Minn., - March 19, 1962, 1 CQ cc • 1 Ll LJ 1 n LJ i Minutes of an adjourned regular meeting of the Common Council of.the City of Rocheste Minnesota, held in the Council Chambers in the.City Hall, in said City, on March 19, 1962. Upon motion by Wilkus, second.by Wilson, and upon roll call`and all -present voting in favor thereof, Alderman Morris was appointed as President pro tem. President pro tem Morris called the -meeting to order at.7:30 o'clock P. M., the following members being present: President pro tem Morris,, Aldermen DeVries, Leonard, Stadler, ,Wilkus, Wilson. Absent: President Tingley. Upon motion by Stadler, second by Leonard, and all present voting in favor thereof, the minutes of the meetings of March 5th and March 14th, 1962 were approved. President pro tem Morris stated this as being the time and place set for receiving and opening bids for the following projects: ' Bids for Contract No. 2 for construction of a water tank -and connecting taunk line for, the low district .,of the Southeast: Service area. The bids of Minnesota, Bridge Co. in the amount of $28,531.00; Doyle Conner Co. Inc. in the amount of $24„497.00; Alvin E. Benike in the amount of $26,600.00; Weis Builders, Inc. in the:amount.of $24,360.00 and Acton Construction Co., Inc. in the amount of $26,488.00 were each received and opened and upon motion by DeVries, second by Wilson, and all present voting in favor thereof, the bids were referred to the Public Works Committee, the Supt* of the Water Department and Agneberg-Sankstone Associates, Engineers for tabulation and recommendation. Bids for Contract No. 3 for construction of a water tankand connecting trunk line for the low district of the Southeast Service area. The bids of Littrup Nielson Inc. in the amount of $15,533.75 and Carlisle G. Fraser, Inc. in the amount of $14,443.00 were each received and opened and upon motion by DeVries, second by Stadler, and all present voting in favor thereof, the bids were referred to the Public Works Committee, the Supt. of the Water Department and Agneberg-Sankstone Associates, Engineers for tabulation and recommendation. C C Bids for construction of a sidewalk on the north side of 18k Street Northwest from 19th Avenue to 18th-Avenue Northwest. The bids of Doyle Conner Company in the amount of $1,841.50; Phil M. Ryan in the amount of $2,119.80; E. J. Mahoney in the amount of $1,959.68 and Stephen Be Woodward in the amount of $1,936.85 were each received and opened and upon motion by Wilkus, second by Wilson, and all voting in favor thereof, the bids were referred to the Public Works Committee i and City Engineer for tabulation and recommendation. Bids for construction of sidewalk on the east side of 14th Avenue Northwest from Elton Hills Drive to Cascade Street. Bids for furnishing the season's supply of crushed rock, sand and gravel, road oil and cutback asphalt and plant mixed bituminous mixture for use in the Street & Alley Department. Mr..James Bennett of 1603 - 2nd Ave*S. towas present and inquired when this work would be finished; he was told it would be completed by the end of September. Mrs. Thompson of the Starlite Motel was also present and inquired if and when sewer and water .would be put on the west side of the highway;_C.,A. Armstrong, City Engineer, reported that there were no construction plans at present but there was a recommendation from the Public Works Committee to be considered at today's meeting instructing them to go ahead with the project'' Mr. Dwayne Robinson of 103 - 17th Street S. E. stated that he ked a corner lot and_inquired if t he would be assessed for both sides, he also inquired what would be done to the raodway; Mr. Armstrong reported that thq policy in the past had been that every corner lot be.assessed for the narrow side and not be assessed fqr anything in -excess of 120 feet, he said the roadway would be left in as nearly as possible the same condition as,it was when they stateed. The following recommendation was then read: "Honorabld Mayor & Common Council City of Rochester, Minnesota Job 1607 Golden Hill and Garden Acres Sewer and Water (Sec. III Land lying West of Gentlemen: T.H063) We have considered the Feasibility Report of the City Engineer dated February 9, 1962 on the above project. We find that there is a real and immediate need for Municipal -sanitary sewer and water services to the properties on the west side of Trunk Highway 63; and mindful of the extremely high cost of this section, we recommend its construction as soon as.plans and specifications can be prepared. We recommend that the benefitted properties now within the City limits lying west of TH 63 be assessed at a rate of $25 per front foot for the sanitary sewer and water mains, plus any costs of sewer easements that may be incurred. We further recommend that the project costs --in excess of the assessments be borne by City"funds and be recovered to whatever degree is possible by Deferred Assessments to properties that may subsequently be annexed to the City and served by this main. Hearing on street grading and surfacing and construction of sanitary sewer and water main in Bumpus Addition. There was no one present wishing to be heard._ President pro tern Morris declared the hearing officially closed. Hearing on,construction Qf Sanitary sewer and water main in,18th 4venue Northwest from Cascade Street to Lot 5, Allendale $ubdivision. Rev. B. J. Williamson was, present and inquired if the total estimated cost of�the project, in the amount of $9100.00 would-be assessed against this one lot; he also urged that this work be -expedited as soon as possible. C. A. Armstrong explained that the $9100.00 was the total cost of the project but they would only be charged according to their frontage. No one else was present wishing to be heard. President pro . . tem Morris declared the hearing officially closed. Hearing on widening and repaving on 4th Avenue Southwest from West,Center Street to 3rd Street Southwest and on 2nd Street Southwest from 3rd Avenue Southwest to 250 feet west of 4th Avenue Southwest. A letter signed by Robert J. Thompson stating as follows was read: "We will be unable to attend a hearing that is to be held next Monday night at athe Council regarding the widening of "2nd.Street S. W. from 3rd Ave.-S.W. to. 250 feet west of 4th Ave. S.W.". This area has a public school, Coffman Building, on one side of the street (north) and the Baptist Church and our property on the South side. As we are the only private individual taxpayer involved, we felt that we.should bring this matter to your attention. In this highly congested traffic area, it is, no doubt, feasible to widen this street, however, in consulting with the City Engineer's office we find that:- 1. The proposal is for only 10 feet wider on each side. This, of course, would not seem too logical in that the street sould be narrower than the block south of the Clinic and would not"line up". It would seem too bad to have to do this extra widening all over again in a few years when now would be.the least expensive time. 2. The proposal calls for widening only from 4th Ave. West to the north -south alley in the middle of the block. (Adjacent oo our property on thwest). This would tend, it would seem, to cause a "bottleneck" of traffic. A.logical plan, we feel, would be to carry this widening west to the end of the block - to 5th Ave. S. W. To widen only a portion of a block would seem impractical as there would seem to be no benefits. We realize that possibly a lack of sufficient funds no doubt:promted this "cut off" in the middle of.a block. If so, we feel that the project whould be dropped until funds are available in order to accomplish an improvement which would be satsifactory-at its completion. /s Robert J. Thompson" Also a letter from the Regional Office of the Post Office Department, Minneapolis, stating that the Congress of the United States makes no appropriation from which special assessments of municipalities may be paid, even though the resulting improvements may bje of direct benefit to r _ the Government, and therefore they have no funds from which this special assessment may be paid, was read. Upon motion by Wilkus, second by DeVries, and all voting in favor thereof, the letters were placed on file. There was no one present wishing to be heard. W.; and on 5th Street Southwest from 3rd Avenue to r 4th Avenue Southwest. Mrs. Elmer Hagen of 502 - 4th Avenue S. W. was present and stated that 1 E their house was'now on a small lot, 54 x 45, and if part of the boulevard were taken that would t C`3 leave their house almost sitting out on the street and therefore was opposed to the widening. Mrs. Carl Johnson of 206 - 6th Street S. W.,and Miss Marian Baker of 316 - 6th Street S. W. were each heard, they said they felt the street was wide enough now, if. they -were widened the traffic would be even heavier, they suggested that stop signs or signal lights be placed in this area to aid pedestrians in crossing 6th Street. Upon motion by Wilkus, second by Stadler, and all voting in favor thereof, the matter of signals or signs,in this area was referred to the Public Safety Committee for study. Mr. John McGovern of 304 - 6th Street S. W. was present and inquired as to the cost of this per front foot and also if sidewalk would have to be replaced. C. A. i Armstrong, City Engineer, stated that the estimated cost was to 00 front -foot for 57 $ $ . .00 per residentia-1• 7.00-to 9.00 $ $ per front foot for multiple dwelling and $9.00 to $12.00 per front foot for commercial, he also stated that sidewalks would have to be replaced in some places. No one else being present.wishing to be heard, President pro tem Morris declared the hearing officially closed. Continued hearing on Part 2 of replacement and improvement of street lighting system in Downtown Business District. A letter from The Salvation Army Advisory Board requesting that they be notified as to the amount of this assessment as.soon as.,possible so they could include I - it' in their next year budget was read and -the -letter was ordered placed on file and the City Clerk,was instructed to notify them that this assessment would not be payable until the year ! 1963. There was no one present wishing to be heard. President pro tem Morris declared the ! hearing officially closed. ! Hearing on proposed change of zoning of Lot 13, Block 32, Northern Addition <29-7th I Street N. E.) from residential to industrial district. There was no one present wishing to be heard.. President pro tem Morris declared the hearing officially closed. The recommendation of the Planning and Zoning Commission that this zone change be made was again read and upon motion 1 , by Wilkus, second by Wilson, and all voting in favor thereof, the recommendation was approved 1 , and the City Attorney was instructed to prepare the necessary ordinance. Hearing on proposed change of zoning of Lots 12, 15, 16 and 17, Block 32, Northern Addition from residential to industrial district and Lot 14, Block 32, Northern Addition from commercial to industrial district. A letter from Elwood Walker in favor of the zone change i was read. There was no one present wishing -to be heard. President pro tem Morris declared the hearing officially closed.. The recommendation of the Planning and Zoning Commission that this v j zone ohange be made was again read and upon motion by Leonard, second by Wilkus, the recommend- a non was approved and the City Attorney was instructed to prepare the necessary ordinance. All voted in favor thereof. The Planning and Zoning Commission had not reported back on this zone change, so a motion was made by Wilkus, second by DeVries, and all voting in favor thereof, that this hearing be continued until a recommendation is rjece,ived from the Planning and Zoning Coitunission,,and when the said recommendation is received notices be sent to the property owners within 200 feet again notifying them of the continued hearing. ' Hearing on rpopoped change of zoning of ,Lot 1, Auditor's Plat "D" (Barretts Addition) 1 from residential to industrial district. There was no one present wishing to be heard. Hearing'on proposed change of zoning of that part of vacated alley in Block 20, Moe and Olds Addition (that past which related to construction of parking ramp) from residential to commercial district. There was no one present wishing to be heard. President pro tem Morris declared the hearing officially closed. The recommendation of the Planning and Zoning Commission that this zone change be approved was again read and upon motion by Leonard, second by DeVries, and all -voting in favor thereof, the recommendation was approved and the City Attorney was instructed to prepare the necessary ordinance_. Hearing on proposed change of zoning of that part of.vacated 3rd Street S. E.. lying east of the alley in Block 20, Moe & Olds Addition from residential to commercial district. There was no one present wishing to be heard. President pro tem Morris declared the hearing officially closed. The recommendation of the -Planning and Zoning Commission that this zone change be approved was again read and upon motion by Leonard, second by Wilkus, and all voting.in favor thereof, the recommendation was approved and the City Attorney was instructed to prepare the necessary._ ordinance. Hearing on approval of plat to be known and designated,as Rolling Greens.4th Addition. There was no one present wishing to be heard. President pro tem Morris declared the hearing officially closed. Upon motion by Stadler, second by Wilson, and all voting in favor thereof, the City Attorney was instructed to prepare a resolution approving the said plat. Hearing on approval of the plat to be known and designated as Northern Heights First Addition. There was no one present wishing to be heard. President pro tem Morris-declared'the hearing officially closed. Upon motion by Stadler, second -by Wilson,.and,all'yoting.in favor thereof, the City Attorney was instructed to prepare a resolution approvint the -said plat: ' Hearingon approval`of the plat to be known and designated as Alexander's Replat. Hearing on approval of the plat to be known and designated as Folwell Heights 2nd Addition. A letter from The,Kruse Company in regard to the two provisions in the recommendation of the City. Planning and Zoning Commission that (1) a temporary cul-de-sac be provided -on the _ !1 East end of South Folwell Court and (2) the street names be revised in order.to avoid possible. confusion because of the similarity in names,, was read; they further stated that they had �# i commenced platting procedures for the,Third Addition which will eliminate the need for the dul-de- i! sac but if this is not accomplished soon enough they agree to construct the requested facility; they said the street names on the plat are merely suggestions on their part and they will gladly 1j conform to any naming or numbering sytem which they are requested to apply. There was no one i! present wishing to be heard., President pro tem=Morris declared the hearing officially closed. Th6' recommendation of the City Planning & Zoning Commission that the_plat be approved with the•two provisions listed above, was again read. A motion wastthen made by Wilkus, second by Wilson, -that the recommendation be accepted and the aname of South Folwell Court be changed to a .name acceptable' - !I to the Planning & Zoning Commission, the Fire Chief and the City Attorney. A motion was then made . by Leonard, second -by Stadler, that the above motion be amended to include that the cul-de-sac be provided if necessary, and all voting in favor thereof, the motion was carried. President pro tem �i Morris then called for a vote on throriginal motion as amended, and all voting in favor'thereof, the motion was carried. _. 1 I A letter from the,Board of Public Health & Welfare requesting approval of the ;! employment of Mrs. Mary Ellen Van Kirk as part time clerk -typist in the Mental Health Clinic, j effective April 1, 1962 was read and upon motion by Wilkus, second by -.Wilson, and all voting in 1 favor thereof; the appointment was approved. A letter -from -the Olmsted County Easter Seal Committee requesting permission to hold,:' a sale of paper lilies on the streets of Rochester on April 14;. 1962, was read and upon motion by Wilkus, second by Wilson, and all voting in favor thereof, their request was granted. A letter from the Commissioner of Taxation notifying the Council of the annual "! county seat instruction meeting for assessors and local board members to be held in the Court it House at 10:00 a.m. on March 21, 1962 and urging that members of the Council attend was read. ' Alderman Leonard was appointed to attend this meeting. II A letter from the Rochester B.P.O. Elks Lodge No. 1091, Inc. asking the Common Council !f to declare its opinion as to the possibility of moving the Elks Club Liquor License from its i resent location at 118 Second St. S. W. to a i, P proposed new building on Blocks 1 and 3 in South Home Second Addition on 15th Avenue in Southeast Rochester, they expect to be ready to move in i; approximately one year from this date; was read. Upon motion -by Wilkus, second by DeVries, and ,( all voting in favor thereof, the letter was referred to the Public Safety Committee. A letter from the Rochester B.P.O. Elks Lodge.No..1091 petitioning the Council for the vacating of the proposed 14th Avenue S. E. between loth Street and 9th Street S. E.,-they have t, purchased from the Mayo Association both blocks 1 and 3 of the South Home Second Addition and as ji 1� Record of Official Proceedings of the Common Council of the City of Rochester, Minn., March 19, 1962 this street does not exist at this time and they own both sides of said street, they believe there is no sound reason why their request should not be granted, was read. Upon motion by Wilkus, second by Wilson, and all voting in favor, the letter was referred to the Public,Safety Committee. The petition of the Rochester Elks Lodge #1091 for change of, zoning of Bloxks 1 and .3 of South Home Second Addition from residpntial to multiple dwelling district was read and upon motion by Wilkus, second by Wilson, and all voting in favor, the petition was referred to the Planning and Zoning Commission. Claim for damage to property in the amount of $4,435.00, signed by Philip Sternberg, Vice President of LeRoy Shane Company, causedby a plugged sewer was read and upon motion by Wilkus, second by Wilson, and all voting in favor thereof, the claim was referred to the City Attorney. The claim for damage to property in the amount of $3,479.27, signed by W. H. VanLith Sec.Treas. of the General appliance & T.V., Inc., caused by a plugged sewer was read and upon motion by Wilkus, second by Wilson, and all voting in favor thereof, the was referred to the City; -,Attorney,. The claim of injury of Mrs. Nora Anderson of 1509 - 13th Avenue N. E. for injury sustained when she fell on the sidewalk at 1019 East Center Street was read and upon motion by Wilkus, second by Wilson, and all voting in favor thereof, the claim was referred to the City Attorney. A letter from Joseph P. E. was referred to this committee last summer. We have had the land that would have to be acquired for streets and parks . purposes appraised and have estimated the cost of construction the proposed street. On the basis of these figures'we do not feel that the project can be supported by public funds at this time. The plan as proposed by the Planning Department was presented as a guide for the property owners to use in replanning and replatting this property in order to give it a more desireable street layout, character, and ultimate value than the existant grid pattern does. It appears that the owners have no inclination to do so, but feel that they should either (1) be allowed -to develop the land in accordance with the existant street.layout or (2) be paid for any changes made,in the street layout. We, recommend, that, in -as -much as the proposed improvement of this area is principally for the benefit of the property itself rather than for,the gaueral public, the responsibility for its improvement be left with the owner's. If the property is developed according to the existing platting, it should be noted that there are -also several problems to be dealt with. The streets are not graded or surfaced and there are no sewers or water mains inplace. There are also two residence buildings which will be practically buried or impounded by the fill necessary to construct the streets.
