street Northwest from 19th Avenue Northwest to the west line of Valleyhigh Replat. Upon motion by DeWitz, second by Haas, resolution adopted. Resolution accepting plans and specifications and ordering bids for the making of the following improvements: construction of la relief sanitary sewer in 7th Street Northwest to a_cpoint 2301 East of llth Avenue Northwest. Upon motion by Haas, second by Morris, resolution adopted. Resolution authorizing the Public Utility Board to enter into contract with C. C, Pagenhart. Upon motion by Morris, second by Schroeder, resolution adopted. Resolution autharizing Mayor and City Clerk to enter into an agreement with the State of Minne sota, Department of Highways. Upon motion by Schroeder, second by Tingley, resolution adopted. Johnson was present and presented a proposal to install revenue producing refuse containers in downtown Rochester. He showed pamphlets on same and informed the Council that these containers had been installed in Winona and proved to be a good source of revenue. He was informed that the City of Rochester has an ordinance prohibiting advertising on public property. 0 ; Record of Official Proceedings of the Common Council of the City of Rochester, Minn., November 4. 1957 The following letter wa-s read: ."The Honorable Uity Council City Hall Rochester, Minnesota Gentlemen: The undersigned have been engaged in the business of install- ation, emgine-ering, operations and 'investments of Community Antenna Sys terns. We have conducted economic and technical surveys of the community as to the basic aspects of a television distribution system for -Roc he•s ter. 1 Asa result of this preliminary work, and because local con- ditions provide a favorable base for a 'comnunity antenna Television System, we the undersigned respectfully request the City Council to take favorable action on an ordInamce granting us, its successors and assigns, the right to construct, maintain and operate a Community Antenna Television System in the City of Rochester, Minn. _ Respectfully Yours,, /s A. G. S.CREID9L s u OSEPH C. POIRE II Mr. Poire was present and presented a proposed ordinance granting a community television franchise. He explained that the community antenna system would include a tower and a system of aluminum and copper cable which would be connected with light and telephone poles and then extended into homes. There would be an installation charge and also cost to the householder, at approximately $5.00 a month. The system would pick up outside stations and could give clear receiption without local interference. He also invited the Council, if they so desired, to go to Mankato and see the sytem they had installed thereo. After discussing the matter a motion was made by Alderman Schroeder referring the matter to the License Committee to report back as soon as possible. Alderman Tingley seconded the motion and all voted in favor thereof. Mayor McQuillan brought up the matter of the handling of the lamps in the Stop and Go signals. He stated they were only replaced about once a wekk which often left them not working for days at a time and had received a report that twenty lights were out last Sunday and therefore recommended that the Council consider designating someone to take care of these traffic lights. Upon motion by Alderman Schroeder the matter was referred to the Police Committee. Alderman Haas seconded the motion and all voted in favor thereof. Mayor McQuillan stated that he had received a letter from the American Municipal Association stating that the City of Rochester would have one vote at the Congress. He also stated that he had been appointed to the radio and communi- cations committee of the American Municipal Association.He then suggested that the Council appoint one of its members as a delegate to this congress to be held on November 30, 1957. Mayor I McQuillan requested that his contingent fund be r-eimbursed in the amount of $199.00. Upon moti on by Schroedar, second by Briese, $199.00 was appropriated from the General Fund and ordered paid to the Mayor Contingent Fund. Mayor McQuillan stated that he had again r eceived a request from the Blue and White Cab Company for equal use of cab stands and suggested that the Council take some action to try to settle ..the use of cab stands. James J. Macken, Jr., Chief of Police, stated that he had been requested to set a meeting time with the Police Committee, City Attorney and representatives of the Cab companies to discuss the matter. Thursday, November j, 1957 at 4:00 P. M. was set as the time for the meeting. President Bach declared a recess at 4:15 P. M. President Bach called the meeting to order again at 8:00 P. M.. all members being present. The recommendation of the Sewer Committee and City Engineer that the bid of Acton Construction, Company of St. Paul, Minnesota for furnishing all labor, materials and equipment necessary for construction of the sludge Digestion Facilities Additions to the Sewage Treatment Plant be accepted for proposal No. 1 (base bid) in the amount of $266.961.00 and checks be returned to the unsuccessful bidders was read and upon motion by Tingley, second by Haas, the recommendation of the Sewer Committee was approved. All voted in favor thereof. Alderman Schroeder introduced a resolution accepting the bid of Acton Construction Company Inc. for construction of the sludge digestion facilities additions to the Sewage Treatment Plant. Upon motion by Haas, -second by Tingley, -resolution adopted. President Mr. Roger Acton/of the Action Construction Company, was present and thanked the Council for the award of the contract and infor,med them that it would take approximately a- year to complete this contract. Alderman DeWitz introduced a resolution granting variance in provisions of Zoning Ordinance to warren L. Edwards for permission to build a garage to protrude five feet ahead of established set -back line. Upon motion by Haas,second by Briese, resolution adopted. (All voted in favor thereof) Alderman Morris introduced a. resolution authorizing and directing the Mayor and City Clerk to execute a deed conveying certain properites from the Board of Park Commissioners in exchange for properties belonging to the Grace Luth?eran Church,, lands in School Section No. Thirty-six (36) in and adjacent to Silver Lake Parke. Upon motion by Morris, second by Tingley, resolution adopted. Alderman Haas introduced a resolution vacating all that part of 20th Avenue Northwest in Rolling Greens Addition which lies sout# of the south line of Lot 14, Block 4 and all that part of 21st Avenue Northwest in Rolling Greens Addition which lies south of the north line of Lot 24, Block 5 and all of 22nd Avenue Northwest in Rolling Greens Addition. Upon motion by Schroeder, second by DeWitz, and upon roll call and all voting in favor thereof, resolution adopted. An Ordinance amending an ordinance entitled, "An Ordinance fad the. purpose of promoting health, safety, order, convenience and general welfare by regulating the use of land, the location, size, use end height of buildings, and the arrangement of buildings on lots, and the density of population within the City of Rochester, Minnesota, all in accordance with a comprehensive plan (changing Lot 6, Block 26; Lots 1,2,3,4,5, and 6, Block 27; Lots 1,2,3 and 4, Block 37 and Lot 6, Block 36 all in Northern Addition to commercial district), was given its first reading. Upon:motion by Tingley, second by Schroeder, and upon roll call and all voting in favor thereof, the rules were suspended and the ordinance was given its second reading. Alderman Tingley moved that the City Attorney be instructed to prepare a • _ resolution starting condemnation proceedings on the Baihly property located at 104 - 1st Street Southeast. The recommendation of the Street & Alley Committee that the request of the Builders Land Company to construct the sanitary sewer, storm sewers, water main, service connections and streets in Elton Hills 3rd Subdivision be granted upon sub- mission of completed plans and specifications was read and upon motion by Morris, second by Schroeder, the recommendation was accepted. An informal meeting was set to meet with Peoples Natural Gas Company representative for Wednesday evening, November 6, 1977 at 7:30 P. M.
