Minutes of an adjourned regular meeting of the Common Council of the City of Rochester,_
Minnesota, held in the Council Chambers in the City Hall in said City, on February 17, 1964.
President Tingley called the meeting to order at 7:30 o'clock P. M., the following
members being present: President Tingley, Aldermen Bergstedt, DeVries, Leonard, Thomas, Wilson.
Absent: Alderman McCaleb.
Upon motion by Wilson, second by DeVries, and all present voting in favor thereof, the
minutes of the meeting of February 3, 1964 were,approved.'
President Tingley introduced Alderman Berger from LaSalle, Illinois who was a guest at
thid'Council meeting.
President Tingley stated this as being the time and place set for hearings on the
following projects:
Hearing on proposed assessment for construction of a sidewalk on both sides of 5th
Place N. W. from Sth Street N. W. to 6th Street N. W. in Country Club Manor 2nd and 6th Additions.
There was no one present wishing to be heard. President Tingley declared the hearing officially
c losed.
Hearing on proposed assessment for construction of a sidewalk on the south side of llth
'Street S. W. from 6th to 9th Avenue S. W.; the east side of 9th Avenue S. W. to the south line of
Lot 2, Block 1, Baihly's Addition; north side of Ilk Street S..W. from 9th Avenue to thw�est end
of 11k St; east side of 7th Avenue S. W. from loth Street to llth Street S. W. on all lots where
sidewalk is'not already in place. There was no one present wishing to be heard. President
Tingley declared the hearing officially closed.
Hearing on proposed assessment for construction of a sidewalk on the east side of 19th
Avenue N. W. between 182 and 19th Street N. W. There was no one present wishing to be heard.
President Tingley declared the hearing officially closed.
Hearing on proposed assessment for construction of a sidewalk on both sides of Iq Street
�N. W. from 18th Avenue N. W. to 19th Avenue N. W. in Sunset Terrace. There was no one present
wishing to be heard. President Tingley declared the hearing officially closed.
Hearing on proposed assessment for construction of a sanitary sewer in 14th Street N. W.
from a point on the trunk line sewer which is adjacent to the C. G. W. right-of-way to a point
37.5,feet east of the west line of Lot 5, Block 6, Valleyhigh Replat. There was no one present
wishing to be heard.
Hearing on proposed assessment for extension of a watermain in the Olmsted County Fair-
grounds. There was no one present wishing to be heard. Presidne Tingley declared the hearing
officially closed.
Hearing on proposed assessment for sanitary sewer extension across 19th Street N. W. and
21st Avenue N. W. There was no one present wishing to be heard. President Tingley declared the
hearing officially closed.
Hearing on proposed assessment for construction of a sidewalk on the north side of 6th
Street S. W. from a point 255 feet west of 15th Avenue S. W. to the east frontage road of T. H.

14-52. There was no one present wishing to be heard. President Tingley declared the hearing
officially closed.
Hearing on the application of the Board of Education of Special School District No. 4
to vary front yard setback of the Zoning Ordinance to permit the enlargement of -Northrop School.
A letter signed by Verna Anderson of 812 - 2nd Avenue N. W. stating that they were opposed:to the
recommendation that 2nd Avenue Northwest between Northrop Grade School and Cascade Park be closed
to traffic was read and ordered placed on file. T. 0. Moore, Planning Director,- explained that
they had merely discussed°the possibility that 2nd Avenue Northwest could be closed between 8th
and 9th Street Northwest, because there was so much traffic, and then the park playground fac-
ilities could also be used as school playground but he said no action had been taken on it, it
was just a suggestion. There was no one present wishing to be heard. President Tingley ordered
the hearing officially closed. A motion was then made by DeVries, second by Wilson, and all
,present voting in favor thereof, the City Attorney was instructed to prepare a resolution granting
the said variance.
Hearing on application of Board of Education of Special School District No. 4 to vary
front yard setback of the Zoning Ordinance to permit the enlargement of Lincoln -School. There
was no one present wishing to be heard. President Tingley declared the hearing -officially closed.
A motion was then made by DeVries, second by Leonard, and all present voting in -favor thereof,
that the City Attorney,be instructed to prepare a resolution granting the said variance.
Hearing, on application of Board of Education of Special School District No. 4 to vary

was no one present wishing to be heard. President -Tingley declared the hearing -officially
closed. Upon motion by DeVries, second by Wilson,- and,all present voting in favor thereof, the
City Attorney was instructed to prepare a resolution granting the said variance.
The Mayor's appointment of Captain Lee E. Graham of 1214 - 10th Avenue Northwest to
the position of Assistant Police Chief on the Rochester Police Department was read and upon motion
by DeVries, second,by Wilson, and all present voting in favor thereof, the appointment was
approved. -
A notice of a one -day Civil Defense Conference to be held at the Rochester State
Hospital on February 20, 1964 was read and President Tingley ordered the same placed on file.
A letter from John C. Emblom, President of Crenlo, Inc. thanking the Council for the
action taken on their zoning petition was read and President Tingley ordered the same placed on
file.
The claim of injury of M. L. McIntire for his daughter Jane E. McIntire for injuries
sustained when she feel through the bleachers at the Mayo Civic Auditorium was read. Upon motion
by Wilson, second by Leonard, and,all voting in favor thereof, the calaim was referred to the
City Attorney.
The claim of Royal Cramer for injuries sustained when he fell on the crosswalk on
South Broadway was read and upon motion by Wilson, second by DeVries, and all voting in favor

thereof, the claim was referred to the City Attorney.
A letter signed by Al Williams, Manager of Tempo Store, opposing the Sunday Closing_
Ordinance was 'read'and President'Tingley ordered the same placed on file.
The two following resolutions adopted'by the Public Utility Board were each read and ,
upon motion by Bergstedt, second by Leonard,'and all voting in favor thereof, the same were
approved:

A resolution adopted by the Board of Park Commissioners that the City Council be
authorized to pay Mr. Ray Keller, the sum of $1,101.46 for services rendered in 1963, over and
above his regular duties in the layout and development of the new Golf Course at the location
known as East Park and that Mr. Keller's salary established at $550.73 per month on a 7 month
basis be altered to 567.25 per month on a 9 month basis, was read and President Tingley ordered
the same placed on file (resolution follows).
A letter from the Board of Park Commissioners requesting permission from the City
Council to pay the following classifications of temporary help according to the schedule
outlined below, was read and President Tingley ordered the same placed on file (resolution
follows);

The recommendation of the City Planning & Zoning Commission stating that they had
reviewed the question of office space and repsectfully request the Common Council to'assign
the City Planning and Zoning Commission additional office space in accordance with their
previous requests~and to permit occupancy of these new quarters as soon as the`City Engineering
Department's drafting room facilities are vacated in Room 5 of the City Hall, was read. Upon
motion by Bergstedt, second by DeVries, and all present voting in favor thereof, the
recommendation was referred to the Finance Committee.
The recommendation of the City Planning and Zoning•Commission stating that they had
reviewed the petition to annex the elementary school site in Sunrise Estates Subdivision, and
recommend that.this property be annexed to the City of Rochester subject to the following
condition (1) that the south 9.0 ft. of the school site be gcquired for street,•purposes and
vehicular acdess be denied from the school site to 37th St. N. W., which is a planned limited
access thoroughfare on the city's adopted thoroughfare plan, -was read. Upon motion by Thomas,
second by DeVries, and all present voting in -favor thereof, this recommendation was referred
back to the Planning and Zoning Commission, they,to check with the School Board for their
comments and report back to the Council.
The recommendation of the City Planning and Zoning Commission stating that they had
reviewed the General Development Plan of Northern Heights Area (Section 24, T107N,.R14W), and
recommend that the following general features be -incorporated into the plan for approval:, was
read: 1. The 30'acre park site.
2. The drainageway should have a•minimum width of 100 ft. and follow the
general alignment of the existing draw running'to the east from U. S. 63.
3. Two cross streets should be provided connecting the two east -west roads
at intermittent points across the drainageway.

4. The'two east -west streets running from U. S. 63 to Northern Heights Drive and
Circle Parkway. The south street should have a minimum 75 to 80 ft. right-of-way.
5. The north -south street which lies east of the Water Tower should have a 75 to 80
ft. right-of-way and -run north to Circle Parkway.
6. The alignment of Proposed Francis Drive N. E.
7. The north -south street which lies east of the Proposed Park.
8. The minor residential access street shall be further detailed -and worked out
to conform to the minimum requirements of Ordinance No. 1010 and Zoning Ordinance.
Upon motion by Leonard, second by Bergstedt, and all present voting in favor thereof, the above
recommendation was approved.
The recommendation of the City Planning and Zoning Commission stating that they had reviewed
the application for an appeal from the decision of the Building Inspector wherein a;permit was
refused for converting a.single family dwelling into a two-family dwelling at 407 - 6th Street S.W.
thatthey had conducted a hearing on this matter and heard both sides of this question and found
the following facts to exist; was read:
1. Miss Elizabeth Cole had contracted with Mr. EarlBungto do certain interior
remodeling work in her home. He started to work on this project about
January 9, 1964. 1-
2. Mr. Bung made application,for a building permit on January 14, 1964. The
permit was not issued immediately, but,he continued to work.
3. ]a checking, the Building.Inspector found -that the owner, was in fact,
converting a singley family dwelling into_a two-family dwelling in the
Residential District under the Zoning Ordinance, and because the lot size
is only 4,232 sq. ft.,_which is less than the minimum 6,000 sq. ft. required
by Ordinance, a permit was refused for this work._
4. At this point, substantial work had already been completed and where upon
the owner appealed for relief under the hardship provisions of the Zoning
Ordinance.
5. There are other two-family and multi -family dwellings in the area. Because
of the extenuating circumstances involved, we recommend that the appeal be
granted and that Miss Cole be permitted a two family dwelling. At the same time
we wish to give the City Building Inspector and his staff our full support in
enforcing the Zonigg Ordinance of the City of Rochester.
We further recommend that the Common Council take a good hard look into the Zoning
Enforcement program and take.whatever steps seem appropriate to strengthen and
bolster the effectiveness of the program and to support the personnel charged with
the enforcement responsibilities.
A petition signed by 19 neighbors and/or property owners near 407 Sixth Street S. W. requesting
the Council to approve the requested remodeling was also read, andordered placed on file. A
motion was then made by Leonard, second by Bergstedt, that the recommendation of the City
Planning & Zoning Commission be received and a hearing on the matter be set for 7:30 o'clock P.M.
on March 2, 1964. All present voted in favor thereof.
The recommendation of.the Public Works Committee that the Council initiate a local
improvement project without petition for paving and sidewalk construction on.14th Street N. E.
from North Broadway to 14th Avenue N. E., was read. Upon motion by Leonard, second by DeVries,
and all present voting in favor thereof, the recommendation was approved.
The matter of contractors and builders starting remodeling and building without first
obtaining a permit was discussed; there is no provision for licensing general contractors at the
present time. Garnet Spring, Building Inspector, suggested the possibility that offenders could"
be given tickets like the Police Dppartment does and they would then have to appear before the
Judge and pay a fine. It was also suggested that more.publicity be given to this matter, either
through.a display ad or news items. A motion was made by Leonard, second by Thomas, and all
present voting in favor thereof, that this matter be placed in the hands of the Public Safety

Committee.
The recommendation of the Public Works Committee that the Council initiate a local
improvement project without petition for widening and repaving East Center Street from 2nd
Avenue S. E. to the Zumbro River was read. Upon motion by Leonard, second by DeVries, and all
present voting in favor thereof, the recommendation was approved.
The recommendation of the Public Works Committee that the City Council advertise for
bids for the season's supply of, traffic marking paint to be received on March 2, 1964 was read.
Upon motion by DeVries, second by Wilson, and all present voting in favor thereof, the
recommendation was approved.
The recommendation of the Public Works Committee that the request of the Methodist
Hopsital for. construction of a pedestrian tunnel across the alley in Block 38, Original Plat
be approved and that the City Attorney be instructed to prepare a permit -agreement for it, was
read. Upon motion by DeVries, second by.Bergstedt, and all present voting in favor thereof, the
recommendation was approved.
The recommendation of the Public Safety Committee stating that they had considered
the application for transfer of "on and off" sale 3.2 beer"license from Florence Pervin, dba
Jim & Joe's Highway Cafe located at 301 - 17th Avenue S.'W. to Donald Claassen and recommending
that the transfer be granted and approved was read. Upon motion by Wilson, second by Bergstedt,
and all present voting in favor thereof, the recommendation was approved and the transfer
granted.
The report of the Public Safety Committee stating that they had considered the
request of Washington Elementary School PTA.for a traffic actuated signal at 14th Street and
13th Avenue N. W. and that this request had been referred to Ed Bathers, Jr. Consulting
Traffic Engineer for evaluation and report and when his report is received the said committee
will make a recommendation to the Council, was read`and President Tingley ordered the same
placed on file.
The recommendation of the Public Safety Committee stating that they had considered
the request of Rochester Barracks #923, Veteran's of World War I to conduct a -parade on June 13,
1964 in connection with their annual State Convention and recommending that their request be
approved and that the Police Department be instructed to cooperate with them in their
arrangement, was read. Upon motion by Wilson, second by MVnins, and all present voting in
favor thereof, the recommendation was approved.
The recommendation of the Finance Committee that a letter be written to the Director
of the Census, Washington, D. C. 20233 requesting an estimate of cost of a special census for
U Rochester in 1965 was read. This Committee feels that with the estimated population growth of
the City in the past four years that this census will definitely affect the payments received
from the State on cigarette and liquor taxes and also the City's own tax limitations. Mr. Tom
to
Moore, City Planning Director,suggested that inquiry also be made as/the-cost of a track or
block to block basis as this information would be very valuable to them. A motion was then

made by Leonard, second by Bergstedt, and all present voting in favor thereof, that the
recommendation be approved and Mr. Burton Baker, Finance Officer, was instructed to write to
the Director of Census, Washington, D. C.
The recommendation of the Finance Committee that the Engineer's Department•be'allowed
to expend $334.00 from the P. T.. Fund for replacing the asphalt tile on two office rooms at the
new Street Department Building was read. Upon motion by Thomas, second by Begstedt, and all -
present voting in favor thereof, the recommendation was approved.
The recommendation of -the Finance Committee that the Housing & Redevelopment Authority
of Rochester be allowed to spend up to $1,000.00 fro general expenses and that periodic use of
-
the Planning Director's facilities be availabel to them was read. Upon motion by Bergstedt, second
by Thomas, and all present voting in favor thereof, -the recommendation was approved.
The recommendation of the Finance Committee that Mr. Ernie Hagen be transferred to the
new Street Department Building to work as custodian at the same compensation, was -read. Upon
motion by Bergstedt, second by DeVries,.and all present voting in favor thereof, the recommend-
ation was approved.
The recommendation of the Finance Committee that Tom 0. Moore be allowed to attend the
two-day short course at the Highway Department Building -in St. Paul, Minnesota on Monday and
Tuesday, February 10 and 11, 1964 at city expense, was read. Upon motion by Bergstedt, second by
Leonard, and all present voting in favor thereof, the recommendation was approved and he was
allowed to attend the short course at city expsnes.
The recommendation cf, the Finance Committee that Mr. Crutis L. Taylor, Recreation
Director, be granted permission to attend the annual Great Lakes District Recreation Conference
to be held -in Milwaukee on March 31 to April 3, 1964 and that the Chairman of the -Recreation
Committee -likewise be authorized to attend said conference at city expense, was read. Upon

The recommendation of the Personnel Advisory Committee that -the salaries of the various
-
Health -Department positions be set -as per attached schedule was read; they stated that they had
met with officials of theCity and County Health Boards, -Mental Health Board, Nursing Advisory
Service and representatives of the Olmsted County Board in arftving at these recommendations;
whereas budget estimates made some time ago provided for about $6,O00 of'increased wage costs in
this department, the attached recommendations will raise -department wages by about $12;000; fhey
find that keen competition for professional and technical public health people has caused the
salaries for -these occupations to continue to rise sharply; they believe that it will -be necessary
for the City•to make the recommended adjustments if we are to compete for competent people and
continue the health program at its present high level; to finance the -cost of these higher than
anticipated wage costs they suggest that the $6;200 provided for the position of Social -Worker
be used as this position was just recently abolished in the Health Department. Upon motion by

the proposed employment policy changes outlined in their letter of January, 1964, and further
suggest a consolidation of previous changes of August 5, 1963 and April 10, 1961, was read.
Upon motion by Leonard, second by Thomas, and all present voting in favor thereof, the
recommendation was approved.
The recommendation of the Finance Committee that the Council reconsider the salary
grade assingment made to the classified position of Finance Officer and recommend that the
assingnment of grade #80 with a wage range of $573-$685 per month be changed to grade #86 with
a range of $626-$748per month; however, they,also recommend that the salary originally proposed
for the incumbent for 1964 remain unchanged at $665. per month but with a step assingment of
step.0 in new grade #86 or $665 per month, with a review for merit step increase 9-16-64, was
read. Upon motion by Leonard, second by Thomas, and all,present voting in favor thereof, the
recommendation was approved.
The recommendation of the Finance Committee that the request of Alfred Nelsen to
attend the 1964 Assessor's School to be held at the Pick-Nicollet Hotel in Minneapolis
beginning March 3, 1964 and continuing through March 6, 1964 be approved and that Mr. Nelsen
be authorized to attend at city expense, was read. Upon motion by Bergstedt, second by
DeVries, and all present voting in favor thereof, the recommendation was approved.

Resolution ordering three proposed Charter Amendments filed and ordering the same to
be voted on at a-ggueral election to tie held on March 10, 1964. Upon motion by Bergstedt, second

Resolution authorizing and directing Mayor'and City Clerk to execute an agreement
between the City of Rochester and the Rochester Methodist Hospital'relative to construction of
a pddestrian traffic tunnel under the alley in Block 39, Original Plat of the City of Rochester
at a point approximately 200 feet north of the north curb of Center Street. Upon motion by
DeVries, second by Wilson, resolution adopted.
An Ordinance providing for the licensing and regulating of pool halls; establishing
a licensing procedure and license fee; providing for the revocation of licenses issued; imposing
restrictions on the use of Pool Halls by Certain Minors; and providing a penalty for violation
hereof, was given its first reading.
An Ordinance amending an ordinance entitled "An Ordinance relating to Business'
Activities on Sundays, prohibiting certain of such activities, and providing penalties for
violations", was again presented. A'motion was then made by Thomas, 'second by DeVries, that the
said ordinance be adopted as read', and all present toting in favor thereof, President Tingley
declared the said ordinance duly passed and adopted.
An Ordinance annexing to ihe'City of Rochester, Minnesota,'certain unplatted land not
exceeding two hundred acres in area and certain platted land in Highland Addition, all being in
the Southwest One -Quarter of Section Twenty -Five, Township One' H6ndr6d Seven North, Range Fourteen
West, Olmsted County, Minnesota (Dr. Green Property), was given its first reading.
An Ordinance amending the Zoning Ordinance (No. 559) (changing Lots 8 through 14,
inclusive of'Rubow's Sunrise Addition to industrial district) was given its first reading.
The City Clerk was instructed to notify the owners of'the eight pieces of property,
which are presently surrounded'by the city limits,(and proposed to be annexed to the City by the
Planning and Zoning Commission) that they could be heard in favor of 'or against such annexation
at a meeting of the Common Council to be held on IIarcti 2, 1964 at 7:30 P. M, upon motion by
Bergstedt, second by DeVries, and all voting in favor thereof.

Upon motion by Wilson, second by Thomas, and all present voting in favor thereof,
the resolution amending a resolution levying assessments for construction of a sidewalk on
18th Avenue Northwest from 22nd Street Northwest to Cascade Street (Roger Anderson) was
tabled.
The meeting was adjourned until 7:30 o'clock P. M. on February 24, 1964._.
