Rochester, .Minn., -June 24, 1958 1 U_J C C9 C.J • 1 1 1 Minutes of a special meeting of the Common Council of the City of Rochester, Minnesota,I held in the Council Chambers in the City Hall, in said City, on June 24, 1958. President Kamm called the meeting to order at 4:00 P. M. the following members being present: President Kamm, Aldermen Haas, Hanlon, McGuckin, Morris, Tingley, Wilkus. The call of the special meeting was read and President Kamm ordered the same placed on file, the said 1 meeting having been called for the purpose of considering the feasibility report, of the City Engineer and the recommendation of the Public Works Committee regarding Country Club Manor storm sewer and any other business the said Common Council may deem proper. R. V. Ehric4, City Attorney, reported that following adjournment last Friday evening he met with representatives of Rochester West Company and during that meeting outlined a possible alternate solution to this problem which involved the acquisition of all lands North of Cascade Creek, which were considered by our Engineer and Council basically undesirable for urbanization, and after the annexation the construction of a suitable ditch or swale with a dedication of these undesirable lands for park and public purposes but after extensive discussion the meeting broke up with no agreement and with the feeling that the obstacles proposed by the alternate solution were almost unsurmountable. He stated that the feasibility report by the City Engineer had been prepared and a recommendation of the Public -Works Committee was ready and he thought the procedure now should be to consider these. Mr. Frank•Newhouse, Attorney for Rochester West Company, then informed the Council that Rochester West Company had signed a contract for purchase of land to provide an outlet for surface drainage water from Country Club Manor. He stated that land use agreement between the City and Rochester West Company would be a major factor and requested that the Council delay action pending further arrangements by the developers. Mr. David Bishop, Attorney for Mr. Furlow, stated that such a contract had been signed and Mr. Furlow no longer had objection to the storm sewer system proposed by Country Club Manor. Mr. A. G. Whiting, former Alderman, was present and gave a short history or explanation of the beginning of this plan. The matter of agreement on selection of one of the alternative plans was discussed and the developers were to meet with the Public Works Committee on Friday, June 27 at 4:00 P. M. A motion was then made by Alderman Wilkus that this matter be considered further by the Council at their meeting to be held on Monday, June 30, 1958 at 7:30 P. M. Alderman Morris seconded the motion and all voted in favor thereof. The following report on feasibility -of proposed local improvement and report of the Public Works Committee was then read and upon motion by Haas, second by Morris, the same were accepted and ordered placed on file: 0 406 Record of Official Proceedings of .the Common Council of the City. of Rochester, Minn., - June 24, 1958 • "Honorable Mayor & Common Council City of Rochester, Minnesota A resolution proposing a storm sewer outfall from Country Club Manor Additions across the SW- Section 33, Township 107 North, Range 14 West, Olmsted County, Minnesota was referred to this office on June 16, 1958 for Engineers Preliminary Report. I report that the improvement is feasible as proposed and may be pipe constr- uction or, if acceptable to the Common Council, may be open ditch or swale construc- tion, described as Plan No. 4 and Plan No. 1, respectively, in the report of Toltz, King, Duvall, Anderson & Associates dated June 4, 1958, a copy of which report is attached hereto and made a part hereof. The estimated costs including engineering and easement acquisition made without survey or plans are $110,000.00 for Plan No. 4 and $50,000.00 for Plan No. 1. Is C . A. ARMS TRONG City Engineer -- REPORT OF COMMITTEE The Public Works Committee has considered the above project and recommends its construction and further recommends that the entire cost of the project be assessed against all lands, platted or unplatted, in the East one-half of Section thirty-two and the West one-half of Section thirty-three, Township One Hundred Seven north, Range fourteen west, Olmsted.County, Minnesota which are now in the City of Rochester and which lie south of 7th Street Northwest. /s ALBERT J. McGUCKIN Alderman Tingley then introduced a resolution receiving preliminary report, ordering a public hearing and directing preparation of plans and specifications in respect to the following improvement: Storm sewer outfall from Country Club Manor Addition across the SW]k Section 33, Township 107 North, Range 14 West, Olmsted County, Minnesota, which was read. A motion waslmade by Haas, second by Morris, that the said resolution be adopted as read and all voting in favor thereof, President Kamm declared the said resolution duly passed and adopted. C. A. Armstrong, City Engineer, inquired if Toltz, King, Duvall, Anderson & Associates, Consulting Engineers should continue with the plans and specifications as previously instructed.
