President Tingley called the meeting to order at 7:30 o'clock P. M. the following members being present: President Tingley, Aldermen Brooks, Morris, Stadler and Wilkus. Absent:.Aldermen Gifford and Wilson. Upon motion by Morris, second by Brooks the minutes of the meetings of April 2nd and 4th, 1960 were approved. The request of Elfreda Reiter, City Clerk for the reappointment of Geraldine Bielenberg as Deputy City Clerk and Clerk of Registration; Gladys Danford as Clerk Typist; Elaine Miller as Secre- tary Personnel Department and City Clerk's Office and Diana Dotzenrod as Bookkeeping Machine Operator was read and upon motion by Morris, second by Wilkus, the appointments were approved. The request of C. A. Armstrong, City Engineer for the reappointment of the following employ- ees in the City Engineer's Office for the fiscal year 1960-1961 was read and upon motion by Stadler, second by. A. Armstrong, for approval and authorization for the employment of the following classifications of regular full time employees in the Street & Alley and Sewer Maintenance crews for the fiscal year 1960 - 1961 was read and upon motion by Wilkus, second by Brooks the same were approved: 1 - Street & Sewer Superintendant 1 Master Mechanic 4 - Foreman 5 Equipment Operators 4 2 Mechanics 6 Equipment Operators 3 4 Equipment Operators 2A 1 Stockkeeper Timekeeper 7 Equipment Operators 2 5 Equipment Operators 1- 3 Laborers Total 39. The request of R. V. Ehrick, City Attorney for the reappointment of Mrs. Patricia Gustine as part-time secretary for the office of the City Attorney was read and upon motion by Stadler, • second by Morris, the appointment was approved. A letter from the Planning and Zoning Commission submitting the name of Willetta Hoaglan as secretary to the Planning Director was read at the meeting held April 4th, 1960 and ordered placed on file. The appointment of Mrs. Willetta Hoaglan as secretary to the Planning Director was again read and upon motion by Wilkus, second by Morris, the appointment was approved. { A letter from the Planning and Zoning commission recommending the following job classi- fications in the City Planning and Zoning Commission staff which.had been filed on April 4th, 1960 was again read: 1 City -Planning Director 1-Secretary to Planning Director l' Assoc•iate Planner Mr. Tom 0. Moore stated•that- the reason that they were requesting approval of these classifications was that the one had been changed from Planning Aid to -Associate Planner. Upon motion by Wilkus, second by Morris, the same was•referred to the Planning, Zoning and Annexation Committee. All voted in favor thereof. A letter from John Gowan, Jr., Municipal Court Committee Chairman of the Olmsted County Bar Association, requesting an opprotunity to meet with the -Council to discuss problems relating to the Municipal Court was read." Upon motion by Wilkus, second by Stadler, the matter was referred to the Finance Ways and Means Committee. A letter from Weber & Judd Company regarding the -loading area in front of their store on Second Street Southwest was read . James J. Macken, Jr., Chief of Police reported that such a load- • ing zone was already established by resolution but the -street had just not been marked as such and it would be taken care of immediately. President Tingley ordered the letter placed on file. A letter from Myron M. Reeve requesting 12-minute parking meters in front of 301 and 305 South Broadway was read. Upon motion by Wilkus, second by Morris, the letter was referred to the Public Safety Committee and the Chief of Police. A letter from the Rochester Fire Fighter's Civic Welfare Association notifying the Mayor and Council of the Firemen's Ball on Tuesday, April 19th, 1960 at the Pla-Mor Ballroom and offering' free.tickets to anyone wishing to go was read. President Tingley ordered the same placed on file. A letter from Meyers Liquor Store, Inc. requesting change of location of "Off Sale".Liquor Store from 413 South Broadway to 1120 7th Street Northwest (Northgate Shopping Center was read. Haling requesting action on the proposed ordinance when assessing for sewer and water when it appears on both the front and side of the lot to give relief to property owners was read. Upon motion by Morris, second by Brooks, the matter was referred to the Public Works Committee. All voted in favor thereof. A letter from the Airport Commission approving Certificate #1 Nietz.Electric Company for labor and material on "B" Hangar at the New Municipal Airport in the amount of $2,390.00 was read. Upon motion by Wilkus, second by Stadler, the claim was ordered paid. All voted in favor thereof. A letter from the Airport Commission accepting recommendations of Architects and Engineers and requesting the Council to approve a change order on the well was read. R. V. Ehrick, City Attorney, stated that the change order had not been returned signed by Max Renner Company and recommended that this be delayed until same is received. Upon motion by Morris, second by Stadler the same was delayed until April 18th, 1960 at 7:30 o'clock P. M. All voted in favor thereof. C. A. Armstrong, City Engineer, first and final estimate in favor of Sam Rueb, Wilbert Rueb and Herbert Rueb for demolishing the City Engineer's warehouse at 517 - 519 South Broadway in the amount of $1690.00 was read. Upon motion by Brooks, second by Morris, the same was appr All voted in favor thereof. A letter from George O"Keefe of 4 - 17th Street Northeast recommending that the council consider the moving of the present location of the dog pound was read. Upon motion by Wilkus, second by Brooks the matter was referred to the Public Safety Committee. All voted in favor there- of. Letters signed by Mrs. L. Wegner,L. A. Wegner, Mr. & Mrs. Robert Berggren, Barbara Mallon, Mr. & Mrs. L. E. Henley, Mr. & Mrs. C. M. Engel, -Mr. & Mrs. Marvin Carlson, Mrs. Dorothy Kennedy and Mrs. Virgil Canfield in favor of the year long ban on dogs and letters signed by Mrs. Gronvold, Frank Berndt, Gerald H. Miller, Mr. & Mrs. William Walton, Fern K. Miller and Miss Nina Clay opposing the year long ben on dogs together with a petition signed by 13 persons in favor were each read and President Tingley ordered the same placed on file. The following resolution adopted by the Public.Utility Board was read and upon motion by Wilkus, second by Morris, the same was referred to the Public Works Committee: "WHEREAS, an invoice'in the amount of $19,443.55 has'been recieved from the City Engineer's office to reimburse the Permanent Improvement Fund for watermain construction occasioned by paving llth Avenue Northwest from 2nd Street Northwest to 7th Street Northwest, and WHEREAS, the amount of $4,340.70 included in this invoice covers relocation of 6" watermain-under the new bridge on llth Avenue Northwest, and WHEREAS, the Public Utility Board is of the opinion that this cost should properly be allocated to the cost of the paving cost, to be paid from the Street and Alley Fund, THEREFORE, be it and it is hereby resolved by the Public Utility Board that the Common Council be requested to approve the elimination of the said item of $4,340.70 from the invoice." The recommendation of the Planning & Zoning Commission stating that they had reviewed the petition to annex lands owned by Mr. Rundell and recommending that these lands be approved for annexation to the City of Rochester and that lands constitute a part of the'p'reliminary plat of Bumpus Addition together with another recommendation from the Commission stating.that they had 524 Record of Official Proceedings of the Common Council of the City .of Rochester, Minn., April 'll, 1960 reviewed the preliminary plat of Bumpus Addition and recommending that the preliminary plat dated February, 1960 be approved as a development plan for this area were each read. Upon motion by Morris, second by Wilkus, the recommendations were accepted and the preliminary plat of Bumpus Addition was approved and the City Attorney was instructed to prepare an ordinance annexing lands owned by Mr. Rundell as recommended. The recommendation of the City Planning and Zoning Commission that they have reviewed the preliminary plat of Miner's Heights 5th Addition and recommending that the plat be granted prelimin- ary approval with the understanding that a 40 foot private drive be shown providing access to Mr. Miner's residence was read. Upon motion by Wilkus, second by Morris, the plat was granted prelim- • inary approval. All voted in favor thereof. The recommendation of the City Planning and Zoning Commission stating that they had review- ed the petition of Mr. Miner to vacate the north 10 feet of loth Street Northeast from 19th Avenue Northeast to the west a distance of approximately 270-feet and recommending that the area shown on the map be vacated and that the owner submit an accurate description of the land involved in this street vacting was read. Upon motion Morris, second by Stadler, the recommendation was accepted and the City Attorney was instructed to prepare a resolution ordering a hearing on the proposed vacation. All voted in favor thereof. The recommendation of the City Planning and Zoning Commission that.they had reviewed the preliminary plat of Leitzen's 5th Addition and recommended that the plat be granted preliminary approval with the understanding that a 53-foot right-of-way will be provided to the north of the south line of SedUbn 25-T-107N R 14W (Centerline 14th Street -Northeast) on the final plat was read. Upon motion by Wilkus, second by Morris, the plat was accepted and the preliminary plat was appr`oved.. All voted in favor thereof. The recommendation of the City Planning and Zoning Commission that they had reviewed the petition to annex lands to be known as Sunset Terrace 3rd Addition and recommending that this annex- ation be approved was read together with another recommendation from the Commission stating that they had reviewd the general development plan for the remainder of Sunset Terrace Addition groperty dated April 6, 1960 and recommending that this plan be approved for the development of Sunset Terrace 3rd • Addition and any other future subdivisions in this area. Upon motion by Morris, second by Stadler, the recommendations were accepted and the general development plan for the remainder of Sunset Terrace Addition es recommended was approved and the City Attorney was instructed to prepare an ordinance annexing lands to be known as Sunset Terrace Third Addition. All voted in favor thereof. A letter.from the Rochester Airport Commission stating .that recommendations were received from the Architects and Engineers to accept the control cab and cab minus one floor in order that Federal Technicians may proceed immediately with the installation of necessary wiring and equipment was read. Also the following letter from Ellerbe and Company was read: "A partial inspection of the Maintenance Building was made at the request of Kraus - Anderson, general contractor for the building. The inspection was made at this time to enable C.A.A. personnel to commence on the installation of the Federal equipment. The inspection was made -by Mr. Don Swenson and Mr. Ken Lebeck of the Rochester Air- port; Mr.,Joe Ostrander and -Mr. Vern,Behm of Ellerbe and Company; and Mr. Sipe of Kraus - Anderson. The following items are to be completed and are as follows: • Record of Official Proceedings of the Common Council of the City of Rochester; Minn., April 11, 1960 1 1 1 - 41 1 D6WALD PUBLISHING CD.• NEW ULM• MINN. 9181 1. Clean all areas. 2. Complete painting and necessary touch-up painting. 3. Complete the installation of the floor base in the control cab. 4. Install two doors on the dumbwaiter shaft. 5. Remove welding flash from the surface of exposed pipecolumns in the cab. 6. As soon as the weather permits, all outside items - painting, cleaning of masonry and glass, caulking and remaining portions of backfill is to be completed. It is the recommendation of the Architects -Engineers that the City of Rochester accept the work of Kraus -Anderson on the cab in the third floor of the Maintenance Building." A motion was made by Brooks, second by Morris, that on the recommendation of the Ellerbe and Company, Architects and Engineers, and on the recommendation of the Rochester Airport Commission that the control cab and cab minus one floor in the Maintenance Building at the new Rochester Municipal Airport be accepted from the contractor so that Federal Technicians may'proceed immed- iately to install necessary equipment; provided however, that this acceptance is subject to the timely completion of the excepted items set forth in the -letter from Ellerbe and Company to the Rochester Airport Commission dated llth day of, April, 1960. All voted in favor thereof. A'letter from the Rochester Airport Commission requesting the Council to approve plans and specifications for Minnesota Project #5501-12 covering sub -base, base and surfacing of roads and parking areas at the New Municipal Airport and advertising for bids for same was read and upon motion by Morris, second by'Wilkus, the recommendation was accepted and the City Clerk was instruc to prepare a resolution ordering bids for same. The following letter from Fire & Safety, Inc. of Minnesota was read: "Follaging our letter addressed to you of October 26, 1959, which was turned over to the Civil Service Commission, we again find it necessary to call your attention to a potentially serious trouble spot that is not a matter for the Civil Service Commission. The matter concerns whether employees'of ours diall makefa living in their chosen profession, or whether they shall lose their jobs so that well paid city firemen with far too much time on their hands, being supported by -our employees who are taxpayers, shall have their earnings as extra income. Please understand that we want our city firemen to be well paid, we want them to have plenty of leisure time, and admire those who spend their leisure time profitably. ' The Civil Service Commission rules that the two city firemen operating under the name bf "Rochester Fire Extinguisher Company" are able to do so because it does not interfere with their work on the city fire department. To this we heartily agree. They can operate a full-time business as long as the city pays them a good living salary in addition. Tehy can also perform the same service as our men for far less money because they have their living before they open their doors in the morning. We also repeat that they have access to fire extinguisher business through their work on the city fire department, because the city paid fire inspectors.who order in service on new equipment encourage or order the business man to call the city firemen for such service or equipment. This has the effect of suggesting that troubles from the fire inspector will end if the party does business with the city firemen. If you do not believe this, we urge you to ask business men who receive orders from the city fire inspector whose phone or business they were encouraged to contact. We have not had such a contact since the city firemen entered the business, though we have the most complete and finest facilities for such service available in this part of•the country. We wmphasize that there is no quarrel between us and the city employees or any -group of men other than the two city firemen using the fire department jobs they hold to make it impossible for some of our employees to make a living. By far the easiest thing we as a firm could do would be to withdraw from the business and relieve two to three men of their jobs. Instead we choose to fight for their jobs and maintain the elaborate service equipment we have for our Rochester customers that the city firemen would never invest their own money in. These two men have decided to make a career of taking away our employee's means of making a living. They have entered every business they could, in addition to the fire extinguisher business, that we must use to earn paychecks of our local 0 52 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., April 11, 1960 • 0,6WAL0PUBLISHING CO., NEW ULM, MINN• 9101 employees. To name them, they entered the door closer repair business and have written most of our suppliers of tools and parts about their operation; next'they entered the CO2 (carbon dioxide) business and advertise that they can furnish such service and materials for so much less than we can. This country is built on being able to supply materials and services ,at the best possible prices, but hardly under thos conditions. We heartily welcome competition, for if anyone can.furnish the services, advantages and materials that, we do to the City of Rochester we would be the first to honor them if they could do it for the same r price or less than we do. However, we will not press the point of these two men entering other businessses merely to hurt us; and our only contention is that they must not be allowed to sell and service fire extinguishers, because the city,fire department enforces extinguisher laws. u We warned in our -October letter that if they were allowed to continue in such flagrant disregard to accepted standards,of the fire profession it could only lead to trouble. If you asked us what we would do about it, we would suggest you follow advanced studies of the National Fire Protection Association, in cooperation with city officials in every part of the nation. We would like to compete with these two men on equal terms, • that is where they would have to make their livings on the business alone, without the financial support of the city taxpayers giving them paychecks. They would then be able to make all the extra money, they wanted, be welcome competitors of outs on equal basis. We wonder if you are aware that these men are selling the city schools and other branches of city departments equipment and service. One of them threatened us with a list of harmful things to -our reputation that he could -do if we did not "get off their back" following our last letter to you. When our complaint was turned over to the Civil Service and very insultingly turned down by them, -this man sent us the article through the mail that appeared in the paper. Since then they have spent their time telling people that we have nothing but junk for equipment, that we gouge every- body we can by charging far -too much, that we employ kids to do our work, and even worse slander. We believe the best way to change their attitude is to invite them to spend their full time in this business. Our men cannot earn as much in their best month of hard work without any days off -as -those men receive from the city without doing business at all. Their city check is merely a subsidy for them, but there is not much chance -they will do without their vacations, sick leave days, pensions and insurance that our men cannot enjoy. The Council will have to face this problem sooner or later. We hope it will be before we have to seriously consider dropping men from our payroll. Respectfully yours, FIRE & SAFETY, INC. OF MINN. s/G.M. Thompson, Gen. Mgr." Mr. Don Clarey and 3 other gentlemen were present and each heard in support of this letter. Mr. R. V. Ehrick then reported -that this issue had been considered by the Firemen's Civil Service Commission and they had decided not to restrict firemen from this type of work. He stated he felt that on this outside employment there were two basic issues: (1) It applies not only to firemen and should any municipal employee have the right to have the second job because it could be in compet- ition with someone else;,is a municipal employee any different than any other employee? (2) What would be classified as incompatible with city employment? Under the Firemen Civil Service law, I • believe it is the function of the Firemen's Civil Service Commission to regulate this and I do not believe that the Council has any right to decide on this. After lengthy discussion, a motion was made by Morris, second by Brooks, that this matter and other city employees holding two jobs be re- ferred to the Council as a Committee of the whole, the Mayor, the Personnel Director, the City Attorney and other department heads. Upon roll call and Brooks and Morris voting "aye" and Stadler, Wilkus and Tingley voting "no", President Tingley declared the motion lost. A motion was then made by Wilkus, second by Stadler that this be referred to the Finance Ways and Means Committee. Upon roll call Brooks, Stadler, Wilkus and Tingley voting "aye" and Morris voting "no", President Tingley declared the motion carried. The.report of the City Weighmaster for the month of March, 1960 showing fees collected for loads weighed in the amount of $129.50 was read and President Tingley ordered the same placed on file. Sell thanking the council for their interest and service to local government and wishing that their many tasks will be met with success was read and President Tingley ordered the,same placed on file. The application of W. R. McKnight for a license to sell non -intoxicating malt beverages off sale was read and upon motion by Morris, second by Stadler, the license was granted. All voted in favor thereof. The applications of W. R. McKnight, Hazel 0. Kruger, Nick Chonos, Lawrence Bielenberg, and Arnold Thorson for a license to sell soft drinks were each read and upon motion by Wilkus, second by Morris, the licenses were granted.. All voted in favor thereof. The applications of W. R. McKnight, Hazel 0. Kruger,,Steve DeVries, Nick Chonis, Lawrence Bielenberg and Arnold Thorson for a license to sell cigarettes were each read and upon motion by Wilkus, second by Brooks, the licenses were granted. All voted in favor thereof. The applications of Thomas J. Brogan and Ernest A. Kqpperud for a Journeyman Warm Air Heating, Ventilating and Air Conditioning Worker's License were each read and upon motion by Wilkus second by Brooks, the licenses were granted. All voted in favor thereof. The applications of John E. Colgan and Lewis R. Martin for a Journeyman Plumber's License were each.read and upon motion by Wilkus, second,by Brooks the licenses were granted. All voted in favor thereof. The application of Earl Berg for a license to buy junk was read and upon motion by Brooks,1 second by Morris, the license was granted. Allvoted in favor thereof. The application of Doyle Connor Company for a license to construct sidewalks, curb and gutter and driveways in the City of Rochester was read and upon motion by Brooks, second by Wilkus, the license was granted. All voted in favor thereof. The applications of Fred Vagt and Everett Cummings for a refuse collectors license were each read and,upon motion by Wilkus, second by Brooks, the applications were,referred to the Public Health & We Fare Board for recommendation. All voted in favor thereof. The official bond of Thomas Wolf in the amount of $500.00 with the Western Surety Company as surety was read and upon -motion by Stadler, second --by Wilkus, the bond was approved, the surety thereon accepted and the same was ordered,placed on file. The contract bond of Universal Motors, Inc. in the amount of $4,022.93 with the Standard Accident Insurance Company as surety was read and upon motion by Stadler, second by Wilkus, the bond was referred to the Mayor for his approval. The following resolutions were each introduced apd read and upon motion madeand seconded and all voting in favor,thereof President Tingley declared the same duly passed and adopted: Resolution approving plans and specifications for the construction of sub -base, base and bituminous surfacing of raods and parking areas at the Rochester (New) Municipal Airport and order- ing bids for same., Upon motion by Wilkus, second by Stadler, resolution adopted. All voted in favor thereof. , Resolution designating the official newspaper for the year 1960 - 1961. Upon motion by Wilkus, second by Brooks, resolution adopted. Upon motion by Brooks, second by Morris, resolution adopted.- All voted in favor thereof. Resolution levying special assessments for the paving of llth Avenue Northwest from 2nd to 7th Street Northwest. Upon motion by Wilkus,.second by Morris, resolution adopted. All voted in favor thereof. Resolution appropriating $1,243.53 from the Parking Meter Fund and ordering payment made to-H & H Electric Company,•$269.78 and Quarve and Anderson Company, $973.75. Upon motion by Wilkus, • second by Morris, resolution adopted. All voted in favor thereof. Resolution appropriating $2,804.67 from the Auditorium Fund and ordering payment made to Park Department $1;975.76 and District Director -of Internal Revenue"$828.91. Upon motion by Morris, second by Brooks, resolution adopted. All voted in favor thereof. Resolution appropriating $211.67 from the General Fund, $86.80 from the Fire Fund, $451.48 from the Sewer Fund, $231.96 from the F. E. Williams Estate Fund, $228.90.from the Parking Meter Fund and $9.00 from the Police Protection Fund and ordering payment made to Woodruff Company, $277.77; Opeples Natural Gas Company, $468.16; N. W. Bell Telephone Company, $241.92 and Herbert G. Knopp Agency, $231.66. Upon motion by Wilkus, second by Brooks, resolution adopted. All voted in favor thereof.
