President DeVries called the meeting to order at 4:00 o'clock P.M., the fol- lowing members bsing present: President DeVries, Aldermen Folkert, Larson,.Ludowese, Postier, Strain. Absent: Alderman Cher.land. The call of the special meeting was read and President DeVries ordered the same placed on file, the said meeting having been called for the purpose of (1) Resolution re. City policy on land acquisition; (2) Planning and Zoning Commission recommendation on amending Valhalla Community Development Plan; (3) Application for dance permit of Allen G. Polikowsky at the 4-H Club Building on July 5th. The following resolution was read: "BE IT RESOLVED by the Common Council of the City of Rochester that for the purpose of qualifying for Federal aid and assistance in acquiring property for public park and recreational purposes the following statement of policy is adopted to govern the acquisition of land for park and recreational purpose: 1.,Every reasonable effort will be made to acquire each parcel by negotiated purchase before instituting eminent domain proceedings against the parcel. 2. An owner will not be required to surrender possession of his property until the City pays or causes to be paid to the owner either (a) the agreed purchase price arrived at by negotiation, or (b) in any case where only the amount of the payment to the owner is in dispute, not less than 75 percent of the appraised fair value as approved by the City and concurred in by the Department of Housing and Urban Development. 3. No person lawfully occupying property will be required to surrender poss- ession without at least 90 days written notice from the City of the date on which possession will be required." Upon motion by Folkert, second by Larson, and all present voting in favor thereof, resolution adopted. Recommendation of the Planning and Zoning Commission on amending Valhalla Community Development Plan. Upon motion by Postier, second by Larson, and all present voting in favor thereof, recommendation accepted and hearing ordered for July 7th, 1969, at 7:00 o'clock P.M. In that there are no other owners within 300 feet of the Valhalla Community Development, motion was made by Larson, second by Strain, and all present voting in favor thereof, to approve issuance of a building permit for construction of swimming pool. An application for a dance permit of Allen G. Polikowsky for July 5th at the 4-H Club Building at the Fairgrounds. Upon motion by Postier, second by Strain and all present voting in favor thereof, application approved and permit granted, provided no beer or liquor sold or consumed on the premises or setups furnished for same. Motion by Larson, second by Folkert, and all present voting in favor thereof, that the Council consider other business. An Ordinance increasing the penalty for misdemeanor violations under Rochester Ordinances; amending Section 1.100 of the ROCHESTER CODE OF ORDINANCES, Section 4 of Ordinance No. 1434 and Section 2 (C) of Ordinance No. 1455. Motion by Postier, second by Folkert, and upon roll call all present voting in favor thereof, the rules were suspended and said ordinance was giiren its third reading. Upon motion by Larson, second by Ludowese, and all present voting in favor thereof, ordinance was unanimously adopted. Question concerning a tree planted in the right of way of a new side- walk project Northwest at 2007 13th Avenue Northwest. Upon motion by Folkert, second by Larson, and all present voting in favor thereof, it was referred to the Public Works Committee for consideration.
