of the City of Rochester, Minn., April 7, 1958
Minutes of the annual meeting of the Common Council of the City of Rochester, Minne-
sota held in the Council Chambers in the City Hall in said City, on April 7, 1958.
President Kamm called the meeting to order at 2:00 o'clock P. M. the following members
being present: President Kammv Aldermen Haas, Hanlon, McGuckin, Morris, Tingley and Wilkus.
An invocation was given by Rev. Joseph Shefveland of Gloria Dei Lutheran Church,
President of the Rochester Ministerial Association.
Mr. Harold Kamm, Alderman at Large and President of the Council, then addressed the
Council stating this is going to be a busy and a good year. Rochester citizens are expecting
unusual leadership by the council to see how we handle and expedite the problems that have arisen
from our tremendous growth program and at the same time, not create an undue burden on the
citizenry. He further stated that 1958 will be a "Test" of efficiency operation. Material and
operating costs continue to rise, this will ignite efforts to redouble study in the area of making
sure we get the most out of each tax dollar. In 1958 serious consideration should be given to
planning the next steps to be taken in our community development beyond those already in blueprint
stage.- In 1958 we shall make a concerted effort to program all the statistical and physical
growth of our community into a "Plan for the Future". The Common Council, as the legislative body
of the City, will be called on to spend many hours and devote much thought to needs of our commun-
ity. Each alderman must be dedicated in order to accept that many assignments gracefully. The
Council, being a public servant, is at the disposal of the citizens at all times and must exercise
equal interest in every part of our city. The older areas need attention as well as the new. We
shall work together toward developing a long range format for Rochester, to keep it the fine City
it is today. He stated that he felt the following objectives were basic -for 1958:
1. Develop( a plan-, to initiate work projects, so a:-perpertual' job opportunity
program may continue in this community.
2. Study necessary capital expenditures needed for long range improvement
activities in Rochester.
3. Initiate a comprehensive guide plan. Utilizing, coordination and assimilating
information and data on Rochester Improvement and put in a written and pictorial
f orm.
4. Develop a close working arrangement with the C. of C., I.O.I., C.L.U., and other
community improvement organizations for a maximum effort in keeping Rochester
a fine City.
5. Be visionary but realistic.
He further stated that recently, in an article listing those things that make a community great,
three of the eight listed, stemmed from the City Hall.
1. Efficient Government. quote, "First on the list of community assets is an
alert and efficient administration".
2. Attitudes. A municipality with a business climate - mindedness, one that will
encourage sound business practices, rather than impede them.
3. Leadership. The big problem at City Hall is no longer honesty, or even simple
efficiency. The fight for these virtues is a continuous one, of course, and
Lucifer is always lurking in the hall, but most city governments have become
reasonably honest and efficient. Today, the big problem is not good housekeeping;
it is whether the City Administration can provide the aggressive leadership and
the positive programs without which no city has a prayer. What is to get priority?
Industrial redevelopment? More housing? (and for whom). There is only so much
money, and if hard policy decisions are not made, the city's energies will be
diffused in programs 'broad' but not bold.
"Sound Study", followed by "Explosive Action". This is the theme for 1958. We have a fine city
team and it is blessed with a good balance of youth and older heads; inexperienced and experienced

personnel; daring, yet conservative individuals; good anchormen are present, to steady the new.
Things will get done in 1958.
President Kamm then introduced Mayor Smekta who gave the following message:
"It is with deep pride that any man would take over the office of Mayor of Rochester.
That pride fills me today as my term of office opens. For our City is progressing rapidly
and election to its chief executive post is a high honor indeed.
But more than pride and honor are to be considered today. There is also a challenge
of office that I must face--a'challenge to fill it well, to give our citizens the capable
and efficient service they deserve, and to make the office of Mayor instrumental in the
further growth of Rochester.
That challenge, gentlemen, is great. It is linked with a similar challenge that all of
you too face. The calls upon you as members of the City Council to serve your City well
will be constant, and your duties will demand unflagging service to the public.
Because of challenges we face - and they should stir any official to his best efforts -
there must be full cooperation between the Council and the Mayor. I pledge that cooperation
on my part, keeping in mind my public statements in the recent election campaign that
Rochester's rapid expansion program demands new, vigourous and constructive leadership.
You on the Council, gentlemen, represent a blending of the old and new in public life,
of that experience in City Government which we need in our deliberations and decisions and
of infusion of a freshness of viewpoint to be brought to the attack on problems faced by
our City.
This blending will, I'am confident, serve the City well. I am further confident that
you will recognize that in the appointments I will submit to you there is a similar blending
of experience and a new participation in the city government.
It is my pleasure to submit for your confirmation the appointment of Alderman Albert
J. Tingley to a three-year term on the Public Utility Board, an office, which I am sure you
will agree, demands a background of experience in our city government and a familiarity with
its relation to the Public Utility system.
To the Board'of Park Commissioners, 3rd Ward, a man who has worked diligently in
behalf of recreation and better park facilities - Phillip H. Lampman.
I am interested in team work and team spirit. This is evident in our Police Civil
Service Commission. That is why I submit to you the name of Dr. James E. Trost'for
appointment to the Commission.
An improtant factor in the future growth of our City is the Planning Commission. It
demands men of vision and good building background. Donald L. Grue has a wealth of
experience and background that will make him a welcome addition to the Commission.
I will submit additional appointments to you at a later date.
In taking office for the year's term with which citizens honordd me at the recent
election, I feel it my duty to review in broad outline my program for Rochester.
At the same time I wish to state that specific recommendations for various improvements
and programs that in streets, zoning, parks and recreational needs - will be submitted
to you from time to time.
At the top of my program is a firm intention to encourage diversified industry to locate
in Rochester to increase employment opportunities and assure an effectively balanced
economy.
I am confident of Council cooperation in this and other phases of a program which
includes the following:
1-Cooperation with the City Engineer's department in furthering a long range street
and sewer program to gain maximum benefit at minimum cost.
2-Study of a complete park and recreational needs for an expending Rochester.
3-To support vigorously the establishment of a regional junior college.
4-Seek a solution of parking and bus transportation problems at maximum public
economy.
5-An exhuastive study of over-all zoning questions to,4ard the end that more effective
zoning regulations may be established.
6-To.lend every effort toward making Rochester physically, socially and economically
attractive to additional industry and citizens.
7-To utilize services of the City Planning Department to coordinate and recommend
problems of first priority to the Council for early solution and action.
8-To work toward a sound and stable tax base through long term financial planning,
efficient municipal purchasing and sound, business -like administration of city
affairs.
9-To recommend a complete study of job calssifications and wage standards of municipal
employees to insure a fair wage program based on present day requirements.
10-To make appointments in the light of the citizen's grasp of problems involved in the
office under consideration and not because of political reasons or connections.
With the submission to you of this program, permit me to say that cooperation with you
gentlement will be paramount in my service as Mayor to a City, which has indeed given me
just cause for pride - a pride that is also mingled with -humility.
I am looking forward to the coming year. It promises to be a year of action - a year
of challenge to all of us, and by working together as a team we will be able to make
Rochester a better city in which to live, work and enjoy."

Alderman Tingley introduced the following resolution which was read and upon motion by
Tingley, second by Morris and all voting in favor thereof, President Kamm declared the said
resolution duly passed and adopted:
"WHEREAS, it is deemed expedient and necessary that the Common Council of
the City of Rochester, Minnesota, adopt rules of order for the conduct of its business,
and
WHEREAS, a copy of Robert's Mules of Order (revised)of the 1915 Copyright,
is before the Common Council.
SO THEREFORE, Be it resolved by the Common Council of the City of Rochester,
Minnesota:
That the said Robert's Rules of Order be adopted by this Common Council as
rules of order for the conduct of its business."'
Alderman Tingley introduced the following resolution which was read and upon motion by

Haas, second by Hanlon and all voting in favor thereof, President Kamm declared the said
resolution duly passed and adopted:
"'Be it resolved by the Common Council of the City of Rochester, Minnesota:
That the said Common Council of the City of Rochester, Minnesota hereby adopts
the following rules and regulations for the order of business of said Common Council:
1. Roll Call. The roll call of the Common Council shall be had
and taken in its alphabetical order according to the names of the
members, except that the name of the President of the Common Council
shall be called first at the first roll call of each meeting and then
after that, at that meeting, his name shall be called and vote taken
after the expression of each of the other members of the said Common
Council.
2. Reading and approval of the minutes of the proceeding meeting.
3. At the first meeting, the appointment of officers and committees.
4. Public Hearings.
5. Reading of petitions and communications.
6. Reports of Committees. All reports of committees shall hereafter be
made in writing, unless ordered otherwise by said Common Council.
7. Unfinished business.
8. Resolutions and ordinances.
9. Bills and claims.
10. Adjournment."
Alderman Hanlon introduced the following resolution which was read and upon motion by
Haas, second by Hanlon and all voting in favor thereof, President Kamm declared the said
resolution duly passed and adopted:
''BE IT RESOLVED by the Common Council of the City of Rochester, Minnesota as
follows:
Section 1. Standing Committees Established. The following permanent standing
committees of the Common Council of the City of Rochester are hereby established:
a. Public Works Committee
b. City Security Committee
c. Internal Affairs and Finance Committee.
Section 2. Committee Functions. The foregoing standing committees shall

consider such matters and perform such functions and duties as are referred or
assigned to them by the Common Council or by the President of the Common Council.
The general jurisdiction of each standing committee is as follows:
a. The Public Works Committee shall consider -all matters relating to:
(1) Streets and alleys
(2) Sanitary and storm sewers
(3) Sewage disposal plant
(4) Water mains, water towers, and other water facilities
(5) Street lighting
(6) Public grounds
(7) Capital improvements
(8) Annexations
(9) Planning and development.
b. City Security Committee shall consider all matters relating to:
(1) Police protection
(2) Fire protection
(3) Health and sanitation
(4) Building codes and building inspection
(5) Traffic control and parking
(6) Licenses and franchise
(7) Public safety.

c. Internal Affairs and Finance Committee shall consider all matters
relating to:
(1) Budgeting and finance
(2) Taxes
(3) Insurance
(4) Investments
(5) Schools
(6) City personnel
(7) Administrative control
(8) Interdepartmental coordination
(9) City Hall
The foregoing breakdown of city functions is intednded to be a representative and
not an exhaustive classification.
Section 3. Each committee shall be composed of not less than three
members who shall be appointed by the President of the Common Council at the
beginning of each official year. In making appointments to the several committees,
the President shall also designate which member shall be chairman of the committee.
Section 4. All prior standing committees of the Common Council are hereby
dissolved and all matters referred to those committees shall.be reassigned to the
new standing committees. The Internal Affairs and Finance Committee shall perform
the functions required of the "Finance Committee" by the Charter of the City of
Rochester."
A motion was then made by Alderman Morris that the Mayor's appointments as submitted
in his message, namely Albert J. Tingley to the Public Utility Board, Phillip Lampman to the Park
Board and Dr. James E. Trost to the Police Civil Service Commission and Donald L. Grue to the
Planning Commission be approved. Alderman Wilkus seconded the motion and all voted in favor
thereof.
President Kamm stated this as being the time and place set for receiving proposals for
being designated as City Depositories. The proposal of the Northwestern National Bank to be
designated as a depository for the funds of the City of Rochester in the sum of $300,000.00;
The First National Bank to bedesignated as a depository for the funds of the City of Rochester in
the sun of $600,000.00 and the Olmsted County Bank and Trust Company to be designated as a deposit-
ory for the funds of the City of Rochester in the sum of $400,000.00 were each read together with
the collateral of each bank. A motion was made by Alderman Morris, second by Alderman Haas that
the proposals be accepted and the City Clerk was instructed to prepare resolutions accepting the
said collateral. All voted in favor thereof.
President Kamm stated this as being the time and place designated for receiving proposals
for official city printing and publishing. A letter from the Post Bulletin Company submitting
their proposal to publish the official printing and advertising of the City of Rochester, Minne-
sota, for the official year c,ammencing April 1st, 1958, in the Rochester Post Bulletin, a legal
newspaper published at Rochester, Minnesota, at the rate established by the statutes of the State
of Minnesota for legal publications and stating that a bond in the amount of $1,000.00 accompanied
the proposal was read. Upon motion by Tingley, second by Morris the bid was rejected. All present
voted in favor thereof.
President Kamm then made the following appointments to the Committees of the Common

The application of Elfreda Reiter for reappointment as City Clerk for the City of Rochester

or the fiscal year 1958-1959 was read and upon motion by Haas, second by Hanlon, Elfreda Reiter was
ointed City Clerk for the ensuing year.
The application of R. V. Ehrick for appointment to the position of City Attorney for the
fisial year 1958-1959 was read and upon motion by Hanlon, second by McGuckin, R. V. Ehrick was
ointed as City Attorney for the ensuing year.
The application of C. A. Armstrong for appointment to the position of City Engineer for
he official year 1958-1959 was read and upon motion by McGuckin, second by Morris, C. A. Armstrong
s appointed City Engineer for the ensuing year.
The application of Tom 0. Moore for reappointment to the position of City Planning
rector for the official year 1959-1959 was read and upon motion by Morris, second by Tingley, Tom 0.
ore was appointed as City Planning Director for the ensuing year.
The application of Garnet Spring for reappointment to the position of Building Inspector
for the officid_year 1958-1959 was read and upon motion by Tingley, second by Wilkus, Garnet
Spring was appointed as Building Inspector for the ensuing year.
The applications of Paul Plantz for reappointment to the position of Electrical Inspector
for the official year 1958-1959 and Ross R. Bay for appointment to the position of Electrical
Inspector for the official year 1958-1959 were each read and upon motion by Wilkus, second by
Tingley, the applications were tabled.
The application of Charles H. Dornack for reappointment to the position of Plumbing
Inspector for the official year 1958-1959 was read and upon motion by Haas, second by Hanlon,
Charles H. Dornack was appointed as Plumbing Inspector for the ensuing year.
The application of William L. Burrows for reappointment to the position.of Heating
Inspector for the official year 1958-1959 was read and upon motion by McGuckin, second by Morris,
William L. Burrows was appointed as Heating Inspector for the ensuing year.
The application of Marvel Kyle for reappointment as Secretary to the Building, Electri-
cal, Plumbing and Heating Inspectors for the ensuing official year 1958-1959 was read and upon
motion by McGuckin, second by Morris, Marvel Kyle was appointed as Secretary to the Building,
Electrical, Plumbing and Heating Inspectors for the essuing year.
The application of W. J. Barden for reappointment as assistant to the City Treasurer for
the official year 1958-1959 was read and upon motion by Morris, second by Tingley, W. J. Barden was
appointed as assistant to the City Treasurer for the ensuing year.
The application of Frank W. Everett for reappointment to the office of Fire Warden of the
City of Rochester for the ensuing official year 1958-1959 was read and upon motion by Hanlon,
second by McGuckin, Frank W. Everett was appointed as Fire Warden for the ensuing year.
The application of Emil J. Aufenthie for reappointment as City Scavenger and Dog
Catcher and the application of Bob Blakely for appointement as City Scavenger and Dog Catcher
for the ensuing official year 1958-1959 were each read and upon motion by Tingley, second by
Wilkus, the same were tabled.

The application of Ivan Boyd for reappointment as Assistant Custodian of the City Hall and
custodian of the voting machines in the City of Rochester for the official year 1958-1959 was read
and upon motion by McGuckin, second by Morris, Ivan Boyd was appointed as assistant custodian
of the City Hall and custodian of the voting machines for the ensuing,year.
The application of Harold Wiesener for reappointment as Assistant Custodian of the City
Hall for the official year 1958-1959 was read and upon motion by Morris, second by Tingley,
Harold Wiesener was appointed as assistant custodian of the City Hall for the ensuing year.
The application of Ernest Hagen for reappointment as Assistant Custodian of the City Hall
for the official year 1958-1959 was read and upon motion by Tingley, second by Wilkus, Errest
Hagen was appointed as assistant custodian of the City -Hall for the ensuing year.
The application of C. A. Cottingham for reappointment as City Weighmaster for the official
year 1958-1959 was read and upon motion by Wilkus, second by Haas, C. A. Cottingham was appointed
as City Weighmaster for the ensuing year.
The application of James A. Waters for reappointment as Chief Maintenance Man in the
Parking Meter Division for the official year 1958-1959 was read and upon motion by Haas, second
by Hanlon, James A. Waters was appointed as Chief Maintenance Man in the Parking Meter Main
Department for the ensuing year.
The application of Joseph Healey for reappointment as Assistant Maintenance Man in the
Parking Meter Maintenance Departement for the official year 1958-1959 was read and upon motion by
Hanlon, second by McGuckin, Joseph Healey was appointed as Assistant Maintenance Man in the
Parking Meter Maintenance Department for the ensuing year.
The application of Andrew J. McCrudden for reappointment as Assistatn Maintenance Man in
khe Parking Meter Maintenance Department for the official year 1958-1959 was read and upon motion
by McGuckin, second by Morris, Andrew J. McCrudden was appointed as Assistant Maintenance Man in
the Parking Meter Maintenance Department for the ensuing year.
The application of Mark P. Gravley for reappointment as Chief Parking Lot Attendant for
the official year 1958-1959 was read and upon motion by Morris, second by Tingley, Mark Gravely
was appointed as Chief Parking Lot Attendant for the ensuing year.
The application of Mark E. Blanchard for reappointment as City Painter for the official
year 1958-1959 was read and upon motion by Tingley, second by Wilkus, Mark E. Blacnhard was
appointed as City Painter for the ensuing year.
The application of Warren Folkert for appointment as Assistant City Painter for the
official year 1958-1959 was read and upon motion.by Wilkus, second by Haas, Warren Folkert was
appointed as Assistant City Painter for the ensuing year.
The application of Flora C. Anderson for reappointment as First General Stenographer for
the Police Department and Stenographer in the Juvenile Bureau of the Police Department for the
official year 1958-1959 was read and upon motion by Haas, second by Hanlon, Flora C. Anderson
was appointed as First General Stenographer for the Police Department and Stenographer in the
Juvenile Bureau of the Police Department for the ensuing year.
The application of Margareth A. M. Anderson for reappointment as Secretary in the Police

Department for the official year 1958-1959 was read and upon motion by Hanlon, second by
McGuckin, Margareth A. M. Anderson was appointed as secretary in the Police Department for the
ensuing year.
A letter from Mrs. Julius Herschleb of 912 Sixth Street Northwest regarding water
flooding their basement, lot and garden was read. Upon motion by Haas, second by Morris, the matter
was referred to the Public Works Committee and the City Attorney.
A letter from Dale P. Quillin, Agency Salesmanager of The Minneapolis Star, requesting a
sign "no parking" in front of the Minneapolis Star and Tribune Office located at 116 North Broad-
way was read and upon motion by Haas, second by Tingley, the same was referred to the City
•
Security Committee and the Chief of Police.
A letter from Emil J. Aufenthie stating that the $30.00 a month he had been receiving
for mileage on his truck did.not cover expenses on same and requested that the Council consider
paying him at the rate of $4.00 per day and he would furnish the gas or $3.00 per day and the
City furnish the gas was read. He also stated that he did not feel it was necessary that he
have an assistant at this time. Upon motion by Morris, second by Tingley, the matter was referred
to the Security Committee.
A letter from the City Planning and Zoning Commission recommending the establishment of
the following job classifications was read and upon motion by Haas, second by Tingley the same
was referred to the Public Works Committee:
1 City Planning Director
1 Secretary (Part - time)
1 Planning Aid
1 Temporary Draftsman
A notice from the Railroad and Warehouse Commission in the matter of application for ten
permit carrier permits was read. Upon motion by Tingley, second by Morris, the notice was ordered
placed on file.
A notice from the Railroad and Warehouse Commission in the matter of application of
Jefferson Transportation Company for an increase in passenger fares for their limousine service
was read. Upon motion by Haas, second by Tingley the notice was ordered placed on file.
The request of the Board of Public Health & Welfare for permission to employ Mr.

Phillip Shoultz as sanitary inspector effective March 24th, 1958 at the beginning salary of
$378.00 per month which is 90% of the base salary was read. Upon motion by Morris, second by
Tingley, the appointment was approved.
A letter from the American Public Works Association requesting that the Council consider
becoming a member of this organization was read. Upon motion by Tingley, second by Hanlon, the
above request was referred to the Public Works Committee with authority to act.
A letter from the Department of Weights and Measures stating that they would make an
inspection of the City's 100,000 pound Howe motor truck scale for the fee of approximately
$30.00 if they so desired was read. Upon motion by Haas, second by Wilkus, the inspection was
approved.
A letter from Roy Watson, Jr. of the Kahler Corporation, inquiring if any further action
had been taken in regard to the installation of traffic signals on the corner of West Center Street

and Second Avenue was read. Upon motion by Tingley, second by Morris, the matter was referred to
the Security Committee.
A letter from the Rochester Hotel Association wishing to go on record in favor of the
solicitation ordinance as presented to the City Council was read. Upon motion by Haas, second by

Tingley, the letter was ordered filed.

The petition of The Kruse Company requesting that the entire unplatted area in Block #6
in Rolling Greens Addition be changed from a residential to a multiple dwelling zone and that the
entire Block #7 in Rolling Greens Addition be changed from a residential to a commercial zone was

read. Upon motion by Morris, second by Tingley, the petition was referred to the Board of Zoning.
The petition signed by L. C. Miller, Catherine A. Miller, F. 0. Fitting, Agnes T. Fitting,
Gerhad Betcher and Dorothy Betcher to have their property in North Rochester on Highway No. 63
changed from a residential to a commercial zone was read. Upon motion by Tingley, second by Haas,
the petition was referred to the Board of Zoning.
The recommendation of the Board of Zoning that the petition of Kleve J. Flakne to have
the property located at 123 - llth Avenue Southeast changed from a residential to a multiple
dwelling zone be rejected was read. Mr. Howard West, Attorney representing the petitioner, was
present and presented a petition of 12 property owners stating that they had no objection to the
property being used as a 5-unit apartment house and in view of having this additional information
requested that the Council give further consideration to same. In view of receiving additional
information, a motion was then made by Hanlon second by McGuckin, that this matter be referred back
to the Zoning Board with the additional information.
The recommendation of the Board of Zoning that the petition signed by Arden and Loretta
Schultz, Carlos and Lenora Ellis, Emil and Jean Pelinka and Ruth Waldron to have the following
described property changed from a residential to a commercial zone was read: Lots 1 and 2 and 3
in Block 1, Beltline Subdivision; Lots 1 and 2 and 3, Block 2 Beltline Subdivision and beginning
on the N. line of 6th Street S.W. 440 feet west of the west line of 15th Avenue S.W., thence west
to west line of highway for place of beg., thence west 197.5 feet, thence north 262.5 feet, thence

east 166 feet to road, thence southeastly along road to beginning, Section 3, Town 106, Range 14,
Olmsted County, Minnesota. The recommendation further stated that in view of the fact that the
Board of Zoning had received a letter from Mr. Arthur Swan, Attorney for all the petitioners except
Mrs. Waldron stating that they wished to withdraw their support of this petition and submit a new
petition a motion was made and carried that this matter be again referred back to the Council without
Any further action. Upon motion by Tingley, second by Wilkus the recommendation was ordered filed.
The recommendation of the Board of Zoning that the request of the City Planning Director
for establishing of uniform building setbacks of 25 feet in Elton Hills Third Sub-Division,be

The recommendation of the Street & Alley Committee that the City Engineer's request to
advertise for bids for the following trucks for the Street & Alley and Engineering Departments be
granted, bids to be received at the first meeting in May was read and upon motion by Haas, second by
Hanlon, the City Attorney was instructed to repare a resolution ordering the said bids: 1 dump truck
(replacement); 1 truck chassis (replacement) and 1 pickup truck (additional).
The report of the City Engineer stating the resolution proposing Extension of watermain
in loth Street Southeast from llth Avenue Southeast to Southgate Addition which had been referred to
him was feasible and that the estimated posts made without,survey or plans are approximately
$21,000.00 was read together with a recommendation from the Water Committee that they had considered
the above project and recommending its immediate construction with the cost assessed against the
abutting property. Upon motion by Haas, second by Tingley, the recommendation was accepted.
A petition signed by 13 property owners to have a sidewalk constructed on both sides
of 14th Avenue Northwest from 14th Street Northwest to 13th Avenue Northwest, including the south
side of Lots 9 and 10 in Block 3, Bielenberg"and Giese First Addition was read. Upon motion by
Haas, second by Morris, the petition was referred to the Public Works Committee and the City
Engineer.
A petition signed by 7 property owners to have a sidewalk constructed on the east side
of 15th Avenue Northwest from 14th Street Northwest to 13th Avenue Northwest was read. Upon..motion

stated that there was a statutory ban on on -sale licenses at groceries but that the Attorney
General ruled that licenses -may be issued where the major businessof such establishments is sale
of beer, with that of groceries as a sideline. But if the reverse is true, a .license may not
be issued. He further stated that this was a matter for determination by the .Council as to
whether the two businesses, in question are engaged in the beer. or grocery business. Upon motion
by Hanlon, second by Morris, the applications of Mrs. A. S. Bourassa and Bernard J. Siskoff were
referred to the City Security Committee. All voted in favor thereof. A motion was then made by
Haas, second by Morris that the other 24 applications listed above for on -sale beer be granted.

• •The recommendation of the Street & Alley Committee was again read, the same having been
held up from -the previous meeting until further consideration could be given to -the following para-
graph:
"The contract shall stipulate that no houses are to be built until sewer and
watermains are installed and the street construction is -advanced to the
point that they will be surfaced before the house is occupied."
This recommendation is in regard to local improvements in Leitzen's Third Subdivision. Mr. Tom 0.
Moore, City Planning Director, stated that the committee had met on this matter and would be coming
up with a recommendation in the near future. Upon motion by Tingley, second by Hanlon, the
recommendation of the Street & Alley Committee was again tabled until the next meeting.
A letter from Mr. R. C. Roesler addressed to Alderman Albert J. Tingley regarding their
request for meter changes on second avenue which was read. James J. Macken, Jr., Chief of Police,
stated that the Parking and Traffic Committee was going to be reactivated and they would come up

with new recommendations for parking meters in certain aread. Upon motion by Hanlon, -second by
Tingley, .the letter from R. C. Roesler was tabled until a recommendation is received from the said
Committee. -
An ordinance annexing to the City of Rochester, Minnesota, a part of Sections Twenty -
Fire and Twenty -Six, Township One Hundred Seven North Range Fourteen West, Olmsted County, Minne-
sota (Miller -Fitting Property) Ordinance No. 981 was given its third and final reading. A motion
was made by Haas, second by Wilkus, that the said ordinance be adopted as read. All voted in favor
thereof and President Kamm declared the said Ordinance duly passed and adopted.
An ordinance annexing to the City of Rochester, Minnesota a part of ,the North one-half
of the Northwest One -Quarter, Section Twenty -Five, Township One Hundred Seven North, Range Fourteen
West, in Olmsted County, Minnesota (Krofchalk Property) Ordinance No. 982 was given its second
reading.. Upon motion by Tingley, second by Morris and upon roll call and all voting in favor
thereof the rules were suspended and the ordinance was given its third and final reading. A motion
was then made by Alderman Tingley that the said ordinance be adopted as read. Alderman Haas
seconded the motion and all voting in favor thereof, President Kamm,declared the said Ordinance
duly passed and adopted.
An Ordinance Providing for the Formation and Government of the Police Department of the
City of Rochester, Minnesota was given its second reading. Upon motion by Haas, second by Hanlon,
and upon roll call and all voting in favor thereof the rules were suspended and the ordinance was..
given its third and final reading. A motion was then made by Alderman Tingley that the said
ordinance be adopted as read. Alderman Hanlon seconded the motion and all voting in favor thereof,
President Kamm declared the said Ordinance duly passed and adopted.
A motion was made by Alderman Haas that the City Attorney be instructed to prepare
resolutions commending Ex -Mayor Bach, Ex -President Schroeder and Ex -Aldermen Briese and DeWitz
for their services to the City of Rochester, said resolutions to be prepared for the next meeting.
Alderman Morris seconded the -.motion and all voted in favor thereof.

Mr. B. F. Mulvihill,/representative for the Street & Alley Department, was present and
inquired if and when he would be given an opportunity to be heard in regard to salaries in the
Street & Alley Department. He was informed by President Kamm that no hearings will be held until
the week of April 21st and when a specific time was designated for him, he would be so informed
by letter.
Mr. Howard Smith, Representative of the Building and Construction Trades Council, was
present and requested that the Council consider the enforcement of a resident labor ordinance re-
quiring that employment preference on city projects be given residents. Mr. Kamm informed Mr.
Smith that this subject would also be studied at the time the salary schedules are studied..
Upon motion by Haas, second by Tingley, the meeting was adjourned until 7:30 P. M.

Minutes of an adjourned regular meeting of the Common Council of the City of Rochester,
Minnesota held in the Council Chambers, in the City Hall in said City on April 7th, 1958.
President Kamm called the meeting to order at 7:30 o'clock P. M. the following members
being present: President Kamm, Aldermen Haas, Hanlon, McGuckin, Morris, Tingley and Wilkus.
President Kamm stated this as being the time and place set for receiving and opening bids
for the construction of a deep well and pump at the Rochester Municipal (new) Airport. The following
bids were received and opened and upon motion by Haas, second by Tingley, the bids were referred

President Kamm stated this was the date set for a hearing on the proposed change of
Zoning of Lot 6, Block 25, Northern Addition (corner of llth Street N.W. and Broadway). Mr. George
Kerr, Attorney representing Mr. and Mrs. Schoenfelder, was present and submitted to the Council a
plat which showed that this lot is already in an lextensively commercial" area and therefore
urged that the Council act favorably on this petition. Mr. John Marsh of 1016 North Broadway was
present and stated.that he was not exactly apposed to the change of zoning but they had heard
that there was to be a trailer court there which would mean noise and lights all night and day and
wondered if some restriction could not be established by the Council on night time limit of the
operation of such a business. Alderman Tingley informed him that the -Council has no control over
the type or hours of business in such a zone. Mrs. Shirly Rose of 34 llth Street Northwest was also
present and inquired if changing the zoning on this property would increase the taxes on her.

Southwest) from a residential to a multiple dwelling zone. There was no one present wishing to
be heard. The recommendation of the Zoning Board that the petition of Howard & Henrietta Grabau
be granted was again read and upon motion by Haas, second by Wilkus, the recommendation was
approved and the City Attorney was instructed to prepare an ordinance making the requested zone
change..
. President Kamm stated this as being the date set for a hearing on the proposed change of
zoning of Lots 10, 11, 12, 13, 14, 15, 16, 17, 18 & 19, in Block 8, Sunset Terrace from a residential
to a multiple dwelling zone. Mr. Stanley Mohn, the petitioner, was again present and explained that
this row of lots were right across from Industrial Opportunities, Inc. and thought they would be
ideal for multiple dwelling. The recommendation of the Zoning Board that the petition to have

Lots 10 - 19, Block 8, Sunset Terrace from residential to multiple dwelling be granted was again
read. Upon motion by Tingley, second by Wilkus, the recommendation was approved and the City
Attorney was instructed to prepare an ordinance making the requested change of zoning.
President Kamm stated this was the time and place set for a hearing on the paving of
7th Street Northwest between Broadway and llth Avenue Northwest. Mr. Louis Hoppa of 236 7th Street
Northwest was present and stated he felt.the Council should consider installation of a traffic
control signal on 7th Street Northwest in the area of 4th Avenue. He stated the traffic was bad
now and felt when 7th Street was widened and paved it would have even more traffic. This being a
part of this particular paving project, but being.a separate item, a motion was made by Tingley,
second by Wilkus, that the matter be referred to the City Security Committee.
Mrs. Charles Fahrman was present and inquired as to how many lines of.traffic would be
going down 7th Street Northwest. C. A. Armstrong, City Engineer, informed her that 44 foot roadway
is sufficient to take'2 lines of traffic.each way if there is no parking on each side with one
line of traffic going each way. She also inquired as to how much land would be taken and was
told that it is not going outside the existing right of way.
Mr. Charles Fahrman of 407 7th Street Northwest was present and inquired if the cost
of this paving,and widening of 7th Street Northwest would be born by the City or property owner.
C. A. Armstrong, City Engineer, informed her that there would be a nominal assessment for residen-
tial property of $5.00 per lineal foot. Mrs. Fahrman also inquired why all the extra land for
widening was being taken from the.north side of the street. She was informed that this was being
done because there was less residential property on this side of the street.
Mr. Robert Jordi of 425 7th Street Northwest was also present and inquired if the side-
walk had to be removed and rebuilt if the cost would all be born by him. C. A. Armstrong, City
Engineer,.informed him that it would be part of the cost of the construction.

Mr. LeRoy Johnson of 411 7th Street Northwest was present/inquired about the work in
front of his place. C. A. Armstrong, City Engineer informed him that when they got in,front of
his house they would have to take up the sidewalk and rebuild it closer to the property line.
Alderman Tingley stated that they had received a number of calls on why land was being
taken on only the South side of 7th Street Northwest from Cascade Creek to llth Avenue Northwest
instead of from both sides. C. A. Armstrong, the City Engineer, reported that the reason it was
being taken only from the South side was that there were fewer residences, a park area.and more
commercial property on this side of the street.

An Ordinance granting to Rochester Video, Inc. a non-exclusive franchise to erect,
maintain and operate transmission cables and distribution facilities along the streets of .the City
of Rochester for the purpose of transmitting, distributing and selling television impulses and tel-
evision energy to the people of the City of Rochester and prescribing the terms and conditions of
such franchise was given its third and final reading.
Mr. John de J Pemberton, Attorney, appearing on behalf of the Southern Minnesota

Broadcasting Company, submitted an outline of considerations believed by the Broadcasting Company
to be relevant and igiportant to the public interest. He based his considerations on subjects of

financial responsibility, technical problems, -code of ethics and policing and administration. He
stated that he felt the applicants seek to bring to Rochester facilities competing with a local
business which is required to comply with Federal -Communications requirements.
Mr. Richard Plunkett, Attorney, representing Rochester Video, stated that the franchise
seekers have no intention of interfering with KROC-TV and that they plan to bring in Channels
2, 4, 9 and 11 but not NBC Channel 5 from the Twin Cities. He further stated that the franchise
applicants had been investigated carefully by the City, that checks had been made and nothing
substantial in the way of an objection had shown up.
Mr. Robert Cross, engineer for KROC, stated that there were documental cases of extreme
interference and felt -some protection from interference should be had.
Mr. J. C. Poire, associated with Rochester Video, said it would be controlled by Federal
Communications Commission as concerns reception interference and added that any complaint by a
citizen not using the antenna service would bring an F. C. C. investigation. After hearing those
present a motion was made by Alderman Haas, second by Alderman Tingley, that the Ordinance be tabled
for two weeks. 1'�
An Ordinance prohibiting solicitation of guests in bus, railroad and airport premises and
providing penalties for the violation thereof was given its third and final reading. A motion was
made by Wilkus, second by Haas, that the Ordinance be tabled until the Play_-12th, 1958 meeting.
An Ordinance providing for the removal of snow, ice, dirt and rubbish.from sidewalks, the
repair of sidewalks, and the collection -of the costs of such work when done by the Municipality as
a special assessment against property -benefited; and providing penalties for violation was given
its third and final reading. A motion was made by Tingley, second by Wilkus, that the Ordinance
be rejected as read. All voted in favor thereof.
A motion was -then made by Alderman Haas, second by Alderman Wilkus that the Public Works
Committee draw up a new Ordinance providing for the removal of snow.
Mr. Andrew Towey, of the Rochester West Company, was present and inquired when the Public
Works -Committee would meet on the matter of storm sewer disposal from Country Club Manor as they
were running short of lots and would like to use lots in Country Club Manor Second Addition as
soon as possible. He was informed that theyhoped to have some kind of a recommendation by the
meeting of April 21st, 1958.
Mr. Bill Lenton, son-in-law of Mrs. A. S. Bourassa, and Bernard Siskoff were each present
in regard to the application for on -sale 3.2 beer license which had been referred to the City
Security Committee. They inquired is there was anything they could do to get favorable action
on these. They were instructed to present a breakdown of sales of beer and groceries.
President Kamm reminded the Aldermen of -the Orientation School which was to start Tuesday
night at 7:15 and to be held every night this week. He urged that if at all possible, everyone
attend each meeting..
A petition with 29 signatures requesting that a survey be made at 6th Street and North
Broadwayto determine if it warrants a traffic signal was read. Upon motion by Tingley, second by
Morris, the same was referred to the City'Security Committee and the Chief of Police for study and
