Minutes of an adjourned regular meeting of the Common Council of the City of,
Rochester, Minnesota, held in the Council Chambers in the City Hall in said City, on July 17,
1961.
President Tingley called the meeting to order at 7:30 o'clock P. M., the following
members being present: President Tingley, Aldermen DeVries, Leonard, Morris, Stadler, Wilkus,
Wilson.
Upon motion by Morris, second by DeVries, and all voting in favor, the minutes of the
meeting of July 10,..1961 were approved.
President Tingley stated this as being thetime and place set for a hearing on the
construction of a sidewalk on the west side of 14th Avenue Northwest from 15th Avenue to 22nd
Avenue Northwest and on the East side of 15th Avenue Northwest to the south line of _Lot 20,
Block.19, Elton Hills 4th Subdivision. There was no one present wishing to be heard. President
Tingley declared the hearing officially closed.
President Tingley stated this as being the time and place set for a hearing on the:
petition for vacating and abandonment of a part of 1st Avenue Northeast from 16th Street. North
to the south line of East =West Alley in Dashow's Addition. There..was no one present wishing -to
be heard. A motion was then made by Leonard, second by DeVries, that. the hearing be officially
closed and the City Attorney was instructed to prepare a resolution vacating and abandoning the
said street. All voted in favor thereof.
A letter from the Board of Public Health & Welfare requesting approval of the appoint -I
ment of Mrs. John Thompson of 506 - 5th Street S. W. as a public health nurse, effective
August 7, 1961 at the salary of $375.00 per month, this employment is being made to replace Mrs.
Ethel Ann Neilssien who resigned her position effective August 4, 1961, was read. Upon motion
by Wilkus, second by Wilson, and all voting in favor thereof, the appointment was approved.

A letter from R. V. Ehrick, City Attorney, requesting that the Common Council grant
Patricia Gustine, his secretary, an unpaid leave of absence from August 15th until October 1st
because of pregnancy was read and upon motion by Stadler, second by DeVries, and all voting in
favor thereof, the leave of absence was granted.
A request from Rochester Junior College for permission to display a "welcoming" banner)
on the overhead cable between Dayton's and the Woolworth Company on the dates of September 1-9,
'1961 was read and upon motion by Leouard, second by Stadler, and all voting in favor thereof,
the requested permission was granted.
A letter from the Rochester Community Chest,'Inc. requesting permission to put up.a
street banner during the Community Chest Campaign period,'October 2 to October 25, 1961, was
read and upon motion by Wilson, second by Stadler, and all voting in favor thereof, the requested)
permission was granted.
A getter signed by Anna B. Greten of 1252 Ninth Avenue Southeast stating that she
was the owner of Lot 24, Block 7, Ireland's First Addition and that on June 18, 1946 the City
Building Inspector had issued a building permit for a temporary residence for five years to her

husband, she is now a_widow and is in the process of selling the property was read. Because of
the temporary permit being recorded, this has created a flaw on the title and is holding up the
sale, the .house has all of the proper set -backs and is properly positioned on the lot and it is
her understanding that the Building Code violations.are not very serious and therefore she
petitions the Council to waive their requirements of the Building Code for this house as soon as
may be reasonably possible. Mr. Garnet Spring, Building Inspector, stated that he was not opposed
granting a permanent permit, he said that he had issued the temporary permit back in 1946 during
war times, but thought that the house met the requirements of the Building Code and could be issued
a regular permit. Mr. Franklin Michaels, Attorney representing the petitioner was present; he
stated that Mrs. Greten was selling this house and was leaving the city to live with her daughter,.
and the filing of the temporary permit had tied up the whole sale; he requested that.theCouncil,
based upon Mr. Spring's recommendation, take action waiving such violation as.there may be in this
code and dissolving the temporary permit and allowing a regular permit. Alderman Stadler then
moved that all restrictions imposed on Lot 24, Block 7, Ireland's First Addition, Olmsted..County
Minnesota, also known as 1252 Ninth Avenue Southeast, Rochester, Minnesota by that certain
temporary building permit issued by the Building Inspector on June 18, 1946 be removed and that
the property henceforth be free of all restrictions imposted by that temporary permit. Alderman
DeVries seconded the motion and all voted in favor thereof.
The following resolution adopted by. the Public Utility Board was read and upon motion
by Wilkus, second by Wilson, and all voting in favor thereof, the resolution was approved:
"Be it and it is hereby resolved.by,the Public.Utility Board1of the City of
Rochester, Minnesota that the'Common Council of the jsaid City.be and -,is hereby
requested to authorize the said Board to enter in -to -'a contract with SOUTHERN
MINN990TA SUPPLY COMPANY for the furnishing, in accordance with specifications
on file, of
(3) 100 KVA SUBWAY TYPE TRANSFORMERS
the total amount of the said contract to be FOUR THOUSAND THREE HUNDRED FIFTY
THREE DOLLARS ($4,353.00) and the said Southern Minnesota Supply Company being
the lowest responsible bidder."
The petition of the Rochester Breeding Farms Hatchery of 1001 First Avenue S. E. to
have the following described property changed from a residential to an industrial district was
read and upon motion by Morris, second by Stadler, and all voting in favor thereof, the petition
was referred to the City Planning & Zoning Commission:
,The south 100 feet of the following described lands in the City, Section 2,
Township 106 North of Range 14 West beginning at the intersection So. line
9k St. S. E. and W. line 1st Ave. S. E. for place of beginning, thence
west 93.66 feet, thence south 477.83 feet to a point in North line 10k.
St. S. E., thence East 94.63 feet to west line 1st Avenue S. E. thence
north to beginning.
A letter signed by Delmar D. Heydt of 1308 Elton Hills Drive stating that on July 7,
1961 the city street employees were tlacktopping 13th Ave. N. W. and as a result of their being
careless and negligent their home was covered on three sides with a fine spray of tar, the estim-
ated cost of removing the tar and painting is $250.00, was read and upon motion by Morris, second
by Wilson, and all voting in favor thereof the letter was referred to the City Attorney.
A letter signed by LeRoy Spratte requesting that consideration be given to the parking
situation on 6th Street N.-E. from Broadway extending east was read and upon motion by Morris,

second by Stadler, and all voting in favor thereof, the letter was referred to the Public
Safety Committee.
A letter from Maxine Due11 concerning her temination as Clerk of Municipal Court in
the City of Rochester was read. Mr: John Bakke, Personnel Director, stated that this matter
has.had thorough airing and more facts have been considered than are mentioned in the letter
or at this meeting. A motion was then made by Leonard, second by Wilkus, and all voting in favor
thereof, that the letter be referred to the Finance, Ways and Means Committee.
Mr. D. J. Thomas was present and showed a proposed plat of Thomas 2nd Addition.which
he was requested to present by the Planning and Zoning Commission, he was also requested to
furnish a temporary chart and an application for approval in connection with the installation of
a sanitary sewer line to serve the unplatted lands -west of Thomas First Addition and North of
llth Avenue Northwest. The proposed plat was referred to the City Planning & Zoning Commission
and Mr. Thomas was requested to furnish them with 18 copies of thej said plat.
` A letter from Miss Sadie Langan of 415 - 8th Avenue Southwest stating that after she
had made all plans to construct a garage on her lot, she was told by the Building Inspector that
her lot was not large enough and she now asked if there was not something that could be done to
allow her to construct a garage. Upon motion by Wilson, second by Stadler, and all voting+
in favor thereof, the letter was referred to the City Planning and Zoning Commission.
The following recommendation of the Parks, Public Grounds and Recreation Committee
was read:
"The Public Health'Board has requested authorization to dispose of the
dental chair, dental X-Ray equipment, dental instruments and instrument
cabinet in the Public Health Center. The Board plans that the room
thereby released would be used for a new Homemaker's Service.
Investigation shows that the facility originally -provided has never
been used for regular dental diagnosis and care. It has been used for a
special flouride study, and occasionally in the course of reserve army
examinations. County patients are cared for in the regular offices of
local dentists, however, and there is no projected use foreseen for the
present equipment or space. The equipment is now out dated, and generarlly
inferior to that used in most local dental offices. The local dental
association has unanimously approved this proposed disposition.
For these reasons, the Committee recommends that this authorization
be granted."
R. V. Ehrick, City Attorney, stated that this equipment had been purchased with the help of the
Federal funds about eleven or twelve years ago but in discussing it with Dr. Wilson, there was
no grant agreement or any agreement with the Federal Government, it was all processed through the
State and in his opinion it was 0. K. to go ahead and sell this equipment. Upon motion by
Wilkus, second by Stadler, and all voting in favor thereof, the recommendation was approved and
the City Clerk was authorized and instructed to notify the Health Officer of the action taken.

The following recommendation of the Parks, Public Grounds and Recreation Committee
" The small park area owned by the City of Rochester near the Zumbro Dam
would seem to lend itself well to construction of a boat launching ramp from
the standpoint of physical layout. We recommend, however, that the City not
undertake this project for the following reasons:
1. The maintenance and policing of this area, located in Wabasha
County, has already proved to be a problem. Further improvement
and development of this area without more supervision than the
City can afford appears -unjustified.

2. There seems. to' -be. no indication that the launching service provided by
private ramp owners is inadequate.to meet normal demands.
3. An opinion from the State Conservation Department suggests that their
willingness to restock the lake with fish would not hinge upon the
existence or lack of a lauching ramp."
Upon motion by Wilkus, second by -Morris, the recommendation was approved. All voted in favor
thereof, except Alderman Wilson who voted "no".
The recommendation of the City Planning and Zoning Commission stating that the plat of
Crescent Park 2nd 'Addition conforms to'the provisions of Ordinance No. 1010and applicable Utate
laws and recommending that this plat be -granted final approval was read and upon motion by.Wilson,
second by Wilkus, the krecommendation was approved and the City.Clerk was instructed to prepare a
resolution approving the said plat. All voted in favor thereof.
The recommendation of the City Planning and Zoning Commission stating that theyhad
reviewed the petition for the establishment of a 25 foot minimum front yard building.setback line
on all lots in Crescent Park 2nd Addition and recommending that this petition be granted 'approval
was read and upon motion by Wilkus, second by Stadler, the recommendation was approved and a
hearing was set for 7:30 P. M. on August 7, 1961. All voted in favor thereof.
A letter from Mayor Alex P. Smekta submitting to the Council, as recommended by the
Rochester Police Civil Service Commission, the reappointment of Mr. James -Paine of 2233 - 6th
Place Northeast as Patrolman, effective July 18, 1961, was read. Upon motion by Morris, second
by Stadler, and all voting in favor thereof, the appointment was confirmed.
The application for transfer of "on and "off" sale 3.2 beer license from-16hn 0. Holt
to Robert Travers at the Pub -Oyster Bar at Miracle Mile was read and upon motion by Wilson,
second by DeVries, and all voting in favor thereof, the application was referred to the Public
Safety Committee.
The application of Leland Fay for a license to construct sidewalks was'read and upon
motion by Wilkus, second by Morris, the license was granted.
The application of Robert Schinke for a license to erect and maintain signs was read
and upon motion by Wilson, second by DeVries, the license was granted.
The applications of Arnold Mork for a license to -sell soft drinks and the applications.
of Arnold Mork and Albert J. Tingley for license to sell cigarettes were each read and upon
motion by Morris, second by DeVries, the licenses were granted.
The applications of Charles Nelsen for a Journeyman Plumber's License, Richard Vale
for a Journeyman Electrician's'License and Paul J. Hennessey for a Journeyman Warm Air Heating,
Ventilating and Air Conditioning Worker's License were each read and upon motion -by Morris,
second by Stadler, the licenses were granted.
The application of Lysne Construction Company for a permit to move a 1k story house
from 5th Street N. W. and llth Avenue N. W. to outside the city limits was read and upon motion
by Wilson, second by DeVries, the permit was granted, said house to be moved under the supervision
of the Building Inspector and the Chief of Police.
The application of Willis T. Bale for a permit to move a house from the 300 block at

by -Wilson, second by DeVries, the permit was granted,..the js aid building to be moved under the
supervision of the.:,Building Inspector and the Chief .of Police.
The contract bonds of Stephen..B. Woodward in the..amounts of $8,681,90 and $2,273.25
with the Fidelity and Casualty Company of New York as surety were each read and upon motion by
Morris, second by DeVries, the same were referred to the Mayor for his approval.
The report of the City Treasurer for the month of June, 1961 was presented and
President Tingley ordered the same,placed on file.
The reports of the Clerk of Municipal Court for the week ending July 7,.1961_showing
total criminal fines.and costs collected and civil fees received $2,249.00 and total remitted to
the City Treasurer $1,724.00 and for the..week ending July 14, 1961 shwoing total criminal.fines
and costs collected and vivil fees received $3,452.00 and total remitted to the City Treasurer
$2,812.00 were each read and having been approved by the City Attorney, President Tingley
ordered the same placed on file.
The following resolutions were each introduced and read and,upon motion made and
seconded and all voting.in favor thereof, President Tingley declared the same duly passed and
adopted:
Resolution authorizing the Public Utility Board to enter into contract with the
Southern Minnesota Supply Company. Upon motion by Morris, second by Leonard, resolution adopted.
Resolution referring proposed improvement for feasibility report and recommendation
for construction of a water tank and connecting trunk line for the low district of the Southeast
Service Area. Upon motion by Leonard, second by DeVries, resolution adopted.
Resolution referring proposed improvement for -feasibility report and recommendation
for construction of a sanitary sewer and watermain in Blocks 4, 5, 6, 10, 11, 12, 16,.17, 18,
22, 23, 24 and that part of Block 3 lying east of Trunk Highway 63 of Golden Hill Addition and ali
of Garden Acres. Upon motion by DeVries, second by Leonard, resolution adopted.
Resolution approving plans and specifications and ordering bids for constructionof a
curb and gutter on 13th Avenue Northeast from 14th to fIl5th Street Northeast. Upon motion by
Leonard, second by Wilson, resolution adopted.
Resolution approving plans and specifications and ordering bids for construction of
a sidewalk on the west side of 14th Avenue Northwest from 15th Avenue to 22nd Street Northwest
and on the east side of 15th Avenue Northwest to the south line of Lot 20, Block 19, Elton
Hills 4th Subdivision. Upon motion by DeVries, second by Leonard, resolution adopted.
