Minutes of an adjourned regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City, on March 16,
1964.
President Tingley called the meeting to order at 7:30 o'clock P. M., the following
members being present: President Tingley, Aldermen Bergstedt, DeVries, Leonard, McCaleb, Wilson
Absent: Alderman Thomas.
Upon motion by Wilson, second by Bergstedt, and all -present voting in favor thereof,
the minutes of the meeting of March 2, 1964 were approved.
President Tingley stated this as being the time and place set for receiving and
opening.bids for furnishing the season's supply of crushed rock, sand and gravel, road oil and
cutback asphalt, and plant mixed bituminous for use in the City Engineer's.Department. The bids
of the following were received and opened, and upon motion by DeVries, second by Wilson, and
all present voting in favor thereof, the same were referred to the Public Works Committee and
the City Engineer for tabulation and recommendation:

following:
President Tingley stated this as being the time and place set for hearings on the
Hearing on petition for vacating of a portion of 14th Avenue S. E. and 9th Street
S. E. in South Home Second Addition: There was no one present wishing to be heard. President
Tingley declared the hearing officially closed. The recommendation of the Planning & Zoning
Commission that this vacation be approved, was again read and upon motion by Wilson,.second by
DeVries, and all present voting in favor thereof, the recommendation was approved and the City
Attorney was instructed to prepare a,resolution vacating the said property.
Hearing on request for variance from the zoning ordinance to permit construction of
an addition to Holmes School. There was no one present wishing to be heard. President Tingley
declared the hearing officially closed.. The recommendation of the Planning & Zoning Commission
that this vacation be approved was again read and upon motion by Bergstedt, .second by McCaleb,
and all present voting in favor thereof, the recommendation was approved and the City Attorney
was instructed to prepare a resolution granting the said variance.
Hearing on petition for amended variance from provisions of the zoning ordinance
applicable to Lots 1 and 2, Block 1, Silver Acres Subdivision. Mr. M. Berens, Attorney for the
petitioner was present and urged that the variance be granted and also said he would answer
a
any questions the Council might have. There was no one elese present wishing to be heard.
President Tingley declared the hearing officially closed. The recommendation of the Planning
and Zoning Commission that the variance be granted was again read and upon motion by Leonard,
second by Wilson, and all present voting in favor thereof, the recommendation was approved and
the City Attorney was instructed to prepare a resolution granting the said variance.
Hearing on approval of the plat to be known as Maple Manor Resubdivision of outlot
2, Block 5.,-Northgate.3fid Addition. There was no one present.wishing to be heard. President
Tingley declared the hearing officially closed. The recommendation of the Planning and Zoning
Commission that the plat be approved was again read and upon motion by DeVries, second by
Bergstedt, and all present voting in favor thereof, the recommendation was approved and the
City Attorney was instructed to prepare a resolution approving the said plat.
Hearing on approval -of the plat to be known as Meadow Park 3rd Subdivision. There
was no one present wishing to be heard. President Tingley declared the hearing officially
closed. The recommendation of the Planning and, Zoning Commission that the plat be -approved was
present -
again read and upon motion by McCaleb, second by Bergstedt, and all/voting in favor thereo,f,,
the recommendation was approved and the City Attorney was instructed to prepare a resolution
approving the said plat.
Hearing on'approval_of the_ plat to -be known as Silver Acres Subdivision. Mr. M.
Berens, Attorney for the petition, was present and urged that the plat be,granted approval.. The
recommendation of the planning and Zoning Commission that the plat be approved was again read
and'upon motion by Bergstedt, second by Wilson, and all present voting in favor thereof, the
recommendation was approved and the City Attorney was instructed to prepare a resolution approv-

the said plat.
The Mayor's appointment of James Ryan of 1509 Ninth Street Northeast to the position
of Juvenile Officer on the Rochester Police Department, to fill the vacancy created by the
appointment of Dean Lent to the position of YPOlice Captain, was read. Upon motion by Wilson,
second by Bergstedt, and all present voting in favor thereof, the appointment was approved.
The Mayor's appointment of Mrs. Mildred Mulholland of 819k North Broadway to serve
as School Crossing Guard at the 9th Street and North Broadway location for the remainder of the
1963-64 school year, this appointment to fill the vacancy created by the voluntary termination of

Mrs. Laurita Kinsley, was read. Upon motion by Wilson, second by DeVries, and all present voting
in favor thereof, the appointment was approved.
A letter from the Board of Public Health and Welfare requesting approval`of the
employment of Mr. Win. C. Bartels, Route 4, Rochester, Minnesota, as Assistant Milk Sanitarian,
beginning March 9, 1964; Mr. Bartels has been assigned to Pay Grade 58, Step A or $414.00 per
month and the employment is made to replace Mr. Ward McIntire who resigned February 4, 1964,
was read (Mr. Bartels is aware of the fact that he must establish his residence in the City of
Rochester within six months). Upon motion by McCaleb, second by Leonard, and all present voting
in favor thereof, the appointment of Mr. Bartels was approved.
A letter from the Board of Public Health and Welfare requesting approval of the
employment of Miss Marjorie Jones, of 953 - 5th Avenue S. E., as Vital Records Clerk in the health
department, beginning April 1, 1964, was read. Upon motion by DeVries, second by McCaleb, and
all present voting in favor thereof, the employment`was approved. (Miss Jones is`presently
employed by the County of Olmsted as a Records Clerk but has been working in the Public Health
Center in the combined program since November, 1957 and due to the retirement of Mrs. Alice Tully
the present vital records clerk, -Miss Jones has requested transfer to this.Cityposition which
in is Pay Grade 28.)
A letter from Alfred Nelson, City Assessor, requesting permission+to employ six
part time deputies for the purpose of determining homesteads and assess personal property in
•
rental units, this would be for the month of April and extending into the greater part of May or
until such time as their work is completed, was read. Upon motion by DeVries, second by Bergstedt,
and all present voting in favor thereof, permission was granted to employe the six deputies.
A letter signed by Clarence Tomshine, Tom Jones and Robert Cross, stating that they
as members of the Mayor's committee have been asked to evaluate the three bids received for the
subject sound installation; accordingly,they met with the chairman of the Music Committee, reviewed
the specifications and bids and consulted the City Attorney; the bids of Dowling Sound Company in
the amount of $4,660.00 and the bid of Hall Electric in the amount of $5,010.00 do not meet the
specifications, but the bid of Electronic Design Company in the amount of $5,650.00 meets the
specifications in all'respects and it is recommended that this bid be"accepted,'was read. Also a
letter signed by Ewald E: Koepsell, Chairman of the Rochester Music Board,`stating they concur-

in the recommendation of the committee which has evaluated the bids as pettains to the sound
equipment installation for the Mayo Park Band Stand and recommend that the bid be accepted, was
read. Upon motion by Leonard, second by DeVries, and all present voting'in favor thereof, the
two letters were referred to the Finance Committee.
A copy of a letter from Robert D. Owens, District Traffic Engineer, stating that
they expect to install a permanent traffic actuated signal at the intersection of T.H. 63
(Broadway) and 14th Street N. E., that the estimated cost of the installation is #13,000.00
instead of $7,000 as stated in the agreement, was read. Upon motion by DeVries, second by
McCaleb, and all present voting in favor thereof, the letter was referred to the Public Safety
Committee.
A letter signed by Paul F. Wilson, M.D., Psychiatrist, requesting that the Council
approve the agreement relative to the County Mental Health Service, was read,. Upon motion by
Bergstedt,, second by Wilson, and all present voting in favor thereof,�the letter was referred
to the Finance Committee.
A letter from the Board of Public Health and Welfare recommending that,the Common
Council approve the following new rates for refuse collection in the -City of Rochester, was read:
For twice'a week collection
One can per collection - $2.00
Every extra can per collection .25
The rate of $2.00 per month is the maximum allowed for private hauldrs according to ordinance
1169, however, the ordinance allows a maximum of 50•cents for every extra can, but since the City
service does not have more than 20 customers using more than one can, a change in this rate is not
contemplated. Upon motion by Leonard, second by McCaleb, and all present voting in favor thereof,
the recommendation was approved and the City Attorney was instructed to prepare the necessary
resolution. Mr. Jerry Reiihert, a member of the Board, was present and stated they felt this
increase would help to make this more self supporting and would like to start it as of May 1,1964.
A notice from the Railroad & Warehouse Commisiion in the matter of the petition of
the Chicago and North Western Raf_lway Company for authority to revise, adjust and rearrange
agency service at certain central and associate stations in6Minnesota, was read and upon motion
by Bergstedt, second by McCaleb, and all present voting in favor thereof, the notice was
referred to the City Attorney.
The summons of Melvin J. Jones vs. the City of Rochester, Minnesota in the amount
of $7,500.00 was read and upon motion by,DeVries, second by Leonard, and all present voting in
favor thereof, the same was referred to the City Attorney.= _
A summons of Adeline Grothe vs. City of Rochester etal. re title of the plaintiff
in real estate located in Lot 65 of Sec. 36-107-14 was read and upon motion by DeVries, second by
Leonard, and all -present voting in favor thereof, the same was referred to the City Attorney.
A petition with 10 signatures requesting that traffic control devices, operational
during school hours, be installed on Elton Hills Road adjacent to the school to increase the
safety of school children, was read and upon motion by Leonard, second by Bergstedt, and all

present voting in favor thereof, the petition was referred to the Public Safety Committee.
The three following resolutions adopted by the Public Utility Board were each read
and upon motion by Wilson, second by McCaleb, and all present voting in favor thereof, the same
were approved:
"Be it resolved by the Public Utility Board, on the recommendation
'of the City Attorney, that the Mayor and City Clerk are hereby authorized
and directed to execute on behalf of the City of Rochester the release and
indemnity agreement dated February 14, 1964 between the City, General
Electric Company and Federal Insurance Company relative to the contract
for Unit Sub -Station, a copy ofwhich agreement, marked Exhibit "A" is
attached hereto and made a part hereof.
Be it further resolved that the Common Council direct the Mayor
and City Clerk to execute the agreement."
"Be it resolved by the Public Utility Board of the City of Rochester
that the Common Council of the said City authorize the said Board to enter
into contract with Clements Chevrolet Company for furnishing in accordance
with specifications on file

the amount of the contract to be FOUR THOUSAND NINE HUNDRED SEVENTY DOLLARS
AND SIXTY CENTS ($4,972.66) less a trade in allowance of SIX HUNDRED SEVENTY

ance of SEVEN HUNDRED -SEVENTY FIVE DOLLARS ($775.00) on one four -door sedan
or a net contract price of THREE -THOUSAND FIVE HUNDRED TWENTY TWO DOLLARS
AND SIXTY SIX CENTS ($3,522.66) and Clements Chevrolet Company beingthe
lowest responsible bidder.
Be it further resolved that the Council direct the Mayor and City
Clerk to execute the contract documents."

Be it further resolved that the Cbmncil direct the Mayor and City
Clerk to execute the contract documents."
The following petitions were each presented and upon motion by DeVries, second
by Wilson, and all present voting in favor thereof, the same were referred to the Planning and
Zoning Commission:
a. Letter from Charles H. Dornack requesting that his name be removed from
the petition regarding sidewalk removal in Graham Addition.
b. Application for plat approval of the final plat'of`"Replat of South Home
2nd Addition".
A letter from the Department of Taxation notifying of a meeting for assessors and
local board members to be held at, the county court house at 10:00 a. m. on March 20, 1964 was
read and President Tingley ordered the same placed on file.
A letter from the Board of Park Commissioners stating that the sum of $30,000.00
was approved in the Permanent Improvement Fund for the new storage area addition at Mayo Civic
Auditorium, this work will be completed'in the next two weeks and they expecto have a balance
in this account; when they budgeted for this work they actually had in mind that should funds be
available after completing the storage addition, they would like to use the balance for North
Hall Lobby Improvements and improved lighting in North Hall Proper and requested that the
balance of $5500.00 be used for these North Hall Projects, was read. Upon motion by Wilson,
second by Bergstedt, and all present voting in favor thereof, the request was referred to the

Finance Committee.

A letter signed by R. Litschen of 120 - 12th St. South in Minneapolis complaining
.about services at the Mayo Clinic was read and the same was referred.to Gregg Orwald, Attorney at
the Mayo Clinic.
Notice of the Conference for Mayors and Councilmen to be held at the Continuation
Center at the University of Minnesota on March 23 and 24, 1964 was again presented. A motion
was made by Leonard, second by Wilson, that the Aldermen elect be authorized to attend if they
so desired as well as present Aldermen. All Present voted in favor thereof.
A letter signed by Garnet Spring, Building Inspector, recommending appointment of
Donald J. Rockenbach of 1411 Third Street N. E. to the position of custodian in theCity Hall

at 90% of the established rate of $4,495 per year effective March 23, 1964, was read. Upon
motion by Leonard, second by Wilson, and all present voting in favor thereof, the appointment
was approved.
_ The recommendation of the City Planning and Zoning Commission stating that at a
regular meeting held March 11, 1964 they had reviewed the request of President A. B. Hagedorn
to attend the American Society of Planning Officials Conference April 4-9, 1964 in Boston,
Mass. at city expense and recommend that he be authorized to attend, was read. upon motion by
Leonard, second by McCaleb, and all present voting in favor thereof, the recommendation was
approved and Dr. Hagedorn was authorized to attend the said conference at city expense.
The recommendation of the City Planning and Zoning Commission stating that they
had reviewed the preliminary plat of Northern Heights 5th Aubdivision and find that this plat
conforms with the minimum requirements of Ordinance No. 1010 and therefore recommend that it
be granted preliminary approval, was read. Upon motion by DeVries, second by Leonard, and all
present voting in favor thereof, the recommendation was approved.

(a) Recommendation of City Planning and Zoning Commission stating that they had
reviewed their recommendation made on January 13, 1964 and also heard.comments from
the owners of the lands surrounded by the City of Rochester, South of 2nd Street S.W.
and north of 3rd St. S.W. and west of Fire Station #3 and east of Vern Clark property,
and on this basis of re-evaluation recommend that the Common Council procedd with the
annexation of thise properties after Mayo 1, 1964.

(b) Recommendation of City Planning and Zoning Commission stating that they
reviwed_their recommendation regarding initiation of annexation proceedings on lands
surrounded by the City of Rochester (Brookside Cabins) and also heard statements from
the owner and on the basis of this re-evaluation of the annexation question, they
recommend that the Common Council delay any further action to annex the Brookside
Cabins for six (6) months.
(c) Recommendation of City Planning and Zoning Commission stating that they had
reviewed their recommendation regarding initaition of annexation proceedings on lands
surrounded by the city of Rochester (Part of S.E.'k, Section 25, T107N, R14W-Whiting,
Gambill and Theye Properties N. E.) AND ALSo heard comments from the owners, the
owners are willing to work out an overall development plan for the area, and because
of this, they recommend that the Common Council delay for six (6) months any further
action on the proceedings to annex these properties to the City.
(d) Recommendation of City Planning and Zoning Commission stating that they had
reviwed their recommendation regarding initiation of annexation proceedings on lands
surrounded by the City of Rochester (Cassidy Property and others in the 1900 block on
19th Street N. W.)'and also heard comments from several of the owners, on the basis
of their re-evaluation, they recommend that the Common Council delay for six (6)
months any further action to annex these properties.

(e) Recommendation of City Planning and Zoning Commission stating that they.had
reviewed.their recommendation regarding initiation of annexation proceedings on lands
surrounded by the City of Rochester (Miller Property on 18th Avenue N. W.) and also
heard comments from the -owner; on the basis of this re-evaluation and the -need for
additional street right-of-way from this property, they recommend that the Common
Council delay any further action on the annexation matter for three (3) months and
that the City of Rochester negotiate with Mr. Miller for the acquisition of the -lands
ndeded for major street purposes in accord with their recommendation of 1-13-64.
(f) Recommendation of City Planning and Zoning Commission stating that they had
reviewed -their recommendation regarding initiation of annexation proceedings on lands
surrounded by the City of Rochester (Lots 1 and 2, Sunrise View Addition) and also
heard comments from the owners; on the basis of this re-evaluation, they -recommend
that the Common Council proceed with the annexation of these properties after May 1,
1964 subject to the conditions of their recommendation of January--13, 1964.
• (g) Recommendation of City Planning and Zoning Commission stating that they had
reviewed their recommendation regarding initiation proceedings on lands surrounded
by the City of Rochester (Elam Baptist Church) and also heard comments from the
owners; on the basis of this re-evaluation, they recommend that the Common Council
annex the Elim Baptist Church property after May 1, 1964 subject to the conditions
of their recommendation of January 13, 1964.
Alderman McCaleb stated that he thought all of these recommendations should be tabled for six
months as long as some of them were being recommended and then they be taken at the same time,
this would allow the Planning and Zoning Commission to further study them; Alderman Leonard
stated that he thought each piece of property had different problems and should be taken
separately. A motion was then made by McCaleb, second by Wilson, that these recommendations
be tabled for six (6) months and then be brought up again for consideration; all voted in
favor thereof, except Alderman Leonard who voted "no".
The recommendation of the City Planning and Zoning Commission stating that they
had reviewed the work program of the proposed Rochester -Olmsted Transportation Planning Study
and recommend that the CommonCouncil approve this study and authorize the Mayor andCityClerk
to execute the resolution to make application, through the Minnesota Department of Business
Development, for an urban planning assistance grant from the Federal Housing and Home Finance
Agency, as authorized under Section 701 of the Housing Act of 1954, to finance the land use
and planning phase of this study, was read. Upon motion by DeVries, second by Wilson, and
all present voting in favor thereof, the recommendation was approved.
The recommendation-of.the Finance Committee that it go on record recommending to the
• future Finance Committee and Council that plans and costs be carried on and stuied in
connection with remodeling of the City Hall; this Finance Committee has engated the services
of an architectural firm and has plans for the remodeling of City Hall; the committee has these
improvements listed out in suggested steps to be taken over three years, with drawings and
cost estimates, said list of steps shown on attached list; they further urged that the next
committee to follow through with this program and at that time to use these plans to their
advantage; they feel that much time has been spent in these drawings and at this time are the
best tht they could foresee, was read. Upon motion by Leonard, second by Bergstedt, the
recommendation was approved. All present voted in favor thereof.
Thethecommendation of the Finance Committee that the Finance Officer be authorized to
purchase a Friden Calculator for the sum of $755.00 out of General Fund monies was read and
upon motion by Bergstedt, second by *-Jilson, and all voting in favor thereof, the recommendation

was approved.
The'recpmmendation of the Finance Committee that Alfred Nelson, City Assessor, be
authorized to attend the Assessors Meeting to be held in St. -Peter, Minnesota on March 10, 1964
was read and upon motion by Wilson, second,by Bergstedt, and all voting in favor thereof except
President Tingley wbo voted "no", the recommendation was approved.
The recommendation of the Finance Committee that the Fire Chief and two Captains be
authorized to attend the 13th Annual Minnesota State Fire School to be held at the University of
Minnesota on.April 27-30, 1964 was read and upon motion by Wilson, second by Bergstedt, and all
present voting in favor thereof, the recommendation was approved and they were authorized to

attend at city expense.
The recommendation of the Finance Committee that the Park Department proceed immediately
for construction of a sanitary building -on Soldiers Field Golf Course as discussed last fall,
funds for the erection of this building should come out of the Permanent Improvement Fund
through unspent budgeted monies of the Park Department, was read and upon motion by Bergstedt,
second by Leonard, and all present voting in favor thereof, the recommendation was approved.
The recommendation of the Finance Committee that John Bakke, Personnel Director be
authorized to attend the one -day management seminar sponsored by the Rochester Personnel
Association to be held April 3rd at the Kahler Hotel and that the $25.00, cost for this eeminar
be paid by the City was read._ Upon motion by Wilson, second by McCaleb, and all present voting
in favor thereof, the recommendation was approved.
The recommendation of the Finance Committee that Mr. Garnet Spring and the Personnel
Director be authorized to secure candidates to fill the position of Assistant to the Electrical

to be subject to Council appointment at that time; this new position was approved in the 1964-5
budget but through a misunderstanding was insufficiently budgeted for in the amount of $1,741.;
they suggest that approval be granted the Inspection Department for use of non -allocated general
fund monies to make up the deficit, was read. Upon motion by Bergstedt, second by McCaleb, and
all -present voting in favor thereof,. the ,recommendation was approved.

The recommendation.of the, Public Safety Committee that the request of. Fred W. Schuster
Agent for Mayo Association for a passenger loading zone &n the west side of 1st Avenue Southwest
in the first parking space south of 2nd Street Southwest, this parking space is presently metered
for 12 minute parking and recommend that this meter be moved two spaces to the south,. was read.
Upon motion by Wilson, second by tannard,. and all present voting in -favor thereof, the
recommendation was approved and the City Attorney was instructed to prepare the neee_ssary
resolution. -
The recommendation of the Public.Safety Committee stating that at the present time,

parking is prohibited on the !east side of 16th Avenue between 1st Street.Southwest and 2nd Street
Northwest between the hours of 8:00 a.m. to 6:00 p.m. on Mondays through Saturdays and the.
Committee recommends that this prohibition be removed and that parking be permitted at all times
on the east side of 16th Avenue between 1st Street Southwest and 2nd Street Northwest, was read.,

The recommendation of the Public Safety Committee stating that they had considered the
request of David Alme, President of the Student Council, Rochester Junior College, for a painted
crosswalk and appropriate pavement markings on signs on 2nd Street Southwest in front of the
college and have instructed the City Engineer to paint a crosswalk across 2nd Street Southwest
at 5th Avenue and to install the neeessary signs to advise the motorist of this pedestrian
crossing, was read. Upon motion by Wilson, second by DeVries, and all present voting in favor
thereof, the recommendation was approved.
The recommendation of the Public Safety Committee stating that they had considered the
application of James Gerald Vesey to transfer the on and off sale non -intoxicating malt beverage
licenses now issued to William Shea dba Shea's Bar and Cafe at 607' North Broadway to James Gera R
Vesey and recommend that the application be approved was read. Upon motion by Wilson,' second by
McCaleb, and all present voting in favor thereof, the recommendation was approved and the
transfer was granted.
The recommendation of the Public Works Committee that bids be advertised to be received
on April 6th for construction of a driveway entrance to Mayo Civic Auditorium from East Center
Street was read. Upon motion by DeVries, second by McCaleb, and all present voting in favor
thereof, the recommendation was approved.
The recommendation of the Public Works Committee that the bid of Rochester Sand &
Gravel Inc. for the season's supply of sand and gravel be accepted at the unit prices bid and
checks be returned to the unsuccessful bidders was read. Upon motion by. DeVries, second by ,

The report of -the City-Weighmaster for the month of February, 1964 showing fees
collected for loads weighed in the amount of•$121.25 was read and President Tingley ordered the
same placed -on file. -
The reports for the month of February, 1964 of -the Building Inspector showing fees
collected for building permits issued $764.00; of the Electrical Inspector showing fees collected
for electrical permits issued $442.00; of -the Plumbing Inspector showing fees collected for
plumbing permits issued $215.25; of the Heating Inspector showing fees -collected for heating
permits issued $368.25; and fees collected for sign permits $161.43 were each presented and
President Tingley ordered the -same placed on file. - a
The reports of -the Clerk of Municipal Court for -the week ending March 6; 1964 showing
total criminal fines and costs collected and civil fees received $2,976.50 and total remitted

Resolution approving and accepting the "Termination Agreement" made as of the
first day of September 1963 and.filed with the City of Rochester pursuant to the Easement
Agreement dated as of October 31, 1962 between Rochester Methodist Hospital, Mayo Association
and the American Oil Company on the one part and the City of Rochester on.the other part;
and that the easement for public street purposes over and across the tracts of land described
in the aforesaid easement agreement of October 31, 1962 is hereby terminated effective as of
September 16, 1963. 'Upon motion by DeVries, second by McCaleb, resolution adopted.
Resolution reque4ting that the Department of Business Development, State of
Minnesota make application for,an,urban planning assistance grant,from the Federal Housing
and Home Finance Agency as authorized under Section 701 of the Housing Act of 1954, as amended,
'for the purpose of providing planning assistance to the,community, in the amount of $90,000.00;
.the governing body of the community hereby agrees to contribute $ one in cash and $30,000.00
in the services of employees of the community to the Department of Business -Development, when
it is required, for the planning purposes as hereinafter set forth; the Mayor is'hereby
authorized and directed on behalf of the community to enter into an agreement with the
Department of Business Development, State,of Minnesota, in furtherance of its request for
federal matching funds for planning purposes; the money so contributed and the services so
pledged shall be available for expenditure and use by the,Department of Business Development,
State of Minnesota, when they have secured a matching federal grant; the money so deposited
shall bear,no interest -and shall be returned to the community if federal matching funds are

An Ordinance annexing to the City of Rochester, Minnesota, certain unplatted
land not exceeding two hundred acres in area and all being in the Southwest Quarter of Section
Twenty -Four, Township One Hundred and Seven North, Range Fourteen West, Olmsted County, -
Minnesota (north, 1000 ft., of south 50 acres of east half, of the Southwest Quarter -Northern
Heights), was given its first reading.

Twenty -Two, Township One Hundred Seven North, Range Fourteen West, Olmsted County, Minnesota
(Crescent Park 6th Addition) was given its first reading. Upon motion by DeVries, second by.
Wilson, and upon roll call and all present voting in favor thereof, the rules were suspended
and the ordinance was given its second reading. Upon motion by DeVries, second by Wilson,
and upon -roll -call and all present voting in favor -thereof, the rules were suspended and the
ordinance was given its third and final reading. A motion was then made by DeVries, second by
Wilson, that the said ordinance be adopted as read and all present voting in favor thereof,
President Tingley declared the said ordinance duly passed and adopted.
Upon motion by Bergstedt, second by Wilson, and all present voting in favor
thereof, the amount of $199.00 was appropriated from the General Fund and ordered paid to the
Mayor's Contingent Fund.

R. V. Ehrick, City Attorney, stated that last year in May a group of citizens appeared
at a Council meeting and advised the Council of some of the difficulties they were having with
the heating systems in their homes and how in some instances due to improper venting, etc..some
of them had sustained a chronic monoxide poisoning which adversely affected their health and
the.prob&em was referred to the Public Works Committee; in the last couple of months there have
been several meetings, two of them held in the Public Health Center -at which the same persons
appeared and also representatives of Peoples Natural Gas Company and representatives of the
City and State Health Department, the City Attorney and Heating Inspector and all persons

interested in the probeem; and then again a week ago they had another meeting and this problem
was analyzed and at this meeting evidence was brought forward on quite a few tests that had been
made by the Health Department .and the Heating Inspector and a program was decided on, Mr.
Burrows is here to speak briefly on this topic. Mr. Ehrick said this group has now some
recommendations to -make to the Common Council and he assumed they should .be made to the Public
Works Committee as to amendments to the Heating Code (1) to require all new construction that
-combustion air be introduced in the vicinity of,the furnace (2) that a special requirement be
made in the matter of a separate flue for incinerators„and (3) the requirement for the
introducing of outside air in the home whenever this home is equipped with exhaust fans or
other appliances that have the effect of depleting the air from outside. A definite recommend-
ation to the Common Council should be made; certain publicity in the form of a notice, to be
paid for by the City, apprising the people of the Code and necessity.far petmits to_be obtained
and apprise the people that this code is for their benefit and protection and they should meet
the code and insist that new contractors and installors obtain permits and have the inspection
that the City provides and also to notify the public of the importance of the maintea.nce of
their systems in the form of periodic inspections and clean -nuts and whatever small repairs are
necessary. Under modern construction standards and also due to the fact that many people are
completing more their basement recreation rooms, which would have the effect of sealing off the
finished area and cutting off the -air that would be provided in an open space. Also the fact
that homes are constructed so well from an insulation standpoint that they don't breathe like

the older homes used to and when exhaust fans -are. sinstalled in quantities there is quite a
possibility that this appliance will have the effect of creating a negative condition in the
home as far as the air is concerned and must be replaced. He recommended that this Committee
meet with the Public Works Committee and then make definite recommendations to the Common Council.
Mr. William Burrows, Heating Inspector, said he had received many complaints and made many
inspections and recommended that this problem be considered as soon as possible.. Alderman
DeVries, Chairman of the Public Works Committee, stated that the Public Works Committee would
have their next meeting at 7:30 o'clock P. M. on March 26, 1964.
Upon motion by McCaleb, second by Leonard, all in favor
and present voting thereof, the
