Minutes of -an adjourned regular meeting of the Common Council of the City of Rochester,
Minnesota, held in the Council Chambers, in the City Hall in said City, on November 17, 1958.
President Kamm called the meeting to order at 7:30 P. M., the following members being
present: President Kamm, Aldermen Haas, Hanlon, McGuckin, Morris, Tingley, Wilkus.

Upon motion by Wilkus, second by Morris, the minutes of the meeting of November 3, 1958
were approved.
President Kamm stated this as being the time and place set for a hearing on the dondemn-
ation of a parcel of land in Sections 14 and 15, Township 107 North, Range 14 West, Olmsted County
•
Minnesota (for airport purposes). There was no one present wishing to be heard. The report of
the Commissioners on condemnation of certain lands and interests in land in Township 105 North,
Range 14 West, Olmsted County, Minnesota for airport purposes was presented. R. V. Ehrick, City
Attorney, summarized the report as submitted by the Commissioners, which awarded the sum of
$4,375.00 for the property owned by Alfred R. and Elner A. Pehl; this was the final parcel at�the
airport, across Highway 63 on the east side. He stated that Mr. Pehl had indicated that the
award was satisfactory and he was going to make the conveyance to the City by warranty deed and
then the condemnation proceedings will be terminated, if he does not do this the resolution
approving the report of the commissioner's could be passed at the next meeting. A motion was then
made by Morris that the hearing be closed and the matter be tabled until the next meeting. Haas
seconded the motion and'all voted in favor thereof.
A letter from the Schuster Realty Company requesting permission for the abandonment of
the well on the Rochester Dairy Pioneer Plant Site was 'read. A motion was made by Morris that
the request be referred to the Board of Public Health & Welfare and the Public Utility Board.
McGuckin seconded the motion and all voted in favor thereof.
A letter signed by Mary E. Gumm of 832 - 14th Street Northwest stating that the "no
parking" signs on 14th Street had affected her business and requesting consideration of same was
read. Upon motion by Morris, second by Haas, the same was referred to the City Security Committee.
A letter from the Mayor's Parking & Traffic Committee kuggesting two matters for the
consideration of the Council e.g. (1).movement of satisfaction of parking tickets from the Police

Department to some other office - City Treasurer's Office and (2) the extension and/or revision of
parking meter zones and parking restrictions was read. Upon motion by Haas, second by Tingley, the
same was referred to the City Security Committee. All voted in favor thereof.
The resignation of Ross Browning as City Treasurer of the City of Rochester, effective
after December 31, 1958, was read. A motion was made by Morris that the Resignation of Ross
Browning be accepted. Haas seconded the motion and all voted in favor thereof.
The matter of accepting applications to fill the vacancy of the position of City Treasurer
was then discussed. A motion was made by Tingley that applications be Received up until December
15th, 1958 for the position of City Treasurer. Wilkus seconded the motion and all voted in favor
thereof.
A letter.signed by Thomas Wolf thanking the Mayor and Council for having, appointed him to

A letter signed by Franklin Michaels, ;Attorney requesting that the signature of Mrs.
H. S. Plummer, Quarry Hill, Rochester, Minnesota be withdrawn from a petition dated November 6,
1958 which calls for construction of sanitary sewer and water main from the west line of
Austin's Replat on llth Street Southwest to a point 280.8 feet west thereof, was read. Mr.
Michaels was present and'stated that Mrs. Plummer had signed this petition under the mistaken
idea that she was merely granting an easement to construct said water main and sewer across her
property for the benefit of property owned by W. J. Zweifel., Upon motion by Tingley, second by

Morris, the matter was referred to the Public Works Committee. All voted in favor thereof.
A letter from the City Planning and Zoning Commission expressing its appreciation to the
Common Council for the support and approval of the Comprehensive Planning Program for the City
of Rochester was read and President Kamm ordered that the same be placed on file.
A letter signed by Dale P. Quillin requesting a parking zone in front of the local office
of the Minneapolis Star and Tribune at 407 South Broadway was read. Upon motion by Haas, second
by Hanlon, the letter was referred to the City Security Committee. All voted in favor thereof.
A letter signed by Howard Garbisch of 122 - 8th Street N. W. in regard to the condition
of the sidewalk on 2nd Avenue Northwest south of 5th Street by the Rochester Ready Mix Company
Driveway was read. Upon motion by Haas, second by Hanlon, the letter was referred to the City
Engineer; All voted in favor thereof.
The following emergency order issued by the Mayor was read -and upon motion by Haas,
second by Hanlon, the same was approved and the City Attorney -was instructed to draw up the
necessary contract:
"Honorable Members, Common Council
City of Rochester
Rochester, Minnesota
Gentlemen:
Mr. Frank Everett, Chief of the Fire Department-, City of Rochester, informs
me that an emergency exists'in the Fire*Department due to the loss of one Seagrave
1006 gallon per minute Pumper. Arrangements have now been made to have the motor
and the pumper unit repaired by the Local Fire Department Mechanics and to have the
body and frame repaired locally by the Truck Service Company. If this truck can be
repaired on an emergency basis locally, it will not be necessary to consider the
acquisition of a new Pumper.
The Fire'Department Mechanics and Truck Service Company are prepared to commence
the repair of the truck damage on an emergency basis so as to minimize -the fire
hazard resulting from this pumper being out of service.
I have therefore authorized this damage to Pumper to be repaired on an emergency
basis and I recommend the Common Council to enter into a contract with Truck Service
Company without submitting the contract for bids.
The estimated cost of repairs to be done by the Truck Service Company is $6,895.00.
No estimate is available of:the cost of_repairing the motor and pumper unit.

was read. A motion was then made by

A motion was then made by Tingley that
the budget as submitted be
approved and the City Clerk was
instructed to prepare a resolution
approving same. McGuckin seconded the motion and all voted in
favor thereof.
The matter of constructing a tower on top of the City Hall building for use of the Civil

Defense was brought up and upon motion by Tingley, second by Morris, the matter was referred to
the Internal Affairs Committee. All voted in favor thereof.
Alderman Morris stated that the intersection of 7th Street and llth Avenue Northeast
had become very hazardous because there was so much traffic and thought consideration should be
given to installing some kind of signal. A motion was then made by Morris that the matter of
installing a signal at 7th Street and llth.Avenue Northeast be taken under advisement by the
City Security Committee. Tingley seconded the motion and all voted in favor thereof, except
Haas and Hanlon, who voted "no".
A motion was then made by Haas that the City Security Committee be given permission to
hire a traffic engineer on an emergency basis. Hanlon seconded the motion and all voted in favor
thereof.
Upon motion by Haas, second by Morris, the meeting was adjourned at 10:50 for ten
minutes. The meeting was called to order again at 11:00 P. M.
Alderman Tingley introduced the following resolution which was read:

A motion was then made by Tingley that the above resolution be adopted as read. Morris,seconded
the motion and all voting in favor thereof, President Kamm declared the said resolution duly
passed and adopted.
A resolution appropriating $52,085.00 from the Sinking Fund and ordering payment made
to Guaranty Trust Company of New York was read. A motion was made by Haas that the said
resolution be adopted as read. Tingley seconded the motion and all voting in favor thereof
President Kamm declared the said resolution duly passed and adopted.
The following letter from the Attorneys representing the Rocabco, Inc. and the Yellow
Cab Corporation was read and upon motion by Haas, second by McGuckin, the same was referred to the
City Security Committee:

Gentlemen:
In hearing before the Security Committee of the Common Council, we have

outlined a rproposal between Rocabco, Inc. and Rochester Yellow Cab Corporation
for the formation of a joint venture association between them to operate the
taxi cabs presently licensed to each through a central management. The
coordination of dispatching, servicing of vehicles, accounting, and management,
would achieve major economies that the companies believe will enable them to
bring much better service to the community. Under the plan, Ye*low•Cab
Corporation would be vested with the management responsibility.
The agreement between the parties will provide that the accomplishment of
this joint venture will be contingent upon the determination of the Council
either:
(a) That such combined operation of the companies will be
permissable without transfer of the existing franchises now
issued respectively to Yellow and Rocabco, or
%b) That such transfer of the franchises to the joint venture
will be necessary and will be consented bo by the Common Council.
If so approved, the agreement would remain in force for the period of 30
years, unless sooner terminated by operation of law orcessation of taxi cab
operations by these two companies.
We are writing, therefore, to request the Council's determination as to
the necessity for such transfer and consent, and if transfer and consent is
determined to be necessary, for such consent.
