P- 182' Record of Official Proceedings of the Common Council of the City. of Rochester, Minn., February. 17, 1959 Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers in the City Ball, in said City, Ion February 17, 1959. President Schroeder called the meeting to order at 7:30 o'clock P. M., the following members being present: President Schroeder, Aldermen Briese, Haas, Kamm, Morris, Tingley. Absont: Alderman DeWitt. Upon motion by Morris, seemnd by Briese, the minutes of the meeting of IFebrnary 3rd and 4th, 1959 were approved. President Schroeder stated this as being the time and place set for receiving and opening bids for the sale and removal of buildings on the East 100 feet of Lots 10, 11 and 12, Block 21, Original Plat ( Known as the Baihley property). The bid of Wilbert and Sam Rueb, that the City to pay the said Wilbert and Sam Rueb, including all salvage, the sum of $500.00. Upon motion by Haas, second by Tingley, the said bid was referred to the Public Grounds Committee.. All voted in favor thereof. President Schroeder stated this as being the time and place set for a continued hearing on filing of a report by the Commissioners on condemnation of lands owned by Josephine Amelia Bottke,.Ann M. Baker and F. B. Baker, individually and Josephkne Amelia Bottke as administrix of the estate of Gust Bottke and George A. and Margery S. Greenwaldt. Mr. D. B. Hunt, Attorney representing the property owners, was present and asked for an opportunity to meet with the Public Grounds (Committee for a few minutes. After a short recess, the meeting was called to order lard no decision having been reached, President Schroeder declared the hearing lterminated and the matter was tabled until the meeting of February 26, 1958. Mr. John Chisholm read a letter signed by L. J. Fiegel, President of the (Olmsted County Bank & Trust Company, requesting a license or permit to construct a "curb service" banking unit, referred to as a "Snorkel", on 2nd Street Southwest japprcaimately one hundred thirty feet west of the west line of Broadway, at the curb, just a few feet west of our main bank entrance at 11 Second Street Southwest. Upon otion by Morris, second by Haas, the same was referred to the Police Committee, the ity Attorney and the Chief of Police. All voted in favor thereof. The following letter from the Board of Education was read and President Schroeder ordered the same placed on file : "Mr. Adolph Bach, Mayor City of Rochester City Hall Rochester, Minnesota Dear Mr. Bach: . The Board of Education, at its.regular meeting on February 4, carefully reviewed the resolution of the Common Council concerning the school tax problem in the new Elton Hills addition. 1 • 1 1 L� 1 0 Record. of Official Proceedings of the Common Council of the City of Rochester, Minn., February 17; 1959 1 • F] 1 • It is the considered opinion of the Boardof Education that the citizens of Elton Hills must pay their proportionate share of the debt of the school district that was outstand- ing at the time of their move to the city. This is common practice in almost every state of the Union. One of the Board members recalled that the Elton Hills problem is similar to the problem of the Mirage Mile when they decided to become a part of the City of Rochester. A committee of the Board expects to meet a member of the State Department of Education next week, and they will further discuss this problem to be certain that our under- standing is correct. Thank you for your interest in our school problems. Sincerely, /x JAMES V. MOON, Superintendent" A letter from John S. Lundy, M. D. commending the fire department on their services' at the time of a fire at his residence was read and President Schroeder ordered the same placed on file. A letter from Mrs. Anna Wetenkanp of 207 - 4th Street Southeast stating) that she did not feel that the -residents on 4th Street should have been charged for the widening and paving which was just assessed was read and President Schroeder ordered the same°placed on file. A letter from Roy Watson, Jr. of the Eahler Corporation, endorsing the action of th.e Council in considering the adoption of an ordinance which would prohibit solicitation on public transportation properties was read. Also a letter signed by Mrs. R. •H. DeWitt and Edith Cutshall protesting the adoption of such an ordinance was read. Mr. D. B. Hunt,. Attorney represemting Airs. DeWitz and Mrs. Cutshall, was present and stated that he felt the' Council should not take such action as in his opinion these people were aiding people coming into the City by helping them find places to stay and were not harming anyone but were making an honest living for themselves. Mayor Bach spoke in favor of these two women and also recommended that the ordinance be not adopted. Upon motion by Tingley, seco)nd.by Haas, the two letters were referred to the License Committee. All voted in favor thereof. A letter from Tom 0. Moore, City Planning Director, for permission to attend a public worts school at the University of Minnesota on March 26th and 27th. 1959 was read and upok motion by Tingley, second by 3aas, the same was referred to the Survey Committee. All voted in favor thereof. A letter from the City Planning and Zoning Commission inviting the Council to attend their meeting on February 26th at 7:30 P. M., at which time the State Community Planning Advisor, Mr. Guy J. Kei.nhofer, would be present was read and President Schroeder ordered the same placed on file. Tervo and James Isaacson requesting the Council to consider them for an off sale liquor license was read and President— Schroeder ordered the same placed on file. A letter from Bert I;sitzen requesting authority to construct streets and install water mains, sanitary sewers, service lines and any other regtiirod construction pertaining to I,eitzen's 3rd Subdivision was read and upon motion by Haas, second by Tingley, the same was referred to the Street & Alley Committee and the City Engineer. All voted in favor "thereof. A claim in the amount of $7 5.00 to $100. 00 of Anthony J. Bl im resulting from the back-up of the city sewer in his basement on February 7th, at the location of 923 - 9th Avenue Southeast, was read and upon motion by Tingley, second by Haas, the.same was referred to the Sewer Committee end the City Attorney. A notice of hearing to be held on Wednesday, February 19, 1959 at 3:30 A. M. in the State Office Building in the matter of the application of Jefferson Transportation Company for an increase in fares was read and the same was ordered placed on file, A petition signed by John E. Verby and Jane .E. .Ver.by to have the follow- ing described property annexed to the City of Rochester was read and upon motion by Haas, second by Morris, the same was referred to the Planning &,Zoning Commission: °A tract of land in Southwest Quarter (SW4) of Section Twenty-five (25), Township One Hundred Seven North (107N), Range Fourteen (14) West, described by metes and bounds as follows: Beginning at a point on the north line of said Southwest Quarter (SW4) 1435.5 feet east of the northwest corner thereof, thence south parallel to the west line of Southwest Quarter (SW4) a distance of 444.0 feet, thence east at right angles to the previous described course a distance of 264.0 feet, thence north parallel to the -west line of said Southwest Quarter ( SW4) a distance of 439.29 feet to the north line of said Southwest Quarter (SW4), thence west along the notth line of said Southwest Quarter (SW4) a distance of 264.0 feet to the place of beginning. Engineer. All voted in favor thereof. A petition signed by Kenneth Yule, Joseph F. Mackey, William H. Ryan and Wilfred A. Yule to have Fifth Street Southeast between loth and llth Avenue vacated was read and rpon motion by Tingley, second by Kamm, the same was referred to the Planning & Zoning Commission. All voted in favor thereof. The recommendation of the Water Committee that bids be advertised for construction of a 1,000,000.gallon water reservoir for the low district of the West Service Area for March 3, 1959 was read and upon motion by Haas, second by Morris, the recommendation was approved and the City Clerk was instructed to (prepare a resolution ordering bids. All voted in favor thereof. The recommendation of the Public Grounds Committee that the bid:=for removal of the buildings on the Baihly property be rejected and that the Council readvertise for bids, to be opened on March 3, 1959, was read and upon motion by Haas, second by Kamm, the recommendation was approved and the City Clerk was instructed to prepare a notibe-.for sale and removal of the said buildings. All voted in favor thereof. The recommendation of the Fire Committee that bids be ordered for the lalarm room addition to the Fire Station No. 1, to be opened March 17, 1958, was read and upon motion by Morris, second by Briese, the recommendation was approved land the City Clerk was instructed to prepare a resolution ordering the said bids.. The recommendation of the Survey Committee that the petition for annexation of part of the North z NW of Section 25, Township 107 North, Range 14 WWest, owned by Krofchalk be approved and the land be annexed subject to the (conditions of the Planning and Zoning Commissions recommendation dated January 24, 11959 was read and upon motion by Tingley, second by Haas, the recommendation was approved and "the City Attorney was instructed to prepare the said ordinance. The recommendation of the Survey Committee that the petition to vacate First Street Northeast from 14th to 15th Avenue Northeast be disapproved so as to provide clear sight disiance for a future railroad crossing on 15th Avenue Northeast and to reserve the land for possible future street development was read and upon motion by Haas, second'by Kamm, the recommendation was approved. All voted in flavor thereof. The recommendation of the Survey Committee that the preliminary plat of Country Club Manor 2nd Addition be granted preliminary approval subject to the conditions set forth in the Planning and Zoning Commissions reoaommendation dated February 3, 1959 and that a revised street numbering system be worked out to eliminate possible confusion in finding addresses was read and upon motion by Kamm, second by Briese, the recommendation was approved. All voted in favor thereof. The recommendation of the Survey Committee that the general plan of Country Club Manor (remainder of Judd farm) dated May 29, 1957 be granted• preliminary approval and that c opy of this plan be forwarded to the Minnesota Highway Department for coordination with plans for the relocation of U. S. 14 West was read and upon motion by Kamm, second by Haas, the recommendation was approved. All voted in favor thereof. The recommendation of the Survey Committee that the Common Council adopt the general development plan of Leitzen 3rd Addition and adjoining property as the official map for this area according to Minnesota Statutes 471.28 and upon adoption the map shall be filed -in the Register of Deeds Office was read and upon motion by Tingley, second by Morris, the recommendation was approved. All voted in favor thereof. The following resolution adopted by the Public Utility Board was read and President Schroeder ordered the same placed on file: "Be it"and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that the Common Council of the @aid City be and is hereby requested to authorize the said Board' to enter into a contract with UNIVERSAL MOTORS, INC., for the furnishing, in accordance with specifications, of ONE (1) FORD 3/4 TON LELIVERY.TRUCK, Model P-35b and equipped as specified, the total bid price being $3,093.49 less an allowance of $300.00 for a used 1948 International Truck, making a net contract price of TWENTY SEVEN HUNDRED NINETY THBBE DOLLARS AND FORTY .EIGHT CENTS ($2,793.4s); the said Universal Motors, Inc, being the lowest responsible bidder." Solberg, Chief Engineer of the State of Minnesota, Department of Aeronautics, submitting copies of the Grant Offer of the Federal Government, dated February 7, 1958 for a maximum of $66o,000.00 in federal funds for the surfacing project for the Rochester Municipal (new) Airport and requesting that the Council adopt a resolution accepting the grant was read. Upon motion by Tingley, second by Briese, the City Clerk was instructed -to prepare a resolution accepting the said Grant Agreement. All voted in favor thereof. The following letter from M. C. Solberg, Chief Engineer of the State of 'Minnesota, Department of Aeronautics, was read: "Miss Elfreda Reiter City Clerk Rochester,, Minnesota Subject: Rochester Municipal (New) - Project Number 9-21-079-5701 Dear Miss Reiter: This is to advise you that the plans and specifications for .insiall- ation of underground electrical duct are approved. Is is necessary that labor rates be inserted. Furnish four copies of rates to this office. The Plans and Specifications for deep well with pump have been approved subject to complieance with the review discussed on February 13 at the .CAA office. Four sets of the corrected specification sheets should be sent to this office. You are authorized to call for bids on this work. Kindly adstise us as to date of letting. This work is a part of the work for which an amendment to the grant agreement was requested. It is necessary that the amendment be accepted before the contracts are entered into. "Having received the approval of the Civil Aeronautic Administration and the State Department of Aeronautics of plans and specifications for the construction of underground electrical ducts and the drill- ing of a well, and the placing of a pump, we hereby request the Common Council of the City of Rochester"to set the date for the opening of bids for said work, and authorize the clerk to advertise for bids. 1t It is important that bids be received.for this work at an early date in view of the fact that the duct -work must be completed prior to the completion of the paving contract. A motion was made by Tingley that the .pro jest beinitiated .and the Chair appoint a .committee to work with Mr. Ellingwood.. Kamm seconded the motion and all voted in favor thereof. Huiting, an employee of the City of Rochester was injured in the scope and course of his employment at the City Dump Grounds. on December 21, 1956, and WHEREAS, Mr. Huitingwas temporarily totally disabled from the date of his injury to June 3, 1957, at which time he returned to full employment for the City of Rochester, and WHEREAS, Dr. W.. H. Bickle of the Mayo Clinic who has attended Mr. Huiting, estimates that Mr. Huiting has sustained 20% permanent partial disability to his back. NOW THEREFORE be it resolved by the Common Council of the City of Rochester that the following payments are hereby authorized to be made -to Norbert A. An Ordinance annexing to the City of Rochester Block five and the west one-half of Block 6, Highland Addition in Olmsted County, Minnesota, was given its third meeting. A motion was made by Alderman Haas that the. said ordinance be- adopted read. President Schroeder declared his motion lost for _want of a se.cond.. Mr. Don Nelson -one of the property owners was pres-ent and inquired when they could bxpect to be annexed, he stated they had been in the process for quite some time now and also stated that they- were aware of the school situation. A motion was then made by Alderman Kamm that this be held in escrow until the next meeting and in the meantime the School Committee meet with the School Board to try to -get more information. Alderman Tingley seconded the motion and all voted in favor thereof , except Alderman Haas who vot ed "no'�.. Mr. B. F. Mulvihill, agent _and Mr. Erwin Peterson, Attorney, of the International Union of Operating Engineers, were again present in regard to meeti with the Council in regard to wage fixing, plans for the employees of the Street & Alley -Department. They were informed that the Council met with all groups in regard to setting salaries, but the meetings could not be _held until after the first of April, when,the Council at that time were the ones to set salaries and they were told that they would be informed when such a meeting would be held. Alderman Morris stated that he had received numerous requests for copies l of the City Charter and that the same were not available. President Schroeder requested that Alderman Morris work together with the City Attorney and City Clerk to investigate the possibility of republishing the -City Charter with all its Iamendments.
