President Kamm called the meeting to order at 7:30 o'clock P. M., the following members being present: President Kamm, Aldermen Haas, Hanlon, McGuckin, Morris, Tingley, Wilkus. upon motion by Morris, second by Tingley, the minutes of the meeting of February 2, 1959 were approved. President Kamm stated this as being the time and place set for a hearing on the report of Commissioners and assessment of damages for condemnation of property, Lot 8, Block 2, Conley's Addition, (839 - 5th Street N. W.). There was no one present wishing to be heard, and no written objections were made by any persons interested in the land required to be taken, R. V. Ehrick, City Attorney, summarized the report as submitted, which allowed $3,600.00 for the building and $6,104.00 for the land (including severance damage). The City Attorney was instructed to prepare a resolution confirming the said report. President Kamm stated this as being the time and place set for receiving bids for the furnishing of 23,100 lbs. of anhydrous ferric chloride for use at the Sewage Treatment Plant. bid of Lyon Chemicals, Inc. in the amount of $2,090.55 (9.05 per cwt.) was received and opened and upon motion by Haas, second by Hanlon, the same was referred to the Public Works Committee and the City Engineer for tabulation and recommendation. President Kamm stated this as being the time and place set for receiving bids for clearing, grubbing and grading for access roads and parking areas at the new Municipal Airport. The following bids were each received and opened and upon motion by Haas, second by Morris, the same were referred to the Airport Commission for tabulation and recommendation: Barnard Curtiss Company in the amount of $46,318.10; Morse Brothers and Associates, Inc. in the amount of $41,953.75; Ben Erwin & Son, Inc. in the amount of $37,497.75; K-S Construction Company in the amount of $44,7b5.20; Freeman Construction Company, Inc. in the amount of $31,449.24; Leon Joyce in the amount of $28,151.60. President Kamm stated this as being the time and place set for receiving bids for the sale and removal of buildings on the Edwin Doty farm (new Municipal Airport). No bids were received. Upon motion by Tingley, second by Morris, the matter was referred to the Airport Commission for further recommendation. All voted in favor thereof. The following veto message by the Mayor was read: "The Honorable Common Council Rochester, Minnesota Gentlemen: I am returning Ordinance No1012 without my approval. May I recommend that further study and consideration be given to the measure. I am not in disagreement with the purpose of the ordinance, in fact, regard it as a much needed traffic control measure. However, may I'point out the ration of that need to time factors arising from approval in planned improvement and acceptance of our primary street system, should be considered. In particular I call atention to the routing of heavy truck traffic on 2nd Street Southwest past St. Mary's Hospital. The direction of a heavy truck route past the hospital has aroused the concern of the management of that major institution, as well as people who are in business in that section, and many citizens. May I point out that truck traffic on Second Street begins at about four o'clock A. M. and continues through the early morning hours. The disturbance of sleep of sick patients may be a real threat to their recovery. Rochester's economy is dependent largely on people who come to our Clinic and,Hospitals for treatment. Our City has established a reputation throughout the world as a courteous City, that has a genuine concern for the sick. Let us maintain that reputation. May I recommend that the ordinance be referred back to the Committee for further study, or if necessary, table it until such time the avail- ability of primary streets will make it possible to divert through traffic from 2nd Street Southwest. At this time may I compliment you on• the fine work that you have bean doing during the past eleven months. I am sure that the citizens of Rochester are as proud as I am in the way you have conducted yourselves. Although the above problem is a knotty one, I am sure that a workable solution will be found. Smekta, Mayor Alderman Hanlon stated that the committee had studied this ordinance at, great length and'would hate to see it lost because of the 2nd Street Southwest area; he stated that the Mayor's Parking and Traffic Committee were again going to study this street but did not think such a good ordinance should be defeated or tabled for one street, when it is needed so badly, and recommended {� that it be referred back to the Mayor's Parking & Traffic Committee. Alderman Tingley stated that at the present time the City had not adopMd any truck ordinance and if this were allowed to die now because of this one street, they would still have no control overthe truck routes; he felt this was a temporary measure and should be considered as such, although an ordinance must be drawn in a definite way. Mr. 0. W. Cribbs, St. Mary's Executive Engineer; Mr. I.J. Mullenbach, I Purchasing Agent at St. Mary's and Clyde Lindberg, Cashier at St. Mary's; were each heard. Mr. Cribbs stated that in a traffic count they had found that 196 trucks went past St. Mary's in an 8 hour period in comparison to Center Street & llth Avenue - 33; 1st Street N. W. & llth Avenue - 14; he stated he felt there should be a control measure and suggested delay and further study before posting 2nd Street S. W. as a truck route. Dr. M. F. Eusterman was also heard; he brought up the routing of 14th Street N. E. through the residential section and urged the Council to consider acquiring land outside the City which could be used as truck routes, as he definitely felt truck routes should be kept away from residential areas as well as hospital zones. After a lengthy discussion, a motion was made by Hanlon that action on this be tabled until March 2, 1959 and it be referred back to the Mayor's Parking & Traffic Committee for further recommen- dation. Morris seconded the motion and all voted in favor thereof. A letter from the Rochester Junior Chamber of Commerce requesting permission to conduct a bingo game at their annual gypsy frolic to be held on May 9, 1959 in the Mayo Civic Auditorium was read andPresident Kamm ordered the same placed on file. A letter signed by L. M. M. was read and President Kamm ordered that the same be placed on file. A notice from the Railroad and Warehouse Commission in the matter of the Application of the Greyhound Corporation for authority to increase its Intrastate Passenger Fares within the State of Minnesota, stating that a hearing on the matter would be held in the State Office Building, St. Paul, Minnesota, on Tuesday, March 24, 1959 at 9:30 o'clock A. RM was read and President Kamm ordered that the same be placed on file. A.letter from Frank W. Everett, Fire Chief, notifying the Council that the new forty-nine star flag is to be flown July 4, 1959 and submitting estimated costs on various sizes and methods of manufacture, the City needs 30 dozen, was read. A motion was made by Haas that the same be tabled until Congress acts on Hawaii. Hanlon seconded the motion and all voted in favor thereof, except Wilkus who.voted "no". A letter signed by Stanley E. Whiting, Leonard Eichendorf, Arthur N. Weiberg, Lloyd J. Joachim, Mary Joachim, D. R. Ostrom and P. M. Johnson stating the dissatisfaction of the householders of the 500 block of 7th Street N. W. with the repairs and renovations made to the boulevards and lawns in the street at the time of the construction of the new road and sidewalk was read. Upon motion by Haas, second by Morris, the same was referred to the Public Works Committee. All voted in favor thereof. A letter signed by Harleth W. Swanson, M. R. 70, Rochester, Minnesota, complaining about his taxes, in the amount of $420.00, was read. Upon motion by McGuckin, second by Hanlon, the same was referred to the City Assessor. All voted in favor.therefif. The following letter from 0. W.,Haling was read and upon motion by Haas, second by Morris, the same was referred to the Planning Commission: "Common Council City of Rochester Gentlemen: Enclosed 1s a_drawing of an area for annexation to the City. It appears that some of the land requested for annexation if part of a rightaway that should be used for.'a road extension on the township line to secure access to the Arnold and Haling property. I request that a four rod strip be left open for an extension of a road along this township line and that acceptance of any plot take this into consideration, before any plot is approved. Yours truly, /s 0. W. Haling" The petition of Mayo Association for vacation of the alley in William-C. Shelton's Subdivision of Block Six (6) in Wm. McCullough's Addition was read and upon motion by Morris, second•by Tingley, the same was referred to the Planning Commission. All voted in,favor thereof. The following resolution adopted by -the Public Utility Board was read and upon motion by Tingley, second by Wilkus, the same was approved and ordered placed on file. All voted in favor thereof. "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that the Common Council of the said City -be -and is hereby requested to authorize the said Board to enter into a contract with GRAYBAR ELECTRIC COMPANY for the furnishing, in accordance with specifications on file, of-; 120 Class 3, 35 ft. Western Red Cedar Poles 120 Class 3, 40 ft. Western Red Cedar Poles 60 Class 3, 45 ft. A preliminary plat of Northern Heights Second Addition was presented and upon motion by Tingley, second by Morris, the same was referred to the Planning Commission. All voted in favor thereof. A letter from the Board of Park Commissioners requesting that they be authorized to spend $300.00 additional between now and the first of the fiscal year on dangerous tree work was read. A motion was made by Tingley that the Park Board be authorized to spend an additional $300.00 on dangerous tree work. Morris seconded the motion and all voting in favor thereof, President Kamm declared the motion carried. The summons and complaint of Lena A. Brown vs. City of Rochester in the amount of • $10,000.00 for injury received from a fall on the sidewalk was read and upon motion by Haas, second ,by McGuckin, the same was referred to the City Attorney. All voted in favor thereof. The summons and complaint of Mayme A. Schultheis vs. City of Rochester in the amount of $10,000.00 for injury received from a fall on the sidewalk was read and upon motion by Tingley4 second by Wilkus, the same was referred to the City Attorney. All voted in favor thereof. The following letter from the Longfellow Suburban Youth Baseball Association was read: "City Clerk City Hall Rochester, Minnesota The Longfellow Suburban Youth Baseball Association, a non-profit organization formed to promote baseball.for boys ages 10 through 13, asks that it be heard at the next council meeting, as to the possibility of leasing land from the city of Rochester. The land in question is a portion of the vacant former City Hog Farm adjoining the south border of Longfellow School. - The land would be used for a playing field, parking facilities, etc. All structures would be of a,temporary nature and the association would want to retain and move these structures, dugouts, etc. at the expiaration of the lease. A motion was • made by Haas that•this be referred to the Public Works Committee and City Attorney for study and recommendation. Tingley seconded the motion and all voted in -favor thereof. The recommendation of the Public Works Committee that bids be received on March 2 for one 150 lb. oil fired portable steamer for the Street & Aliey Department with one Bros. 1937 #3173 portable steamer to be traded in, was read. Upon motion by Haas, second by McGuckin, and all voting in favor thereof, the recommendation was approved. The recommendation of -the Public Works Committee renmmending initiation of Local Improvement Procedure under State Statute 429 for paving 7th St. N. E. fromBroadway to 2nd Avenue N. E., this project to be constructed as part of the Bond Issue Street Improvement Program with assessments also to be levied in accordance with assessment polices to benefited property on 7th Street, was read. Upon motion by Tingley, second by Morris, and all voting in favor thereof, the recommendation was approved. • • Record of Official Proceedings of the Common -Council of the City of Rochester, Minn., February 16, 1959 R • 1 1 • 11 The recommendation of the Public Works Committee that an option be taken with the Kruse Company for the purchase of the south 100 feet of land in Rolling Greens 2nd Addition for street purposes, the purchase price of this property to be $6,356.and the option is to run for a period of time to be arrived at in consultation with the city attorney and city finance Harold officer, was read. Mr./Payne, of the Kruse Company, stated that they would be willing to give a 12 to 13 month option if the City so desired. A motion was then made by Tingley that.the recommendation be accepted. McGuckin seconded the motion and all voted in favor thereof. The recommendation of the -Public Works Committee and City Engineer that the bid of Lyons Chemical Company for furnishing 23,100 lbs. of anhydrous ferric chlorice for us@ at the Sewage Treatment Plant be accepted was read. Upon motion by Tingley, second by Haas, the recommendation was accepted. All voted in favor thereof. The recommendation of the Internal Affairs Committee that Mr. Frank.J. Bright be appointed to the position.of Personnel Manager for the City of Rochester effective March 16, 1959, and that the salary for this .position be set at $6500.00 per year, was read. Upon motion by Haas, second by Hanlon, the recommendation was approved. All voted in favor thereof. Dr. Bruce Douglass of the Music Committee was present and presented plans for repairs at the band shell and requested that the Council set a date to open bids for doing this work. Upon motion by Hanlon, second by Haas, a 10 minute recess was declared to prepare a resolution ordering bids for the work on the band shell. All voted in favor thereof. Alderman Tingley introduced a resolution ordering the City Clerk to advertise for sealed bids for the improvement at the concert shell at Mayo Park.(bids to be opened at 2:00 P. M.on March 2, 1959). A motion was made by Haas that the said.resolution be adopted as read. Wilkus seconded the motion and all voting in favor thereof, President Kamm declared the said resolution duly passed and adopted. The application of Charles M. Serene Jr. for a Journeyman Plumber's License was read and upon motion by Tingley, second by Morris, the license was granted. The application of Walter D.. Klee for an Electrical Contractors License was read and upon motion by Morris, second by Haas, the license was granted. The application fro.transfer of 3.2 "off sale" license No..1812 and 3.2 "on sale" license No. 937 from Donald Cunningham to Mrs. Bessie Pierce at 6 North Broadway was read and upon motion by Haas, second by Hanlon, the same was referred to the City Security Committee. The report of the City Treasurer for the month of January, 1959 was presented and President Kamm ordered the same placed on file. The report of the City Weighmaster for the month of January., 1959 showing fees collected for loads weighed in the amount of $86.40 was read and President Kamm ordered the same placed on file. The report of the Clerk of Municipal Court for the week ended February 6, 1959 showing -total criminal •fines and costs collected and civil fees received $1,878.60 and total remitted to the City Treasurer $1,030.40 was read and having been previously approved by the City Attorney, President Kamm ordered the same placed on file. The.reports for the year ended March 31, 1959 from Raymond B. Vecellio, Public Examiner, of the financial affairs of the Rochester Police Relief Association and the Rochester Fire Department Relief Association were each presented and President Kamm ordered the same placed on file. The following resolutions were each introduced and read, and upon motion made and seconded and.all voting in favor thereof, President Kamm declared the said resolutions duly passed and adopted: Resolution confirming the report of COMMISSIONERS ON CONDEI&ATION OF THE SOUTH 96' OF LOTS 8,'BLOCK 2, CONLEY'S ADDITION TO THE CITY OF ROCHESTER, MINNESOTA FOR PUBLIC STREET PURPOSES. Upon motion by Haas, second by Hanlon, resolution adopted. Resolution referring proposed improvement for feasibility report and recommendation for the following improvement(s): Paving 7th Street Northeast from Broadway to 2nd Avenue North- east. Upon motion by Hanlon, second by McGuckin, resolution adopted. Resolution authorizing and directing the City Clerk to advertise for sealed proposals for the furnishing of 1 - 150 pound Oil Fired Portable Steamer with one 1937 #3173 Portable Steamer to be traded in. Upon motion by Wilkus, second by Hanlon, resolution adopted. Resolution accepting agreement with Olmsted County for 1959 Maintenance of State Aid and County Aid Roads within the corporate limits of the.City of Rochester, Minnesota. Upon motion by McGuckin, second by Morris, resolution adopted. Resolution authorizing the Public Utility Board to enter into contract with GRAYBAR ELECTRIC COMPANY. McGuckin seconded the motion and upon roll call and Wilkus voting "no", Presi- dent Kamm declared the motion lost. A motion was made by Hanlon that the Council reconsider the action taken by them on February 2nd, 1959`which would establish a separate board for the Mayo -Civic Auditorium. Haas seconded the motion and upon roll call, Alderman'Hsas,.,Hanlon, McGuckin, Morris and Wilkus voting "aye" and Tingley and Kamm voting "no", President Kamm declared the motion carried. Alderman Hanlon stated that he felt the Council had been too hasty in -establishing a separate board for the Mayo Civic Auditorium, that much of the business of the Mayo Civic Audi- torium and Park Department was overlapping and could perhaps better -be handled by one Board. 'Also next year there would be a seven member Park Board and he thought the Council should wait before taking further action on a separate Board. Alderman Tingley -stated that he felt when the people voted for the amendment establishing the Mayo Civic Auditorium fund that they wanted the control of it away from the Park Board and he thought that'if separate control -was not establishe the Charter Commission would seek another amendment. He felt if a separate board were not creat- ed, that the Park Board had just been given another mill and a half levy. All members stated they felt further consideration should be given to this before action is taken. R. V. Ehrick, City Attorney, requested the Council to consider the problem of a compre- hensive safety program for the City of Rochester. He said that the City has an affirmative duty to maintain its facilities in reasonably safe condition and"these duties as related to safety extend to streets; curb and gutters; sidewalks including signs, snow and ice control; boulevards, including trees; parks; public buildings; utility department and motor vehicles. He said that cities are being held to higher safety standards by the courts and noted that there had been a 0 12 Record of Official Proceedings of the -Common Council of the City of Rochester, Minn., February 16, 1959 substantial increase in claims against the City in the past year. He stated that he had discussed this with the City Engineer and Chief of'Police. He further stated that he could see the need for safety training programs for municipal employees and thought there should be an organized program with a safety inspector who could head such training program. A motion was made by Wilkus that this matter be referred to the City Security Committee and the - Internal Affairs Committee for study. (The said Committee to work with the City Attorney) Tingley seconded the motion and all voted in favor thereof.
