Minutes of a regular meeting of the Comn on Council of the City of Rochester, Minnes-
ota, held in the Council Chamber's in the City Hall, in_said City, on September 5, 1961.
President Tingley, called the meeting to order at 2:00 o'clock Y. M.:, the following
members being present': President Tingley, Aldermen DeVries, Leonard, Stadler, Wilkus, Wilson.
(alderman Morris Arrived at 4:15 P. M..). '
Upon motion byWilson, second. by DeVri•es,, the minutes of the meeting 'of August 21,
1961 were approved,with the following correction; that line 32 of page `1 of the minutes be changed
to read "7:30'o'clock P. M. on September 18', 1961", instead of "7:30 o'clock P.M. on February 18,
19 61" .

President Tingley stated this as being the'time and place set for receiving and
opening bids for construction of a dog kennel and house. The' bids .of Weis Builders, Inc., in the
amount of $39,650.00 and Floyd Larson•, Contractor in the amount of $39,932.00 were each received
and -opened and upon motion by Leonard,°,second by Wilson, and all voting,in favor thereof, the
committee composed of Frank J. Wilkus, Garnet Spring, RobertBlakely and Daniel Robbins, Architect.
President Tingley stated this as being the time and place set for receivin& and
opening bids for grading base and prime coat for taxiway construction on T-Hangar at the Rochester
Municipal Airport. The bids of Quarve & Anderson,f r Alternate "A" in the amount of $4,088.00
and Alternate "B" in the amount of $1,400.40 and ,the bid of Leon Joyce in the°amount of $4,593.00
for Alternate "A" and Alternate "B" in the amount of $1,499.00, were each received and opened and
upon motion by Stadler, second by Wilkus, and all�'voting in favor thereof, the bids were referred
to the Airport Commission.
President Tingley stated this as being the time and place set for receiving and openi
bids for installation of fixed time traffic signal on North Broadway at 2nd Street. The bid of
H & H Electric Company in the amount of $3,675.00.was received and opened and upon motion by
Stadler, second by Wilson, and all voting in favor thereof, the same was°referred to the Public
Works Committee and the City Engineer.
President Tingley stated this as being the time and place set for receiving and
bids for installation of a semi -traffic actuated traffic singal on 5th Street Northwest at 6th

Avenue Northwest. The bid of H & H Electric Company in the amount of $4,289.00 was received and
opened and upon motion by Stadler, second by Wilson, and all voting in -favor thereof, the -same
was referred to the Public Works Committee and the City Engineer.
A letter from Garnet Spring, Building Inspector, requesting permission to attend the
Midwest Conference of Building Officials to be held at the City of Waterloo, -Iowa on September 24
through 27, 1961 was read. Upon motion by Wilson, second by:Stadler, and all voting in favor
the request was granted and Mr. Spring was authorized to attend at city expense4,,,,
A letter from Marvin-W. Price, City Assessor, requesting permission:*to attend the

International Association of Assessing Officers from October 7th through the llth in Montreal,
Canada, was read'and upon motion by Wilkus, second by Wilson, and all voting in favor thereof, 'the
request was denied. .
A notice from the League of Minnesota Municipalities listing the dates for the

regional meetings (the one in Southeast Minnesota to -be held in Austin, Minnesota on September 18

and President Tingley ordered the same placed on file.
The annual report of the Rochester Bus Line, Inc. for the year ending December 31,
1960 was presented and President Tingley ordered the same placed on file.
The reports of the Clerk of Municipal Court for the week ended August 25, 1961
showing total criminal fines and costs collected and civil fees received $9,606.00 and total
remitted to the City Treasurer $1,851.00 and for the week ended September 1, 1961 showing total
criminal fines and costs collected and civil.fees received $2,676.50 and total remitted to the
City Treasurer $1,966.50 were each read and having been approved by the City Attorney,
President Tingley ordered the same placed on file.
The contract bond of E. J. Vonch-and E. J. Mahoney in the amount of $13,102.00 was
read (United States Fidelity and Guaranty Company as surety) and upon motion by Wilson, second
by DeVries, the bond was referred to the Mayor for approval.
The following letter was read:
"Honorable Common Council

Rochester; Minnesota
Gentlemen:
At an informal meeting of the Olmsted County Board of Commissioners,
held on August 17, 1961, a proposal of the Mental Health Clinic and -a
recommendation of the Rochester Board of Public Health and Welfare, that
the Mental Health Clinic be placed under the'direction of"the Olmsted
County Board of Commissioners, was presented to said Board.
It was stated, in making this decision the Rochester Board of Public
Health and Welfare is impressed with the possibilities of a Mental Health
Clinic Administrative'Board free to devote full time to the problems of
the Mental Health Clinic and with the opportunity, through a reorganization,
• of eliminating the duplication of taxation on the'City of Rochester taxpayer.
It was unanimously agreed by members of the County Board to formally
adopt a resolution enabling a reorganization of the Mental Health Clinic,
during their next proceedings to be held on September 6th and 7th, 1961.

Mr. Robert Knox, Chairman of the Advisory Board for the Mental Health Clinic was present and
requested that`the Common Council reconsider their action and again consider the possibility of
putting the Mental Health Clinic under the complete control of the County Board rather than
joint control of the City and County. After a lengthy discussion a motion was.made by Stadler,
second by Wilkus, that this matter be referred to the Parks, Public Grounds and Recreation
Committee for study and report back to the Common Council. All voted in favor thereof.
Mr. John Kerr presented plats of Mill Reservation Subdivision and Northern Heights
1st Addition and requested preliminary approval of the same. Upon motion by Stadler, second by
Wilkus, and all voting in favor thereof, the same were referred to the Planning & Zoning.
Commission.
The following resolutions were each introduced and read and upon motion made and
seconded and all voting in favor thereof,'President Tingley declared the said resolutions duly
passed and adopted:

Resolution authorizing and directing the City Clerk to advertise for sealed proposals
for the repointing of the City Hall'Building.. R. V. Ehrick, City Attorney, reported that the
city would have to have the services of an anccitect or engineer for drawing -the specifications
and plans for the said repointing; C.-A'. Armstrong stated that he had someone available in his
office -who Could draw these specifications and plans. Upon motion by Leonard, second by-
DeVries, resolution adopted.
A resolution amending a, resolution adopte& August 7,.1961 vacating -a portion of 1st
Avenue Northeast, as platted in.Dashow's Subdivision. Upon motion by Morris, second by Wilkus,
and upon roll call and all voting in favor thereof', resolution adopted.
- Resolution accepting the conveyance of land by the Mayo Association to the City of
Rochester by Quit Claim Deed dated August 8, 1961, said land being in Section'12, Township 106,
Range 14 West, Olmsted County, Minnesota (the aforesaid Quit Claim Deed is to correct the
description of land heretofore conveyed by the'tZayo Association). Upon motion by DeVries, Second
by Wilkus, resolution adopted. -

Resolution that on the appeal of the owners from the decision of the Building Inspector,
upon the application of the owners for a variance of the provisions of the -Zoning Ordinance,
and after hearing duly held on August 21, 1961 a variance is granted and -provisions of Section
8Ck of Ordinance No. 558, as amendbd', are hereby waived so as to permit the owners of the North
16 feet of Lot 8, the South 26 'feet of Lot 7 and the East 52 feet of the vacated alley by the
said Lots, all in Block 31, Head'& McMahon's Addition to the City of Rochester, to construct a
garage on said premises without meeting the yjard requirements of said Section 8C2. Upon motion
by Wilkus, second by Wilson, resolution adopted.
Resolution 'that on the appeal of the owner from the decision of the Building Inspector,
upon the application of the owner for a variance in the provisions of the Zoning Ordinance and
after hearing duly held on August 21; 1961, the owner of the East 90 feet of Lot 5, Block 25,
Head & McMahon's Addition is granted a variance to construct a single dwelling thereon although
said land is 50 squre feet short of the minimum area requirements of the Zoning Ordinance, Upon
motion by Wilkus, second by Wilson, resolution adopted. -
Resolution authotiging and directing the Mayor and .City Clerk to execute on behalf of
the City the.Quit Claim Deed -conveying a portion of IAt 10, Block 17, Northern Addition to
the City of Rochester, to Mr. and Mrs. Emery Anderson. Upon motion by Wilkus, second by Wilson,
resolution adopted.
Resolution establishing the -following one-way streets in the -City of Rochester:
(1) 2nd Avenue Northwest -between 8th Street and loth Street as -,the said
2nd Avenue Northwest aiviaes around Cascade Park. The east lane of
2nd Avenue Northwest at this location is established for North bound
traffic and the West lane is established for South bound traffic.
(2) 3rd Avenue Northwest between 2nd Street and 4th Street is established
for one-way traffic North bound.

(3) 4th Street Northwest between 3rd Avenue and 4th Avenue is established for
one-way traffic west bound.
(4) 4th Avenue Northwest between 2nd Street and 4th Street is established for
one-way traffic south bound.
Upon motion by Wilkus, second by Wilson, resolution adopted.
Resolution amending the Resolution adopted on.July 21, 1958 establishing parking and
parking meter regulations and provisions pursuant to Ordinance No. 871, as follows:.
(1) Subsection a. of Section (1) ANGLE PARKING,.is hereby amended so as to read
in its entirety as follows:
"a. On -1st Avenue Northwest and Southwest on both,sides of the street from the
Chicago and North Western railroad tracks on the North the 2nd Street Northwest and
from 6th Street Southwest South to the end of 1st Avenue Southwest."
(2) Subsections f., j., and k. of Section (1) ANGLE PARKING, are hereby repealed.
(3) Section (2) NO PARKING ZONES, is hereby amended by adding thereto Subsections
to read as follows: -
"ct. On the North side of 4th Street Northwest from 3rd Avenue to 4th Avenue, at
all times."-
"cu. On the primary roadway of 6th Street Northwest from 4th Avenue to trunk
highways No. 14 and 52, at all times." ,
"cv. On the South side of the North Service Drive of 5th Street Northwest from

7:00-A. M. and 6:00 P. M. on days when St. Francis School is in session."
"di. On the East side of 11th Avenue Southeast from a point 110 feet South of
Center Street, at all times."
"dj. On the West side of llth Avenue Southeast from Center Street to First
Street, at all times."
"dk. On the West side of North Broadway, from 7th Street to a point approximately

An Ordinance annexing to the City of Rochester, Minnesota, certain unplatted°lands not
exceeding 200 acrasiin area all being in the west one-half of section 12, township 106 north,
range 14 west, Olmsted County, Minnesota (Westport Addition), was given its second reading.
An Ordinance annexing to the City of Rochester, Minnesota, a certain unplatted land not
exceeding 200 acres in area, all being in the Southeast 2 of Section 3, Township 106 North, Range

A motion was then made by Morris, second by DeVries, that the said -ordinance be adopted
as read, and upon roll call and all voting in favor'thereof, President Tingley declared the said
ordinance duly passed and adopted. '
An Ordinance amending an Ordinance entitled "An Ordinance for the purpose of promoting
health, safety, order, convenience and general welfare by regulating the use of land, the location,
size, use and height of buildings and the arrangen ent of buildings'on lots, and the density of
population within the City of Rochester, Minnesota, all in accordance with a comprehensive plan
(changing Lots 1 to 6 inclusive, Block 1 and Lots 7 to 16 inclusive and Lots 23 to 32 inclusive

Block 4, Graham Addition to Multiple Dwelling District; and Lots�i to 6 inclusive and Lots 17 to
22 inclusive, Block 4, Graham Addition to Commercial District), was given its third and final
reading.
A motion was made.by Morris, second by DeVries, that the said ordinance be adopted as
read, and upon roll call and all voting in favor thereof, President Tingley delcared the said
ordinance duly passed and adopted.
The recommendation of the City Planning and Zoning Commission re the petition to change
the zoning on Lots 14, 15 and 16 of Jordan's Subdivision and part of Lot 17, Section 36
Township 107 North,•Range 14 West from a residential district to the multiple dwelling district
was again presented. A motion was made by Wilson, second by DeVries, and all voting in favor
thereof, that the recommendation be tabled until the meeting on September 19, 1961.
The City Clerk was instructed to write a letter to -Dr. James Moon, Superintendent of
Schools, telling him that the Council would hear him and the School Board in regard to their
budget on September 19, 1961 at 8:00 o'clock P. M.

same were approved and the Mayor and City Clerk were authorized and directed -to draw warrants upon.
