of the City of Rochester, Minn., Juij, 11, 1966
Minutes of an adjourned regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City, on July 11,
1966.
President DeVries called the meeting to order at 4:00 o'clock P. M., the
following members being present: President DeVries, Aldermen Day., Eichten, Folkert, McCaleb,
Perry, Wilson.
The following summary of Bus Transportation Proposals was then read:

June 6, 1966 - Council passed a resolution requesting the Railroad and Warehouse
Commission to give favorable consideration to an application for temporary
authority to operate a public bus transportation system by William E. Kelly.
The resolution stated the intention of the Common Council to grant a non-exclusive
franchise for a period.of fifteen years and that this intention was based in part
upon the representation of William E. Kelly that:
1. Bus operations.would commence as soon after June 15, 1966 as soon
as labor contract be negotiated and temporary operating authority
can be obtained from the R. R. & Whse Commission;
2. A minimum of four trunk lines will be operated which will provide
more extensive.bus service to the City than is being presently
provided by Rochester Bus Line, Inc.
3. A minimum of four buses will be used to inaugerate service and
additional buses will be added as soon as possible as needed, and;
4. The proposed fare rates will be 251� each per trip or twelve trip
tickets for $2.00.
On June 15, 1966 Mr. Kelly met with Labor Representatives and the terms of the
labor contract were reduced to writing. This contract was forwarded to Mr. Kelly
but as of this date the signed contract has not been returned.
On June 17, 1966 Mr. Kelly filed his application with the R. R. & Whse Commission.
The Commission indicated approval of Mr. Kelly's application, but the order was
withheld pending filing of papers of incorporation, financial statement, filing
fee and application for bus plates.
On July 1, Mr. Kelly met with the Railroad & Warehouse Commission and asked to have
his petition amended on the St. Mary's run and agreed with Commission to start the
St. Mary's run on or before July 18 and that he would start operating the other
3 routes on or before 60 days from July 18, 1966. He subsequently agreed to start
St. Mary's run no later than July 11 and the other four no later than July 11 and
the other four no later than the first day of school.
On July 6, 1966 he agreed by phone to attend a Council meeting July 7 at 4:00 P.M.
On July 7, Mr. Kelly sent a telegram notifying the Council he would not be able to
attend the meeting and also indicated he would start*St. Mary's run July 11, 1966.

On July 8, Mr. Kelly called from Minneapolis. He was informed of meeting July 11
at 4:00 P. M. He indicated he could not make this meeting and asked if he could
talk with Council on July 9. He asked to be called back within one hour if this
was satisfactory. He was called back within 35 minutes to be notified and that
this was not satisfactory, but he was not at this number.
On the afternoon of July 9, Mr. Kelly was in Rochester and made the attached
statement to the newspaper. (Attachment #2)
On July 11, Mr. Kelly sent a telegram to Council notifying he would not be at the
Council meeting at 4:00 P. M. and notified Council he would start St. Mary's run
on or before July 17.
Talked with Railroad & Warehouse Commission and they indicated, if Council would
approve amendment to St. Mary's run the order would be given immediately and waive
temporary the filing requirements.

Favorable credit ratings checks were received from Northwestern National Bank
of Minneapolis (Lake Street Branch) and from Richfield State Bank.
The following telegram from W. E. Kelly, President Capitol City Bus was then
read:

"In regards':to your Monday meeting I cannot be present cause I have aschool
bid opening and I see no need of it otherwise I was there Friday set up
Number one route and am ready to,start when Railroad and Warehouse Commission
gives me the permission and the certificate. I do not think you folks
understand that before you can operate in Rochester you must file•a coprorat-ion
and certificate of insurance and you must file your routing and all of this
takes time.' The -Commission -and I agreed that we would start Number one on or
before school starts. In order to run these two, three and four we must have
an agreement with the schools. You cannot have an outsider taking school
kids and leave nothing for the City Buses. If this isn't Okay by you you can
have anyone start the buses you wish and -they can purchase the new bus from
D-11as which is there at the cost price. P. S. You have passed a resolution
and I have that in my hands that part has not changed. Please answer this
wire.

Mr. George Holter of Richfield was again present and stated that he would try
to,start buses in Rochester by August 1, 1966 and would start with four buses and if possible
four routes; he was going to spend some time in Rochester to try to work out the routes.
Alderman Wilson then introduced a resolution rescinding the resolution adopted
by the Common Council on June 6, 1966 and,approved.by•the Mayor on June 14, 1966 relative to
public bus transportation service for the City of Rochester, which was read. A motion was
made by Wilson, second by McCaleb, that the said resolution be adopted as read and all voting
in favor thereof, President DeVries declared the said -resolution duly passed and adopted.
A motion was then made by McCaleb, second by Wilson, urging Mr. George Holter
to file application with the Railroad & Warehouse Commission for -rights -to operate aIpublic
transportation system in the City of Rochester; all voted in favor of the motion.
Upon motion by Wilson, second by McCaleb.; and all voting in favor thereof, the
meeting was adjourned until 7:30 P. M. on Jujly 18, 1966.
