Minutes of an adjourned regular meeting of .the Common Council of the City of Rochester,
Minnesota, held in the Council Chambers in the City Hall in said City, on March 20, 1961.
President Tingley called the meeting to order at 7:30 o'block P. M., the following

members being present: President Tingley, Aldermen Brooks, Gifford, Morris, Stadler, Wilkus,r
Wilson.
Upon motion by Wilson, second by Brooks, the minutes of the meeting of March 6, 1961
were approved. Upon motion by Gifford, second by Stadler, the minutes of the meeting of March 15,
1961 were approved. All voted in favor thereof.

President Tingley stated this as being the time and place set for receiving and
,
opening bids for the following:
Bids for furnishing one 4-door six cylinder sedan for use in the City Engineer's
Department. The bids of Adamson Motors, Inc. in the amount of $1,871.00; Universal Motors, Inc.,
. .
in the amount of $1,999.90 and Clements Chevrolet Company in the amount of $2,039.00 were each
received and opened and upon motion by Morris, second by Wilkus, the same were referred to the
Public Works Committee and,the City Engineer for recommendation and tabulation. All voted in
favor thereof.
Bids for furnishing one station wagon for use in the City Engineer's Department. The
bids of Adamson Motors', Inc. in the amount of $1,673.00; Postier & Eggers Company, Inc. in the
amount of $1,856.69; Universal Motors, Inc. in the amount,of $1,699..00 and Clements Chevrolet
Company in the amount of $1,790.00 were each received and opened and upon motion by Morris,
second by Gifford, the samerwere referred to the Public Works,Committee and the,City Engineer for
tabulation and recommendation. -All voted in favor thereof. ,
Bids for furnishing one station wagon for use in the Rochester Fire,Department. The
bids of pniversal.Motors, Inc. in the amount of $?,311.10 and Clements Chevrolet Company in the
amount of $2,444.00 were each received and opened and upon motion by Morris, second by Gifford,

the same were referred to the Public Safety Committee and the Fire Chief for tabulation and
recommendation. All voted in favor thereof.
Bids for furnishing four patrol cars for use in the Rochester Police Department. The
bids of (net price less trade-ins) Adamson Motors, Inc. in the amount of $6,495.00; Clements
Chevrolet Company in the amount of $7,245.36; Universal Motors, Inc. in the amountrof $7,249.96
were each received and opened and upon motion by Morris, second by Wilkus, the same were referred
to the Public Safety Committee and the Chief of Police for tabulation and recommendation. All
voted in favor thereof.
Bids for paving of State Aid Streets 114, 107 and 108 from llth Avenue Northwest at
5th Street to 3rd Avenue Northwest at 2nd Street. The bids of Rochester Sand & Gravel Company
in the amount of $309,921.41; Woodrich Construction Company in the amount of $321,317.05; Palda
& Sons, Inc. in the amount of $331,234.31; Ashbach Construction Company in the amount of
$333,692.24 and Arcon Construction Co., Inc. in the amount of $356,025.14 were each received and
opened and upon motion by Gifford, second by Wilson, the same were referred to the Public Works

Committee and the City Engineer for tabulation and recommendation. All voted in'favor'*there6f.
The City Engineer's estimate on the cost of construction of State Aid Streets 114, 107 and 108
from llth Avenue Northwest at 5th Street to 3rd Avenue Northwest at 2nd Street in the amount
9f $332,429,64 was read and'ordered placed on file. -
President Tingley stated this as being the time and place set for a hearing on the
reconstruction and widening, curb and gutter, sidewalk construction and replacement on llth.
Avenue`Northeast from 5th Street Northeast to 14th Street Northeast.' Mr. Reaume Reopelle of 945-
llth Avenue Northeast was present and questioned what it would cost per front foot and how wide
they plan to go and if they plan.to take part of the home owners lot. C. A. Armstrong, City
Engineer, stated that the width will be 44 feet, it will cut into'the existing boulevard; the
cost is'estimated in the neighborhood of $6.00 per'.running foot for residential property and the
---City will not•take'any more right-of-way than is dedicated,'they•will'stay within the 66 foot
.width. There was no one else present wishing to be heard and President Tingley declared the
..hearing -officially closed.,
President°Tingley stated this as being the time and place set fora hearing on the
matter of•the application for a temporary permit to use the buildings at the abandoned Lobb Field
for uses in contravention with the provisions of"the Zoning Ordinance. Mr. Fred Schuster -was
present and stated that he wished to make it known that the original request had been for
Hangar No. •1, Hangar ,No. 2; Hangar .No. 3 and the `Terminal Building but -that the recommendation of
the Planning and.Zontng Commission and the notice of hearing had included all the buildings at
Lobb Field, which included the building now occupied by K. M. McGhie; he said they were not
opposed to -this being included but wanted it known because this building was closer then the
others to the residential property.. There was no one else wishing to be heard and President
Tingley declared the hearing officially closed. The recommendation of the City Planning and
Zoning Commission recomen$ing that a temporary permit to use the buildings at -abandoned Lobb
Field for uses in,con.travention with the provisions of the 'Zoning Ordinance be approved under the
provisions of Section 10 (c) of Ordinance No. 558 which would authorize any use to be made of all
of the existing buildings for a time not to exceed ten years or until such time as a plan for the
entire area has been submitted and approved or until such time as it may be properly determined
that non-conformance is out of harmony with other uses in the immefdate area, whichever event
occurs first, was again read. A motion was then made by Stadler, second by Gifford, that the
recommendation be approved and the said request be granted and the City Attorney be instructed to
prepare .the necessary resolution. All voted in favor thereof.
President Tingley stated this as being the time and place,set for receiving and
opening bids for furnishing crushed rock, sand, gravel, road oil and cutback asphalt and plant
mixed bituminous mixture for use in the City Engineer's Department. The following bids were
received and opened and upon motion by Morris, second by Brooks, the same were referred to the
Public Works Committee and the City Engineer for tabulation and recommendation. All voted in
favor thereof.

The recommendation of the City Planning and Zoning Commission (tabled at the last
meeting) stating that they had reviewed the petition to change the zoning on the property at the
Northeast corner of 14th Street Northeast and 1st Avenue Northeast from a residential district to
a commercial district and recommending that the petition be denied, was again read. Also the
recommendation of the City Planning and Zoning Commission stating that they had reviewed the
petition of protest against the change •in zoning and stating that they had reviewed it and did
not feel that is is for this commission to decide the validity of the petition and therefore
they referred it back to the Council and City Attorney for consideration was read. Mr. David

Fanning of 119 - 14th Street Northeast and Mr. Harry Beahm of 134 - 14th Street Northeast were
each present and protested the change in zoning. Mr. Joseph Dingle, Attorney representing the
petitioner, was present and urged that the Council"approved this zone change; he'said his
client was not going to construct an oil station on this property and they..would be willing to

sign an affidavit to that affect; he said they would probably build a small line store about.
the same as is built there now. A motion was then made by Wilson, second by Wilkus, that the
recommendation of the Planning & Zoning Commission be denied and the zone change be granted and
a hearing on -the requested zone change be set.for 7:30 P. M. on April 17, 1961. Upon roll call
all voted in favor thereof, except Alderman Morris who voted "no".
The following,recommendation of the Finance, Ways & Means Committee was then read:
"To the Honorable Mayor _.
and
Members of the Common Council
Gentlemen:
We, the undersigned members of the Finance, Ways and Means Committee,
hereby recommend that the City of Rochester purchase the proposed Blanket
Bond covering all city employees in the amount of $2,500.00 per person,
with excess coverage on those.positions where the departments deem it
necessary. The City Treasurer's bond shall be placed with the same
company that writes the blanket bond. .The three year prepaid cost of the
,company
is $1,955.18 (including.Treasurer bond).
This cost pro -rated over the three year period amounts to $651.73 per
year which is about $350 saving annually on the bonds necessary, and
required by,the employees of the City of Rochester.
The cost of the bond shall be pro -rated against each department in
proportion to the numbertof bondable positions in e4tch department.

Mr. Kenneth.Heins a Members,of.the,Advisory Insurance Committee was present and explained to the
Council that the Committee (composed of Herbert Knopp, Francis -McGovern and Kenneth Heins) had
gone.:over_this quite thoroughly and had received informal bids from ten different companiesi The
question as to whether or not this could be done wihhout putting it up for bids was brought up
and R. V. Ehrick, City Attorney, stated that he felt a legitimate division of this bond area
would allow to separate the Treasurers bond and the others bonds. A motion was then made by
Brooks, seeond by Stadler, that the recommendation be approved and the City Clerk was instructed
to go ahead and secure the said coverage. All voted in favor thereof.
A letter from the AFL-CIO Central Labor Union endorsing the plans for Highway #52
from 4th Street Northwest to llth Street Southwest and favoring plans for re-routing Highway #52
from llth Street south around the City approximAtely to Marion and also a letter, from the
Rochester Building and Construction Trades Council urging that the Council take favorable action
in regards to this project were each read. Upon motion by Stadler, second by Gifford, the let
were ordered placed on file. All voted in favor thereof.,
A letter from W. A. Meeker of 945 - 5th Avenue S. E. protesting the issuance of a
liquor license at the new Municipal Airport was read ,and President Tingley ordered the same
placed on file.
The request of Lyle W. Gardner for two weeks military leave, to begin on or about
July 30, 1961 and ending on or about August 13, 1961 to be At Fort Carson, Colorad& Springs,
Colorado, was read and upon'motion by Wilkus,'second by Morris, his request was granted. All
voted in favor thereof.

The application of Edward Sursely to change the use of the property located at 623

East Center Street, from its present non -conforming use -as a grocery store to a Used Clothing.
Store, was read and upon motion by Gifford, second by Morris, the.letter was referred to the City
Planning and Zoning Commission. All voted in favor thereof.
A letter from Home Opportunities, Inc. requesting that the City contract with them
to install all the improvements in Sunset Third Addition was read and,,upon motion by Wilkus,
second by Morris, the same was referred,to the Public Works Committee and the City Engineer.
A letter from Carlton Penz and Al M. Goodman requesting that the City contract with
them to install4sanitary sewer, watermain and culvert at the 5th Street entrance and the street_
grading and surfacing in Cascade Center.Plat was read and upon motion by Wilkus, second by Morris,
the same was referred to the Public Works Committee and the City Engineer.

A letter from Albert W. Kaleas of 121 - 10th Avenue S. E. addressed to Dr. R. W.
Gifford kegarding snow removal and snow plowing was read and upon motion by Stadler, second by
Brooks, the same was referred to the Public Works Committee. All voted -in favor thereof.
Upon motion by Brooks, second by Wilson, a ten minute recess was declared. Upon roll
call all -voted in -favor thereof, except Stadler and Wilkus, who voted "no".
A letter from C. A. Armstrong, City Engineer, stating that his department had been
requested by the Council to estimate the cost of removing the windrow of snow from driveways and
crosswalks after plowing of the streets and they estimated that this cost would be between $3000
and $5000 for each snowfall, depending on the depth,.was read. C. A. Armstrong reported that,
about ten additional front end loaders would either have to be purchased or rented, he thought
renting them would be the most feasible. After further discussion the letter was referred to the
Public Works Committee for further study and recommendation upon motion by Brooks, second by
Wilson and all voting in favor thereof.
The application of-E. A. Rundell requesting approval of the preliminary plat of*
the subdivision plan to be known as Bumpus Addition was.read and upon motion by Wilson, second by
Stadler,,,the application was referred,to,the Planning and Zoning Commission. All voted in favor
thereof.
k petition signed by Donald L. Close and Carl M. Elford for annexation of Lots 1, 2,
3 and 4, Block 2, Crescent Park First Addition and a part of the Southeast quarter of Section 22,
Township 107 North, Range 14 West, to be known as Crescent Park Second Addition, was read and upon
motion by Stadler, second by Wilson, the petition was referred to the Planning and Zoning
Commission. All voted in favor thereof..
The three following.resolutions adopted by the Public Utility Board were each read
and upon motion by Wilson, second by Brooks, the same were approved:
"Be it and it is hereby resolved by the Public Utility Board of the City
of Rochester, Minnesota, that the Common Council of the said City be and is
hereby requested to authorize the said Board to.enter into a contract with
Truck Service Company for the furnishing, in accordance wihh specifications
on file, of
ONE (1) ton 1961 GMC Pick -up -truck at a pprice of �2,311.65
with tra a allowance for a 1953 truck of $720.65 ana net
contract price in the amountzof $1,591.00.
said Truck Service Company being the lowest responsible bidder."

with trade in allowance of a1955 3/4 ton Ford pick -up -truck in the amount of
$972.00 and a net contract price in the amount of $1,559.00 said Truck Service
Compan Company being the lowest responsible bidder.",
A letter requesting permission for Judge William S. LaPlante to attend the 8th
Annual Traffic Court Conference and Municipal Court Conference on April 12, 13 and 14, 1961 at
the Center For Continuation Sfudy on the Minneapolis Campus`of the University of Minnesota was
read and upon motion by Stadler, second by Wilson, the request was granted and Judge LaPlante was
authorized to attend at city expense. All voted in favor thereof.
A letter *inviting the Mayor and Councilmen to the fourth annual Firemen"s Ball
which is being held at the Pla-Mor Ballroom on -Tuesdays April 4, 1961 was read and President
Tingley ordered the same placed on file.
A letter from the Commissioner of Taxation requesting that a council member attend
the annual county seat instructional meeting for assessors and local board members which is to
be held at the court house on Wednesday, March 22, 1961 at 10:00 A. M. was read. Alderman Morris
was to attend if possible.
A petition signed by Walter E: Horn, Vera L. Horn, Philip Sternberg, Eugene J.
Fishgoll, Olmsted Savings and Loan Association, Joseph S. Flynn, Gerdia C. Flynn and Olmsted
County Bank & Trust Company requesting that the following described property be vacated, was read:
All that part of 1st Avenue�Northeast lying North of the North line of
16th Street Northeast and South of the South line of the -alley running
East and West immediately North of Igo's Addition and Dashow's Subdivision
in the City of Rochester according to the plat thereof on file and of
record in the office of the Register of Deeds in and for said County.
Upon motion by Morris, second by Stadler, the petition was referred to the City Planning & Zoning
Commission. All voted in favor thereof.
A bill in the amount of 512.86 for painting, electrical, steel, concrete, lumber
yard materials and miscellaneous labor expenses for construction of a civil defense shelter was
presented. A motion was made by Gifford, second by Wilson, that the said bill be referred to the
'Public Safety Committee for recommendation. Upon roll call Brooks, Gifford, Morris and Wilson
voting "aye" and Stadler, Wilkus and Tingley voting "no", President Tingley declared the motion
carried.
A petition with ten signatures"
requesting "that half the distance from the corners
of 14th Street and 15� Avenue and 16th Street and 15k Avenue Northwest be posted with signs reading
'No Parking 8 A.M. - 4 P.M. or during school hours, the posting to rur•from a southerly to
northerly direction on both the.East and West sides of 15k Avenue Northwest" was read and upon

motion by Wilkus, second by Gifford, the petition was referred to the Public Safety Committee.

All voted in favor thereof.
The recommendation of the Public Works Committee that the City,contract with Carlton
Penz and Al Goodman for them to construct at their expense the sanitary sewer, water main and
culvert installation in Cascade Center Plat was read. Upon motion by Gifford,.second by Brooks,
and all voting in favor thereof, the recommendation was approved..
The -recommendation of the Public Works Committee stating that. after considering the
proposed developmenp plan prepared by,the Planning Board and previously approved by the Council,
the property lying east of,5th4Avenue S..E. and south of Bear Creek,.the. committee approves the
•
previous action and recommend that it be referred to the Finance Committee to determine the
possibility of the City financing the costs of land acuquisition and street construction and
further recommend thatthePublic Works Committee be authorized to engage anappraiser to advise
them on the probable cost of the land was read. Upon motion by Gifford, second by Stadler, the
recommendation was approved and the Public Works Committee was authorized to engage an -appraiser.
All voted in favor thereof.
The recommendation of the Public Safety Committee that the Council proceed with the
building of the new dog kennel ano residence for the Pound Master and the following steps be

taken (1) the City Engineer and City Planning Director draw a plat and land use for that area
owned by the City and (2) the City Engineer secure plans for the Pound Master residence and the
dog kenaels, was read. Upon motion by Wilkus, second.by Stadler, the recommendation was approved.
All voted in favor thereof.

The recommendation of the Public Safety Committee that the Common Council appoint
Mr. Roscoe Van Horne to the position of Civil Defense Director for the City of Rochester and

Olmsted County effective April 3,'1961 at the beginning rate of $549 per month in grade 39 of
the county pay plan -was read and upon motion by Stadler, second by Gifford, the recommendation was

approved. All voted in favor thereof. .
The recommendation of the Public Safety Committee that additional street lighting be
provided on East Center Street at its intersection with the North Mayo Civic Auditorium Drive and

the Mayo Field Drive was read. A motion was made by Brooks, second by Tingley, that this be
referred to the Lighting Committee and upon roll call Brooks, Morris and Tingley voting "aye" and
a
Gifford, Stadler, Wilkus and Wilson voting "no", President Tingley declared the motion lost. A
motion was then made by Gifford, second by Stadler, that this be tabled. All voted in favor.
The recommendation of the Public Safety Committee that the bid of Adamson. Motors, Inc.
in the amount of $6,495.00 for furnishing four patrol cars to the city of Rochester be accepted

and that the checks of the unsuccessful bidders be returned, was read and upon motion by Morris,
second by Wilson, the recommendation was approved. .All voted in favor thereof.)
The recommendation of the Public Works Committee that the bid of Quarve & Anderson
for crushed rock, Rochester Sand & Gravel Company for washed sand and Rochester Sand & Gravel
Company for pit run gravel be accepted at the unit prices bid and checks be returned to the

unsuccessful bidders was read. Upon motion by Wilkus, second by Morris, and all voting in
favor thereof, the recommendation was approved.
The recommendation of the Public Works Committee that the bid of The Rochester
Sand and Gravel Company for the seasons supply of plant -mixed bituminous mixture for use in
the City Engineers Department be accepted at the unit prices bid and checks pe returned to the
unsuccessful bidders was,read: Upon motion by Morris, second by Gifford, and all voting in
favor thereof, the recommendation was approved.
The recommendation of the'Public Works -Committee that the bid of Adamson Motors,
Inc. for one four door - six cylinder sedan for use in the City Engineers Department be
accepted at a lump sum and checks be returned to the sunsuccessful bidders was read. Upon
motion by Wilkus, second by Wilson, and all voting in favor thereof, the recommendation was
approved.
The recommendation of the Public Works Committee that the bid of Adamson Motors,
Inc. for One 1961 Two -Door Station Wagon for use in the City Engineers Department be accepted
and checks be;returned to the unsuccessful bidders was read. Upon motion by Gifford, second
by Morris, and all voting in favor thereof, the recommendation was approved.

The recommendation of the Public Works Committee that the bid of Rochester Sand &
Gravel Company for construction of State Aid Streets 114, 107 and 108 from llth Avenue N. W.
at 5th Street to 3rd Avenue Northwest at 2nd Street Bbrthwest be accepted at the unit prices
bid and checks be,teturned to the unsuccessful bidders was read. Upon motion by Wilkus, second
by Morris, and all yoting in favor thereof, the recommendation was approved.
The recommendation of the Public Works Committee that the bids of American Oil
Company for furnishing road oil and cutback asphalt by 10,000 gallon tank car delivery and
Northwestern Refining Company for road oil and cutback asphalt by truck transport delivery be
accepted at the unit prices bid and checks be returned to the unsuccessful bidders was read.
Upon motion by Vilkus, second by Gifford, and all voting in favor thereof, the recommendation
was approved.

Inc. in the amount of $2,311.10 for the furnishing of one station wagon for use in the Fire
Department be accepted and checks be returned to the unsuccessful bidders was read. Upon motion
by Gifford, second by Wilson, and all voting in favor thereof, the recommendation was approved.
The recommendation of the City Planning and Zoning Commission stating that they,

had reviewed the final plat of Suk's Replat and recommend that the plat be granted final app
was read.. Upon motion by Brooks, second by Gifford,,the recommendation was approved and the
City Clerk was instructed to prepare a resolution approving the said plat. All voted in favor

read. Upon motion by Morris, second by -Gifford, the recommendation was approved and a hearing
was set for 7:30 P. M. on April 17, 1961. _All voted in favor thereof.
The recommendation of the City Planning and Zoning Commission that final'payment
to Ladislas Segoe and Associates be authorized from funds available in the 1960-61 budget and
charged to that budget but that actual payment be withheld until the City has received the
complete final report was read. A motion was made by Gifford, second by Morris, that the said

recommendation be approved and upon roll call Brooks, Wilson and Tingley voting "no" and Gifford,
Morris, Stadler and Wilkus voting "aye", President Tingley declared the motion,carried.
The recommendation of the City Planning and Zoning Commission that the petition to
vacate the East 60 feet of the alley in Dashow Addition between 1st Avenue Northeast and 2nd
Avenue Northeast be denied was read. A motion was made by Gifford, second by Tingley, that -the
recommendation be approved and the petitition be denied and upon roll call Brooks, Wilkus and.
Wilson voting "no" and Gifford, Morris, Stadler and Tingley voting "aye", President Tingley
declared the motion carried and the petition denied.
The recommendation of the,City Planning and Zoning Commission recommending that the
zoning of all of the Johnson Property exclusive of streets, be changed from a residential to an
indistrial district was read. A motion was made by Gifford, second by Wilkus, that the said

recommendation be approved and a hearing was set for,7:30 P. M. on April 17, 1961. All voted in
favor thereof.
The report of the City Treasurer for the month of February, 1961 was read and

The reports of the Clerk of Municipal Court for the week ending March 10, 1961
showing total criminal fines and costs collected and civil fees received $1,944.00 and total .
remitted to the City Treasurer �$1,719.00 and for the week ending March 17, 1961 showing total
criminal fines and costs collected and civil fees received $2,930.00 and total remitted to the
City Treasurer $2,335.00 were each read and having been approved by the City Attorney, President
Tingley ordered the same placed on file.
