Minutes of a regular meeting of the Common Council of the City of Rochester, Minnesota,
held in the Council Chambers in the City Hall, in said City on January 3, 1961.
.President Tingley called the meeting to order at 2:00 ot'clock P. M. the following members
being present: President Tingley, Aldermen Gifford, Stadler, Wilkus and Wilson. .Absent: Alderman
Brooks and Morris.
Alderman Wilkus moved to amend the minutes of the meeting of December 19, 1960 to insert
on page 14 at the beginning of the firstparagraph of said P g g� g page the following: "An Ordinance Amend-
ing an Ordinance entitled, 'An Ordinance for the purpose of promoting health, safety, order, con-
venience and general welfare by regulating the use of land, the location, size, use and height of

buildings on lots, and the density of population within the City of Rochester, Minnesota, all in
accordance with a comprehensive plan" (The east 150' of Lots 9, 10, 11 and 12, Block 5 less that
part of Lot 9 which is used for street purposes Cascade Manor to a Commercial District) was given
its first reading. Alderman Gifford seconded the motion and all present voted in favor thereof.
A motion was then made by Stadler, second by Wilson, that the minutes of the meeting of December
19th, 1960, as amended, be approved. All present voted in favor thereof.
-The recommendation of the Public Safety Committee; that the application of William T.
Bale for a housemover's license be granted was read. A motion was made by Wilkus, second by Stadler,
that the recommendation be approved and the license be granted. All present voted in favor thereof.
President Tingley welcomed Mr..Mark Gray, the new Maintenance Engineer for the City of
Rochester, who was present at the meeting.
A letter from Mr. C..A. Armstrong, City Engineer, requesting permission for attendance
and expenses for Albert Toddie, Robert Toddie, Frank Eaton and himself to attend the Annual City
& Village Engineer's Conference at the University of Minnesota Continuation Center January 30 and
31, 1961 was read. A motion was made by Gifford, second by Wilson, that permission be granted these
employees'to attend the said conference at city expense. All present voted in favor thereof.
A letter from Mr..Paul A. Grassle, President of the Rochester Charter Commission, stating
that Judge Arnold Hatfield has been informed of the three vacancies on the Charter Commission Board
and when these appointments have been filled, Mr..Grassle would then call a meeting of the Commission

was read. President Tingley ordered the letter placed on file.
A letter from the City Planning and Zoning Commission requesting an informal private
meeting with the Mayor and the Common Council prior to their annual meeting on January .9, 1961 was
read. .A. motion was made by Gifford, second by Wilkus, that the Council members meet with the Plann-
ing and Zoning.Commission at8:00 o'clock P. M. Thursday, January 5th, 1961 in the Council Chambers.
All present voted in favor thereof. V
Alderman Brooks arrived at 2:45 P. M.
A. letter from Mr. John Bakke, Personnel Director, requesting the Council grant an extension
on the present leave of absence of Dana Lund to run from December 6, 1960 to April 1, 1961 without
pay due to illness was read. A motion was made by Gifford, second by Stadler, that the leave of
absence be granted. All present voted in favor thereof.
The summons and complaint of Kingsley Crampton demanding judgement in the amount of
$150,000.00 for injuries received on January 17th, 1960 in the Firetruck-Bus accident on the corner

of Broadway Avenue and 2nd Street Southwest was read. Upon motion by Wilkus, second by Gifford, the
matter was referred to the'City Attorney. All present-voted.in favor thereof.
The Summons and'Coniplaint of Harriet E. Sjoquist and Andrew L. Sjoquist in the amount of
$20,000.00 resulting from injuries received in & fall on the sidewalk on October 9, 1960 at the
intersection of 1st Avenue and 2nd Street Southwest was read. Upon motion by Wilkus, second by
Gifford, the matter was referred to the City Attorney. All present voted in favor thereof.
An amended joint and separate answer of Kingsley J. Crampton and Jefferson Transportation
Company and Cross-Claim'RE Firetruck-Bus crash on January 17, 1960 was presented. Upon motion by
Wilkus, second by Gifford, the matter was referred to the City Attorney., All present voted in favor
thereof. 1.
A letter from Garnet Spring, Building Inspector, requesting permission for the Building,
Plumbing and Heating Inspectors to attend a 2-day institute January 19 and 20 at the University of
Minnesota Center for Continuation Study at City expense was read. Upon motion by Wilson, second by
Stadler, the request was granted and the Inspectors were authorized to attend at City expense. All
voted in favor thereof.

The following letter was read: '

Dear Mayor Smekta:
To summarize the meeting of the Mayor of Rochester, City Councilman, Park Board Members
and Chamber of Coimnerce Representatives on the twenty-first day of December 1960 at the
Kahler Hotel, I submit the following:
Daily adjustment of the Mayo Civic Auditorium for educational and religious purposes to be
a basic charge of $100.00 per day for the use of the arena and $50.00 per day for the use
of the theater. This basic charge to include the setting up of stages, tables and chairs
(and taking down of same) head usher, cleaning, cashier, ticket -taker, doorman, use of audio
equipment, heat and lights. Men available under separate charge for sound operator, stage
'hands and spotlight operator. With the understanding that the arena will not be available
June 19th through August 27th, 1961 and that each case is to be weighed on,it's own merits
before the Park Board and their decision will be final.
The above conditions were accepted at this meeting for:
The Minnesota Congress of Parents and Teachers
The Minnesota State Institute of Elementary School Principals
The Minnesota Conference of Luther League - Gloria Dei.

Dr. Gifford stated that for this particular type of convention he thought the City should not have
to underwrite the costs but that it should be taken care of by some private group - the Chamber of
Commerce, Downtown Retailers Association or local hotel industry - those who benefit from the sched-
uling of a convention in our city. Alderman Wilkus stated he felt that charging only $100.00 a day
for the use of the arena and $50.00 a day for the use of the theatre for such groups would mean the --
City was helping to subsidize convention costs and thought a committee should be named. President
Tingley stated he would like to see the building used as much as possible rather than being dark.
Mayor Smekta said the reduced cost would meet the basic overhead of the auditorium and suggested that
this plan be tried on a trail basis. After further discussion on the matter, a motion was made by

second by Brooks
Wilkus/that this matter be referred back to the Park Board. Alderman Gifford amended the motion
that the Park Board consider turning this over to a committee consisting of private groups -
Chamber of Commerce, Downtown Retailers and Hotels - to make up any diffefende in reduced rental
costs if they are approved. Alderman Brooks seconded the motion as amended and'all voted in favor
thereof. President Tingley then called for a vote on the motion as amended and all voting in favor
r� thereof, the motion was declared carried.
A letter from Mr. Ralph L. Ellingwood, Director of the Traffic Violations Bureau, re-

questing authorization to employ an additional assistant in his department due to the growth of

work load was read. The letter also requested that consideration be given t6 the possibility of
reserving two non -metered five-minute parking areas on the.front of or on the 3rd Street Southwest
side of the City Hall for use by citizens while in the bureau for disposition of parking'and traffic
tickets. A motion was made by Stadler, second by Wilson, that the'Traffic Bureau be granted an
additional assistant and the matter of reserving two parking meters fpr the use of the public in the
disposition of their traffic tickets be referred to the Public Safety Committee. All voted in favor
of the motion.
'A.letter from Builders Land Company requesting the necessary engineering services for
the development of Elton Hills Sixth and Seventh Subdivision be provided, so work can be done'as
weather permits in the spring of 1961 was read. Upon motion by Wilkus, second by Wilson, the letter)
was referred to the Public Works Committee. All voted in favor thereof.
A letter from Mr'. Basil B. Thompson of Thompson Rexall Drug Company requesting a 12-mi
parking meter at the corner of Center Street and 1st Avenue Northwest was read. Upon motion by
second by Gifford, the request-wis referred to the Public Safety Committee. All voted in favor
thereof.
President Tingley declared a 15-minute recess at 3:45 P.M.
President Tingley called the meeting to order at 4:00 o'clock P. M.
President Tingley stated that at a special meeting held on Friday, December 30, 1960, a
motion was made and seconded that a public hearing be held on Tuesday, January 3, 1961 on the pro-
posed transfer of "on sale" liquor license from Wi.tzke's Town House, Inc. to the Town House of
Rochester, Inc.; that the persons opposing the proposed transfer and the incorporators each be
heard separately. President Tingley then asked if there was anyone in the audience wishing to be
heard for the opposition of the transfer of this license. There was no one present wishing to be
heard and President Tingley declared this part of the hearing officially closed.
The recommendation of the Public Safety Committee that the application for a transfer of
"on sale" liquor license from Witzkets Town'House, Inc. to the Town House of Rochester, Inc. be
granted was then read.
Mr. Robert C. Oesterreich, President of The Town House of Rochester, Inc., then intro-
duced the other incorporators who were each present: Mr. Rae Arend, Vice President;"Mr. Stanley C.
Mohn, Secretary; Mr. Elmer Halling, Treasurer and Mr. Arthur Hoffman, Director. Mr. Oessterreich
-reported that he would be managing the business and the -other incorporators would be taking no
active part in the management of same. He stated that there were no plans to move this business

from the'current location to a new location as they have a ten year lease on the building and the

parking facilities are good. There was no one else present wishing to be heard and President
Tingley declared the hearing officially closed. ~
Upon motion by Wilkus, second by Wilson, the recommendation of the Public Safety Committee
was approved and the transfer of the license to The Town House of Rochester, Inc. was granted. All
(voted in favor thereof.

The following letter from Mr. Wm. Lyke, Secretary, ,Local 520 Rochester Fire Department was
a

Dear Sirs:
A few years ago, after two firemen and a 10-year old boy lost their lives in Silver
Lake, a number of life preservers in cases were erected around Silver Lake. This
winter, it has been called to the attention of a number of individual firemen, by
certain people of the City of Rochester,that some of these life preserves and cases.
are not in good repair. We realize that the upkeep of these preservers is in the hands
of the Park Department. We do not wish to show them up`or to antagonize them, but at
our December meeting of Local 520, of the Rochester Fire Department, it was decided,
that if it was alright with the City Council and the Park Department, Local 520 would
assume the responsibility of the upkeep and maintenance of these life preservers and
cases.
Due to the number of calls received by both the Police and Fire Departments concerning
children playing on unsafe ice this Winter, we feel that these life preservers should be
kept in A.-1 condition at all times.
If this proposal is`agreeable with you please contact our Secretary.

Mayor Smekta stated that he thoughta letter of commendation be written to Local 520 of the Rochester
Fire Department for their'interest and efforts in this matter. As this project had previdusly'been
handled by the Park Department, a motion was made by Wilson, second by Morris, that the Council
accept the services of the firemen but the letter be referred to the Park Department for final action.
All voted in favor thereof.
A letter from Mr. W. W. Hayes, Civil Defense Director, offering his services as Rochester
-
Olmsted County Civil Defense Director until a replacement can be named was read. He also urged a
stronger program but felt the present frogram was better than no program at all. Alderman Stadler
said he thought we should consider the invitation of the Mayo Clinic Disaster Committee to.meet'with
them. A motion was made by Morris, second by Wilkus, that the letter be referred to the Public
Safety Committee. Alderman Morris withdrew' his motion after further discussion on the matter and
Alderman Wilkus withdrew his second. A motion was then made by Stadler, second by Gifford, that
we accept the offer of Mr. Hayes as temporary Civil Defense Director and that we meet with the
Mayo Clinic Disaster Committee on Thursday, Sandary 19, 1961 at�8:00 o'clbck P. M. All voted in
favor of the motion.
A recommendation from the Finance, Ways and Means Committee that the salary of Charles Camp-
bell, Civil befense Coordinator, be set ai"$720000 per year for the performance of the Civil Defense
duties for the year 1961, said salary to be in -addition to his regular pay as patrolman in the.
Police Department was read. Upon motion by Wilkus, second by Gifford and all voting in favor there-
of, the recommendation was accepted.

A recommendation of the Public Works Committee requesting that -the contracts for the sale
of buildings located at 403 4th Street Northwest for $150.00 to Theodore F. Franke and building
located at 426 6th Avenue Northwest to Russell Smith for $5.00 be approved and signed was read.
Upon.motion by ;Wilson, -second by Gifford and all voting in favor thereof, the recommendation was
approved and the Mayor and City Clerk were authorized and directed to execute the said contracts,
The recommendation of the -Board of Park Commissioners that they be authorized and direc
to pay the following sums as compensation•for the following State Employees and Moving Picture
Machine Operators beginning •January 1, 1961 was read: `

The "Performance Rate" shall include a "move in", "move out", and one performance.,
A matinee or rehearsal the day of a performance will pay 1/2 of the "performance
rate" in addition to the "performance rate" paid for the performance. Normally,
the carpenter, electrician and propertyman will be paid flat -rates --only when working
performances and the hourly rates will be used only for "day work" when there are no
performances.

Moving Picture Machine Operator $ 3.75 - 3 hour minimum
Public Address Operator 2.75 - 3 hour minimum_
Lamp Operator 2.75 - 3 hour minimum
President Tingley ordered same placed on file.
The application of Littrup Nielson for a renewal of his sewer and drain layer's license
was read. Upon motion by Wilkus, second by Wilson, the license was approved. All voted in favor
thereof.
The application of Rochester Yellow Cab Company for the renewal of 27'taxicab licenses
was read. Upon motion by Gifford, second by Wilson and all voting in favor thereof, the licenses
were granted.
.The application of Blue and White Cab Company for the renewal of 10 taxicab licenses was
read. Upon motion by Wilkus, second by Gifford, and all voting in favor thereof. the licenses were
granted.
The license bonds of Littrup Nielson and Harry McNeilus d/b/a McNeilus Junk Yard each
in the amount of $1,000.00 with the Western Surety Company were each read. Upon motion by Brooks,
second by Wilson, the.bonds were approved, the surety thereon accepted and the same were ordered
placed on file.
The reports of the Clerk of Municipal Court for the week ending December 23rd, 1960 show-
ing total criminal fines and costs collected and civil fees received in the amount of $2,934.88 and
total remitted to the City Treasurer $2,159.88 and for the week ending December 30, 1960 showing
total criminal fines and costs collected and sivil fees received in the amount of $1,934.00 and
total remitted to the City,Treasurer in the amount of $1,564.00 were each read and having been
approved by the City Attorney the same wereordered placed on file.

property, appeared before the Council requesting the prorating of the sanitary sewer and watermain
assessment (assessment No. 3278 and 3279)project in Lot 32, Auditor's Plat "A" in order that a 69.75
foot piece of property on the south sido of loth Street Southeast could be sold off. The remaining

assessment against the entire tract for sanitary sewer is $5,683.03 and for watermain, the remaining ,
assessment which had not been certified for collection with the taxes is $2,506.61. He said the
City Engineer had worked out an amount,of $334.83 remaining for sanitary sewer and $279.00 -for water -
main on the 69.75' piece of property.- He -said he would appreciate it if the.council could make
arrangements to prorate this assessment in order that Mr.. Schulz could pay- off -the assessment on
the 69.75' piece so he could give a clear title to this property. Mr. R. V. Ehrick, City Attorney,

stated that.a resolution was being prepared prorating this assessment-.
Upon motion by Wilson, second by Gifford, the meeting was adjourned until 7:30 o'clock (+I

President Tingley stated this as being the time and place set for a hearing on the street i

grading and surfacing and the construction of a sanitary sewer and watermain, storm sewer and
service connections in Cascade Center Plat. " Mr. Carlton Penz, owner of the property was present

and stated that he would like to have..these improvements put in this winter or as soon as possible.
He was informed by Mr. Armstrong, City Engineer, that if the sewer and water were put in this -winter, �I
ly
the results might be unsatisfactory.. He also said that the plans and specifications were ready and
if the owner preferred to contract their own work done they could do so at their own risk. Mr.,
Penz said that if there was danger in constructing these improvements during the winter months,. that

pos-sibly it be best.that they wait until spring. There was no one else present wishing to be heard
so President Tingley declared the hearing officially closed.-, l

President Tingley stated this as being the time and place set for a hearing on the levying
of special assessments for the construction of a curb and gutter abutting the East 50" of Lots 26 &

27, Block 2, Hetzel & Hagen's Addition. There' was no one present wishing to be heard and President �!
Tingley declared the hearing officially closed. 'A motion was made by`Wilson, second by Stadler,
instructing the City Clerk to prepare the necessary resolution levying the special assessments. All �� •
voted in favor thereof.
Judge William LaPlante appeared before the Council asking that they defer action on the !�
setting of his salary at this time. He said that the -State Legislature actually sets.his.salary
now its maximum of 8 500.00. He asked that the Council consider recommending i}

to the Legislature to raise its limitations.due to the ever-increasing case load and the responsi-

bility of the newly established Traffic Bureau. He said that the salary now "set is more in line
with what a part time judge would receive. _After further discussion, Mr. Ehrick, City Attorney, 1�
stated that the legislature would be interested in the Council's recommendation as to.the.judge's ?j

salary. A motion was made by Gifford, second by Wilkus, that the judge's salary be referred to the I�
Finance Ways and Means Committee keeping in mind a recommendation which can be made to the State

1961 the City Attorney and the Assistant City Attorney be authorized an office expense allowance
for the calendar year 1961 in the total amount of $1,920.00, this sum to be paid to the City Attor-
ney and Assistant City Attorney in equal monthly installments in accordance in a division to be
agreed upon by them was read. Upon motion by Wilkus, second,by Stadler and all voting in favor

' Mr. Ehrick stated a resolution had been prepared appropriating $450.00 from.the General
Assistant
Fund payable to Warren Eustis,/City Attorney, for extra -ordinary services 'rendered between July 1'
and October 1, 1960 in the trial of approximately,45 misdemeanor cases filed by the Olmsted County
Sheriff's 'Office and the Minnesota Highway Department in Municipal Court. He said these additional
cases were due to the change in the legislative law that misdemeanors shall be prosecuted by the -
city, village or borough attorney of the place where the court is situated. The County Attorney
tried these cases during 1959 and early in '1960.' Starting July 1, 1960 the City Attorney was re-
quired to prosecute these cases. Mr. Ehrick said there is a resolution prepared tonight requesting
and' petitioning'the legislature to amend Section 488.17 of the Minnesota Statutes that the County
Attorney of the County of Olmsted is the logical and proper person to prosecute these misdemeanors
which occur outside the limits of -the City.' It was his 'feeling that this matter would be transferred

back to the County Attorney. No action was taken on the resolution making payment td Mr. Eustis.

"BE IT RESOLVED by the Common Council of the City of Rochester, that the Legislature'
of the State of Minnesota be, and it hereby is, respectfully.requested to enact a
' special law authorizing. the Common Couricir of the City of Rochester, in addition to
"on sale" intoxicating liquor licenses presently authorized by Section 340.11, Sub-
division 5 of the Minnesota Statutes, to issue one additional "on sale" intoxicating
liquor license for the premises known and used as the New Rochester Municipal Airport.
BE IT FURTHER RESOLVED That this request to the Legislature for a special law is
based on the following grounds: 1) The City of Rochester is the.owner of -the approximate
2,000 acre site located six and one-half miles south of Rochester on Trunk Highway No.
63, which comprises the site of the New Rochester Municipal Airport. 2) Although the
New Rochester Municipal Airport opened for commercial operations and public use in
September, 1960,-and although the City has provided new, attractive restaurant facilities,
it has been unable to obtain a restaurant operator to provide necessary food service to
patrons at the Airport. 3) The Common Council was advised by prospective restaurant .
operators that an "on sale" intoxicating liquor license is an economic necessity for a
profitable restaurant operation at the Airport. 4) Although the New Airport site is
located approximately six and one-half miles south -of Rochester and is, therefore,
outside the territorial limits of the City of Rochester, the City has been granted
full police powers on the Airport site by Section 360.038, Subdivision 3, of the
Minnesota Statutes and the City intends to provide police and fire protection to -the
Airport site.

BE IT FURTHER RESOLVED That a certified copy of this resolution be forwarded by the
Mayor of the City of Rochester to Mr. Donald T. Franke, State Representative, and to
Mr. A. M. Keith, State Senator, for their assistance'in obtaining the enactment of the
requested special law."

An ordinance amending an ordinance entitled, "An Ordinance regulating the sale of in-
toxicating liquor within the City of Rochester, providing for such sales by duly licensed persons,
establishing regulations for the operation of places where such intoxicating liquor is sold, pro-
vidingregulations for the g granting of such licenses, setting license fees, providing penalties for
the violation thereof, and repealing all inconsistent ordinances. This is an emergency ordinance
rendered necessary for the preservation of the public peace, health and safety" (Amending Section 7
of Ordinance No. 645) was given its third.and final reading.
A motion was then made by Stadler, second by Wilson and all voting in favor -thereof, the
ordinance was adopted.
An Ordinance amending an Ordinance entitled "An ordinance for the purpose of promoting
health, safety, order, convenience and general welfare by regulating the.use of land, the location,
size, use and height of buildings on lots, and the density of population within the City of Rochester
Minnesota, all in accordance with a comprehensive Plan" (Changing "the east 150 feet of Lots 9, 10,
11 and 12, Block 5, less that part of Lot 9 which is used for street purposes in Cascade Manor
to a:.Commercial District) was given its second reading.
A. motion was made by Brooks, second by Wilkus; that the rules be suspended and the

Mayor Smekta asked Mr. Brooks if he had any recommendations to makeonthe Downtown
'Lighting and other street lighting, including some requests for better lighting of public alleys.
Mr. Armstrong reported that the State Highway Department would like to meet with the City regarding
the lighting on proposed Highway 52 and 2nd Street Southwest and also Broadway South and 12th Street.
He stated they also would like to discuss the proprosed rerouting of T. H. 52 South of town. Mr
Armstrong was requested to arrange a meeting with the Highway Department in the near future. A
motion was made by Wilson, second by Brooks, that the down town street and alley lighting be referred
,to the Lighting Committee to come back to the Council with their recommendation. All voted in favor
I thereof.
