M., the following members being present: President DeVries, Aldermen Day, -Ellison, Folkert, Larson, Perry, I Postier. Absent: None. Upon motion by Folkert, second by Postier, and all voting in favor, the minutes of the meeting of April 10, 1967 were approved. President DeVries stated this as being the time and place set for receiving and opening bids for furnishing one (1) 1250 G. P. M. Pumper for use in the Fire Department. The bids of Minnesota Fire Extinguisher Co -Ward LaFrance Truck Corporation in the amount of I$27,750.00 and Peter Pirsch & Sons Co. in the amount of $29,596.00 were each received and opened and upon motion by Folkert, second by Postier, and all voting,in favor, the bids were referred to the Public Safety Committee and Fire Chief for review and report. President DeVries stated this as being the time and place set for hearings on II the following projects: Hearing on construction of sidewalk on the north side of 17� Street N. W. from 'i 19th to 21st Avenue Northwest. C. A. Armstrong, City Engineer, explained that this project I� had been initiated by petition, with seven out of thirteen property owners signing, on this �! basis the Public Works Committee in March had recommended that the project be approved and l the cost be assessed to the abutting property. A letter signed by Carl A. Jenke requesting that his name be removed from the petition was read. A letter signed by Glen K. Aakre of 2015 17k Street N. W. stating that he was in favor of the project was read. A letter signed by Marvin Olson, Principal of Sunset Terrace School, supporting the proposed sidewalk was U I l also read. There was no one present wishting to be heard. President DeVries declared the hearing officially closed. A motion was then made by Day, second by Folkert, and all voting in favor, that the project be proceeded with. Hearing on construction of curb and gutter in the 700 block on 13th Avenue N. E. Ii C. A. Armstrong, City Engineer, explained that this project had been initiated by petition of the owners, with six out of twelve property owners signing, on this basis the Public Works li Committee had recommended that the project be approved and the cost be assessed to the abutting property. Mr. John Rice of 717 - 13th Avenue S. E. was present and protested this project at this time because of the additional cost. Mr. Richard Randall of 804 - 13th Avenue S. E. was present and inquired what would have to be done to include the addition block in which he lived. 01 He was told to circulate a petition to the property owners in the-800 block. There was no one else present wishing to be heard. President DeVries declared the hearing officially closed. A motion was then made by Larson, second by Folkert, and all voting in favor, that this be returned to the Public Works Committee and they hold up this construction for a reasonable j time to see as to the possibility of combining the two blocks. Hearing on petition for vacating Oakside Avenue S. W. (2nd Avenue S. W.) I • 1 L 1 adjoining Lot 3, Block 10, Golden Hill Addition. Mr. Ray Krofchalk, the petitioner, was present and stated that he had initiated this quite some time ago, the District' Court had tried to close this Avenue but found that it was in the City and could not be closed by District Court ruling, they tried to sell it but could not because of part of the street being closed; he said he had an agreement that these two parcels will go together and the trailer court will be removed and they will sign an easement so the sewer and water will go just west of the court. There was no one else present wishing to be heard. President DeVries declared the hearing officially closed. A motion was then made by Perry, second by Postier, and,all voting in favor, that the City Attorney be instructed to prepare a resolution vacating , Oakside Avenue. Hearing on Community Development Project to be known as King's Court Apartments (south side of 31st Street Northeast between U. S. 63 and 3rd Avenue N. E.). There was no one present wishing to be heard. President DeVries declared the hearing officially closed. A motion was then made by Perry, second by Ellison, and all voting in favor, that the City Attorney be instructed to prepare the necessary resolution. Hearing on.districting change of zoning on Lots 18 through 28, Block 21, Northern Addition -to the M-1 District. Mr. Robert Patterson, Attorney representing the petitioner, was present, he said they were again here on their petition to change Lot 19, Block 21, to M-1 District, Waters Conley has to provide off street parking and is going to use this lot if the I zone change is granted; he urged that the zone change be granted. Mr. Joseph Valsvik of 19 - 6th Street N. W. was present and opposed the zone change. Mrs. Florence Lund, Mr. Leroy Borland and Mr. Alvin Freimund were each present and opposed the zone change. Mr. George Brumm, the petitioner,was present and asked the Council to take favorable action on this as soon as possible. T. 0. Moore, Planning Director, reported that the Planning & Zoning Commission were considering this area at their next meeting to be held on April 26, 1967 and would probably then have a recommendation. A motion was then made by Postier, second by Folkert, and all voting in favor, that this be tabled until May 1, 1967 to give the Planning & Zoning Commission a chance to have their hearing and report back. An invitation to the open house at the Public Library to be held on April 17, 1967 7:00 - 10:00 P. M. was read and President DeVries ordered the same placed on file. A letter signed by Stanley F. Drips, Chairman of -the Mayor's Parking and Traffic Committee, recommending that a traffic engineer be employed by the City, was read. Upon motion by Perry, second by Ellison, and all voting in favor, the letter was referred to the Public Works Committee. A letter from the Board of Park Commissioners stating that they were in accord and recommend the adoption of the Tree Ordinance, was read and President DeVries ordered the same placed on file. A letter signed by C. A. Armstrong, City Engineer, recommending the appointment of Orville E. Strehlow to the position of Maintenance Man at the Sewage Treatment Plan beginning April 10, 1967, at the beginning wage of 90% of the base rate, was read. CD•78920 second by Ellison, and all voting in favor, the appointment was approved. The request of John P. Silliam for parking at the curb in front of 905 North Broadway was read and upon motion by Peprry, second by Postier, and all voting in favor, the request was referred to the Public Safety Committee. The request of The Avalon Hotel for a guest loading space in front of their hotel at 301 North Broadway was read and upon motion by Perry, second by Postier, and all voting in favor, the request was referred to the Public Safety Committee. A copy of "The Subsidy Sickness" clipped from the Wall Street Journal and sent by Mrs. Donna Schuster was presented and President DeVries ordered the same placed on file. The following resolution adopted by the Public Utility Board was read and upon jj motion by Perry, second by Folkert, and all voting in favor, the resolution was adopted: "Be.it. resolved by the Public Utility Board of the City of Rochester that the Common Council authorize the said Board to enter into a contract with WORTHINGTON CORPORATION for furnishing, delivering, erecting and placing in commercial operation A SURFACE CONDENSER AND AUXILIARY EQUIPMENT in accordance with plans and specifications prepared by Pfeifer and Shultz, Engineers as modified by letters from Worthington Corporation,..' copies of which are attached and made a part of this resolution. The amount of the contract to be TWO HUNDRED SEVENTY SEVEN THOUSAND EIGHT HUNDRED DOLLARS ($277,900.00) and WORTHINGTON CORPORATION being the lowest responsible bidder. , Be it further resolved that the Common Council direct the Mayor and the City Clerk to execute the contract documents." The following resolution adopted by the Public Utility Board was read and upon motion by Postier, second by Perry, and all voting in favor, the resolution was adopted: "Be it resolved by the Public Utility Board of the City of Rochester that the Common Council authorize the said Board to enter into a contract with ULTEIG ENGINEERS for furnishing services to provide RIGHT-OF-WAY FOR THE SOUTH LOOP OF THE 115 KV TRANSMISSION LINE the amount of the contract to be on a cost plus basis, cost to be based on standard costplus rate of two times pay -roll cost (Where pay -roll cost equals 1.2 times time -card rate) and in accordance with the proposal a copy of which is attached and made a part of this resolution. The estimated total fee for the work described will approximate FIFTEEN THOUSAND DOLLARS ($15,000.00). Be it further resolved that the Common Council direct the Mayor and the City Clerk to execute the contract documents." The application of Robert C. Neill for a variance on the property at 307 Third Avenue Northwest was read and upon motion by Folkert, second by Ellison, and all voting in favor, the application was referred to the Planning & Zoning Commission. A letter signed by Mrs. H. Anderson, poppy chairman for Veterans of Foreign Wars, requesting permission to build an archway of poppies over the sidewalk in front of the Veterans of Foreign Wars building at 16 - 6th St. S. W. was read and upon motion by Perry, second by Postier, and all voting in favor, the letter was referred to the Public Safety Committee. A letter signed by Eugene E. O'Neill requesting that the petition to annex lands in Allendale Subdivision be reactivated was read and President DeVries ordered the letter placed on file. A notice from the Municipal Commission setting a hearing on the proposed annexation for May 12, 1967 at 10:00 in the Council Chambers in the City Hall`l°shad been received. 1 0 1 1 0 1 11 Record of Official Proceedings of the Common Council • of, the City of Rochester, Minn., April 17, 1967 1 0 1 1 • The recommendation of the Planning & Zoning Commission stating that they had reviewed the matter of transferring the Zoning Enforcement from the Building Inspector's Office to the City Planning Director's office; you will recall that this was discussed with the Common Council on March 15, 1967; having considered this proposal further, they are of the opinion that all matters pertaining to zoning should be handled in one city office; they feel that such a move would help to eliminate confusion on the part of the public in getting interpre= tations of the provisions in the ordinance and thereby result in a better understanding of zoning; in order to accomplish this transfer of the zoning enforcement authority, they recommend that ordinance No. 1296 be amended as shown, was read. Upon motion by Perry, second by Ellison, and all voting in favor, the recommendation was referred to the Public Works Committee and the City Clerk was instructed to send copies of the proposal to each Alderman. The recommendation of the Planning and Zoning Commission stating that they had reviewed the need to eb tabl'ish improved referral proceedures between the various City Boards and Commissions and the City Planning.Commission in order for the Planning Commission to better advise the Common'Council-on all matters pertaining to City development'as they are charged; they feel that it is important to have the development and expansion proposals of the other municipal agencies, departments, boards and commissions channelled through the Planning Commission for recommendation to the Council, by following this procedure it is felt that A - greater understanding will be developed and the Commission can better fulfill'its roll of advising the Council on all development matters within the City; they therefore recommend that the Common Council institute a policy instructing the Boards and Commissions to channel all matters pertaining to land use, site acquisition, site development, disposal pf public land and other related matters through the Planning Commission for review and recommendation to the Council, such a procedure should help to expedite deliberations on these -items and create a better understanding of the various proposals, was read. Upon motion by Folkert, second by Day, and all voting in favor, the recommendation was approved and the City Attorney was instructed to prepare the necessary resolution. (Copies were to be sent to the Aldermen). The recommendation of the Planning & Zoning Commission stating that they had reviewed the need for a joint meeting to be held with all of the private and public planning groups and agencies that are currently actively engaged in planning the 'downtownarea `of Rochester, this letteris -to inform the members of the Common Council that the Commission has arranged a meeting of the above agencies and firms for Thursday, April 20, 1967 at 4:00 p. m. in Room 4, in the City Hall, was read. President DeVries ordered the same placed on file. The recommendation of the Public Works Committee that the City advertise for bids for furnishing the season's supply of liquid chlorine for the Sewage Treatment Plant, was read. Upon motion by Perry, second by Day, and all voting in favor, the recommendation was approved and the City Clerk was instructed to prepare a resolution ordering bids. �r] Record of Official Proceedings of the Common Council of the City of Rochester, Minn., April 17, 1967 E The recommendation of the Public Safety Committee stating that they had met with the representatives of the Minnesota State Highway Department, City Engineer's office and the Rochester Police Department and considered the location of a pedestrain overpass to be erected over trunk highway 52 West; the committee recommends that this pedestrian overpass be located at or near the intersection of trunk highway 52 West and Sixteenth Street Northwest, was read. Upon motion by Day, second by Ellison, and all voting in favor, the recommendation was approved. A petition with 12 signatures recommending denial of the change of zoning on Lot 5, Block 8, Northern Addition and adjoining vacated Willow Street N. W. from R-1 District to the R-3 District (vacant area on south side of 14th St. N.W. west of Cascade Creek) was read together with an analysis of the petition submitted by T. 0. Moore, Planning Director. The analysis showed that more than 20% of the owners of property, exclusive of streets and alleys, within 200 feet of the property proposed to be rezoned had signed the petition of protest but the protest was filed with the City Clerk after the public hearing. R. V. Ehrick, City Attorney stated that the ordinance provides that the petition to be valid should be filed before or at the time of the public hearing. Mr. Richard Mase of 1200 - 5th Alzenue N. W., Mr. Joseph Milkanin of 1204 5th Avenue N. W. and Mr. Harry Bowman of 420 14th Street N. W. were each heard opposing the requested zone change. President DeVries ordered the petition placed on file. An Ordinance amending an Ordinance entitled, "An Ordinance for the purpose of promoting health, safety, order, convenience and general welfare, by regulating the use of land, the location, size, use and height of buildings, and the arragnement of buildings on lots, and the density of population within the City of Rochester, Minnesota all in accordance with a comprehensive plan (changing Lot 5, Block 8, Northern Addition to R-3 Multi -Family Residence District)", was given its first reading. A motion was made by Ellison, second by Day, that the rules be suspended and the ordinance be given its second reading but upon roll call Alderman Perry voted "nog'. A petition with 469 signatures stating their position that the general development for the Hilltop area of Valhalla Subdivison should remain as approved at the former meeting of the Common Council and said Hilltop area,when it is annexed to the City should remain as R-1 and their strenuous objection to any change in zoning of said area so as to permit any develop- ment other than single family residential homes, was presented. Mr. William Juede of 2204 - llth Ave. N.W. and Mr. Gerald Balm of 1020 24th St. N.W. were present and stated that the purpose of the petition was basically just to express their thoughts. Mr. James Parker, one of the representatives of Valhalla was present and stated that it was not their intention to hide anything and when they are ready to bring in their proposal for zoning or a request for a change in zoning they would be prepared to tell everyone exactly what is involved at that time. Alderman Larson then introduced an ordinance annexing to the City of Rochester certain unplatted land not exeeeding two hundred acres in area, all being in Section Twenty -Six, Township One Hundred Seven, Range Fourteen, Olmsted County, Minnesota, which was given its first reading. Upon motion by Postier, second by Larson, and upon roll call and all voting in favor, the rules were suspended and the ordinance was given its second reading. A motion was then made by Perry, second by Postier, that the rules be suspended and the ordinance be given its third and final reading but upon roll call Alderman Day voted "nay". Upon motion by Perry, second by Ellison, and all voting in favor, the resolution was approved. - A resolution requesting the Minnesota Municipal Commission to conduct a public hearing on the matter of the annexation of certain lands in Allendale Subdivision, Olmsted County, Minnesota, more than seventy five percent bordered on three sides by the present territorial limits, was read. Upon motion by Perry, second by Ellison, and all voting in favor, the resolution was adopted. A resolution requesting the State Legislature to enact (1)'a law authorizing the County of Olmsted and the City of Rochester to enter into an agreement under the Joint Exercise of Powers Act to provide needed public health services and perfrom health functions for the County and the City, jointly and cooperatively•or, as may be provided by the agreement, by either the County or the City acting separately on behalf of the other and (2) a law eliminating the present restriction in Minnesota Statute Section 449.09 on the amount of Taxes which the City of Rochester may levy for municipal band, orchestra and chorus, the present'law limits to $25,000.00 the tax levy of the City of Rochester for this purpose; this has proved to be insufficient, was read. Upon motion by Folkert, second by Perry, and all voting in favor, the resolution was approved. A resolution authorizing and directing the Mayor and City Clerk to execute on behalf of the City of Rochester the agreement with the Mayo Foundation relative to the construction of certain local improvements in Meadow Park Fourth Subdivision, was read. Upon motion by Perry, second by Larson,'and all voting in favor, the resolution was approved. A motion was made by Folkert, second by Perry, that the matters of (1) as to whether.schools are property marked and (2) whether speed'limits around schools have been recommended or enforced, be referred to the Public Safety Committee for study; all voted in favor. The matter of the construction of a one million gallon water tower at the site of the old water works property on 4th Street S. E. was tabled until this meeting. President DeVries reported that a committee from the Utility Board was still working on this but had not come up with their facts and findings at this date. A motion was then made by Perry, second by Larson, that this again be tabled pending receipt of a resport from the Public Utility Board, all voted in favor except President DeVries who voted "nay". adjourned.
