President DeVries called the meeting to order at 7:30 o'clock P. M., the following members being present: President DeVries, Aldermen Day, Eichten, McCaleb, Perry and Wilson. Absent: Alderman Hanlon. A letter signed by Dexter Roeder of 1643 Second Ave. N. E. regarding a traffic problem at the intersection of 2nd Avenue and 16th Street Northeast, was read and upon motion by Wilson, second by McCaleb, and all voting in favor thereof, the letter was referred to the Public Safety Committee. A letter from the Office of Civil Defense regarding the Radiological Monitor Training Course to be held May 15 and 22, 1965 was read. Upon motion by Wilson, second by Eichten, and all voting in favor thereof, the same was ordered placgd on file and theCity Clerk was instructed.to send copies of all departments. The claim of.injury of Kathryn J. Nehring was read and upon motion by Wilson, second by Eichten, and all voting in favor thereof, the same was referred to the City Attorney. The petition of Leonard R. and Chrarlotte R. Davis to apportion special assess- ments in Peck's 6th Addition was read and upon motion by Wilson, second by Eichten, and all voting in favor thereof, the petition was referred to the Public Works Committee and City Attorn11 ey. 0 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., April 12, 1965 A letter signed by Harold DeVries, President of the Council, recommending that Frank Renning be reappointed as a member of the Firemen's Civil Service Commission for a three year term, his tderm of office to expire April, 1968, was read. Upon motion by Wilson, second by Eichten, and all voting in favor thereof, the appointment was approved. A letter signed by 0. N. Mertz, Chief of the Fire Department, requesting that some changes be made in the Fire Department Budget for the year 1965-66, the total budget will be exactly as approved, the only change is that different categories within the budget have been changed, was read. Upon motion by Wilson, second by McCaleb, and all voting in favor.thereof, the request was referred to the Finance Committee. A letter signed by 0. N. Mertz, Chief of the Fire Department, requesting permission to hire a full time Secretary for the Fire Department, was read and upon motion by Wilson, second by McCaleb, and all voting in favor thereof, the letter was referred to the Personnel Advisory Committee. A letter signed by Malcolm K. Campbell, M. D. President of the Board of Public Health & Welfare, stating that the United States Public Health Service is conducting an 8 weeks course on Environmental Sanitation for public health personnel employed by state and local governments in cooperation with the Department of Civil Engineering of the University of St..Louis between June 14 and August 16; this board of health has studied the possibilities that Mr. Robert D. Rossi, Milk Sanitarian of the health department, could participate in this course, the United States Public Health Service will pay tuition and a stipend of $9.00 per day that will cover the living cost at the university campus; this it to request favorable consideration.from'the Common Council in accepting that Mr. Rossi attend this course during the 2-month period with continuation of salary, we will be very pleased if the committee to which this matter would be referred will meet with the members of the board to discuss this matter further, was read. Upon motion by Wilson, second by McCaleb, and all voting in favor thereof, the letter was referred to the Finance Committee. The recommendation of the Finance Committee that Captain Lehnherr, Captain Clark, and Firefighter Emery Walters be authorized to attend the Northwest Fire School to be held on the St. Paul Campus of the University of Minnesota on April 26-29, 1965 and also that Chief 0. N. Mertz be authorized to attend the Monday afternoon and Tuesday session, was read and upon motion by Day, second by McCaleb, and all voting in favor thereof, the recommendation was approved. The recommendation of the Finance Committee that the automobile insurance be purchased from Walter C. Heins Agency, the amount of the contract for one year is $4,183.19 to be paid in such amounts: 5-1-65 $573.52; 6-6-65 $753.99 and 9-1-65 $3,055.68; the Finance Committee recommends the acceptance of the alternate #3 in which the limits are Personal Injury 100/300; Property Damage 100; and Comprehensive Coverage on all vehicles, was read and upon motion by Perry, second by Eichten, and all voting in favor thereof, the recommendation was approved. The recommendation of the Finance Committee that the Board of Park Commissioners be authorized to negotiate for obtaining 13 plus acres from the Graham Estate, to be used in i Record of Official Proceedings of the ' Common Council 6 S 7 • of the City of Rochester, Minn., April 12, 1965 1 1 1 • 1 connection with Eastwood Park, was read and upon motion by Day, second by McCaleb, and all voting in favor thereof, the recommendation was approved. The following communication from the Board -of Park Commissioners was read: "WHEREAS, the City of Rochester has 1. 5,000 feet of lake shore that needs improving and protecting by the placement of rock walls. 2. 4 miles of river bank that needs rip -rapping in certain spots and locations. 3. 4 to 5 miles of stream bed that needs cleaning up. 4. 240 acres of wooded area that needs improving by the removal of dead and undesirable trees and the laying out and development of nature tails therein. AND WHEREAS: The City of Rochester, through its park Department, could 1. Supply plans, specifications and supervision. 2. Supply tools, motor equipment and transportation as needed. 3. Supply bookkeeping, accounting and making up of payrolls as needed. NOW THEREFORE, The City of Rochester proposes that the Economic Opportunity Program supply the Rochester Park Department with a Neighborhood Youth Corp to do the above work. A break down of the time and cost involved is as follows: 1. 5,000 feet of lark shore work. 30 men working 32 hrs. per week, for a period of 20 weeks, 19,200 hours at $1.25 per hr. 24,000.00 1,500 cu. yds. of rubble rock @ 2.50 3,750.00 Hauling 300 loads of rubble rock @ 16.00 per load 4,800.00 Tools, mauls, crow bars, rubber toots, misc. 400.00 Two supervisors - 20 weeks @ 32 hrs. @ 2.40 each 3,072.00 $36,022.00 36,022.00 2. 4 miles of river bank that needs rip -rapping and protecting in spots and certain locations. 310 men workin 32 hrs. per week for a period of 10 weeksl2,000.00 9,600 hours @ 1.25 per ;man hour 172259799 500 cu. yds. rubble rock @ 2.50 1,250.00 Hauling - 100loads rubble rock @ 16.00 1,600.00 Two Supervisors - 10 wks, 32 hrs per week @ 2.40 per hr. each 1,536.00 16,386.00 16,386.00 3. 4-5 miles of stream bed that needs cleaning up to eliminate eyesores and promote beauty. 30 men working 32 hrs per week for a period of 5 weeks @ 1.25 per hour 6,000.00 Hauling and other equipment use; 1 piece 5 wks, 32 hrs. @ 4.00 640.00 Two Supervisors: 5 wks = 320 hrs. @ 2.40 768.00 7,408.00 7,408.00 4. 240 acres of wooded area tha needs eleaning out and the developing of nature trails: 15 men working 32 hrs per wk at $1.25 for 10 weeks 6,012.50 Supervisor 20 weeks, 32 hrs. per week - 320 hours @ 2.40 768.00 Material for path surfaces. L00 cu.yd. @ 2.95 29.500 320 hours @1.00 for Transportation vehicle, (32 hrs. per week for 10 weeks) 320.00 Total 7,395.50 7,395.50 $67,211.50 The above described work would do much for the preservation and enhacement of the beauty of the city as well as providing greatly to addition of the pleasure the public would get'in their use of the parks. Consequently, the Mayor, the Common Council and the Board of Park Commissioners move the adoption of a resolution making the request." Aldlerman Day stated that they had met with the Park Board on this, that 907. of the cost would be paid by the Federal Government and the Union had been contacted and were not opposed to it. A motion was then made by Eichten, second by Day, that the Council proceed with what is necessary to initiate this program to get it started; all voting in favor thereof, President DeVries declared the motion carried. The applications of Paul J. Kronebusch for a commercial garbage collectors license; H. Watson and Stanley Watson for Commercial Rubbish Collectors license; and Herbert Bornfleth(2),I George Fenske (2), Leonard Fenske (3), Harold Johnson (2), Orville Kirkham (2), Lester Lawrence (2), Fred Vagt (1), Harold Watson (3), Rodney Watson (1), Stanley Watson (2) and W. H. Record of Official Proceedings of the Common Council of the City of Rochester, Minn., April 12, 1965 Watson, Jr. (1) for General Refuse Collectors license were each read. These applications had been approved by the Board of Public Health & Welfare. Upon motion by Wilson, second by Eichten, and all voting in favor thereof, the licenses were granted. The applications of Hunt Drug Store, Crestview Motel and Golden Hill Market & Cafe for a license to sell cigarettes were each read and upon motion by Wilson, second.by Day, the licenses were granted. The application of Golden Hill Market & Cafe for a license to sell 3.2 non -intoxicating beverages "off sale" was read and upon motion by Wilson, second by Eichten, and all voting in favor th thereof, the license was granted. • The report of the City Treasurer for the month of March 31, 1965 was presented and President DeVries ordered the same placed on file. The reports for the month of March, 1965 of the Building Inspector showing fees collected for building permits issued $402.00; of the Electricla Inspector showing fees collected for electrical permits issued $1,185.00; the Plumbing Inspector showing fees collected for plumbing permits issued $422.25; the Heating Inspector showing fees collected for heating permits issued $964.00 and fees collected for sign permits issued $1,093.19, were each presented and President DeVries ordered the same placed on file. The report of the Clerk of Municipal Court for the week ending April 9, 1965 showing total.criminal fines and costs collected and civil fees received $3,187.00 and total remitted to the City Treasurer $2,502.00 was presented and President DeVries ordered the same placed on file. Alderman Day.introduced a resolution that $175,000.00 of General Fund and $75,000.00 of the Fire Protection Fund be invested in U. S. Treasury Bills for one month, was read and upon motion by Wilson, second by Eichten, and all voting in favor thereof, President DeVries declared the said resolution duly passed and adopted. Alderman Wilson moved that the five following resolutions appropriating city funds for various purposes be considered by the Common Council as a single group, each alderman having, previously examined each individual resolution, Alderman McCaleb seconded the motion and all voted in favor thereof. A motion was then made by Wilson, second by Eichten, that the following five resolutions be adopted as read, and all voting in favor thereof, President DeVries declared the • said resolutions duly passed and adopted: 1. Resolution appropriating $4,678.21 from the General Fund and $281.00 from the Police Fund and ordering payment made to Wilton Mfg. Company $562.47; Viktor 0. Wilson M. D. $1,090.50; Brandt Automatic Cashier Co. $1,157.50; Quality Printing Company $734.74 and I.B. M. $1,414.00. 2. Resolution appropriating $1,245.99 from the Park Improvement Fund and ordering payment made to Marge Narveson Draperies $355.00; The Miracle Equipment Co. $365.90; Standard Auto Parts $295.12 and Peoples Natural Gas Company $229.97. 3. Resolution appropriating $1,445.50 from the Permanent Improvement Fund, $1.80 from the Bark Improvement Fund, $276.76 from the Lighting Fund and $64.13 from the F.E. Williams EstateFund: City of Rochester, P.U. $64.13. 0 F�, 90 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., April 12, 1965 Upon motion byWilson, second by Perry, the matter of whether Lot 44A in North Sunny Slopes should be accepted by the City was referred to the Park Board, this lot was deeded to the City of Rochester by Newton Holland to he used as a bird sancturary. All voted in favor thereof. The recommendation of the Rochester Housing and Redevelopment Authority, dated March 12, 1965 ( which was tabled to this date) regarding the Workable Progdram for Community Improvement was again read. Alderman Day then read the following letter that he prepared: "The reason that I asked you to table this confirmation of Urban Renewal, was that I wanted more time to study what we were getting into. I also felt that the newly appointed 18 member advisory group should have more than 30 days to study the program before having their names attached to this confirmation. As you know, they were appointed on March.lst, 1965, and this report was presented • to us for our approval on March 30, 1965. I don't think that these fine, civic people could honestly say that they,could put their stamp of approval on.this 6k million dollar project with 29 days' study. I also was veryconcerned that the 144 business people who will face being put out of business for two or theee years, or more, with the possibility of coming back to much -higher rents, be fully informed of this program.. To the best of my knowledge, from the letters I have received, these business men in this 22 square block. area, are completely in the dark as to what this program is, and how it will affect them. I also thinkthat all of the taxpayers of Rochester should be more fully informed as to what this program will cost them, and also they should be informed that for a peiord of time we will lost the tax money from the present buildings; consequently, the taxpayers share of the tax burden during this reconstruction period, will be much higher. A week ago in the Mayors' message to this City Council, we were reprimanded for not accelerating the Urban Renewal Program. Iw ould like to take this opportunity to say that I think the Mayor, as leader.of both the Urban Renewal Commission, and Citizens Advisory Committee, and also a prime pusher of this project, has been grossly negligent in not fully informing .the small business men of Urban Renewal's plusses and minuses. I fell that we would be completely unfair to the people of Rochester if we do not hold this confirmation of our intentions to participate in the Urban Renewal program until we have had sufficient open meetings .to inform them. . Dewey Day" Alderman Day stated that he did not think sufficient public hearings had been held on this and suggested that a public hearing be set and all of the businessmen in this area be sent a notice of the hearing; he said he was not either for or against the urban renewal program but thought it should be studied more at this time. Alderman Eichten stated that he felt once a complete planning survey is completed we can either redevelop with private monies or federalgrants. The community program in which the city expresses its desire to update various buidling codes and ordinances must be approved before a planning grant can be requested and the purpose of the planning grant is to provide funds for a detailed analysis and land use survey of the area • proposed for redevelopment. Tom 0. Moore, City Planning Director, whose office prepared the community program at the request of the Housing and Redevelopment Authority, stated that the documents merely state in general berms that the city's willingness to enter in a program to combat blight conditions; whether or not the city will eventually participate in urban renewal can be determined at a later date. After further discussion a motion was made by McCaleb; second by Perry, that this be tabled until May 3, 1965; all voted in favor thereof. (In the meantime a meeting was to be set up with the Council, Mayor, Housing & Redevelopment Authority, and anyone interested to discuss this further). A resolution approving the request of the Board of Park Commissioners re Neighborhood Youth.Corp. to do various work (listed in letter on page 5) was read. A resolution requesting the Legislature of the State of Minnesota to submit to the appropriate committees or sub -committees of the Senate and House and to the State Board of Education for interim study and recommendation the matter of state financial aids to school districts, was read. A motion was made by Wilson, second by Day, that the said resolution be adopted as read, and all voting in favor thereof, President DeVries declared the said resolution duly passed and adopted. Upon motion by Wilson, second byDay, and upon roll call and all voting in favor thereof, the rules were suspended and an ordinance annexing to the City of Rochester, Minnesota, certain unplatted land in the Southeast quarter of Section Twenty-five, Township One Hundred Seven North, Range Fourteen West, Olmsted County, Minnesota, which is completely surrounded by land within the Municipal Limits of the City of Rochester, Minnesota (Gambill property) was given its third and final reading. A motion was then made by Perry, second by Wilson, that the said ordinance be adopted as read and all voting in favor thereof, President DeVries declared the said ordinance duly passed and adopted. Upon motion by Wilson, second by Eichten, and upon roll call and all voting in favor thereof, the rules were suspended and an ordinance annexing to the City of Rochester, Minnesota certain unplatted land not exceeding two hundred acres in Area, all being in the East one half of Section Thirty -Four Twonship One Hundred Seven North, Range Fourteen West, Olmsted County, Minnesota (S.E. quandrant of U.S. 14-52 Standard Oil Company ) was given its third and final reading. A motion was then made by Wilson, second by Perry, that the said ordinance be adopted as read and all voting in favor thereof, President DeVries declared the said ordinance didy Passed and adopted. Upon motion by Wilson, second byEichten, and upon roll call and all voting in favor thereof, the rules were suspended and an ordinance annexing to the City of Rochester, Minnesota, certain unplatted lands not exceeding two hundred acres in area, all being in the South one-half of Section Thirty five, Sownship One Hindred Seven North, Range Fourteen West, Olmsted County, Minneeota (16th Avenue and 4th Street N. W) was given its third and final reading. A motion was then made by Wilson, second by Perry, that the said ordinance be adopted as read and all voting in favor thereof, President DeVries declared the said ordinance duly passed and adopted.
