President DeVries called the meeting to order at 8:00 o'clock P. M., the following members being present: President DeVries, Aldermen Day, Eichten, Hanlon, McCalet Perry, Wilson. Absent: None. The request of the Advisory Committee on Rochester Education (ACRE) that the Council finance the construction of the utilities from the edge of the proposed Junior College site to the buildings was again discussed. C. A. Armstrong, City Engineer, presented the following preliminary estimate of costs and possible amounts that could be assessed to the Water Department and benef fitted properties and also a copy of plans showing the proposed construction: Sanitary Sewer The estimated cost of proposed 12" and 15" sewer line from Old T. H. 20 to the buildings is $71,160. The estimated assessments are as follows: 6aaitary Sewer FY'B�SbUtting land in the City $6,000.00 From abutting land outside the City limits 6,000.00 From non abutting lands outside the City (area assessments for Trunk line benefit) 10,000.00 Total assessable (Present $6,000 and future ($16,000) 22,000.00 Balance to be met by City funds 49,160.00 Watermain The estimated cost of the proposed 10" and 8" watermain from Homestead Village Lane to buildings is $65,900. The estimated assessments are as follows: From the Water -Department (additional cost of 12" main) 15,750.00 From abutting land in the City 6,000.00 From abutting land outside the City limits 6,000.00 Total assessable (present $21,750,future $6,000) 27,750..00 Balance to be met by City funds 38,240.00 Storm Sewer The estimated cost of proposed 15" storm sewer drain from building to Mayo Run is $8,700. None of this is assessable to others. To be met by City funds 8,700.00 Summary Total Recoveralbe Balance to Cost from Water met by Dept. & others City funds Sanitary sewer $71,160. $22,000. $49,160. Alderman Hanlon, Chairman of the Finance Committee, stated that this money had not been budgeted, but he felt the project was a benefit to the,entire community and therefore said he would go along with this and recommended that the monies be appropriated from the General Fund. It was also noted that part of the work could be done and paid for in 1966 and the balance in 1967 so it would not have to all come out of this years budget. Alderm. McCaleb bhen moved that the Common Council approve the request to construct sanitary sewer water main and storm sewer from the City limits to the buildings on the proposed Junior College site; Alderman Wilson seconded the motion and all voted in favor thereof. Alderman DeVries then introduced the following resolution which was read: 0 378 t Record of Official Proceedings of the Common Council of the City of Rochester, Minn., February 21, 1966 "WHEREAS, the State of Minnesota, the County of Olmsted and the City of Rochester are cooperating in the acquisition, establishment and improvement of a new Rochester Junior College site in Section Six (6), Township One Hundred Six (106)North, Range Thirteen (13) West, Olmsted County, Minnesota and as a part of this cooperative effort, the State of Minnesota is assigning certain lands owned by the State to the site, the County of Olmsted is acquiring by eminent domain certain additional land to be conveyed to the State of Minnesota as a part of the site, and the City of Rochester will extend municipal utilities to serve the site, and WHEREAS, it is desirable that the lands devoted to the new Rochester Junior College site as well as certain additional lands owned by the State of Minnesota be annexed to the City of Rochester so that all of the services of the City of Rochester, including sewer, water, electric, power, police protection and fire,grotection can be provided as a part of the City of Rochester. NOW THEREFORE, brit resolved that the Common Council of the City of Rochester hereby requests the Executive Council of the State of Minnesota to petition the Common Council of the City of Rochester in accordance with Section 414.065 of the Minnesota Statutes to annex the following described lands in Olmsted County, Minnesota: The South One -Half (S'k) of the Northwest Quarter (NWk) of Section Six (6),�Township One Hundred Six (106) North, Range Thirteen (13) West 80 acres The South one thousand one hundred eighty (1180) feet of the'Northeast Quarter (NE'k) of Section Six (6), Township One Hundred Six (106) North, Range Thirteen (13) West 72 acres All that part of the Northwest Quarter (NWk) of the Southeast Quarter (SEk) of Section Six (6), Township One Hundred Six (106) North, Range Thirteen (13) West, lying north of the south Right-of-way line of Trunk Highway No. 14 30 acres Thewest three hundred thirty (330) feet of the South one thousand one hundred eighty (1180) feet of the Southwest Quarter (SW'k) of the Northwest Quarter (NWk) of Section Five (5), Township One Hundred Six (106) North, Range Thirteen (13) West 9.6 acres ,The west three hundred thirty (330) feet of that part of the Northwest Quarter (NWk) of the Southwest Quarter (SW'k) of Section Five (5), Township One Hundred Six (106) North, Range Thirteen (13) West, lying north of the South Right-of-way line of Trunk Highway No. 14 7.4 acres The above described lands all of which are owned 'An fee by the State of Minnesota include the proposed new Rochester Junior College site, the necessary intervening lands to make the site abut upon the present territorial boundaries of the City of Rochester, and certain additional lands which will make the City's Eastwood Park and Golf Course abut upon the City's territorial limits. Be it further resolved that the City Clerk is directed to forward a copy of this resolution to the Honorable Stephen T. Quigley, Commissioner of Administration of the State of Minnesota together with a map of the area proposed to be annexed and a copy of the form of petition for annexation used by the City of Rochester." A motion was made by Eichten, second by McCaleb, that the said resolution be adopted as read and all voting in favor thereof, President DeVries declared the said resolution duly passed and adopted. Mr. William Scarborough of the Restancare, Inc., the corporation that is going to construct a three million dollar nursing home and apartment comples on the property southeast of the Tropic Bowl and Outrigger Lounge at 430 - 5th Avenue S. E., was present. They had requested the vacation of certain streets-i.e. 5th Street S. E. from Bear Creek to within 150 feet of 6th Street; and 6th Avenue S. E. from Bear Creek to the middle of the block between 5th and 6th Streets. C. A. Armstrong, City Engineer, reported that the Public Works Committee had reviewed this and would recommend vacation of 5th Street S. E. and 7th Avenue S. E. but would defer action on 6th Avenue S. E. from Bear.Creek to the middle of the block between 5th and 6th Street because this may eventually beconstructed as a street. A proposal to charge for vacating streets on a per foot basis had also been discussed but they decided to do nothing on this until a policy was established. C. A. Armstrong, City Engineer also reported the project construction would necessitate dredging and widening Bear Creek which would cost probably between $10,000 and $12,000, Mr. Scarborough said that Restancare, Inc. would pay one half the cost of dredging and widening. No action was taken but the City Engineer was to prepare a report by the Public Works Committee submitting these recommendation. Upon motion by Mr -Caleb, second by Perry, and all voting in favor thereof, the meeting was adjourned. City Clerk 0 i
