President Postier called the meeting to order at 7:30 o'clock P. M., the following members being present: President Postier, Aldermen Cherland, Larson, Ludowese, McNary, Strain, Willmarth. Absent: None. Hearing on petition to rezone property bounded by loth Street S. E., 15th Avenue S.E., U. S. 14-52 and Bear Creek Park from the B-lb zone to the B-3 zone. Mr. Haro Krieger, Attorney was present in behalf of the petitioners and said they had previously presented the facts and would answer any questions. There was no one else present wishing to be heard. President Postier declared the hearing officially closed. A motion was made by Ludowese, second by Willmarth, that the zone change be granted and the City Attorney be instructed to prepare an ordinance making the requested zone change; all voted in favor. Hearing on application for approval of the final shopping center plan for Welles Shopping Center. Mr. William Dunnette of 1020 15th Avenue S. E. was present and inquired if loth Street would be continued through, it is the only,sway children have to go to Horace Mann School; he said he owned 120' x 240' here and wondered what kind of access he would have to his property. Mr. Harold Krieger, Mr. Carlton Penz and Mr. Mike Montlack were present. A plat of the proposed chopping center plan was presented and and the following points were reviewed: (a) all buildings will be located 30 feet from the property line instead of the required 50 feet (b) the sign shown in the access off 15th Avenue has been relocated as required (c) that screening be placed on the east and west side and the property will be laddscaped and maintained (4) the parking plan has been taken care of (e) that right turns only be made at the llth Street exit onto 15th Avenue and a raised island be constructed within the driveway (f) the property is in the process of being platted (g) the owners are aware of the flood elevation (h) it is understood that there is a telephone easement somewhere in the northwest corner and there is an understandir with Mr. Bailey of N.W. Bell Telephone Co. and in the event it has to be moved the telephone company will move it and Mr. Penz will pay for the relocation (i) the illumination plan is taken care of. A motion was made by Willmarth, second by Cherland, that the plan be approved and the City Attorney was instructed to prepare a resolution as required; all voted in favor. An Ordinance rezoning certain property and amending the Zoning Ordinance of the City of Rochester, Minnesota (property at Northwest corner of 12th Street and 15th Avenue Southeast - Welles Shopping Center) was given its first reading. Upon motion by Cherland, second by Strain, and all voting in favor, a resolution was adopted authorizing James J. Macken, Jr., Chief of Police to act as agent for the City to file an "Application for Reimbursement Funds" with the State of Minnesota Peace Training Board to defray the cost of salaries, expenses and substitute protection Record of Official Proceedings of the 'Common � Council of, the City of Rochester, Minn., October 7, 1970 • incurred by the City of Rochester during basic training of peace officer as authorized by Minnesota Laws 1969, Chapter 1139, Section 13, Subd. 4 and Public Law 90-351. Mr. Jack Dolan, Traffic Engineer, reported that he had talked to engineers at the Minnesota Highway Department in regard to the layout at 37th Street N. W. and they did have some plans and lay outs; they were to meet with the Council, representatives of IBM and City officials next Monday at the meeting of the Council as a committee of the whole. Upon motion by Larson, second by Cherland, and all voting in favor, the meeting was adjourned until 7:30 P. M. on October 19, 1970. City Clerk
