President Tingley called the meeting to order at 7:30 o'clock P. M., the following members being present: President Tingley, Aldermen DeVries, Morris, Wilkus, Wilson. .Aldermen Stadler arrived at 7:55 P. M. Upon motion by Wilkus, second by Morris, the minutes of the meeting of April 3, 1961-were approved. All present voted in favor thereof. The request of Elfreda Reiter, City Clerk, for reappointment of Geraldine Bielenberg as Deputy City Clerk; Gladys Danford as Clerk -Typist; Elaine Miller as Secretary for City Clerk and • Personnel -Department and Ella Springmire as Bookkeeping Machine Operator was read and upon motion by DeVries, second by Wilson, the appointments were approved. All present voted in favor thereof. The request of C. A. Anderson as Secretary was read and upon motion by Wilkus, second by Wilson, and all voting in favor thereof, the appointments were approved. A letter from R.Q.V. Ehrick, City Attorney, recommending'the reappointment of Mrs. Patricia Gustine to -the postion of Office Secretary in the City Attorney's office was read and upon motion by Morris, second by Wilson, and all present voting in favor thereof, the was approved. A letter from Marvin W..Price, City Assessor, requesting permission to hire the` assistance of the part time Deputy Assessors, who will obtain the Personal Property Class III assessments and the Homestead Classification on real estate, was read and upon motion by Wilson,:second by DeVries, and all present voting in favor thereof, his request was granted. A letter from Tom O..Moore, City Planning Director, requesting approval` of the reappointment of Richard 0. Roth as Associate Planner and Willetta E.'Hoaglan as Secretary .to the Planning Director was read and upon motion by DeVries, second by Wilson, and all present voting in favor thereof, the appointments were approved. A letter from William S. LaPlante, Municipal Judge, appointing the following personnel as officials of the Court for the year ending the first Monday in April 1962, was read and upon motion by Wilkus, second by Morris, and all present voting in favor, the same were approved: Municipal Court: ` Carol Forde Deputy Clerk ` Elaine Ryan Deputy Clerk Traffic Bureau: -Ralph Ellingwoos Director & Deputy Clerk Karen Paulsen Assistant to Director and Deputy Clerk Jane Streiff Deputy Clerk Sharon Hirscher Deputy Clerk Alderman Stadler arrived at 7:55 o'clock P. M. A petition with 51 signatures requesting that the City dog pound be removed from its present location along North Broadway and be relocated at some point further distant from th e City was read. Mr. David Hunt of 1642'North Broadway was present and spoke in behalf of the property owners in that area; he stated that the dog pound in this area was a great nuisance due to the noise and suggested that it be moved further into the country. Alderman Morris stated that he felt some effort should be made to find a new location, the property along Broadway was • 236 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., April 10, 1961 very valuable property as commercial and if the City ever sold it the dog kennels and house would again have to be moved, he thought it was better to try and get a new location before the new one was built. Alderman Stadler, Chairman of the Public Safety Committee, stated that the Committee had tried to find a different location but so far had been unable to do so, but would welcome any suggestions or recommendations. A motion was then made by Morris, second by Stadler, that the petition be referred to the Public Safety Committee. All voted in favor. r A letter from the Board ofPublicHealth & Welfare requesting approval of the appointment of Miss Verona Keith as a staff public health nurse, effective April 17, 1961, was read and upon motion by Wilkus, second by Wilson, and all voting in favor thereof, the appointment was approved. The application of Special School District' No. 4 requesting approval of the preliminary subdivision plan to be known and designated as Northeast School Addition was read and,the preliminary plan was submitted. Upon motion by Wilson, second by Stadler, and all voting in favor thereof, the same was referred to the Planning and Zoning Commission. A letter from the Auxiliary of the Veterans of Foreign Wars and the Auxiliary of the American Legion requesting permission to sell poppies on the streets of Rochester on Saturday, May 27, 1961 was read and upon motion by Tingley, second by Stadler, and all voting in favor thereof, their request was granted. A letter from Gordon Yeager of 1314 East Center Street concerning the possibility of the acquisition of a public access site on Lake Zumbro was read and upon motion by Stadler, second _ r by Wilkus, and all voting in favor thereof, the same was referred to the Parks, Public Grounds and Recreation Committee.' The claim of injury of Mrs. Helen S. Dahlin in the amount of $2,000.00 for damages caused by a slip and fall on the concrete floor of the city dog pound was read and upon motion by Wilson, second by Stadler, and all voting in favor thereof, the same was referred to the City a Attorney. t The report of feasibility of proposed downtown street lighting program submitted by Mr. Harold 0. Moee,Superintendent oftheElectric Department, was read and upon motion by Stadler, second by Wilkus, and all voting in favor thereof, the same was referred to the Purchasing, Utilities and Miscellaneous Committee. A letter signed by Paul E. Zollman, President of the Rochester Chapter of Izaak Walton League, requesting that the Council consider the dredging of Silver Lake was read and upon motion by Stadler, second by DeVries, and all voting in favor thereof, the letter was referred to the Parks, Public Grounds and Recreation Committee. The recommendation of the Finance, Ways and Means Committee recommending that the City of Rochester Employment Policy be amended by the addition of.a new Sub Section 5 under.•Section 2B was read and upon motion by Wilkus, second by Wilson, the recommendation was approved and the City Attorney was instructed to'prepare the necessary resolution. The proposed amendment reads as 1 1 U 1 • - Record of Official Proceedings of the Common Council of the City of Rochester, .Minn., April ' 10, _ 1961 Z 3 7 • 1 • J follows: "Employees who hold joint City -County positions and who are on both the City and County payrolls, performing one full time job jointly for`both agencies, shall be required to reside within the County and shall not be subject to City residence requirements, providing their availability for work is not. impaired." The recommendation of the City Planning and Zoning Commission stating that they had reviewed the`appeal from the decision of the City Building Inspector to vary the height regulations of the residential district to permit construction of the Northeast Junior High School and recommending that because this is a public school building and has side yards of not less'than 110 feet and is situated close to the base of a hill to the north, and will not deprive anyone of light, air or open space, that this variance in the height regulations be approved, was read. Upon`motion by Stadler,`second by Wilkus, this recommendation was tabled Until April 17, 1961 at which timea hearing is set for this matter. All voted in favor thereof, The recommendation of the City Planning and Zoning Commission stating that they had reviewed the petition to annex lands to be known as Crescent Park 2nd Addition and recommend that this annexation be approved was read and upon motion by Wilkus, second by Morris, and all voting in favor thereof, the recommendation was approved and the City Attorney was instructed to prepare the ordinance annexing the said lands. The recommendation of the City Planning and Zoning Commission requesting the Council to consider the extension of Ordinance No. 1020 (expired March 31, 1961) which provided for interim zoning procedures on North Broadway from 7th Street to the Zumbro River was read and upon motion by `Stadler, second by Vilkus, and all voting in favor thereof, the same was referred to then Planning, Zoning and Annexation Committee. The application of George Edward Rucker for an "on" and "off" sale non -intoxicating malt liquor license was read and upon motion by Wilson, second by Morris, the same was referred 1 _ . to the Public Safety Committee. The applications of Harold Sheppard, Robert B. Ridler, T. A. Heimer and Dorothy & Lowell Zeller for "off" sale non intoxiiating malt liquor license were each read and upon motion by Wilson, second by DeVries, the licenses were granted. The applications of Huey's Wholesale Company (8); Cooperative Oil Company; Helen & John King; Erickson Service Station; Bell Vendini Company (8); Dorothy & Lowell Zeller; West Town Pure Oil Company; Lawrence E. Johnson; Dale Haug; Eldon L. Johnson; Louis Ruffalo; T. A. Heimer; Bernard J. E. Johansen; Richard Hargesheimer; City of Rochester, Park Department; Rudolph Biaggio and Harold Sheppard for a license to sell `cigarettes were each read and upon motion by Wilson, second by'-Wilkus, the licenses were granted. Lance and Harris Plumbing & Heating Company for a Master Plumber's License and the applications of Donald C. Connolly, Robert B. Matheson, Charles T. Barry, John E. Colgan, William J. Tointon and Ardell Flicker for Journeyman Plumber's License were each read and upon motion by Wilson, second by DeVries, the licenses were granted. The applications of Charles.B. Bulderback, Alden Fuerstneau,' Harold Beaver, Carl F. Schultz, Alvin Y. Tupper, Maurice F. Brown and Arthur Bonnickson for Journeyman Electrician's t. License were each read and upon motion by Wilson, second by Stadler; the licenses were granted. The applications` of I;eslie R. Lance and Harris Plumbing & Heating Company for a Hot Water and Steam Heating Contractors`License and the applications of William L. Weaver, Norman Wendt, Thomas Brogan and Wendel Toft for Journeyman Warm Air Heating, Ventilating and Air Conditioning Worker's License were each read and upon motion by Wilson, second by Stadler, the licenses were` approved. - The applications of K.R. The application of Rudolph Biaggion for a pool hall license (5 tables) was read and upon motion by Wilson, second by DeVries, the" license was granted. 'Lance -(2)' each in the amount of $1,000.00 with the Western Surety Company as surety were each read and upon motion by Morris, second by Stadler, the bonds were approved, the surety thereon accepted and the same were ordered'placed on file. ` ,The bontract bonds of Universal Motors; Inc. in the amount of $2,311.10 with the Standard Accident`Insurance Company as surety and Northwestern Refining Company in the amount of $6,800.00 with Anchor Casualty Company as surety were each read and the same were referred to the Mayor for his approval.' _ The report of the Clerk of Municipal Court for the week ending April 7, 1961 showing total criminal fines and costs collected and civil fees received $2,287.00 and total remitted t to the City Treasurer $1,880.40 was read and having been previously approved by the City'' Attorney, President Tingley ordered the same` placed on file. He said the action was against Mrs. Romer from Wabasha. The fire truck was repaired by -firemen while they were an duty so the out of pocket expense was only about $5100.00. Mrs. Romer had property damage in the amount of $5000.00, but in the course of the accident she- also struck three parked cars. Mr. Ehrick recolm ended settlement of this case .even though the City•would take a loss of about $600.00. A motion wag then made by Stadler, second by Wilson, that -the recommendation of the City Attorney, be accepted and the Mayor be' authorized to sign the release. All voted 2n favor thereof. A letter from•the Rochester Civic Theatre, Inc. requesting an opportunity to appear ,before the Rochester City Council to discuss a proposal re•gardirfg the location ofla theatre building adjacent of -the Art Center building in Mayo Park was read.
