President Tingley called the meeting to order at 7:30 o'clock P. M., the following members being present: President Tingley, Alderman Brooks, Gifford, Morris, Stadler, Wilkus, Wilson. (Alderman Gifford arrived at 9:40 P..M.) Upon motion by Stadler, second by Morris, the minutes of the meeting of November 7, 1960 were approved. All voted in favor thereof. _President:Tingley stated this as being the time and place set for hearings on the following projects: Hearing on the proposed change of zoning of Lots 3, 4t 5 and 6, Southgate Addition,from a residential district to a multiple dwelling district. The recommendation of the Planning and Zoning Commission dated October 6, 1960 recommending that the petition to have Lots 3,4,5 and,6,, Southgate Addition changed to multipledwelling district be granted was again read. There was no one present at the hearing wishing to be heard. President Tingley declared that the hearing be officially closed. A motion -'was then made by Brooks, second by Wilson, that the recommendation of of the Planning and Zoning Commission be approved and that the City Attorney be instructed to prepare:an ordinance making the requested zone change. All present voted in favor thereof. Hearing on proposed assessment for construction of a sidgwalk on the north side of llth (Avenue Northwest from 16th Avenue Northwest to the East line of Lot-19, Block 1, Thomas First Addition. There was no one present wishing to be heard. President Tingley declared the hearing officially closed. Hearing on the proposed assessment for construction of a sidewalk on both sides of 15th (Avenue Northwest from 20th Street Northwest to 22nd Street Northwest in Elton Hills 3rd Addition. !There was no one present wishing to be heard. He said it -was -his -understanding that he was not be be charged for repairs to his sidewalk but only for the new sidewalk constructed but when he figured it he got only $107.64 and he was being assessed $122.14. C. A. Armstrong, City Engineer stated that only.the new sidewalk where there had been no sidewalk before was being assessed and he told Mr.'Helm to come into his office the next day and they would refigure his. assessment. There was no one else p wishing to be heard. President Tingley then declared the hearing officially closed. k letter krom Arthur R. Swan, Attorney transmitting petitions with 293 signatures requesting that the following described property be annexed to the City was read:' The East � of Lot 1,, Block- 3, Golden Hill Addition, and Lot 7, .Block 3,- Golden Hill Addition, and Blocks 4, 5, 6, 10, 11, 12, 16, 17, 18, 2211" 23, and 24 of Golden Hill Addition, and Blocks 1 and 2-of Garden Acres-, Olmsted County, Minnesota, which land -abuts upon the present territorial limits of the -City of'Rochester and is so conditioned as property to be subjected to municipal government. Also a letter from Dr.-Viktor O. Milson, City Health Officer, which stated the following was read: "It is my understanding that'the people of the Golden Hill area living between Highway #63 and 3rd Avenue S.-E., are petitioning for annexation to -the City of Rochester. I wish you to know that I strongly recommend that this annexation be carried out in order that the city water supply may be promptly extended to this area, and secondly, that the city sewage system may be -provided to this area as soon as possible"thereafter. Communtty type water supply and sewage services are needed to solve the urgent sanitary problem of the Golden Hill area. "Annexation to the City is the logical method of obtaining these services. The basis for my recommendation is the extensive sewage contamination of the underground waters -of this area as shown in -a report of a survey made by the Olmsted County Department of Health. This survey shows a serious contamination of well waters similar to that found in the West"Zumbro Addition which has previously been annexed to the City of Rochester. Copies of this report of the survey may be obaained at the health department." Is VIKTOR 0. WIISON, M.D. City Health Officer A motion was then made by Wilson, second by Wilkus, that the petitions be referred to the City Attorney for verification and to the Planning and Zoning Commission for study and recommendation. All present voted in favor thereof. A petition with 29 signatures requesting the restoration of parking privileges on onei side of the street on 9k Street S.•E. was read. Upon motion by Morris, second by Stadler, this petition was referred to the Public Safety Committee and the Chief of Police. All present voted in favor thereof. A petition signed by Gordon Winslow, President and Charles W. Wafters, Secretary of the Rochester Ready -Mix Company requesting that.a part of Lot 1, Block 18, Northern Addition and a part of Willow Street and 13th Street N. W. be vacated was read. Upon motion by Wilkus, second by Brooks, the petition was referred to the City Planning and Zoning Commission. All present voted in favor thereof. A letter signed by,Clarence Sattre requesting that the Council consider his application to secure an Off Sale Liquor license to be used on his property at 1700 South Bdwy. a in a building to be erected by him, if and when that property is annexed to the City, was read. Upon motion by Wilson, second by Brooks, the letter was ordered placed on file. All present 0 voted in favor thereof. �'74 Record of Official Proceedings of the Common Council of the City of. Beckley of 'Beckley Business Equipment Company requesting that the Council consider permitting them to use a parking space on First Avenue Southeast near Center Street on the west side of their -store for their delivery truck was read. Upon motion by Brooks second by Morris, the letter was referred to the Public Safety Committee. All present voted in favor thereof. A letter from the Firemen's Civil Service Commission certifying the following names of members of the Fire Department for appointment to the position of motor operator was read: Lloyd Baker, Marvin L. McGowan, Lowell G. Lybargar, Walter L. Clark, Otis D. Ondler, Wendell E. Bass, Bernard L. Drier, Donald F.-Leonard, Lawrence Griffin, Lester Christopherson and Francis Strom. A motion was then made by Wilson, second by Wilkus, that the above listed men be appointed as motor operators for the Rochester Fire Department. All present voted in favor thereof. A letter signed by Carl D. Million, 1960 March of Dimes Chairman, stating that the Olmsted County Chapter wishes to display a 4 x 30 foot banner acorss Second Street S.W. at South Broadway during the National Foundation Campaign which will take place between January 2nd and January 31st, 1960, was.read. Upon motion by Wilson,•second by Brooks, the letter was referred to the Public Safety Committee and the Chief of Police with power to act. All present voted in favor thereof. The following letter was then read and upon motion by Brooks, second,by Wilson, the same was referred to the Mayor. All present voted in favor thereof. "Common Council City of Rochester Rochester, Minnesota, Attnr Mr. A. Tingley, President Gentlemen: On Sept. 23rd, 1960 -.almost two months ago - the undersigned individuals addressed a•letter to the common council calling attention to what was believed to be a series of illegal procedures connected with the Cleminshaw tax assessment • re-evaluation of�reai estate in the City of Rochester. The matter was referred to Mayor Smekta for investigation. Is it improper to ask.if it was investiaged? Surely, a legal opinion was indicated. If not, why not? It becomes even more demanding that we know the law, especially in view of the "peculiar" circumstances relating to the unique methods used in re-evaluating the Mayo Clinic and Kahler'Corporation properties by our City Tax Assessor. Perhaps we should await developments, but it is not difficult to reach the con- clusion that a substantial tax' deficit is facing -the City. Is this. why work on next year's City Budget has bogged down?'Or, does it mean we are facing higher taxes notwithstanding the glib promises of the City Tax Assessor? These are questions that need to be answered to the public forthrightly. Or is the head of our City government covering up a scandal that appears to be brewing in City Hall? - .- � _ .. . .. . We feel it is time�•to discard the Cleminshaw and City Tax Assessors Valuations, and request.'a new`re=evaluation under the supervision of the Minnesota Commissioner of Taxation. Z`liis' is the usual` procedure as' outlined` in the 'Tax Assessor's Manual. Our _progressi`ve type 'Jof.' government, has` brought us `nothing but bungling errors, buckpassing and c- iaos.­ .isn't it time. -to remove ttie wrong -doers from pbblic office and get back to hard-headed, common sense government? FRIEDE LL • Mayor Smekta then presented the following letter which was read: "Honorable Alex Smekta Mayor Rochester, Minnesota Dear Mayor Smekta: We are aware that you are presently considering the appointment of a 1 • • 1 • • Record of Official Proceedings of the Common -Council of the City of Rochester, Minn., November 21, . 1960 . 1 • F� 0 1 • -' full time director for the joint City of Rochester and Olmsted County Civil - Defense organization to fill the vacancy which will exist upon the resignation of Mr. Woodrow Hayes, your present Civil Defense Director We take this opportunity to review with you the duties and responsibilities you and the city council have in civil defense because of your position as the governing body responsible for the public welfare and safety of the residents of your community. Chapter 12, Minnesota Statutes, provides that civil defense is a governmental function. Each political subdivision is directed to establish a local civil defense organization in accordance with the State Civil Defense program. Each political subdivision must appoint a civil defense director who will have direct eesponsibility for the organization, administration, and operation of the local civil defense organization,.subject to the direction and control of the local goirerni:ng body. ' While the Minnesota Department of Civil. Defense has the general responsibility of outlining the civil defense program and developing guide lines for the survival effort of the State of,Minnesota, implementation of,this policy is the responsi- bility of local government.. Definite laedership.must be provided by local govern- - ment to assure that local civil defense preparations are adequate. The real operational strength of our civil defense program mist be in the community. This, of course, is where people live and this is where the resources are that must be geared to state or national survival effort. The preparation of our people, the organization; the detail of planning, the development of an emergency staff to prepare ourselves for asurvival effort in the face of a thermo- nuclear attack in this Country must be accomplished in communities such as Rochester and in counties such as Olmsted. This is where our basic strength lies, as is true in the daily life of our county, and we must depend on them to carry us through the crisis of a thermonuclear assault on this Country. This is not the figment of imagination --it is a serious reality. Under Woody Hayes and his predecessor, the late Dr. Winchell Craig, a great deal has been accomplished in your civil defense program. We are sure that this information has been reported to you previously.in detail. There is, however, a practical limit to what any man can do on a part time basis, especially when he is regularly employed in another job. Of course, the kind of person you must consider for your civil defense director would be a key man in your community. The resources of your community and your county, and their daily contribution to our society and economy have an impact that is statewide as well as nationwide.. The contribution that your community and county must make in civil defense must have a similar effect. In the interest of national security and our survival effort, we cannot afford to have less. I am certain that you, as head of a local -unit of government, understand your legal and moral responsibilities for civil defense. I am confident that you realize the detailed planning and the organizational effort that must be accomplihhed the training that must be undertaken, and the total effort hthat must be expended to make your community and county even partially prepared for their civil defense responsibilities. It is no small job. The civil defense effort in your community and county must be complete, and must affect each individual and every esixting public and private enterprise. It is my considered opinion that it will require the full time.effort of a capable leader to accomplish the civil defense job that lies before Rochester and Olmsted County. Witip resources such as you have in Rochester and Olmsted County, resources of national importance, it cannot be accomplished with less. May we hear from you soon on this matter? SCHON Director, Civil Defense State.of Minnesota Alderman Stadler stated that he had met with Mr. Anglim of the State ,Civil Dense and he had taken him_up to the Mother House and showed him the unit set up there, he said he left him a copy of Chapter 12, Minnesota Statutes, which outlines'°the program and also provided that the City could levy up to 20G per head for a full time program; Mr. Stadler said Max Kjerner and Dr. Ivens of t Mayo Clinic, who are responsible for the disaster unit would like an opportunity to meet with the Council and County Commissioners to discuss the program. President Tingley stated that he felt this was a Federal Program and should be handled by them, he did not feel the City could spend enough money to take care of such a program and recommended that no action be taken until after American Municiapl Association meeting,in New York, at which time the National Civil Defense Committee would meet and make a report, Ma-�,or Smekta said he thought it would be wise to meet Record of Official Proceedings of the Common. Alderman Stadler was to try to arrange a meeting with the Common Council, County Commissioners and representatives of Civil Defense on Thursday, December 8, 1960 in the evening. The recommendation of the City Planning and Zoning Commission stating that they had reviewed the petition to change the zoning of property at 629 - 4th Street Northwest from a residential to a multiple dwelling district and recommended that this petition be denied because the property lacks ample street frontage and there is sinsufficient space for adequate offstreet parking, was read. A petition with 10 signatures of residents in this area requesting that the petition be denied was also read. Mrs. Fredia Thumann, the petitioner, was present and urged that the Council grant this zone change, she said she felt the Council should make some arrange- ment to replace some of the multiple dwelling district that was being taken away when 5th Street, is completed and could not see why moving a house with a number of apartments to this address could be undesirable. A motion was -then made by Wilkus, second by Stadler, that the recommend- ation of the Planning &Zoning Commission be accepted and the petition be denied. All present voted in favor thereof. The recommendation of the City Planning and Zoning Commission stating that they had reviewed the matter of relocating advertising signs along the new highway approaches into the City of Rochester wasread. They further stated that this question was first discussed at the commission me,eting of November 2, 1960 and since this is a problem that not only concerns the City of Rochester, but also the County Commissioners and possibly the State of Minnesota, they recommend that the Common Council discuss this matter with these groups and arrive at a satisfactory solution to this problem before the scenic beauty of these -approaches into the City is hidden U behind numerous advertising signs. R. V. Ehrick, City Attorney, reported that the Council could not prohibit the placing of sings at these approaches as the property was outside of the City limits and did not think they could do anything unless it was to notify the County and State how the City felt.. A. motion was then made by Wilkus that this recommendation be given to the City Attorney and he direct a letter to the Commissioners of Olmsted County and to the State of Minnesota, Department of Highways; his motion was lost for want of a second. A. motion was then made by Morris, second by Stadler, that this recommendation be refereed to the City Attorney for his research and observation and report back'to the Council. All present voted in favor The recommendation of the Public Works Committee that 4 parking stalls in Municipal Parking Lot #2 (South Broadway) be leased to Woodhouse Bros. for their exclusive use of their business vehicles as requested in their letter of November 2, at a charge of $6 per month per stall (they consider this case a circumstance warranting special consideration, and do not propose to extend the practice of leasing stalls to people for ordinary use) was read. A motion was made by Brooks, secondby Wilson, that the recommendation be accepted. All present voted in favor. Upon motion by Morris, second by Stedler,,the recommendatior was approved. .All -present voted in favor thereof. The following recommendation of the Public Works Committee and City Engineer re Job #6015 - Sanitary Sewer and Water main in West Zumbro Addition} was read: "Honorable Mayor & Common Council City of Rochester, Minnesota Gentlemen: Pending decision from the Courts on the status of the annexation of West Zumbro, we wish to inform the Council and property owners involved, of the estimated assessments for this work. These assessments are based on the bids received (but not contracted) for installation of sanitary sewer and water mains in all -of West Zumbro. They do not include service connections or -any street grading or surfacing. It is assumed that all frontages will be assessed on a uniform cost per front foot. It is also assumed that property adjacent to West Zumbro which is benefitted by the installation will be assessed (on a deferred basis) in proportion to its f frontage. The total estimated costs incldding construction, interest and engineering are $219,493. The total assessable frontages are 10,416.feet, which result in a cost per front foot of $21.07. Most lots are 51 feet wide, which would be $1,074.57. Corner lots are-54 feet wide, which would be $1,137.78. Altho this cammittee recommends this construction because of the conditions that prompted its annexation, we want these costs, which are based on the actual bids, known to all before the contracts are awarded, esp'ecially.because they are higher than preliminary estimmes predicted." It was suggested that a public hearing be held on these costs, in order to apprise all property owners in West Zumbro Addition what the approximate assessments would be. A motion was then made by Wilson, second by Vilkus, that a public hearing be set for 7:30 o'clock.P. M. on Monday, December 5, 1960. All present voted in favor thereof. The recommendation of the Public Works.Committee and City Engineer that the attached contract for sale of the building at 913 - 5th Street N. W. to L. M. McNee be approved qas read. Upon motion by Wilkus, second by Brooks,.the recommendation was approved and the Mayor and City Clerk were directed to execute the said contract. All present voted in favor thereof. The recommendation of the Public Works Committee and City Engineer that the bid of L. M. Feller Construction Company.for construction of Bridges No. 65503 and 55504 over Cascade Creek, approach fill and storm sewer on M.S.A.S. No. 114 be accepted at the unit prices bid and that checks be returned to the unsuccessful bidders was read. Upon motion by Wilkus, second by Morris, the recommendation was approved. All present voted in favor thereof. The recommendation of the Public Works Committee and City Engineer that the bid ofE. J. Vonch for construction of a'sidewalk on both sides of 15th Avenue N. W. from 22nd Street N.W. to 14th Avenue N. W.. in Elton Hills 3rd and 4th Addition be accepted at the unit prices bid and checks be returned to.the unsuccessful bidders was read. .Upon motion by Wilkus, second by Wilson, the recommendation was approved. All present voted in favor thereof. .The recommendation of the Public Works Committee and City Engineer that the bid of C. M. Boutelle for curb and gutter on the west side of 36th Avenue N. W. from 3rd Street to 3rd Place N. W. be accepted at the unit prices bid and checks be returned to the unsuccessful bidders was read. Upon motion by Wilkus, second by Wilson, the recommendation was approved. The recommendation of the Public Works Committee and City Engineer stating that they had considered the request of Russell Carroll for the removal of the curbed island between the frontage road and 19th-Street N. W. in front of Lot 1, Markay Addition and that they recommend removal of the burbed island in front of Lot 1, Markay Addition as it may be required by their proposed driveway arrangement wasread. It was further recommended that this Committee be authorized to grant this modification of the curb construction as they -see -fit upon submission by Mr. Carroll of the proposed driveway arrangement and -payment of the costs involved. Upon motion by Wilson, second by Stadler, the recommendation was approved. All present voted in favor thereof. Mrs. Tillie Berndt of 419 - 5th Avenue Northwest was present and stated that she was - not satisfied with the offer made on her property and requested that the property be reappraised, she said she had been told that this would be done and so far nothing had been done; she said she was unable to buy a home like hers for the money that had been offered to her R. V. Ehrick, City Attorney, stated that the Council had determined to hold fast on all'offers and he said that he had suggested to Mrs. BerAdt'that after all offers have been made that some consideration might be given to her property and other properties involved; he said the final group of offers had been made, however, they had until December 15th to dcdept, but he suggested that -perhaps this might be the time to refer Mrs. Berndtts request to the Public Works Committee. A motion was then made by Wilson, second by Morris, that all the properties .that have been rejected, be referred back to the Public Works'Committee for reconsideration. All present voted in favor thereof. - The recommendation of the Public Safety Committee that the provision in Ordinance No. 645 forbidding the granting of an "on sale"intoxicating liquor license for only premises outside the patrolled limits of the main business -section of the City of Rochester be eliminated and that the Ordinance be amended to conform to the language of Section 340.13 of the Minnesota Statutes which provides in substance that licenses may bd issued for any premises not restricted against commercial use was read. Upon -motion by Wilson, second by Stadler, the recommendation was accepted and the City Attorney was instructed to prepare the necessary ordinance. All present' voted in favor thereof. Alderman Gifford arrived at 9:40-o'clock P. M. The recommendation of the Public Safety Committee that the request of Adeline Grother 'for a license to sell non -intoxicating malt liquors 'ton" and "off" sale at-917 North Broadway be denied was read _(it wad the opinion of the committee that 917 North Broadway is not an appropriate location for this.type of business). Upon motion by Wilkus, second by Wilsori, the recommendation was=approyed and the licenses were denied. All present voted in favor thereof. The The recommendation of the Public Safety Committee that the request of Bob Saterdalen of 227 - 10th Avenue Northeast for a junk buyer's license be approved when the applicant files the proper bond as required by the ordinance, was read. Upon motion by Wilkus, second by Morris, the recommendation was approved. All votedi in favor thereof. The application of Earl P. Speltz for a Joprnoyman Hot Water and Steam Fitter's license was read and upon motion by Gifford, second by Brooks, the license was granted. All voted in favor thereof, The application of Maass Plumbing & Heating Company for a license to connect with sewers and drains was read and upon motioli by Stadler, second by Gifford, the license was granted.) All voted in favor thereof. The application of Lesmeister Bros. for a permit to move a house from 839 - 5th Street Northwest to a location out is the country was read. Upon motion by Wilson, second by Morris, the permit was -granted, said house to be moved ender the supervision of the Building Inspector and the Chief of Police. All voted in favor thereof. The license -bond of Maass Plumbing & Heating Company in the amount of $1,000.00 with the Western Surety Company was read and upon motion by Stadler, second by Wilson, the bond was approved, the surety thereon accepted aid the same was ordered,placed on file. All voted i1i favor thereof. , . The report of the City Treasurer for the month of October, 1960 was presented and President Tingley ordered the same placed on file. , The reports of the Clerk of Municipal,Court,for the week ending -November 4, 1960 showing total criminal fines and costs collected and civil fees received $2,857.00 and total remitted to the City Treasurer $2,242.00; and for the,week ending November- 10, 1960 showing total criminal fines and costs collected and vivil fees receiyed •$2,398.50-and total remitted to the City Treasurer $2.398.50;,and for the week ending November 18, 1960 showing total criminal,fines and costs collected and civil fees received $2,518.00,and total remitted to the City Treasurer $2,518.00, were each read and having been approved by the City Attorney, President Tingley ordered the same placed -.on. file. Mayor Smekta again brought up the matter of the "crooked" and "cockeyed" streets in the Elton Hills Additions. He said it took him.almost an hour the other day to find an address that he was looking for and he has had complaints from residents in this,areaathat they cannot fine addresses; he recommended that the Council study thoroughly any future plats presented to them for approval. A lengthy discussion was held but no action was taken. The -following resolutions were each introduced and read and upon motion made and seconded,and all voting in favor thereof, President Tingley declared the said resolutions duly passed and adopted: Resolution adopgipg assessment for construction of a sidewalk at 8 separate locations (Sidewalk Project No. 4-1960). An Ordinance Annexing to the City of Rochester, Minnesota, Certain Unplatted ,Land not exceeding Two Hundred Acres in Area, All Being in the Southeast One -quarter of Section 34, Township 107 North, Range 14 West, Olmsted County, Minnesota (Ranch Motel Property) was given its first reading. A motion was then made by Stadler, second by Wilson, that theordieanbe suspended. and an ordinance providing for the formation and government of the Fire Department,be given its second reading. Upon roll.cill Tingley voted "no". An Ordinance amending an ordinance entitled, "An Ordinance reguIting the sale of intoxicating liquor within the City.of Rochester, providing for such sales by duly licensed ` persons, establishing regulations for the operation of places where. -such intoxicating liquor is sold,.providing regulations for the granting of such licenses,_ setting license fees, providing penalties for the violation thereof, and repealing all inconsistent ordinances. This is an emergency ordinance rendered necessary for the preservation of the public peace, health and safety", was given its first reading. Alderman Brooks stated that Mr. Harold Blazing of the Public Utility Department had called himandtold him. that the lights were now all installed on Highway No. 52 North and that he had checked the lights and the same were O.K. and he thought that the City should approve this lighting. He was to report to the Public Works Committee. Alderman Brooks stated that when Mayo Association had started to develop Homestead Village Addition they had dug a ditch through Slatterly Park and they have not filled this ditch to date and he felt this should be taken care of. ­It was noted that this should be under the jurisdiction of the Park Department. No action was taken. Alderman Gifford read the.following from the minutes of the Elanning and Zoning Commission and wondered if anything had been done: "A commercial building is currently being erected on part of the property .contained in this plat and the Common Council has not at this time adopted an ordinance granting this zone change. A letter to this effect was sent from this office to -the Building Inspector on October 14, 1960. However, Construction is still in progress in.violation of the Zoning Ordinance." Mr. Garnet Spring, Building Inspector, reported that they had obtained a building permit from the County before the plat was accepted and there was nothing that could be done.
