A3528 11 Minutes of a special meeting of the Common Council of the City of Rochester, Minnesota,, held in the Council Chambers in the City Hall, in said City, on May 18, 1961. President, l)ingley called the meeting to order at 7:30 o'clock P.M., the following members being Present: President Tingley, Aldermen DeVries, Leonard, Morris, Wilson. Absent: Stadler and Wilkus. The call of the special meeting was read and President Tingley ordered that the same be placed on file, the ksaid meeting.having been called for the purpose of considering a stipulation in the gas rate case pending in District Court and any other business the said Common i Council may deem proper. Alderman Wilson introduced a resolution authorizing and directing R. V. Ehrick, City Attoonney, to execute on behalf of the City, the stipulation in connection with the present gas rate lawsuit pending in the District Court of Olmsted County ( a copy of the stipulation is attached to.the resolution) which was read. Mr. Ehrick read.the stipulation to the Council and explained same to them. A motion was then made by Wilson, second by Leonard, that the said resolution be adopted as read and upon.roll call and all present voting "aye", President Tingley declared the said resolution duly passed and adopted. R. V. Ehrick then.told the Council that there were liable to be some substantial, expenses in the defense of this.law suit. .He esti}nated that it may take 3 to 4 weeks to try. He said.we would have experts sitting here while the testimony comes in and he was thinking of . tiring an attorney that has. -had experience.in these rate cases to aasist him. He said the Gas Company have their Attorneys coming up from Omaha and they have had experts working on,this for months; this is a test case in Minnesota and they want to establish fair value in Minnesota as a matter of law. The Council told him that they had anticipated that there would be considerable expense connected...with this. Upon motion .by Wilson, second by,Leonard, the meeting was adjourned. - Cit o Clerk •
